CALL TO ORDER
The Otter Tail County Board of Commissioners convened Tuesday, Aprils, 1994, at
9:30 a.m. at the Otter Tail County Courthouse with Commissioners Harley Windels,
Chairman; Bill Stone; Virginia Partmann; Malcolm Lee and Andy Lindquist present.

Motion by Stone, seconded Lee and unanimously carried to approve the final plat of
West Point Shores, Ot~er Tail Lake, subject to County Attorney's response on covenants.
SEWAGE SYSTEM INSTALLERS LICENSES
Motion by Partmann, seconded Stone and unanimously carried to approve the renewal
application for Sewage System Installers License of Gene Payne Construction,
Parkers Prairie, MN.
Motion by Partmann, seconded Stone and unanimously carried to approve the new
application for sewage System Installers License of Bitzan Backhoe, Evansville, MN.
SEWAGE SYSTEM CHECK REQUEST
Motion by Lee, seconded Lindquist and unanimously carried to honor the request of the
Dead Lake Property Owners Association to place Dead Lake on the schedule for septic
system survey.
1994 NATURAL RESOURCES BLOCK GRANT
B~ll Kalar, Land & Resource Management Director, provided a handout outlining the 1994
Na~ural Resources Block Grant which included planned expenditures for this grant.
VETERANS SERVICE OFFICE OPERATIONAL IMPROVEMENT GRANT RESOLUTION

BE IT RESOLVED that Wayne Stein, Auditor, act as the legal sponsor for project ls)
contained in the County Veterans Service Officers Grant Application submitted on
February 14, 1994, and that the County Veterans Service Officer is hereby authorized to
receive grant funds from the Minnesota Department of Veterans Affairs for funding of
this project on behalf of Otter Tail County.
BE IT FURTHER RESOLVED that Wayne Stein, Auditor, has the legal authority to apply for
financial assistance, and the institutional, managerial, and financial capability to
ensure adequate construction, operation, maintenance and replacement of the proposed
project.
BE IT FURTHER RESOLVED that Otter Tail County has not violated any federal, state or
local laws pertaining to fraud, bribery, graft, kickbacks, collusion, conflict of
interest or other unlawful or corrupt practices.

TRANSFER OF FUNDS
Motion by Lee, seconded Lindquist and unanimously carried to approve a transfer from the
County Building Fund to the Road and Bridge Fund in the amount of $6,785.37 for the
following:

SOIL SURVEY AGREEMENT

Motion by Lindquist, seconded Partmann and unanimously carried, to approve payment, in
the amount of $19,528.29, to reimburse the Soil Conservation Service for costs incurred
in furnishing technical assistance for the period of January 1, 1994 through
March 31, 1994, as per the Soil Survey Agreement.
FORGIVENESS OF PENALTY
Motion by Lindquist, seconded Stone and unanimously carried to deny according to earlier
set policy, forgiveness of penalty and interest as requested by Cathleen S. Manning on
Parcel No. 14-000-02-0011-000.
TAX FORFEITED PROPERTY
Motion by Stone, seconded Lee to convey to the City of Parkers Prairie the following
described parcel of tax forfeited property at a ~otal purchase price of $50 (which
includes fees):

After discussion, all Board members voted against this motion. The Auditor was directed
to bring back appropriate policy language which can be applied to this and other
properties at the April 12, 1994, County Board meeting.
Motion by Lee, seconded Partmann and unanimously carried to review this request at the
April 12, 1994, meeting after an appropriate policy has been developed.
LAND SURVEYORS CERTIFICATE OF CORRECTION TO PLAT
NAME OF PLAT: WENONGA BEACH
Motion by Lee, seconded Partmann and unanimously carried to accept for recording the
Land Surveyor's Certificate of Correction to Plat prepared by David A. Anderson,
Registered Land Surveyor, under the laws of the State of Minnesota, Registration No.
13620, and that pursuant to the provision of Chapter 505.173 through 505.177 Laws of
Minnesota, 1957, David A. Anderson, the undersigned, a Registered Land Surveyor in the
State of Minnesota declares as follows:
1. That the plat of Wenonga Beach, dated April 6th, 1925, and filed on April 14, 1925
in the office of the County Recorder, Otter Tail County, Minnesota, in Book J of
Plats, page 78, was prepared by Ernest E. Johnson, Registered Land Surveyor No.
1201, now deceased.
That said plat contains the following omissions to wit:

Motion by Lindquist, seconded Lee and unanimously carried to authorize the Building
Maintenance Supervisor to proceed with obtaining quotations from Otter Tail County
carpet dealers with regard to carpet replacement at the 505 South Court Street Social
Services building.
HUMANE SOCIETY REQUEST
Motion by Lindquist, seconded Lee and unanimously carried to request Melo. Olson to
appear before the County Board relative to a request by the Humane Society for several
unused desks.
NEW YORK MILLS BUILDING
Motion by Lindquist, seconded Lee and unanimously carried to amend the New York Mills
Building Lease wherein the county would assume responsibility for its own employees as
outlined by the Coordinator.
M.C.I.T. DEDUCTIBLES
Motion by Lee, seconded Lindquist and unanimously carried to authorize payment of
deductibles to close liability insurance files No. 4728 and 4729 in the amounts of $750
and $700 payable to Minnesota Counties Insurance Trust.

