HomeMy WebLinkAboutBoard of Commissioners - Minutes - 09/07/19930 0 Minutes of the OTTER TAIL COUNTY BOARD OF COMMISSIONERS Commissioners' Room, Floor 1-B Otter Tail County Courthouse Tuesday, September 7, 1993 9:30 a.m. Call to Order The Otter Tail County Board of Commissioners convened Tuesday, September 7, 1993, at 9:30 a,m, at the Otter Tail County Courthouse with Commissioners Malcolm Lee, Chairman; Andy Lindquist, Harley Windels, Bill stone and Virginia Fortmann present. Approval of Minutes Motion by Stone, seconded Windels and unanimously carried to approve the minutes of August 24, 1993, as submitted. Contract Approval: SAP 56-600-11 Motion by Lindquist, seconded Fortmann and unanimously carried to approve the contract for SAP 56-600-11, Stalker/Long Lake Road Project which has been approved by the County Attorney and Highway Engineer contingent upon receipt of the proper liability insurance certificate from Dennis Drewes Construction. Contract Approval: CP 93:TM Motion by Windels, seconded Partmann and unanimously carried to approve the contract for CP 93:TM, 1993 Traffic Marking Contract which has been approved by the County Attorney and Highway Engineer. Change Order Approval: Phelps Mill Dam Motion by Windels, seconded Stone and unanimously carried to approve Change Order No. 1, Phelps Mill Dam Project, which is as follows: Item No. l -Installation of catch basin C3-2 to improve drainage and reduce erosion - $4,731 Item No. 2 -Operators bridge modification to lower deck elevation and allow hinged grate access to stop logs -$6,009 Item No, 3 -Concrete removal from upstream apron area of flume -$4,173 Item No, 4 -Deletion of repair Mill substructure -$4,000 Item No. 5 -Repair Mill substructure based on time and materials -maximum amount, $14,000, No change in contract time under Change Order No. l, Preliminary Budget: Informational Meeting Notice was given that the Otter Tail County Board of Commissioners has scheduled a public meeting Monday, September 13, 1993, at 9:30 a.m. at the Otter Tail County Courthouse, Fergus Falls, MN, in the Commissioners' Room, Floor 1-B. The purpose of the public meeting is to discuss the Otter Tail County 1994 preliminary budget, 0 0 Ot"'ter Tail County Board of Commissioners September 7, 1993 Page 2 Empty Pesticide Container Collection Marie Tysdal, Public Information Officer, from the Solid Waste Department discussed the Empty Pesticide Container Collection efforts to obtain local chemical dealers input as it relates to the new law regarding acceptance of empty pesticide containers. After discussion, it was determined that Tysdal would send a letter to each chemical dealer requesting input, followed by a personal visit. Tysdal will report outcome to the Board. Payment Authorized Motion by Lindquist, seconded Fortmann and unanimously carried, to approve a payment to Lake Region Hospital and Nursing Horne, in the amount of $1,033.03, for costs incurred under Minnesota Statute 609.35. Motion by Fortmann, seconded Windels and unanimously carried, to approve a payment to Fergus Falla Medical Group PA, in the amount of $637.75, for coats incurred under Minnesota Statute 609.35. Tax-Forfeited Land The Auditor provided a handout of parcels that forfeited to the State of Minnesota as of August 31, 1993, for informational purposes. Payment Authorized Motion by Lindquist, seconded Fortmann and unanimously carried to approve payment from the Otter Tail County Coroner 1993 budget to Richard Dalquiat, in the amount of $1,410.03, for costs incurred while attending the Mastera V Advanced Death Investigation Seminar in st. Louis, MO. Motor Vehicle Department Closed Motion by Fortmann, seconded Stone and unanimously carried, to approve the closing of the West Otter Tail County Motor Vehicle Office on Thursday, September 30, 1993, to allow the Motor Vehicle staff to attend the 1993 Deputy Registrars Review School. The Auditor will place appropriate notices in the newspaper of the closing. Payment Authorized Motion by Lindquist, seconded Stone and unanimously carried, to approve payment to the City of Pelican Rapids, in the amount of $25.00, for mowing a parcel of tax forfeited property described as follows: Wilson's Addn. Lot 4, Block 1 Except the South 100' The above coat to be added to the sale price of this property. Motion by Stone, seconded Fortmann and unanimously carried, to approve payment to the City of Parkers Prairie, in the amount of $41.30, for quarterly utility services on a parcel of tax forfeited property described as follows: Lakeview Add'n Lota 1, 2, 3 and 4 Block 34 and vacated alley adj. The above coat to be recovered from the rental payment presently being received. If the rental payment is not sufficient the coat will be added to the sale price -of the property. 0 Otter Tail County Board of Commissioners September 7, 1993 Page 3 Motion by Stone, seconded Fortmann and unanimously carried, to approve reimbursement to the Otter Tail County Highway Department, in the amount of $185.07, for hauling away trash from the following described parcel of tax forfeited property: Blyberg's First Addn. Lot 18 Block 5 The above cost will be added to the sale price of this property. Motion reluctantly by Windels, seconded Lindquist and unanimously carried to approve payment to Ballard Sanitation, Inc., in the amount of $313.15 for garbage services provided since the date of forfeiture. The Board identified the need for a policy to address matters such as this and Stein agreed to draft such policy. State Auditors' Conference The County Auditor reported on the State Auditors' Conference he recently attended and provided handouts to the Commissioners on the 1994 HACA Determinations with statewide totals. Approval to Pay