HomeMy WebLinkAboutBoard of Commissioners - Minutes - 01/04/19940 Minutes of the OTTER TAIL COUNTY BOARD OF COMMISSIONERS Commissioners' Room, Floor 1-B Otter Tail County Courthouse Tuesday, January 4, 1994 9:30 a.m. Statutory Meeting Pursuant to Statutes, the Board of County Commissioners of Otter Tail County, Minnesota, convened Tuesday, January 4 1 1994, at 9:30 a.m. with Commissioners Malcolm Lee, Harley Windels; Bill Stone; Andy Lindquist and Virginia Partmann present. Call to Order Chairman Selected The 1993 Board Chairman, Malcolm Lee, called the meeting of the Otter Tail County Board of Commissioners to order. The first order of business was the selection of a Chairman of the Board for the year 1994. Motion by Lee, seconded Partmann and carried, with Windels abstaining, to nominate Commissioner Harley Windels as Chairman of the Board of Commissioners for the year 1994. Vice-Chairman Selected Windels assumed the chair and called for nominations for Vice-Chairman. Motion by Partmann, seconded Lindquist and carried, with Stone abstaining, to nominate Commissioner Bill Stone as Vice-Chairman of the Board of Commissioners for the year 1994. Approval of Minutes Motion by Stone, seconded Lee and unanimously carried to approve the December 28, 1993, minutes as submitted. Motion by Lee, seconded Partmann and unanimously carried to approve an addition to the December 21, 1993, minutes with regard to the purchase of a Laser Plane 125 Package. The addition to be included is as follows: Laser Plane Purchase Motion by Lindquist, seconded Partmann and unanimously carried to authorize the purchase of two Laser Plane Model 125 Packages and three grade rods from Northwest Laser, Inc., St. Paul, MN, at a total cost of $3,045.90 from the '93 budget. 1994 Meeting Dates Motion by Stone, seconded Lee and unanimously carried, to establish the following as the dates the County Board will meet during the year 1994 to conduct County business, with the full day1 s meetings commencing at 9:30 a.m. and the afternoon meetings of the County Board commencing at 1:00 p.m.: 0 Q ·ot:t:ei~'Tail County Board of Commissioners January 4, 1994 Page 2 Full Day Morning: Human Services Regular Board Afternoon: Regular Board January 4 & 18 11 & 25 February 1 & 15 8 & 22 March 1 & 15 8 & 22 April 5 & 19 12 & 26 May 3 & 17 10 & 24 June 7 & 21 14 & 28 July 5 & 19 12 & 26 August 2 & 16 9 & 23 September 6 & 20 13 & 27 October 4 & 18 11 & 25 November 1 & 15 8 & 22 December 6 & 20 13 & 27 Board of Equalization: June 17 Motion by Lee, seconded Lindquist and unanimously carried to convene the County Board of Equalization on June 17, 1994, at 9:30 a.m. and to reconvene the County Board of Equalization for final action on June 30, 1994. Resolution of Otter Tail County For Adopting the Permanent Rules of The Wetland Conservation Act Upon a motion by Lindquist, seconded Stone and unanimously carried, the Otter Tail County Board of Commissioners adopted the following resolution: WHEREAS, the Minnesota Wetland Conservation Act of 1991 requires that local government units implement this law by adopting the rules and regulations promulgated by the Board of Water and Soil Resources pertaining to wetland draining and filling; and WHEREAS, the Board of Water and Soil Resources has requested that local government units adopting the permanent rules of the Wetland Conservation Act notify them of the decision regarding adoption; and WHEREAS, the local government unit is responsible for making Wetland Conservation Act determinations for landowners; and WHEREAS, the Otter Tail County Board of Commissioners previously assumed the responsibilities of a local government unit for wetland alterations within Otter Tail County under the interim rules. NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners of Otter Tail County that it hereby accepts the responsibility as the local government unit for the Wetland Conservation Act for areas within the legal boundaries of the County of Otter Tail, but excluding areas lying within the incorporated limits of any municipality, as of January 4, 1994, within the guidelines as set forth by the Wetland Conservation Act and rules. 0 'ott:er·~Tail County Board of Commissioners January 4, 1994 Page 3 BE IT FURTHER RESOLVED, that Otter Tail County hereby adopts the rules and regulations promulgated by the Board of Water and Soil Resources pertaining to wetland draining and filling. Dated: Ouw,~ II (f/{jif ~ ) OTTER TAIL COUNTY BOARD OF COMMISSIONERS z;~ Larry thn, Clerk By dels, Chairman Resolution Authorizing Signature of Board of Water & Soil Resources Natural Resources Block Grant Documents Upon a motion by Lee, seconded Partmann and unanimously carried, the Otter Tail County Board of Commissioners adopted the following resolution: WHEREAS, Otter Tail County has a state approved comprehensive local water plan which has been locally adopted pursuant to Minnesota Statutes Chapter 103B.311 and 103B.315; and WHEREAS, the State of Minnesota, acting by and through its Board of