Minutes of the OTTER TAIL COUNTY BOARD OF COMMISSIONERS Commissioners' Room, Floor 1-B Otter Tail County Courthouse Tuesday1 December 28, 1993 1:00 p.m. Call to Order The Otter Tail County Board of Commissioners convened Tuesday, December 28, 1993, at 1:00 p.m. at the Otter Tail County Courthouse with Commissioners Malcolm Lee, Chairman; Harley Windels; Bill Stone; Andy Lindquist and Virginia Partmann present. Approval of Minutes Motion by Windels 1 seconded Stone and unanimously carried to approve the minutes of December 21, 1993, as submitted. Motion by Lindquist, seconded Partmann and carried, with Stone opposed, to approve, with correction, the minutes of December 20, 1993. The correction appears as an addition to clarify the SWCD Budget and reads, nThis amount is payable only for month of January, 1994. 11 '93 Annual County Agricultural Inspector's Report Roland Sauck, Ag/Ditch Inspector, presented the West Otter Tail County 1993 Annual County Agricultural Inspector's Report. Retirement Acknowledged Chairman Lee acknowledged Roland Sauck's retirement effective December 31, 1993. A plaque was presented to Roland by the Chairman in appreciation of his service and dedication to the County. '94 Audit Overview Wayne Stein, Auditor, provided an overview of the State Auditor's '94 checklist. A number of changes were reviewed as well as component user information. Chairman Lee indicated to Board members that the December 17, 1993, meeting with the auditors was both interesting and productive. Premise Permit Application Motion by Stone, seconded Portmann and unanimously carried to adopt the following resolution: WHEREAS, the responsibility for the regulation of lawful gambling and the issuance of licenses and permits for conduct of lawful gambling lies with the Minnesota Gambling ContFol Board; and WHEREAS, the Lake Country Sportsmans Club of Otter Tail County, Battle Lake, made an application to the Gambling Control Board for a premises permit to lawful gambling at Ye Old School House in Friberg Township of Otter Tail County; MN, has conduct and ~ b~ter Tail County Board of Commissioners December 28, 1993 0 0 Page 2 WHEREAS, Minnesota Statutes 349.213 provides that the Gambling Control Board may not issue a premises permit unless they receive a resolution from the Otter Tail County Board of Commissioners approving the permit; and WHEREAS, the Otter Tail County Board of Commissioners is aware of no reason to oppose the conduct of lawful gambling by the Lake Country Sportsmans Club of Otter Tail County, Battle Lake, MN, at Ye Old School House in Friberg Township of Otter Tail County. NOW, THEREFORE, BE IT FURTHER RESOLVED, that the Otter Tail County Board of Commissioners hereby approves the conduct of lawful gambling by the Lake Country Sportsmans Club of Otter Tail County, Battle Lake, MN, at Ye Old School House in Friberg Township of Otter Tail County, provided that the applicant meets all the necessary criteria for the licenses and permits required by the Gambling Control Board. IT IS FURTHER RESOLVED, that notice of this application and approval shall be provided to the Town Board of Friberg Township by sending them a copy of this resolution. Adopted this 28th day of December, 1993. OTTER TAIL COUNTY BOARD OF COMMISSIONERS By Attest: Larry Krohn, Clerk Land Surveyor's Certificate of Correction to Plat Name of Plat: Lake View Addition to Parkers Prairie Townsite Otter Tail County, Minnesota Motion by Stone, seconded Windels and unanimously carried to accept for recording the Land surveyor's Certificate of Correction to Plat by Curtis J. Stoeckel, Registered Land Surveyor, under the laws of the State of Minnesota, Registration No. 13077, and that Pursuant to the provisions of Chapter 505.175 Laws of Minnesota, he has reviewed the legal description and the surveyor's drawing of Lake View Addition to Parkers Prairie Townsite, Otter Tail County, Minnesota and declares as follows: 1. That the plat of LAKE VIEW ADDITION to Parkers Prairie Townsite, dated June 2nd, 1903 and filed on June 17th, 1903 in Book E of Plats, Page 45, was prepared by a surveyor who is now deceased; 2. That the existing land description is in error; 3. That in the 23rd line of the owners instrument of dedication where it states 11 thence North 36 degrees 46 minutes West 812 feet to the section line between sections 15 and 16 11 , is now hereby corrected to read sections 15 and 22. 4. That the above correction was prepared from existing plat data and that I did not perform a field survey to determine actual locations. Curtis J. Stoeckel Land Surveyor Minnesota Registration No. 13077 0 u Otter Tail County Board of Commissioners December 28, 1993 Page 3 Extension Committee Motion by Lindquist, seconded Partmann and unanimously carried to reappoint Julian Sjostrom, Pelican Rapids, and Patty Van Santen, Battle Lake to a three year term on the Extension Committee commencing January 1, 1994. Federal Disaster Aid Update Harold Stanislawski, County Extension Agent, provided an update on the Federal Disaster Aid as it related to Otter Tail County. Comparison figures were given for '93 as compared to drought conditions of '88. Energy/Capital Outlay Presentation Rick Sytsma, Building Maintenance Supervisor, introduced Bob Pope and Mark Bucholz, representatives of Honeywell. After a short presentation by the Honeywell representatives, Chairman Lee requested a copy of a typical Honeywell contract be provided to the County Attorney for his review and the Board's further consideration. Approval to Pay Bills Motion by Lindquist, seconded Windels and unanimously carried to authorize the payment of bills per Attachment A of these minutes. Fixed Asset Transfer Motion by Stone, seconded Portmann and unanimously carried to approve the transfer of Unit No. 23, an '81 Chevrolet pickup, from the Highway Department to Phelps Mill and to approve the transfer of Unit 82, '61 Ford tractor with loader, from the Highway Department to the Solid Waste Department for use at the Northeast Landfill. Performance Evaluation Swmnary The Board reported that the performance evaluation of Kenneth Becker, Ag Inspector, was positive. Adjournment At 2:50 p.m., Chairman Lee declared the meeting of the Otter Tail County Board of Commissioners adjourned until 9:30 a.m. on Tuesday, January 4, 1994.
