Call to Order
The Otter Tail County Board of Commissioners convened Tuesday, January 18, 1994, at
9:30 a.m. at the Otter Tail County Courthouse with Commissioners Harley Windels,
Chairman; Malcolm Lee; Bill Stone; Andy Lindquist and Virginia Partmann present.
Approval of Minutes
Motion by Lee, seconded Lindquist and unanimously carried to approve the minutes of
January 11, 1994, as submitted.
Waste Pesticide Collection
Marie Tysdal, Public Information Officer with the Solid Waste Department, described
upcoming plans for a Waste Pesticide Collection to be held on Friday, April 8, 1994,
from 8 a.m. -12 noon at the Battle Lake County Garage. Otter Tail County is
responsible for securing the site, volunteers to work at the collection and all
advertising for the collection.
Waste Chemical Container Collection
Marie Tysdal discussed with the Board possible dates for a Waste Chemical Container
Collection. After discussion, Thursday, July 7 and Friday, July 8, 1994, were dates
selected for the collection.
Solid Waste Advisory Board
Motion by Stone, seconded Partmann and unanimously carried to reappoint Lyle Rosenow and
George Palmer, of Henning and Parkers Prairie respectively,to the Solid Waste Advisory
Board to serve a three year term commencing January 1, 1994.
Board of Adjustment
Motion by Stone, seconded Partmann and unanimously carried to reappoint Craig Anderson,
Ottertail, to the Board of Adjustment for a one year term commencing January 1, 1994.
Motion by Partmann, seconded Stone and unanimously carried to appoint James Ayres,
Fergus Falls, to a one year term commencing January 1, 1994.
Elected Officials Salary Resolution
Motion by Partmann, seconded Lindquist and unanimously carried to adopt the following
resolution:
WHEREAS, the Otter Tail County Board of Commissioners finds that the following facts
support this resolution:
1. The offices of County Attorney, Auditor, Recorder, Sheriff and Treasurer are elected
positions scheduled for election in November of 1994.

2. Minnesota Statutes relating to each of the elected offices listed above require that
the County Board, at the January meeting prior to the first date on which applicants
may file for the elected offices, shall set by resolution the minimum salary to be
paid for each of the offices.
3. The same statutes set the minimum salary for each of the elected officials in
counties with 40,000 or more inhabitants at $8,000.00.
NOW, THEREFORE, BE IT RESOLVED that the Otter Tail County Board of Commissioners hereby
sets the minimum salary for each of the following elected officials of Otter Tail County
for the term following the next election at $8,000.00 per year:

County Auditor
County Recorder
County Sheriff
County Treasurer

Payment Approved
Motion by Lee, seconded Partmann and unanimously carried to reimburse the amount of
$28.76 to the Otter Tail County Highway Department for film duplicating services.
Premise Permit Application
Motion by Stone, seconded Windels unanimously carried to adopt the following resolution:
WHEREAS, the responsibility for the regulation of lawful gambling and the issuance of
licenses and permits for the conduct of lawful gambling lies with the Minnesota Gambling
Control Board; and
WHEREAS, the Perham Lion's Club, Perham, MN, has made an application to the Gambling
Control Board for a premise permit to conduct lawful gambling at the Perham Oasis, Inc.
in Perham Township of Otter Tail County; and
WHEREAS, Minnesota Statute 349.213 provides that the Gambling Control Board may not
issue a premise permit unless they receive a resolution from the Otter Tail CoUnty Board
of Commissioners approving the permit; and
WHEREAS, the Otter Tail County Board of Commissioners is aware of no reason to oppose
the conduct of lawful gambling by the Perham Lion's Club, Perham, MN, at the Perham
Oasis, Inc. in Perham Township of Otter Tail County.

NOW, THEREFORE, BE IT FURTHER RESOLVED that the Otter Tail County Board of Commissioners
hereby approves the conduct of lawful gambling by the Perham Lion's Club, Perham, MN, at
the Perham Oasis, Inc. in Perham Township of Otter Tail County, provided that the
applicant meets all the necessary criteria for the licenses and permits required by the
Gambling Control Board.
IT IS FURTHER RESOLVED, that notice of this application and approval shall be provided
to the Town Board of Perham Township by sending them a copy of this resolution.

Flexible Spending Account Fee Schedule
For Administrative Services Agreement
Motion by Lee, seconded Partmann and unanimously carried to authorize the Chairman of
the Otter Tail County Board of Commissioners to sign the Flexible Spending Account Fee
Schedule for Administrative Services Agreement with DCA, Inc., for the period of
January 1, 1994 through December 31, 1994.