Water and Soil Resources (BWSR), has authority to award natural resources block grants for purposes of implementing comprehensive local ~ater plans, the Wetland Conservation Act, and the DNR shoreland program to local government pursuant to Laws of Minnesota, 1993, Chapter 172, Section 6; and WHEREAS, the Minnesota Department of Revenue has determined the minimum amount necessary to be raised by Otter Tail County for the base grant portion of the grant; and WHEREAS, BWSR has determined that Otter Tail County is eligible for a Natural Resources Block Grant of up to $67,445.72 upon BWSR acceptance of the local government unit's application and the execution and delivery of a Grant Agreement. NOW, THEREFORE, BE IT RESOLVED: That the Otter Tail County Board of Commissioners approves execution of a grant agreement by Otter Tail County with the State of Minnesota to receive state funds for the implementation of its comprehensive local water plans, the administration of the Wetland Conservation Act and administration of the DNR shoreland program, under the terms of the Grant Agreement and all statutory requirements; and That the Otter Tail County Board of Commissioners authorizes the expenditure of $46,003.72 in-kind contributions to match the Natural Resources Block Grant as specified in Laws of Minnesota 1993, Chapter 172, Section 6, and the Grant Agreement. 0 . I Dated '-J~'fll"-ui./"'A"'1"f"'9-c..LJl!c,.,_,l."'q~fc.ed~ OTTER TAIL COUNTY BOARD OF COMMISSIONERS By indels, Chairman LarryKrohn, Clerk Vehicle Purchase Motion by Lee, seconded Partmann and carried, with Partmann opposed, to authorize the Assessor to purchase 1 based on the lowest quotation received, a '93 Plymouth Sundance/Dodge Shadow from Worner Auto Center, Fergus Falls, MN, at a cost of $7,986 which is inclusive of the 7/70 power train warranty. The motion went on to authorize the Assessor to purchase, based on lowest quotation, a '94 Pontiac Sunbird from Worner Auto Center at a cost of $9,239. The '93 vehicle is to be paid from the '93 Assessor's budget and the '94 vehicle is to be paid from the 1 94 Assessor's budget. Some discussion followed with regard to vehicle purchases being made from a capital account. Partmann stressed the need for this purchase plan as opposed to each department proceeding with individual vehicle purchase quotations. Office Furniture Motion by Stone, seconded Lee and unanimously carried to authorize the Assessor to proceed with the purchase of refurbished office panels and components, new countertops, etc. from Cooper's Office Supply, Fergus Falls, MN, at a cost estimate of $11 1 043. Bob Moe was requested to contact the Building Maintenance Supervisor with regard to storage, for future use, of the desks removed from the department. Printing & Publishing Bids The Otter Tail County Board of Commissioners, having previously advertised for bids to be received for printing and publishing of the county board minutes, legal notices, delinquent tax list and county1 s annual financial statement, proceeded to open bids which-were found to be as follows: Legal Notices, Publications and Commissioners Minutes: Fergus Falls Daily Journal $6.98 per S.A.U. After consideration, a motion was made by Lee, seconded Fortmann and unanimously carried, to award bids for publishing and printing for the year 1994 as follows: Legal Notices, Publications and Commissioners Minutes: Fergus Falls Daily Journal $6.98 per S.A.U. Pocket Gopher Bounty Upon a motion by Lindquist, seconded Lee and unanimously carried, the following resolution was adopted: RESOLVED by the Board of County Commissioners of Otter Tail County, Minnesota, that the sum of thirty cents ($.30) be paid out of the Revenue Fund of the County for every pocket gopher killed in said County during the year 1994 in cases where the township in which the pocket gophers were so killed shall provide for the payment of at least an additional bounty of forty cents ($.40) for each pocket gopher so killed. RESOLVED FURTHER that said payment of such bounty shall be made by the County Auditor upon certificates executed by the Chairman and/or Clerk of the Town Board of said township setting forth that the pocket gophers were duly presented to the Chairman of such Board and that the township had issued and delivered to each claimant a payment for at least seventy cents ($.70) for each pocket gopher so killed. Adopted at Fergus Falls, MN, this 4th day of January, 1994. OTTER TAIL COUNTY BOARD OF COMMISSIONERS Q 0 bt~er'Tail County Board of Commissioners January 4, 1994 Page 6 Upon a motion by Lee, resolution was adopted: Tax Forfeited Land Sale Apportionment seconded Lindquist and unanimously carried, the following RESOLVED by the Board of County Commissioners of Otter Tail County, Minnesota, that WHEREAS, it is provided in Minn. Stat. 282.05 for the apportionment of proceeds from the sale of tax forfeited lands, and WHEREAS, the County Auditor shall apportion the tax sale proceeds to the taxing districts pursuant to Minn. Stat. 282.08, and