Call to Order
The Otter Tail County Board of Commissioners convened Tuesday, November 9, 1993,
at 1:00 p.m. at the Otter Tail County Courthouse with Commissioners Malcolm Lee,
Chairman; Andy Lindquist, Harley Windels, Bill Stone and Virginia Partmann present.
Approval of Minutes
Motion by Stone, seconded Windels and unanimously carried to approve the minutes of
November 2, 1993 as submitted.
U.S. Fish & Wildlife Service
Don Kleven, U.S. Fish & Wildlife representative, requested a fee purchase of 104 acres
from Werner F. and Margaret M. Neumann of Fergus Falls. After hearing testimony from
George Sund and Don Peterson {nearby farmers) with regard to drainage problems, the
matter was tabled until the November 23, 1993 1 Board meeting.
Planning Commission Recommendations
Motion by Windels, seconded Lindquist and unanimously carried to table approval of the
Conditional Use Application of Marilyn Skillings, Sybil Lake 1 at the applicant 1 s
request.
Motion by Partmann, seconded Stone and unanimously carried to approve the following
Conditional Use Applications and Preliminary Plats as recommended by the Planning
Commission:

Premise Permit Application
Motion by Partmann, seconded Windels and unanimously carried the following resolution
was adopted by the Otter Tail County Board of Commissioners:
WHEREAS, the responsibility for the regulation of lawful gambling and the issuance of
licenses and permits for conduct of lawful gambling lies with the Minnesota Gambling
Control Board; and
WHEREAS, the American Legion Post 30, Fergus Falls, MN, has made an application to the
Gambling Control Board for a premise permit to conduct lawful gambling at the Wee Villa
Lodge in Elizabeth Township of Otter Tail County; and
WHEREAS, Minnesota Statutes 349.213 provides that the Gambling Control Board may not
issue a premise permit unless they receive a resolution from the Otter Tail County Board
of Commissioners approving the permit; and
WHEREAS, the Otter Tail County Board of Commissioners is aware of no reason to oppose
the conduct of lawful gambling by the American Legion Post 30, Fergus Falls, MN, at the
Wee Villa Lodge in Elizabeth Township of Otter Tail County.
NOW, THEREFORE, BE IT FURTHER RESOLVED that the Otter Tail County Board of Commissioners
hereby approves the conduct of lawful gambling by the American Legion Post 30,
Fergus Falls, MN, at the Wee Villa Lodge in Elizabeth Township of Otter Tail County,
provided that the applicant meets all the necessary criteria for the licenses and
permits required by the Gambling Control Board.
IT IS FURTHER RESOLVED, that notice of this application and approval shall be provided
to the Town Board of Elizabeth Township by sending them a copy of this resolution.

Land Surveyor's Certificate of Correction to Plat
Name of Plat: Empire First Addition to Village of Ottertail, Minnesota
Motion by Stone, seconded Lindquist and unanimously carried to accept the Land
Surveyor's Certificate of Correction to Plat by David A. Anderson, Registered Land
Surveyor, under the laws of the State of Minnesota, Registration No. 13620, that he has
reviewed the legal description and the surveyor's drawing of Empire First Addition to
Village of Ottertail, and declares as follows:
1. That the plat of EMPIRE FIRST ADDITION TO VILLAGE OF OTTERTAIL, MINNESOTA, dated
September 6, 1962, and filed on July 1, 1963 in the office of the County Recorder,
Otter Tail County, Minnesota in Book O of Plats, Page 123, was prepared by
John Reber, Land Surveyor, Minnesota Registration No. 2650, now deceased.

