HomeMy WebLinkAboutBoard of Commissioners - Minutes - 10/05/19930 Minutes of the OTTER TAIL COUNTY BOARD OF COMMISSIONERS Commissioners' Room, Floor 1-B Otter Tail County Courthouse Tuesday, October 5, 1993 9:30 a.m. Call to Order The Otter Tail County Board of Commissioners convened Tuesday, October S, 1993, at 9:30 a.m. at the Otter Tail County Courthouse with Commissioners Malcolm Lee, Chairman; Andy Lindquist, Harley Windels, Bill stone and Virginia Partmann present. Approval of Minutes Motion by Stone, seconded Windels and unanimously carried to approve the minutes of September 28, 1993 as submitted. NYM Proposal: Architects' Report David Shultz, representative of the architectual firm of Yeater, Hennings, Ruff, Shultz, Rokke &c. Welch, presented a Preliminary Space Program Analysis and a Preliminary Building Design Criteria of the East Otter Tail County Offices. Commissioners Lindquist and Windels, members of the Building Committee, commented on considerations made by their Committee in the needs assessment process. Motion by Lindquist, seconded Windels and unanimously carried to request proposals to lease, with an option to purchase, commercial office space as set forth in a Preliminary Space Program Analysis. Proposal for building space must be received in the Office of the Otter Tail County Coordinator no later than Monday, October 25, 1993. A minimum of fifty off-street vehicle parking spaces will also be required and included in the specifications~ Order Establishing the Pelican Group of Lakes Improvement District Upon a motion by Partmann, seconded Stone and unanimously carried the following resolution was offered: WHEREAS, the Otter Tail County Board adopted a resolution of intent to establish the Pelican Group of Lakes Improvement District on August 17, 1993; and WHEREAS, a public hearing was held on August 28, 1993, within the proposed district regarding whether the district should be established; and WHEREAS, the Otter Tail County Board allowed 30 days for written comments regarding the proposed district to be received and considered by the board; and WHEREAS, the Board of Commissioners makes the following findings: 1. The Pelican Lake Improvement District will benefit the public welfare by enabling residents of the district to plan for and finance programs to address issues of water quality, related land resources and water surface use~ 2. The Pelican Group of Lakes Improvement District will benefit the property values and quality of life within the district by enhancing and maintaining the environmental quality of the Pelican Group of Lakes and the surrounding land areas. i Otter Tail County Board of Commissioners October 5, 1993 Page 2 3. The formation of the Pelican Group of Lakes Improvement District will help reduce o and eliminate pollution of the lakes in the district on a long-range basis. 0 NOW, THEREFORE, the otter Tail County Board of Commissioners hereby orders: 1. The establishment of the Pelican Group of Lakes Improvement District. 2. That the boundaries of the Pelican Group of Lakes Improvement District shall encompass all parcels of real property any part of which is located within 500 feet of the ordinary high water mark of Bass, Big Pelican, Fish and Little Pelican Lakes in Scambler and Dunn Townships of Otter Tail County, to include the entire tax parcels, except for all such parcels classified for agricultural use. 3. That the water and related land resource management programs to be undertaken in the district include the following: a. Develop and implement a comprehensive plan to eliminate water pollution; b. Receive financial assistance from and participate in projects or enter into contracts with federal and state agencies for the study and treatment of pollution problems and related demonstration programs; c. Undertake research to determine the condition and development of the body of water included within the lake improvement district and to transmit the studies to the Department of Natural Resources, the Minnesota Pollution Control Agency and other interested authorities; d. Make cooperative agreements with the United States or state government or other county or city to effectuate water and related land resource programs; e. Conduct programs of water improvement and conservation; f. Implement a water monitoring system; g. Serve as local sponsor for state and federal projects or grants; h. Regulate water surface use as deemed necessary and reasonable; or i. Such other programs, plans, studies, developments and implementations as are allowed or permitted by law, and approved by the County Board from time to time. 4. That the programs of the lake improvement district will be financed by the levying of an ad valorem tax solely on the property within the district. 5. That the Administrator of the Otter Tail County Department of Land and Resource Management shall be responsible for supervising the programs of the district. 6. The Board of Directors of the Pelican Group of Lakes Improvement District shall consist of nine members, who must be owners of property located within the district. The initial director shall be appointed to alternating terms of one, two and three years each. Thereafter, three directors shall be elected each year to serve three year terms. No director may serve more than two successive complete terms. An individual shall be eligible for re-election to the Board of Directors after three years absence. Directors may be removed by a two-thirds vote of the remaining board members or by a vote of the majority of the property owners present at an annual meeting. Vacancies in the Board of Directors may be filled by a majority vote of the remaining Otter Tail County Board of Commissioners October 5, 1993 Page 3 7. 8. 