WHEREAS, Minn. Stat. 282.08(4) (b) provides that the County Board may set aside 20% of the proceeds remaining after the value of public improvements, special assessments and bond issues levied on the property have been paid, for acquisition and maintenance of county parks and recreational areas, and WHEREAS, Otter Tail County has a park and recreational area which would benefit by such an apportionment, NOW, THEREFORE, BE IT RESOLVED, that the County Auditor retain 20% of the proceeds from the sale of tax forfeited lands for acquisition and maintenance of parks and recreational areas from the proceeds available after making the necessary statutory disbursements, said proceeds to be disbursed according to law. Dated:~ l/1 If f '1 OTTER TAIL COUNTY BOARD OF COMMISSIONERS indels, Chairman Delinquent Real Estate Tax List Motion by Partmann, seconded Lee and unanimously carried to set the cost assessed to delinquent real estate parcels, that are published in the Delinquent Tax List, at $17.00. This action is provided in MS 279.092 which allows the County Board to establish a reasonable fee to recover all the cost incurred against each parcel included in the delinquent tax list. Wayne Stein, Auditor, indicated in 1993 the cost to publish the Delinquent Tax List was $13,238.91 and approximately 803 parcels were published at a cost of $16.49 per parcel. 1994 Annual Appropriations Motion by Lindquist, seconded Lee and unanimously carried to authorize payment of the following 1994 annual appropriations: Otter Tail Country Tourism Association $ 5,000 ' • • •;. ot,;er Tail County Board of Commissioners January 4, 1994 Page 7 West Otter Tail Fair Association East Otter Tail Fair Association $12,000 $12,000 1994 AMC Membership Dues Motion by Lindquist, seconded Partmann and carried, with Lee opposed, to approve payment of the 1994 Association of Minnesota Counties annual membership dues in the amount of $11,411. ' / Two Year Special Assessment Motion by Lindquist, seconded Lee and unanimously carried to approve the certification as a two year special assessment for noxious weed destruction beginning in 1994 at a rate of six percent interest on Parcel No. 40-000-02-0014-000 owned by Loy Ekstead. Total costs incurred for the destruction of noxious weeds amounted to $582.16. Vehicle Purchase Motion by Lee, seconded Stone and unanimously carried, after hearing the quotations of Minnesota Motors, Worner Auto Center and Nelson Ford presented by the Highway Engineer, to approve the purchase of a 1994 Chevrolet S-10 Blazer at a cost of $12,995 from Minnesota Motors, Fergus Falls, MN, the lowest bidder. Bid Openings Set Motion by Lindquist, seconded Lee and unanimously carried to set the bid opening for two tandem axle dump trucks for 1:00 p.m. on March 1, 1994, as requested by the Highway Engineer. Motion by Partmann, seconded Stone and unanimously carried to set the bid opening of SAP 56-608-19 Street Improvements for 1:00 p.m. on March 1, 1994, as requested by the Highway Engineer. County Board of Commissioners January·4, 1994 Page,8 Phelps Mill Country l L-'"~~ Motion by Lindquist, seconded Partmann and ~irman to execute the Revised Agreement unanimously carried to authorize the Board's for County Park Use and Maintenance with Phelps Mill Country. Closed to the Public At 11:06 a.m. a motion was offered by Lee, seconded Lindquist and unanimously carried to close the meeting of the Otter Tail County Board of Commissioners to the public for the purpose of exercising Attorney/Client Privilege in discussing the work environment of the Public Health Department and also in conjunction with resolution of potential litigation. Attorney-Client Privilege is authorized in MS 47l.705 Subd l d. Open to Public At 11:48 a.m. the meeting of the Otter Tail County Board of Commissioners was opened to the public. Olson Property Motion by Lindquist, seconded Lee and unanimously carried to direct the Coordinator to contact the architectural firm of Yeater, Hennings, Ruff, Schultz, Rokke 1 Welch Architects & Planners of Moorhead, MN, in the evaluation and suitability determination of the Olson property. The Public Health Director will also participate in the evaluation process with regard to the Public Health Department's employee environment. Planning Commission Appointments by Lee, seconded Partmann and unanimously carried to re-appoint Carl Johnson, Vergas, to the Planning Commission for a three year term commencing January 1, 1994. Motion by Partmann, seconded Lindquist and unanimously carried to appoint Leona Zimmerman, Fergus Falls, to the Planning Commission for the duration of Mike Ackley' s term, December 31, 1994. (Ackley has resigned.) Motion by Stone, seconded Partmann and unanimously carried to re-appoint David Trites, Parkers Prairie, to the Planning Commission for a three year term commencing January 1, l994. Adjournment At l2:00 p.m., Chairman Windels declared the meeting of the Otter Tail County Board of Commissioners adjourned until 1:00 p.m. on January 11, 1994.