The call along said shore of the Otter Tail River was omitted from the legal
description on said plat.
That the legal description on said plat is hereby corrected as follows, to wit:
Beginning at a point on the north line of Government Lot 2 distance 593.0 feet west
of the southeast corner of Government Lot 1 in said section 10; thence continue on
this line a distance of 52.0 feet; thence South 55 degrees 30 minutes West 120.0
feet to the shore of the Otter Tail River; thence South 43 degrees 01 minutes East
along said shore of the Otter Tail River, a distance of 725.0 feet; thence South 37
degrees 53 minutes East along said shore of the Otter Tail River, a distance of
871.7 feet to a point 33.0 feet north of the south line of said Government Lot 2;
thence East parallel with said south line of Government Lot 2 1 a distance of 269.5
feet; thence North 37 degrees 53 minutes West a distance of 651.1 feet; thence
South 53 degrees 50 minutes West 66.0 feet; thence North 37 degrees 53 minutes West
150.0 feet; thence North 53 degrees 50 minutes East 66.0 feet; thence North 37

Wilkin County Joint Drainage Ditch No. 2
A meeting with Wilkin County has been scheduled for 1:00 p.m. on November 24, 1993, in
the Otter Tail County Commissioners' Room, Fergus Falls, for discussion of Joint
Drainage Ditch No. 2.
Waste Education Grant Program
Mike Hanan, Solid Waste Director, and Marie Tysdal, Public Information Officer,
discussed a grant program from the Minnesota Office of Waste Management. After
discussion about specifics of the Waste Education Grant Program, a motion was offered by
Partmann, seconded Windels and unanimously carried to authorize the Solid Waste
Department to proceed in writing of the grant proposal as outlined, with 25% of the
funds coming from the Otter Tail County Solid Waste Department budgeted monies for
public education.
Otter Tail County
Policy on Worker Safety & Health
Motion by Partmann, seconded Stone and unanimously carried to approve the Otter Tail
County Policy on Worker Safety & Health, with revisions as noted.
Speed Zone Study Request
WHEREAS, the City of Dalton has requested a forty mile per hour speed zone be
established on CSAH No. 82 along the south City limits of Dalton, and
WHEREAS, the County of Otter Tail also believes that a speed zone would be beneficial in
this area.

NOW THEREFORE, BE IT RESOLVED, that Otter Tail County does hereby request that the area
be studied by the Minnesota Department of Transportation to determine the need for a
proper speed zone, if any,
BE IT ALSO RESOLVED, that the Minnesota Department of Transportation proceed with
establishing a legal speed zone if the findings of the traffic study are supportive.

Certification Training
Motion by Lindquist, seconded Partmann and unanimously carried to approve payment for
certification training within the Highway Department as follows:
Minnesota Asphalt Paving Association, directed by the Minnesota Department of
Transportation, $1,235.
Concrete Certification, Anoka/Hennepin Technical College, $440.
Bike/Pedestrian Trail
City of Battle Lake to Glendalouqh State Park
WHEREAS, the City of Battle Lake is applying for a grant under the Minnesota Department
of Natural Resources 1993 Cooperative Trail Grants Program, and
WHEREAS, the proposed trail project would provide a linkage between the City of
Battle Lake and Glendalough State Park for pedestrians, hikers and bicyclists.
NOW, THEREFOR, BE IT RESOLVED, that the Otter Tail County Board of Commissioners is in
support of this proposed project in concept and believes it would benefit this region
and State of Minnesota from the standpoint of recreational opportunities and enhance the
safety of the users.

Partnership for Greater Minnesota
Motion by Stone, seconded Partmann and unanimously carried to approve payment in the
amount of $200/year, as requested by the Highway Engineer, for membership in the
Partnership for Greater Minnesota, whose purpose is to represent rural Minnesota's
transportation interests through lobbying efforts, etc.
Turnback Agreement
Relying upon letters of understanding with the Minnesota Department of Transportation
and the united States Fish & Wildlife Service regarding maintenance of acceptable water
levels in the Beyer's Body Shop slough, a motion was offered by Lindquist, seconded
Stone and unanimously carried to approve execution of the Turnback Agreement with the
State of Minnesota Department of Transportation for the portion of U.S. Highway 59 from
the south junction of Interstate 94 to the junction of State Highway 210 and from the
Fergus Falls City Limits to the north junction of Interstate 94 (now renumbered as
Otter Tail County Nos. 82 and 88).
Adjournment
Closed to the Public
At 4:02 p.m. Chairman Lee declared the meeting adjourned and closed to the public for
purposes of discussing labor negotiation strategies with the County's four collective
bargaining units. The next meeting of the Otter Tail County Board of Commissioners is
scheduled for 9:30 a.m. on Tuesday, November 16, 1993.