9. directors, subject to approval by a majority vote of the property owners present at the next annual meeting. A director elected to fill a vacancy shall serve the unexpired term. That the effective date of the establishment of the lake improvement district is June 6, 1994. That this Order shall be published in the official newspaper of the county along with notice to property owners within the district that they may petition for a referendum on establishing the district before the effective date of its establishment. That a copy of this Order shall be filed with the Secretary of State, the Pollution Control Agency and the Commissioner of Natural Resources. Adopted this 5th day of October, 1993. Lee, Chairman Attest: Cf Larry Krohn, Clerk 0 Premise Permit Application Motion by Stone, seconded Windels and unanimously carried the following resolution was adopted by the Otter Tail County Board of Commissioners: WHEREAS, the responsibility for the regulation of lawful gambling and the issuance of licenses and permits for conduct of lawful gambling lies with the Minnesota Gambling Control Board; and WHEREAS, the Confidence Learning Center, Brainerd, MN, has made application to the Gambling Control Board for a premise permit to conduct lawful gambling at the Country Manor Motel in Compton To\AIIlship of Otter Tail County; and WHEREAS, Minnesota Statutes 349.213 provides that the Gambling Control Board may not issue a premise permit unless they receive a resolution from the Otter Tail County Board of Commissioners approving the permit; and WHEREAS, the Otter Tail County Board of Commissioners is aware of no reason to oppose the conduct of lawful gambling by the Confidence Learning Center, Brainerd, MN, at the Country Manor Motel in Compton Township of Otter Tail County. NOW, THEREFORE, BE IT FURTHER RESOLVED that the Otter Tail County Board of Commissioners hereby approves the conduct of lawful gambling by the Confidence Learning Center, Brainerd, MN, at the Country Manor Motel in Compton Township of Otter Tail County, provided that the applicant meets all the necessary criteria for the licenses and permits required by the Gambling Control Board. Lee, Chairman Safety Manuals Motion by Portmann, seconded Lindquist and unanimously carried to authorize the purchase of SARA Title III safety manuals for the Highway Department at a cost of $400 payable to the State of Minnesota Department of Emergency Management. Crushing Salvaged Bituminous Pavement Materials Contract Motion by Windels, seconded Stone and unanimously carried to authorize the Chairman's signature on the Crushing Salvaged Bituminous Pavement Materials Contract with Kingsway Construction, Inc. of Little Falls, MN, as previously awarded and approved by the County Attorney. Change Order Approval: Phelps Mill Dam Motion by Portmann, seconded Stone and unanimously carried to approve Change Order No. 2 for the Phelps Mill Dam Project -Temporary Suspension as outlined by the Highway Engineer. Mission Statement of the Otter Tail County Board of Commissioners Motion by Windels, seconded Stone and unanimously carried to adopt the following as the Mission Statement of the Otter Tail County Board of Commissioners and to circulate such statement to all County offices: The mission of the Otter Tail County Board of Commissioners is to: 1. Carry out the lawful duties delegated by the State legislature. 2. Provide the people of Otter Tail County with affordable, efficient government services. 3. Serve the people of Otter Tail County by striving to provide a quality of life which affords people a healthy and safe work and recreation environment. RATIONAL: The Otter Tail County Board of Commissioners acts as an arm of State government to carry out those duties and responsibilities that have been outlined by legislative action. In addition to those mandated services, it is the responsibility of the Commissioners to carry out, to the best of their ability, those duties that deal with the smooth 0 Otter Tail County Board of Commissioners Octobers, 1993 Page 5 operation of the County. Those duties include such items as tax collection and the services associated with it such as land assessing and communication systems, the maintenance of highways, the collection and direction of the solid waste stream, the issuance of permits and licensing in addition to those areas necessary for the day-to-day operation of County government. It is not only the responsibility of the Commissioners to work with and assist those people who deal in services that benefit the general work environment, health and recreation of residents of Otter Tail County but also to protect the environment for future generations. Those areas may include public health, land and resource, park maintenance, among others. Finally, it is the responsibility of the Otter Tail County Board of Commissioners to: discuss issues and cooperate with State officials; act as a sounding board for County residents as needed; encourage staff and residents to work together for the purpose of effecting the best quality of life for resident of Otter lTail County. Lee, Chairman Performance Evaluation Summary The Board reported that the performance evaluations of Diane Thorson, Public Health Director and Chester Toso, Veterans Service Officer, were both satisfactory. County Drainage Ditches Roland Sauck, County Ditch Inspector, provided information on a number of County drainage ditches. Ditches discussed were numbers 8, 52, 49, 64, 70, and 25. Motion by Lindquist, seconded Portmann and unanimously carried to direct the Ditch Inspector to contact the property owner, Lauritz Bystol, regarding culvert replacement on County Drainage Ditch No. 52. Approval to Pay Bills Motion by Windels, seconded Lindquist and unanimously carried to approve the payment of bills per Attachment A of these minutes. 0 0 0 Otter Tail County Board of Commissioners Odtober s, 1993 Page 6 Adjournment Closed to the Public At 2:22 p.m. Chairman Lee declared the meeting adjourned and closed to the public for purposes of discussing potential litigation with regard to the detention facility floor problem, as authorized by Attorney-Client Privilege M.S. 471.705, Subd. 1 d, and for labor negotiation strategies with the County's AFSCME collective bargaining unit. The next meeting of the Otter Tail County Board of Commissioners is scheduled for 1:00 p.m. on Tuesday, October 12, 1993.
