CALL TO ORDER
The Otter Tail County Board of Commissioners convened Tuesday, March 15, 1994, at
9:30 a.m. at the Otter Tail County Courthouse with Commissioners Harley Windels,
Chairman; Bill Stone; and Malcolm Lee present and Commissioners Andy Lindquist and·
Virginia Partmann absent.
APPROVAL OF MINUTES
Motion by Stone, seconded Lee and unanimously carried to approve the official copy of
the March 8, 1994, minutes.
DETENTION FACILITY ANNUAL REPORT
John Halvorson, Detention Facility Commander, presented the 1993 Otter Tail County
Detention Facility Annual Report. Included in the report were Inmate Statistical Data;
Court Processing Procedure Statistics; Total Population Statistics and Prisoner Days;
Work Release Statistics and other information which included a summary of income.
DETENTION FACILITY MEAL COST SURVEY
The Detention Facility Commander, responding to an earlier request by the Board,
provided meal cost survey comparison figures of nine 9ther counties. There was some
discussion of going out for bids when the present meal service contract expires in July.
HOUSEHOLD HAZARDOUS WASTE CONTRACT
Mike Hanan, Solid Waste Director, anriounced that the Household Hazardous Waste Contract
has been approved by the Minnesota Pollution Control Agency and would be developed as
part of the recycling center expansion.
SOLID WASTE: QUADRANT AGREEMENT WITH ITASCA COUNTY
The Solid Waste Director, discussed with the Board issues of the Quadrant Agreement with
Itasca County. Specific matters of discussion were the Contingency, Non-Combustible and
Financial Assurance Funds.
NORTHEAST LANDFILL POSITION
After listening to the explanation of the Solid Waste Director for the need of an
additional attendant position at the Northeast Landfill Demolition Site, a motion was
offered by Lee, seconded Stone and unanimously carried to authorize the additional
three-fourths time position.

AUTHORIZATION FOR EXEMPTION FROM LAWFUL GAMBLING LICENSE
Commissioner Lee indicated no reason for denial of an application for Authorization for
Exemption from Lawful Gambling by Ducks Unlimited, Pelican Rapids, MN, for an activity
to be held April 13, 1994, at the Pelican Supper Club.
LAND SURVEYORS CERTIFICATE OF CORRECTION TO PLAT
NAME OF PLAT: EVANDERS BEACH
Motion by Lee, seconded Stone and unanimously carried to accept for recording the Land
Surveyor's Certificate of Correction to Plat prepared by Terry Lee Anderson, Registered
Land Surveyor, under the laws of the State of Minnesota, Registration No. 14676, and
that Pursuant to the provision of Chapter 472, Laws of Minnesota, 1955, and Chapter
505.173 through 505.177 Laws of Minnesota, Terry Lee Anderson, the undersigned, a
Registered Land Surveyor in the State of Minnesota declares as follows:
1. The subdivision plat of Evanders Beach was prepared by Edgar Haugan a Registered
Land Surveyor of whom is retired from surveying practice. His whereabouts is
unknown and he may be deceased.
2. The subdivision plat of Evanders Beach was filed for record in the office of the
County Recorder in and for Otter Tail County, Minnesota on March 11, 1925 and was
recorded in Book J of Plats on Page 75.
3. That the subdivision plat of Evanders Beach contains errors, omissions or defects in
the following particulars to wit:
The outside boundaries of the plat were described along the surveyors survey line
adjacent to the shoreline of Eagle Lake. This error inadvertently eliminates a
small sliver of land between the survey line and the actual shoreline of the lake.
The following description is to be permanently attached to the plat of Evanders
Beach describing the aforementioned sliver of land.
That part of Government Lot 2 of Section 10, Township 131 North, Range 40 West,
Otter Tail County, Minnesota described as follows:

Beginning at the Southeast Corner of Lot 12 of Evanders Beach, on file and of
record in the office of the County Recorder in and for Otter Tail County,
Minnesota; thence southerly along the southerly extension of the easterly line of
said Lot 12 to the shoreline of Eagle Lake; thence southwesterly following along
the shoreline of Eagle Lake to its intersection with the southwesterly line of said
Evanders Beach; thence northwesterly along the southwesterly line of said Evanders
Beach to the most southerly corner of said Evanders Beach; thence northeasterly
following along the southeasterly line of said Evanders Beach as platted to the
point of beginning.
That the sidelines of Lots 1 through 12 of Evanders Beach are to be extended to
intersect the shoreline of Eagle Lake.

