Call to Order
The Otter Tail County Board of Commissioners convened Tuesday, January 11, 1994, at
1:00 p.m. at the Otter Tail County Courthouse with Commissioners Harley Windels,
Chairman; Malcolm Leei Bill Stone and Andy Lindquist present and Commissioner
Virginia Partmann absent.
Approval of Minutes
Motion by Lee1 seconded Lindquist and unanimously carried to approve the minutes of
January 4, 1994, as submitted.
Bid Opening: Rotary Snowblower
At 1:03 p.m., after having previously advertised for bids to be opened, the Highway
Engineer opened the following bids for a Rotary Snowblower:
MacQueen Equipment, Inc.
St. Paul, MN
Ruffridge-Johnson Equipment
Minneapolis, MN
$78,253
No Bid
Rick West, Highway Engineer, will make a recommendation for bid award at the
January 18, 1994 1 Board meeting.
Final Payment: Snow Removal Equipment
Motion by Lee, seconded Lindquist and unanimously carried to approve payment in the
amount of $55,237.96 payable to MacQueen Equipment Inc., St. Paul, for Snow Removal
Equipment as awarded on May 11, 1993.
Phelps Mill Dam Project
The Highway Engineer reported Barbarossa and Sons will commence Phase II of the Phelps
Mill Dam Project on February 7, 1994, with completion {except for seeding and minimal
clean-up) some time in the next four to six weeks.
Right-of-Way Request
Motion by Lee, seconded Lindquist and carried, with Stone abstaining, to deny the
request of Henning Public School to encroach CSAH 65 Right-of-Way near the school's
expansion project. It was pointed out that businesses have used right-of-ways for
parking, however permission had not been granted for permanent buildings.

Interim Ditch Inspector
County Drainage Ditch No. 70
Motion by Lindquist, seconded Lee and unanimously carried to direct the Highway Engineer
to serve as an interim Ditch Inspector and, further, to inspect the outlet of
Sewell Lake with regard to County Drainage Ditch No. 70 and report his findings to the
County Board.
Ditch Inspector Position
Motion by Lee, seconded Lindquist and unanimously carried to direct the Coordinator to
initiate the hiring process with regard to the Ag/Ditch Inspector position formerly held
by Roland Sauck. The motion also directed the position to be under the supervision of
the Land & Resource Management Office Director, and located within this department.
Sewage Disposal System Cleaners' Licenses
Motion by Lindquist, seconded Lee and unanimously carried to approve the following 1994
Sewage Disposal System Cleaners' License renewals:

Motion by Lee, seconded Stone and unanimously carried to reappoint George Hanson to the
Personnel Board of Appeals for a three year term commencing January 1, 1994.
Board of Adjustment
Motion by Windels, seconded Lindquist and unanimously carried to reappoint
George Walter, Perham, to the Otter Tail County Board of Adjustment.

Motion by Lee, seconded Lindquist and unanimously carried to reappoint Cecil Femling and
John Everts, Pelican Rapids and Battle Lake respectively, to the Otter Tail County Board
of Adjustment.
Land Surveyor's Certificate of Correction to Plat
Name of Plat: Sublots A, B, c, D, E, and F of Lots.
Section 28, Township 136 North, Range 40 West
Motion by Stone, seconded Lee and unanimously carried to accept for recording the Land
Surveyor's Certificate of Correction to Plat by David A. Anderson, Registered Land
Surveyor, under the laws of the State of Minnesota, Registration No. 13620, and that
Pursuant to the provision of Chapter 505.175 Laws of Minnesota, he has reviewed the
legal description and the surveyor's drawing of Sublets A, B, C 1 D, E and F of Lot 5,
Section 28, Township 136 North, Range 40 West, Otter Tail County, Minnesota and declares
as Follows:
1. That the plat of Sublots A, B, C, D, E and F of Lot 5, Section 28, Township 136
North, Range 40 West, dated September 23, 1910, and filed on December 13, 1910 in
the office of the County Recorder, Otter Tail County, Minnesota, in Book L of
Plats, Page 12 1 was prepared by Martin Aalberg, Civil Engineer and Surveyor, now
deceased.
2. That said plat contains the following omissions to wit:

omitted from the legal description on said plat.
That the legal description on said plat is hereby corrected as follows, to wit:
Beginning at Meander Post No. 98 on the section line between Sections 28 and 33 in
Township 136 North of Range 40 West of the 5th Principal Meridian: thence West
along said section line 734 feet: thence North 414 feet to the shore of McDonald
Lake: thence North 75 degrees East along said shore of McDonald Lake, a distance of
133.0 feet; thence South 77-3/4 degrees East along said shore of McDonald Lake, a
distance of 280.0 feet; thence South 62-1/2 degrees East along said shore of
McDonald Lake, a distance of 138.5 feet; thence South 40-3/4 degrees East along
said shore of McDonald Lake, a distance of 324.0 feet; thence south along said
shore of McDonald Lake, a distance of 78.0 feet to place of beginning.

Forgiveness of Penalty Requested
C, ),Motion by-Stone, seconded Lee and unanimously carried to accept payment in the amount of ~ $59 without penalty, for the second half 1993 property taxes for 28-000-05-0042-000,
Brad Carlson, due to clerical error.
County Drainage Ditch No. 21
County Attorney, Wally Senyk, discussed with the Board matters related to County
Drainage Ditch No. 21. Some discussion followed about redetermination of benefits due
to new construction in some areas along the ditch system as well as areas that in the
past did not benefit, however, may now benefit from the ditch. A report will be
prepared by the County Attorney.
Soil Survey
Stein reported there was a special levy in the years 1986, 1987, 1989, 1990, 1991, and
1992 for the Soil Survey cost. Balance outstanding $615,000 -$536,886.83 $78,113.17.
Amount available for implementation of Soil Survey and GIS -$789,000 -$615,000 =
$174,000.
Don DeMartelaere, Area Soil Scientest; Mike Lieser, West Otter Tail Soil Scientist Party
Leader; and Dave Aldeen, East Otter Tail Soil Scientist Party Leader, updated the Board
on the progress of the Soil Survey. Field work in the mapping process is expected to be
completed early next winter, however, it may be two more years before the written
documentation is completed. The II final acre ceremony11 is expected to take place in
October 1994.
Motion by Stone, seconded Lindquist and unanimously carried to authorize the Chairman to
execute the renewal of the existing Soil Survey Agreement. Soil Survey representatives
were requested to make quarterly progress reports to the Board.
Second Amendment To Joint Powers Agreement For Solid Waste Incineration
Motion by Lindquist, seconded Lee and unanimously carried to authorize the Chairman to
execute a Second Amendment to Joint Powers Agreement for Soild Waste Incineration.
Tri-County Solid Waste Agreement
Motion by Stone, seconded Lee and unanimously carried to authorize the Tri-County Solid
Waste Incineration Agreements be sent to the Tri County Solid Waste Commission
for their approval with annual renewal.
Adjournment
At 3:20 p.m., Chairman Windels declared the meeting of the Otter Tail County Board of
Commissioners adjourned until 9:30 a.m. on Tuesday, January 18, 1994.
