CALL TO ORDER
The Otter Tail County Board of Commissioners convened Tuesday, June 7, 1994, at
9:30 a.m. at the Otter Tail County Courthouse with Commissioners Harley Windels,
Chairman; Bill Stone; Virginia Partmann; Andy Lindquist; and Malcolm Lee present.
APPROVAL OF MINUTES
Motion by Stone, seconded Partmann and unanimously carried to approve the May 24, 1994,
minutes as submitted.
WEST CENTRAL AREA AGENCY ON AGING
Virginia Smith, Director of the West Central Area Agency on Aging, provided copies of
the "Area Plan on Aging 1993-1994-1995" and other handout materials. The Board was
updated on a number of issues and a request was made for the West Central Area Agency on
Aging to be an additional insured under the county's Minnesota Counties Insurance Trust
(M.C.I. T.) workers' compensation coverage. Decision on this request was tabled pending
further information.
OLD CSAH NO. 35 TURNBACK -EDNA TOWNSHIP
A motion was made by Partmann, seconded Lindquist and unanimously carried to authorize
the Highway Engineer to proceed to work out an agreement with regard to the described
old CSAH No. 35 Turnback in Edna Township.
BID OPENING: 1994 TRAFFIC MARKING CONTRACT
Motion by Lee, seconded Lindquist and unanimously carried to set the bid opening date.
of 1994 Traffic Marking Contract for 1:00 p.m. on July 12, 1994.
STATE OF MINNESOTA: CPV MEMBERSHIP
Motion by Stone, seconded Portmann and unanimously carried to approve the request of the
Highway Engineer to approve payment of $350 to the State of Minnesota's Cooperative
Purchase Venture (CPV) for membership in cooperative purchasing.
1994 HAZARDOUS WASTE GENERATOR LICENSE FEE
Motion by Portmann, seconded Lindquist and carried, with Lee and Stone opposed, to
authorize payment of $150 to the Minnesota Pollution Control Agency (MPCA) for a
hazardous waste generator license fee for 1994.

RIGHT-OF-WAY CONDEMNATION RESOLUTION
CSAH NO. 14
Motion by Lee, seconded Lindquist and unanimously carried to adopt the following
resolution:
WHEREAS, Otter Tail County proposes to construct and improve CSAH No. 14; and
WHEREAS, the improvement consists of realigning and reconstructing said highway as
determined necessary to provide for the safety of the traveling public; and
WHEREAS, temporary and permanent highway easements over certain lands are required to
provide for said construction; and
WHEREAS, Otter Tail County has authority to acquire right-of-way for said highway by
eminent domain pursuant to M.S. Section 163.02, Subd. 2; and
WHEREAS, a portion of said lands required for easement purposes are owned and described
as follows:
Owner: Daniel T. and Deborah L. Ament
The S 1/2 of the NE 1/4 of Sec. 16-T135N-R39W,
except tract & the S 1/2 of the NW 1/4 of Sec. 15-T135N-R39W; and
WHEREAS, Otter Tail County has been unable to successfully negotiate the acquisition of
the required easements; and
WHEREAS, prior to taking possession, petitioner Otter Tail County, shall, pursuant to
MS Section 117.042, deposit with the Court an amount equal to the petitioner's appraisal
of value; and
WHEREAS, petitioner's appraiser, Milton Paulson, appraised said properties at a value
totaling $7,993.88.
NOW, THEREFORE, BE IT RESOLVED, that the Otter Tail County Board of Commissioners hereby
authorizes the acquisition of said land by eminent domain and to take title and
possession of that land prior to the filing of an award by the Court appointed
commissioner, pursuant to MS Section 163.02, Subd. 2, 117.011 and 117.042; and
BE IT FURTHER RESOLVED, that the Otter Tail County Board of Commissioners hereby
authorizes the deposit of $7,993.88 with the Otter Tail County District Court for the
purposes of taking possession of said properties as soon as authorized by the Court,
prior to the filing of an award by Court appointed commissioners, pursuant to MS Section
117.042, said amount representing the petitioner's approved appraisal of value of
subject properties; and
BE IT FINALLY RESOLVED, that the Otter Tail County Attorney is requested to file the
necessary petition therefore and to prosecute such action to a successful conclusion or
until it is abandoned, dismissed, or terminated by the County of the Court.

Motion by Partmann, seconded Stone and unanimously carried to approve payment to
Edwards Contracting Inc., Hampton, IA, in the amount of $19,805.50, as awarded on
April 12, 1994, for Seasonal Supply of Herbicides.
HIGHWAY DEPARTMENT: CONTRACT APPROVAL
Motion by Lee, seconded Partmann and unanimously carried to authorize the Chairman's
signature on highway construction contracts with Sherbrooke Asphalt, Inc.,
Pelican Rapids, MN, for SAP 56-641-08 & Etc. as previously awarded.
Motion by Stone, seconded Lee and unanimously carried to authorize the Chairman's
signature on highway construction contracts with Mark Sand and Gravel Co., Fergus Falls,
MN, for SAP 56-659-11 & Etc.

SARA TITLE III HAZARDOUS MATERIALS REPORT

The Highway Engineer discussed proceeding with Phase II on what would be an additional
three miles of existing County Road 148 located in Butler and Corliss Townships. The
Highway Engineer acknowledged funds would not be available to pursue this project. The
consensus of the Board, in consideration of the wetland areas and the excessive expense,
was that it would not be possible to pursue at this time due to budget constraints.