Recycling Resolution
After hearing recommendations from Recycling Committee members, Lee and Windels, a
motion was offered by Lindquist, seconded Partmann and unanimously carried to adopt the
following resolution:

The Minnesota State Legislature and the Otter Tail County Board have determined that
recycling is an essential component of solid waste management plans.
Minnesota Statutes, Section llSA.51, Subd. 2(a), requires that by December 31, 1996,
each county will have a goal to recycle thirty (30) percent by weight of total solid
waste generation, and requires each county to develop and implement programs,
practices or methods designed to meet this recycling goal.
Minnesota Statutes, Section llSA.49, requires establishment of a program to
encourage counties in the development and implementation of solid waste management
projects and to transfer the knowledge and experience gained from such projects to
other communities in the state.
Otter Tail County established a countywide recycling program in 1989 which has grown
significantly and now requires an expanded processing facility to more efficiently
and economically process materials for marketing.
Otter Tail County has acquired experience in the processing and marketing of
recyclable materials which it is willing to make available to smaller neighboring
counties.
Otter Tail County is willing to organize and participate in a regional effort with
neighboring counties to process and market recyclable materials in a more economical
and efficient manner than any one of the counties can achieve, acting alone.
A regional recycling effort would better enable the participating counties to meet
the goals established by the Minnesota State Legislature and will reduce the need to
dispose of solid waste through alternative methods which may pose risks of negative
environmental impact.
Otter Tail County intends to make application to the Minnesota Pollution Control
Agency for a Capital Assistance Grant to construct and expand a regional recycling
center.
NOW, THEREFORE, BE IT RESOLVED, by the Otter Tail County Board of Commissioners that the
Solid Waste Director is hereby authorized to sign a preliminary grant application for
Nine Hundred Two Thousand Two Hundred Ninety-seven Dollars ($902,297.00) of Capital
Assistance Grant funding for the Otter Tail County Regional Recycling Center.
BE IT FURTHER RESOLVED by the Otter Tail County Board of Commissioners that if the Nine
Hundred Two Thousand Two Hundred Ninety-seven Dollars ($902,297.00) Capital Assistance
Grant is awarded, Otter Tail County will implement the project, provide necessary local
financing and accept and exercise the governmental powers necessary to develop and
operate the regional project.

New York Mills Building
Larry Krohn and Wally Senyk, County Coordinator and County Attorney respectively,
updated Board members regarding the New York Mills building proposal with the City of
New York Mills.
Other Reports
Commissioner Stone reported on a recent ag meeting which included discussion about
upgrading rural sewer systems and feedlot discussions.
Commissioners Partmann and Stone highlighted a recent RTC Coalition meeting.
Bid Opening: '94 Highway Signing Materials
At 1:02 p.m., after having previously advertised for bids to be opened, the Highway
Engineer opened the following bids for '94 Highway Signing Materials:

The Highway Engineer will make an award recommendation at the January 25, 1994, Board
meeting.
Bid Award: Rotary Snowplow
After hearing the recommendation of the Highway Engineer, a motion was offered by Lee,
seconded Lindquist and unanimously carried to award the Rotary Snowplow bid as follows:

Spinning Sanders
In light of safety and efficiency, a motion was offered by Stone, seconded Lee and
unanimously carried to authorize the Highway Engineer to replace the remaining twelve
drum sanders with spinning sanders payable through an internal adjustment of the Highway
budget.
Retirements
Chairman Windels presented retirement plaques of appreciation to the following Highway
Department individuals for their years of service to the County. Those individuals
were:

Motion by Partmann, seconded Stone and unanimously carried to authorize the payment of
bills per Attachment A of these minutes.

Consolidated Vehicle Maintenance
Rick West, Highway Engineer; Bob Williams, Recycling Center Manager; and Joe Peloquin,
Sheriff's Department Captain; discussed a proposed consolidated vehicle maintenance plan
for the Board's consideration. The group outlined their proposed objective with
consideration of the present situation and an overview of the background. Options for
long term and short term recommendations were made.
A motion was offered by Lindquist, seconded Partmann and unanimously carried to direct
this group to proceed, through appropriate channels, with the hire of a full-time
mechanic to address the recycling needs first and to proceed with 25% Recycling/75%
Highway Department usage as outlined in a proposed agreement. West 1 Williams and
Peloquin were directed to continue exploring long-term alternatives and provide a
recommendation.
Forgiveness of Penalty & Interest
Motion by Lee, seconded Lindquist and unanimously carried to forgive penalty and
interest on the following parcels due to a unique clerical error that occurred in the
billing process--provided the tax amount of $35,088 is paid within two weeks from this
date:

Tax Increment Financing
The Board invited Bob Moe, Assessor, and Wayne Stein, Auditor, to the meeting for
discussion of a proposed tax increment financing for Pioneer Home, Fergus Falls.
Concern was expressed that this property may eventually be removed from the tax rolls.
A public hearing is scheduled at the Fergus Falls City Council Chambers on January 19,
1994.
Capital Program
In response to a request by the County Attorney to use an unexpended '93 County
Attorney's budget amount, a motion was offered by Lee, seconded Lindquist and
unanimously carried to refer the request to the County1 s Budget Committee.
Adjournment
At 3:12 p.rn., Chairman Windels declared the meeting of the Otter Tail County Board of
Commissioners adjourned until 1:00 p.m. on Tuesday, January 25, 1994.