Bills Motion by Stone, seconded Lindquist and unanimously carried to approve payment of bills per Attachment A of these minutes. Otter Tail/Wadena Community Action council Motion by Windels, seconded Lindquist and unanimously carried to authorize the Chairman to execute a letter on behalf of the Otter Tail County Board of Commissioners of support to Otter Tail/Wadena Community Action Council for their efforts to access grant money from the Minnesota Housing Finance Agency to address the region's growing problem of homelessness~ U.S. Fish & Wildlife Service Motion by Lee, seconded Lindquist and unanimously carried to approve the request of the U.S. Fish & Wildlife service for a waterfowl easement from Walter W. and Mary Alice Hendricks of Pelican Rapids. Professional Services Motion by Lindquist, seconded Fortmann and unanimously carried to direct the County Coordinator to retain the professional services of Frank Quisenberry, Employers' Resources International, to assist the Data Processing Steering Committee at an estimated cost of $1,680 for the assessment. County Drainage Ditch #21 Motion by Partmann, seconded Windels and unanimously carried to authorize the County Auditor to make an interfund loan from the General Fund to the County Ditch Fund, in the amount of $5,750.00, to reimburse expenses incurred by Interstate Engineering, Inc., for services performed in preparing the preliminary engineers study on County Drainage System Ditch #21. Motion by Fortmann, seconded Windels and unanimously carried to approve the engineering services contract with Interstate Engineering, Inc. for preparation of the preliminary engineers study on County Drainage System Ditch #21, subject to changes identified by the county Attorney. 0 0 0 Otter Tail County Board of Commissioners September 7, 1993 Page 4 Law Library Rent The County Attorney read a draft letter written to the Attorney General seeking his opinion regarding the Board's motion of March 18, 1992, to require the Law Library to pay $1,000 per month rent for office space with the monies to be allocated to the Building Maintenance Fund. The statute states the County Board shall provide space for the Law Library, but it is unclear if rent can be charged. Motion by Partmann, seconded Stone and unanimously carried to direct the County Attorney to send the letter to the Attorney General for his opinion and the County would abide by his interpretation and, if necessary, return the $1,000 per month rent it has charged the Law Library which was retroactive to January 1, 1992. Conditional Use Applications Motion by Lindquist, seconded Windels and unanimously carried to uphold the recommendations subject to conditions, if any, of the Planning Commission in approval of the following Conditional Use Applications: Amor Township, Dead Lake Clitherall Township,et al, Clitherall Lake Barbara Legett, Little Pine Lake "Pfeffer/Christensen Development", Herb Christensen, Otter Tail Lake Floyd F. & Ruth A. Felton, Spruce Lodge, Star Lake Dorothy Bylander, Bylander's Resort, Sybil Lake Motion by Windels, seconded Partmann and unanimously carried to uphold the recommendations of the Planning Commission in denial of the following Conditional Use Application: Emery Kraft, Lake Lizzie Note: For detailed information regarding any of the above listed conditional use permits, contact the Land & Resource Management Office. EAW Discussion The Board discussed the need to look at the benefits of requesting an Environmental Assessment Worksheet as a matter of procedure for cluster developments on water. At this time an EAW is not a part of the process and often, when ordered, is perceived to be a delay tactic rather than a beneficial study as intended. No formal action was taken to amend the ordinance. "No Wake" Advisory After discussion with the Land & Resource Management Director and mention by commissioners about individual letters they had received about shoreline erosion due to the high water conditions on area lakes, a motion was offered by Stone, seconded Fortmann and unanimously carried to direct the County Attorney to prepare a resolution for adoption seeking the public's voluntary compliance of no wake zones along the shorelines. Presidential Declaration of s Major Disaster Resolution Based upon a request from Star Lake Township for inclusion of public property in the County's request for Presidential Declaration of a Major Disaster Resolution, a motion was offered by Windels for the amendment. The motion failed for lack of a second. 0 Ot:ter Tail County Board of Commissioners September 7, 1993 Page 5 Sewage Disposal System Cleaners License Motion by Lindquist, seconded Stone and unanimously carried to approve the following Application for Sewage Disposal System Cleaners License: Hawes Septic Tank Pumping -Loren Hawes, Randy Dorow Sewage Disposal Installers License Motion by Lindquist, seconded Windels and unanimously carried to approve the following Application for sewage Disposal Installers License: Jerry Buchholz, Fergus Falls, MN OSM Agreement Motion by Partmann, seconded Lindquist and unanimously carried to authorize the Chairman's signature on the contractual agreement with Orr Schelon Mayenon & Associates, Inc. (OSM) for the basic concept of system evaluation and design and construction of the recycling center as set forth in phases by the County Attorney. Adjournment Closed to Public At 2:32 p.m. Chairman Lee declared the meeting of the Otter Tail County Board of Commissioners adjourned and closed to the public for the purpose of discussing Attorney- Client issues regarding the tax appeal of Demetre Nicoloff and the matter of the Otter Tail County Detention Facility floor and the Northeast Landfill leachate collection tank.