M,C.I.T. POLICY CHANGES
Motion by Lindquist, seconded Partmann and unanimously carried to authorize the payment
of $219 to the Minnesota Counties Insurance Trust, Policy No. PC114094, resulting from
additional premium for endorsements to the county's insurance policy.
DITCH VIEWER POOL
Motion by Lindquist, seconded Lee and unanimously carried to name Howard Geese,
Fergus Falls, MN, to the Otter Tail County Ditch viewer Pool List.
THE INTERNATIONAL COALITION
FOR LAND/WATER STEWARDSHIP IN THE RED RIVER BASIN
Motion by Lee, seconded Lindquist and unanimously carried to request The International
Coalition for Land/Water Stewardship in the Red River Basin to remove Otter Tail
County's name from their list of Participating Counties as listed on their Northwest
Minnesota CLWP Joint Powers Board letterhead because our county is not a current member
of this organization.
APPROVAL TO PAY BILLS
Motion by Stone, seconded Lee and unanimously carried to authorize the payment of bills
and claims as listed on Attachment A of these minutes.
1994 YEARLY PURCHASES -BIDS ACKNOWLEDGED
Rick West, Highway Engineer, acknowledged receipt of the following bids for 1994 yearly
purchases. Individual bids were opened by Damon DeVillers, Assistant Highway Engineer,

Rick West, Highway Engineer, opened the following bids for County Wide Sand Seal. He
will review these bids and offer a recommendation at the April 12, 1994, Board meeting.

WASTE OIL FURNACE -BATTLE LAKE GARAGE
The Highway Engineer reported he had obtained quotations for replacement of a waste oil
furnace at the Battle Lake Garage.
A motion was offered by Lindquist, seconded Stone and unanimously carried to authorize
the Highway Engineer to proceed with replacement of this furnace at a cost of $6 1 0891
which includes installation, as quoted by Bjorn 1 s Heating & Air Conditioning,
Fergus Falls, MN.
ROOFING OF PHELPS MILL LEAN-TO & LOG HOUSE
The Highway Engineer reported he had obtained an estimate quotation from Brian Jorgenson
for roofing of the Phelps Mill lean-to and log house. The breakout of the estimate,
which totalled $9,313 was $3,228 for the mill lean-to; $5,935 for the log house; $150
for patching of various garage roofs.
A motion was offered by Lindquist, seconded Lee and unanimously carried to authorize the
Highway Engineer to proceed with the repairs as outlined.
REVIEW OF 1994 CONSTRUCTION PROJECTS
Rick West, Highway Engineer, reviewed with the Board the 1994 Highway Improvement
Program. An overview was provided for each project and its location was indicated on a
map which was presented as handout materials.

Motion by Lee, seconded Lindquist and unanimously carried to authorize the Highway
Engineer to proceed with setting the bid opening on the following projects for 1:00 p.m.
on May 10, 1994:

FIVE YEAR CONSTRUCTION PROGRAM PUBLIC INPUT MEETINGS
The Highway Engineer indicated public input meetings have been scheduled throughout the
county on the Five Year Highway Construction Program.
PEDAL-DE-POND BIKE TOUR
Motion by Partmann, second by Stone and unanimously carried to allow the Pedal-de-Pond
Bike ·Tour on May 7, 1994, per the designated routes, upon approval of the Sheriff, and
that Otter Tail County would be held harmless in reference to potential liability.
PREPAYMENT AUTHORIZED
Motion by Partmann, seconded Lindquist and carried, with Lee opposed, to authorize
payment to the Minnesota Department of Transportation (MnDOT) in the amount of $3,199.50
for installation of informational signing along trunk highways.
Motion by Lindquist, seconded Partmann and unanimously carried to approve prepayment
registration for five employees (four Highway Department and one Land & Resource
Management Office) to attend the 1994 NPDES Construction Site Storm Water Permit
Informational Seminar at Detroit Lakes. The cost for the seminar is $17 per individual.
PHELPS MILL DAM REPAIR UPDATE
The Highway Engineer updated the Board on the Phelps Mill Dam Project.
COUNTY DRAINAGE DITCH NO. 21
Dave Belcher, area landowner along Otter Tail County Drainage Ditch No. 21, requested
permission from the Board to assemble a group of volunteers to clear debris from the
ditch. After discussion with the Highway Engineer and Board members it was determined
that the engineering study indicated the flow problem to be associated with the
elevations of the ditch, therefore, until that problem is corrected it was determined
that the drainage ditch could not flow.
PERFORMANCE EVALUATION SUMMARY
Motion by Stone, seconded Lee and unanimously carried to report the performance
evaluation of Robert Moe, Assessor, was favorable.
CLOSED TO PUBLIC
At 2:50 p.m. the meeting of the Otter Tail County Board of Commissioners was closed to
the public for the purpose of continuing labor negotiation strategy discussions with
regard to the Teamsters' essential unit.