PAYMENT APPROVED
Motion by Lee, seconded Partmann and unanimously carried to approve payment to Sioux
Engineering, Inc., in the amount of $1,108.43, for the preparation and presentation of
viewer instruction for County Ditches and also to approve the payment of $64.80 for food
provided to those attending the ditch viewer training session.
TEMPORARY BEER/WINE LICENSE
Motion by Lee, seconded Partmann and unanimously carried to rescind the motion of
May 24, 1994 1 wherein a policy was set to establish a three day temporary beer/wine
license to apply to "for profit" applicants at a rate of $50. Establishment of such fee
is not necessary according to Minnesota Statute. Also rescinded in this action, was the
approval of a temporary beer/wine license for Four Star Promotions, Inc. of
Alexandria, MN.
DATA PROCESSING TASK FORCE
After hearing the recommendation of the Data
(Krohn/Metcalf/Scheels), a motion was made by Portmann,
Processing Committee
seconded Lindquist and
unanimously carried to accept the recommendation of the task force to discontinue
in-house development of tax related software and to proceed with vendor evaluation and
selection to meet the county's software needs.
SMALL CITIES DEVELOPMENT PROGRAM GRANT AGREEMENT
Motion by Stone, seconded Partmann and unanimously carried to authorize the Chairman's
signature on the Small Cities Development Program Grant Agreement for $418,547 with the
State of Minnesota, Department of Trade & Economic Development, Business and Community
Development Division.
MEETING WITH THE GOVERNOR
Chairman Windels reported on two recent meetings with Governor Arne Carlson. Windels
made known to the Governor various areas of concern expressed by the Otter Tail County
Board of Commissioners.

NORTHEAST LANDFILL
Mike Hanan, Solid Waste Director, and Kathy Marshall of Foth & Van Dyke discussed the
bid specifications and concerns with regard to the Phase I Ash & MSW Final Closure of
the Northeast Otter Tail Sanitary Landfill. At the May 24, 1994, County Board meeting
the bid was awarded to the lowest bidder, Kern & Tabery, contingent upon approval by the
County Attorney.
Motion by Lee, seconded Partmann and unanimously carried to accept the clarification of
the Kern & Tabery bid to include a ten year warranty on installation of the liner (as
identified in the bid specifications) as a written addendum. The total amount of
would remain unchanged. The motion also included authorization for the Chairman to sign
the contract on behalf of the county.

Motion by Stone, seconded Partmann and unanimously carried to approve payment of bills
per Attachment A of these minutes.

Motion by Stone, seconded Partmann and unanimously carried to reappoint Ray Mounts and
Clarence Bladow for another term of four years on the Otter Tail Lakes Area Sewer
District Board.
JUNKYARD, AUTO SALVAGE, RECYCLING FACILITIES, ETC.
Motion by Lee, seconded Partmann and unanimously carried to refer junkyard, auto
salvage, recycling facilities, etc. to the Planning Commission for recommendation with
regard to a possible ordinance.

PLANNING COMMISSION RECOMMENDATIONS
Motion by Lee, seconded Lindquist and unanimously carried to approve the recommendation
of the Planning Commission with regard to the Conditional Use Application of

Motion by Lee, seconded Partmann and unanimously carried to honor the request for an
extension for filing of final plat of "Pine Lake Shores11 until October 1, 1994.
SNOWMOBILE TRAIL AGREEMENTS
Motion by Lindquist, seconded Stone and unanimously carried to enter into a Snowmobile
Trail Agreement where Otter Tail County acts as fiscal agent for OCTA and Lake Runners.
1994 SEWAGE DISPOSAL INSTALLERS LICENSE
Motion by Lee, seconded Lindquist and unanimously carried to approve the 1994 Sewage
Disposal Installers License Application of Lake Region Well Drilling, Vergas, MN.

JULY 4TH PARADE REQUEST
Motion by Lindquist, seconded Lee and unanimously carried to approve the request of
Pat Garza for a July 4th parade along a portion of Otter Tail Lake to be held along
route approved by the Sheriff's office.
HUMANE SOCIETY
A motion was made by Lindquist, seconded Partmann and unanimously carried to approve
payment of $25,000 to the Humane Society of Otter Tail County for capital improvements
and to address capital improvements in budget sessions in the future. The Board
acknowledged areas of animal control, stray animals, etc. would be a significant and an
expensive problem for the Sheriff's department were it not for the Humane Society.
RESOLUTION OF SUPPORT
Motion by Partmann, seconded Lee and unanimously carried to adopt the following
resolution of support:
WHEREAS, the Otter Tail County Board of Commissioners haye considered a number of
factors in support for the location of a newly constructed corn processing plant in
Otter Tail County; and
WHEREAS, Northern Corn Processors has announced their intention to locate a newly
constructed corn processing plant in the Red River Valley areas of Minnesota, North and
South Dakota; and
WHEREAS, representatives of the City of Fergus Falls and other communities of Otter Tail
County are engaged in efforts to have Northern Corn Processors select a site in
Otter Tail County for the plant; and
WHEREAS, the construction of this plant in Otter Tail County would benefit the economic
climate and improve the welfare of all county residents.
NOW, THEREFORE BE IT RESOLVED, that the Otter Tail County Board of Commissioners
supports the construction of the Northern Corn Processors plant in Otter Tail County,
Minnesota.
