Call to Order
The Otter Tail County Board of Commissioners convened Tuesday, September 14, 1993, at
1:00 p.m. at the otter Tail county Courthouse with Commissioners Malcolm Lee, Chairman;
Andy Lindquist, Harley Windels, Bill Stone and Virginia Partmann present.
Approval of Minutes
Motion by Stone, seconded Lindquist and unanimously carried to approve the
September 7, 1993 minutes as submitted.
Motion by Partmann, seconded Lindquist and unanimously carried to approve the minutes of
the special meeting of the Board held August 28, 1993, as submitted.
Bid Opening: Crushing Salvaged Bituminous Pavement Materials
The Highway Engineer, after having previously advertised for bids, opened the following

Motion by Lindquist, seconded Portmann and unanimously carried to accept the lowest

Motion by Lindquist, seconded Windels and unanimously carried to approve the following

Premise Permit Application
Motion by Windels, seconded Lindquist and unanimously carried the following resolution
was adopted by the Otter Tail County Board of Commissioners:
WHEREAS, the responsibility for the regulation of lawful gambling and the issuance of
licenses and permits .for conduct of lawful gambling lies with the Minnesota Gambling
Control Board; and
WHEREAS, the Dent Firefighters Relief Association, Dent, MN, has made application to the
Gambling Control Board for a premise permit to conduct lawful gambling at the Colonial
Lounge in Perham Township of Otter Tail County; and
WHEREAS, Minnesota Statutes 349.213 provides that the Gambling Control Board may not
issue a premise permit unless they receive a resolution from the Otter Tail County Board
of Commissioners approving the permit; and
WHEREAS, the Otter Tail County Board of Commissioners is aware of no reason to oppose
the conduct of lawful gambling by the Dent Firefighters Relief Association, Dent, MN, at
the Colonial Lounge in Perham Township of Otter Tail County;-and ..
NOW, THEREFORE, BE IT FURTHER RESOLVED that the Otter Tail County Board of Commissioners
hereby approves the conduct of lawful gambling by the Dent Firefighters Relief
Association, Dent, MN, at the Colonial Lounge in Perham Township of otter Tail County,
provided that the applicant meets all the necessary criteria for the licenses and
permits required by the Gambling Control Board.
IT IS FURTHER RESOLVED, that notice of this application and approval shall be provided
to the Town Board of Perham Township by sending them a copy of this resolution.

Resolution to Repurchase Tax Forfeited Property
Motion by Stone, seconded Partmann and unanimously carried to adopt the following
resolution:
RESOLVED by the Board of County Commissioners of Otter Tail County, Minnesota, that
WHEREAS, on September 8th, 1993, Dalas D. Whipps, owner of record of the following
legally described parcel:
46-000-07-0044-001
Section 7 Township 134 Range 39
East 270' of West 520' of Government Lot 4 North of County Road #1
WHEREAS, Dalas D. Whipps has made an application to repurchase said property which was
forfeited to the State of Minnesota on August 13th, 1992, for nonpayment of the 1985
tax.
WHEREAS, the sum of $588.16 has been remitted, representing the aggregate of all
delinquent taxes, penalties, costs, assessments and fees.
NOW, THEREFORE, BE IT RESOLVED, the Otter Tail County Board of Commissioners does hereby
approve the above repurchase as it will promote and best serve the public interest and
will relieve the undue hardship which has resulted because of the forfeiture of the
above described property.

Upon recommendation of the Budget Committee the following resolution was offered by
stone, seconded Fortmann and unanimously adopted:
WHEREAS, on or before September 15, 1993, each taxing authority must adopt a proposed
budget for fiscal year 1994 and must adopt and certify a proposed net property tax levy
for payable 1994.
WHEREAS, the Otter Tail county Board of Commissioners held a special meeting on Monday,
September 13, 1993, to consider and discuss the 1994 budget requests and tax levy
information.
BE IT RESOLVED, by the Otter Tail County Board of Commissioners of Otter Tail County
Minnesota, that
The amount of $12,333,845 be adopted as the County's proposed gross property tax levy
for the payable year 1994, representing a 4.2% increase over the gross property tax levy
for the payable year 1993, and that the amount of $9,999,420 be adopted as the County's
proposed net property tax levy for the payable year 1994 representing a 3.6% increase o over the net property tax levy for the payable year 1993. (Attachment A)

BE IT FURTHER RESOLVED, that the amount of $34,500,000 be adopted as the County's
proposed budget for the General Fund and for the Budgeted Special Revenue Funds for the
fiscal year 1994, representing a decrease of 2.82% from the County's 1993 proposed
budget. (Attachment B)

The Solid Waste Director, together with the Foth & Van Dyke Engineer returned to the
Board meeting at a later time to make a recommendation for bid award to
Kern & Tabery, Inc., citing this firm's experience and the lower price of excavation and
replacement of unsuitable soils. At the Board's direction Hanan will check references
of the low bidder and a bid award will take place at the September 21, 1993, meeting.
Waste Reduction Week Proclamation
Motion by Stone, seconded Fortmann and unanimously carried to offer the following
resolution:
WHEREAS, Otter Tail County is concerned about wise waste management and pollution
prevention; and
WHEREAS, the Minnesota waste Management Act calls for reducing waste and pollution at
their sources of generation; and
WHEREAS, Statewide and city activities will revolve around the State of Minnesota's o environmental hierarchy of reduce, reuse and recycle;
NOW, THEREFORE, BE IT RESOLVED, that the Otter Tail County Board of Commissioners hereby
proclaims the week of September 27 -October 2, 1993, to be
WASTE REDUCTION WEEK in Otter Tail County.

