HomeMy WebLinkAboutBoard of Commissioners - Minutes - 05/24/19940 0 Minutes of the OTTER TAIL COUNTY BOARD OF COMMISSIONERS Commissioners' Room, Floor 1-B Otter Tail County Courthouse Tuesday, May 24, 1994 9:30 a.m. CALL TO ORDER The Otter Tail County Board of Commissioners convened Tuesday, May 24, 1994, at l:16 p.m. at the Otter Tail County Courthouse with Commissioners Harley Windels, Chairman; Bill Stone; Virginia Partmann; and Malcolm Lee present. Commissioner Andy Lindquist was absent. APPROVAL OF MINUTES Motion by Stone, seconded Partmann and unanimously carried to approve the May 17, 1994, minutes as submitted. 1993 ANNUAL REPORT WEST OTTER TAIL SOIL & WATER CONSERVATION DISTRICT Norm Fjestad, Chairman of the West Otter Tail Soil and Water Conservation District, provided Board members with copies of their 1993 Annual Report for the West Otter Tail Soil & Water Conservation District. BID AWARD: NORTHEAST LANDFILL After having previously opened the bids at 1:00 p.m. on May 19, 1994, for the Phase I Ash & MSW Final Closure of the Northeast Otter Tail Sanitary Landfill, the Solid Waste Director provided the following bid summary: A-1 Minn-Kata Excavating, Inc. 1,588,000.00 1,574,000.00 Brooklyn Park, MN ,Carl Bolander & Sons Co. 1,196,350.00 1,176,350.00 0 St. Paul, MN Duininck Bros., Inc. 1,040,000.00 1,035,000.00 Prinsburg, MN Kern & Tabery, Inc. 789,047.40 781,651.00 Wadena, MN After recommendation from Mike Hanan, Solid Waste Director, to proceed with the A-2 option, a motion was offered by Partmann, seconded Lee and unanimously carried to award the Northeast Landfill Phase I Ash & MSW Final Closure, A-2, to the lowest bidder, Kern & Tabery, Inc. of Wadena, MN, contingent upon the review and approval of the County Attorney. • 0 Otter Tail County Board of Commissioners May 24, 1994 Page 2 SOLID WASTE SERVICE SYSTEM FEES Michelle Petterson, Service Fee System Administrator, outlined examples of a service fee letter. After discussion, a motion was made by Partmann, seconded Stone and unanimously carried to authorize the Service Fee System Administrator to proceed with Method #2 1 a proposed method of calculating service fee charges based on the volume of waste generated by businesses. PLANNING COMMISSION RECOMMENDATIONS Motion by Stone, seconded Partmann and unanimously carried to approve the following Conditional Use Application/Preliminary Plat recommendation of the Planning Commission: 11 Highland Vista", Big Pine Lake Motion by Lee, seconded Partmann and unanimously carried to approve the following Conditional Use Application/Preliminary Plat recommendation of the Planning Commission: 11 Starland Shores 11 , Star Lake Note: For information regarding any of the above Conditional Use Applications/Preliminary Plats, contact the Land & Resource Management Office. 1994 SEWAGE DISPOSAL SYSTEM INSTALLERS/CLEANERS LICENSE Motion by Lee, seconded Stone and unanimously carried to approve the following 1994 Sewage Disposal System Installers License: Abbott Exe. & Trucking, Erhard, MN (new) Motion by Lee, seconded Stone and unanimously carried to approve the following 1994 Sewage Disposal System Cleaners License: Hawes Septic Tank Pumping (adding additional truck) FINAL PLAT Motion by Lee, seconded Partmann and unanimously carried to approve the final plat of Haven Hills, First Addition, as presented by the Land & Resource Director. FORGIVENESS OF PENALTY Motion by Stone, seconded Lee and unanimously carried to deny the request of Rev. Sharon Johnson for forgiveness of penalty on 1994 property tax on parcel no. 25-000-26-0161-011 in accordance with established policy. SUBDIVISION CONTROLS ORDINANCE After hearing a report from the County Auditor regarding metes and bounds splits within the shoreland areas of the county, a motion was made by Lee, seconded Partmann and 0 0 Otter Tail County Board of Commissioners May 24, 1994 Page 4 unanimously carried not to impose a moratorium which initially would allow time for amendment to the Subdivision Controls Ordinance. EXHIBITION & SHOWS ORDINANCE Motion by Stone, seconded Partmann and unanimously carried to approve the Exhibition & Shows License Application of Four Star Promotions, Inc. of Alexandria, fvIN, for an event entitled "Runestone Festival" scheduled for June 17-19, 1994. TEMPORARY BEER/WINE LICENSE Motion by Lee, seconded Partmann and unanimously carried to set a policy of charging a fee of $50 on a three day temporary wine and beer license of 11 for profit 11 applicants. Motion by Lee, seconded Stone and rmanimously carried to approve a temporary beer/wine license for Four Star Promotions, Inc. of Alexandria, fvIN, for June 17-18, 1994. CULVERT REPLACEMENT Motion by Partmann, seconded Lee and unanimously carried to authorize the Highway Engineer to proceed under the culvert replacement sharing (50%) materials and installation policy with regard to a request from St. Olaf Township for a 48" culvert. Motion by Stone, seconded Partmann and unanimously carried to approve, under the culvert replacement sharing (50%) materials and installation policy, a request by Eastern Township for replacement of a 60 11 culvert contingent upon the Highway Engineer's verification that this retroactive request has followed the established policy. REAPPOINTMENT A motion was made by Lee, seconded Partmann and unanimously carried to appoint Richard K. West to a four year term as the Otter Tail County Highway Engineer. West was publicly thanked for his past years of service. JUVENILE TEMPORARY HOLD ATTENDANTS After discussion with the Jail Administrator and Court Services Director, a motion was made by Partmann, seconded Lee and unanimously carried to authorize the training of thirteen Juvenile Temporary Hold applicants, eleven will begin work assignments and the two remaining will be placed on an eligibility list. PERFORMANCE EVALUATION SUMMARY Motion by Lee, seconded Partmann and unanimously carried to accept the written performance summary of Charles Kitzman, Court Services Director as presented and, further, direct said evaluation be placed in his personnel file. For the public record the Board reported the performance evaluation of Charles Kitzman, Court Services Director, to be a "very favorable recommendation11 • PERHAM TOUR REPORTED Commissioners Windels, Lee and Stone reported on their recent tour of several of the Perham businesses. A letter of thanks will be sent to the Mayor of Perham for hosting an interesting tour. () Otter Tail County Board of Commissioners May 24, 1994 Page 5 RIGHT-OF-WAY: SP 56-614-09 & 10 Motion by Windels, seconded by Stone and unanimously carried to authorize the Highway Engineer to proceed with eminent domain, if needed, with regard to right-of-way acquisitions in the City of Richville, Project SP 56-614-09 & 10. COUNTY PARKING LOT USAGE Motion by Partmann, seconded Lee and unanimously carried to approve the use of two of the county's parking lots for the Summer Fest on June 18, 1994. The lots affected by this request are across from City Hall and across from Metz Bakery. PAYMENT AUTHORIZED Motion by Lee, seconded Partmann and unanimously carried to approve payment in the amount of $476.84 to Minnesota Counties Insurance Trust for deductible reimbursements of File Nos. 5013, 5031, 5041, 5042 and 5043.