BID AWARD: TWO NEW HEAVY DUTY TANDEM AXLE SNOWPLOWING DUMP TRUCKS
Motion by Lee, seconded Stone and unanimously carried to award the bid for two new heavy
duty tandem axle snowplowing dump trucks to Hall GMC, Fargo, ND, lowest bidder, in the
amount of $96,490 as recommended by the Highway Engineer.
OUTDOOR RECREATIONAL GRANT
Rick West, Highway Engineer, recommended pursuit of an Outdoor Recreational Grant
through the Department of Natural Resources (DNR). He indicated grant monies, if
awarded, would be a 50/50 match and could be used for the Phelps Mill Park for
installation of a new well and for permanent/improved restroom facilities which would
also meet the Americans with Disabilities Act (ADA) standards.
A motion was offered by Lee, seconded Stone and unanimously carried to recommend the
Highway Engineer proceed with the grant as described.
PHELPS MILL DAM PROJECT
The Highway Engineer apprised the Board of the Phelps Mill Dam Project. He indicated
grouting would start this week with anticipated completion in about one week.
A motion by Stone, seconded Lee and unanimously carried to aut~orize the Highway
Engineer to install a 11bubbler line 11 along the dam for reduction of ice build-up/damage
to the dam structure at an estimated cost of $1,200.

COMMISSIONER PRESENT
() At 1:00 p.m. Commissioner Partmann was present for the remainder of the Otter Tail
County Board of Commissioners' meeting.
APPROVAL OF BILLS
Motion by Stone, seconded Partmann and unanimously carried to approve the payment of
bills per Attachment A of these minutes.
BCBS SERVICE AGREEMENT
Motion by Partmann, seconded Lee and unanimously carried to authorize the Coordinator to
execute the Blue Cross Blue Shield Service Agreement for 1994 as outlined by the
Coordinator.
AFSCME CONTRACT
Motion by Lee, seconded Partmann and unanimously carried to authorize the Chairman's
signature on the American Federation of State, County & Municipal Employees AFL-CIO,
Local Union No. 1830 contract for 1994 through 1996.
VETERANS HOME COMMITTEE
0 Chairman Windels reappointed Commissioner Lee to serve on the Veterans Horne Committee.

MCIT: ANNUAL STATE OF THE COUNTY RISK MANAGEMENT REPORT
Kim Chapman, Meadowbrook Insurance Group representative, discussed the 1993 State of the
County Risk Management Report for Otter Tail County. His presentation outlined the
county's losses in property, casualty and workers' compensation payments as well as the
five year modification history and the county's ranking among other member counties in
the pool. He commended Otter Tail County for their ~ignificant ranking improvement
over the past several years.
AMC LEGISLATIVE COMMITTEE REPORT
Commissioner Lee reported on a recent AMC Legislative Committee meeting regarding a
number of issues related to the Local Government Trust Fund, Health Care Reform1
elimination of the Homestead Credit, Renters Credit Refund, and others were mentioned.
CLOSED TO PUBLIC
At 2:48 p.m., Chairman Windels declared the meeting of the Otter Tail County Board of
commissioners closed to the public for the purposes of individual performance
evaluation and discussion of labor negotiation strategies with three of the county1s
bargaining units (Teamsters). The performance being evaluated was that of Bob Moe,
Assessor.

At 4:12 p.m., Chairman Windels adjourned the meeting of the Otter Tail County Board of