Drainage Ditch #21
Motion by Lindquist, seconded Partmann and unanimously carried to direct the Ditch
Inspector to work with the Highway Engineer to determine the hydrological capacity on a
certain portion of Otter Tail County Drainage Ditch #21 so that two private individuals
could install culverts to allow them access to their land located across the ditch.
Each individual would bear the burden of expense for the culvert and each individual
would be responsible should the culvert cause any problem at a later date. Both
individuals were present at the Board meeting. They were identified as Richard Pachel
and David Hagen.

Resolution for Veterans Home
Bond Referendum Election
Upon motion by Portrnann, seconded Lindquist and unanimously carried, the Otter Tail
County Board of Commissioners adopted the following resolution at its meeting of
September 14, 1993:
WHEREAS, the Otter Tail County Board of Commissioners finds that the following facts
support this resolution:
1. Laws of Minnesota, 1993, First Special Session, Chapter 1, Article 9, Section 66,
provides that the Minnesota Veterans Hornes Board shall establish a veterans home in
Fergus Falls, Minnesota, to provide skilled nursing care, which must be purchased or
built with funds, 65 percent of which must be provided by the federal government,
and 35 percent by other non-state sources, including local units of government.
2. The Otter Tail County Board of Commissioners has been asked to provide one-half of
the 35 percent non-state share of the construction costs, which is an amount not to
exceed 1.5 million dollars.
3. otter Tail County has powers and duties as a human services board, provided by
Minnesota Statute Section 402.02, to plan for and deliver human services for its
residents directly or through contract with other governmental or non-governmental
providers.
4. Many of the Otter Tail County resident veterans and their spouses would benefit from
the availability of skilled nursing care in a veterans home located in Fergus Falls.
5. Approximately 16 percent of the veterans residing in the entire catchment area
proposed for a veterans home in Fergus Falls are Otter Tail County residents and are
older on average than those in other counties.
6. Community nursing homes in Otter Tail County are frequently filled to capacity or
are unable to provide for the special skilled nursing care needs of veterans,
thereby necessitating frequent transfer of Otter Tail County veterans to nursing
care facilities located a significant distance from their homes.
7. otter Tail County resident veterans and their spouses will receive at least as great
a part of the total benefits provided by the veterans home in Fergus Falls as is
represented by Otter Tail County's contribution to the total construction costs of
the facility.
8. Under Minnesota statutes, Section 198.01, veterans homes provide nursing care and
related health and social services for veterans and their spouses, and otter Tail
County has the authority, under Minnesota Statutes, Section 475.52, Subd. 3, to
issue general obligation bonds for the acquisition or betterment of health and
social service facilities.
9. Otter Tail County has the authority, pursuant to Minnesota Statutes Section 471.59,
to participate in a joint powers agreement with the Veterans Hornes Board of the
State of Minnesota, whereby Otter Tail County will provide up to 1.5 million dollars
to the Veterans Hornes Board to be used as part of the local share necessary to
obtain 65 percent funding from the United States Veterans Administration in order to
construct a skilled nursing care facility in Fergus Falls, which will be owned and
operated by the Minnesota Veterans Hornes Board.

10. Otter Tail County may issue general obligation bonds for the purpose of contributing
to the construction cost of a veterans home in Fergus Falls, Minnesota, only after
obtaining the approval of a majority of the electors voting on the question of
issuing the obligations, as required by Minnesota Statutes Section 475.58.
NOW, THEREFORE, BE IT RESOLVED by the Otter Tail County Board of Commissioners that the
question of whether Otter Tail County should issue general obligation bonds, in an
amount not to exceed 1.5 million dollars, for the purpose of contributing to a portion
of the construction costs of a veterans home skilled nursing care facility in the City
of Fergus Falls, Minnesota, shall be submitted for authorization by a vote of the people
at a special election to be held on November 2, 1993.
BE IT FURTHER RESOLVED that the form of the question on the ballot shall be as follows:
SHALL OTTER TAIL COUNTY ISSUE NOT TO EXCEED $1,500,000
GENERAL OBLIGATION BONDS TO PROVIDE PART OF THE FUNDS FOR
THE ACQUISITION AND BETTERMENT OF A HEALTH AND SOCIAL
SERVICES FACILITY CONSISTING OF A VETERANS HOME TO BE
OWNED AND OPERATED BY THE BOARD OF DIRECTORS OF THE
MINNESOTA VETERANS HOMES?
BE IT FURTHER RESOLVED that the County Auditor shall post and publish notice of the
election and prepare official ballots in the manner required by law.

Household Hazardous Waste Contract
Motion by Fortmann, seconded Windels and unanimously carried to authorize the Chairman
to sign on behalf of Otter Tail County the Household Hazardous Waste Contract with the
Minnesota Pollution Control Agency (MPCA) and Otter Tail County as the sponsoring agent.
Drainage Ditch #21
Motion by Windels, seconded Lindquist and unanimously carried to authorize the Chairman
to sign on behalf of Otter Tail County the engineer's preliminary consulting services
agreement on Otter Tail County Drainage Ditch #21.

Adjournment o closed to Public
At 3:52 p.m., Chairman Lee declared the meeting adjourned and closed to the public for
purposes of discussing potential litigation regarding the otter Tail County Detention
Facility floor per the Attorney-Client Privilege as authorized in 471.705, Subd. ld.
The next meeting of the Otter Tail County Board of Commissioners is scheduled for
9:30 a.m. on Tuesday, September 21, 1993.
