Minutes of the OTTER TAIL COUNTY BOARD OF COMMISSIONERS Commissioners' Room, Floor 1-B otter Tail county Courthouse Tuesday, August 24, 1993 1:00 p.m. Call to Order The Otter Tail County Board of Commissioners convened Tuesday, August 24, 1993, at 1:00 p.m. at the Otter Tail County Courthouse with Commissioners Malcolm Lee, Chairman; Andy Lindquist, Harley Windels, Bill Stone and Virginia Partmann present. Approval of Minutes Motion by Lindquist, seconded Windels and unanimously carried to approve the minutes of August 17, 1993, with correction to page three, Conditional Use Application of Warren Melquist. Correction should read as follows: Conditional Use Application Motion by Windels, seconded stone and unanimously carried to approve the Conditional Use Application of Warren Melquist, West McDonald Lake, as previously presented and subject to conditions, if any, indicated by the Planning Commission and the Land & Resource Management Office. Big Pine Lake Water Shed Steering Committee Carl Annalora, Mike Hermanson and Howard DeMotts, members of the Big Pine Lake Water Shed Steering Committee, discussed with the Board their formation of a steering committee to address water shed issues. The group updated the Board on their preliminary water quality studies. Obstruction Hearing: Ditch 21 In addition to members of the general public, the following Friberg and Maine Township officials were present for the Ditch 21 Obstruction Hearing: Friberg Township: Gordon Hanneman, Supervisor Duane Mavis, Clerk Maine Township: Harold Doty, Supervisor Carl Trites, Clerk As part of the abandonment proceedings vs repair of otter Tail County Drainage Ditch #21, it was determined that a township line road between Friberg and Maine Townships (which runs across Drainage Ditch #21) is an obstruction to Otter Tail County's Drainage Ditch #21. After lengthy discussion with officials of the affected townships, the County's ditch inspector and Highway Engineer, as well as members of the public, a motion was offered by Stone, seconded Lindquist and unanimously carried to order a preliminary engineering survey prior to demand of the townships to remove their obstruction. (The townships were willing to comply and wanted to replace the culvert at issue, but lacking engi~eering specificatiOns, Wou!,!i ·'not ·have 'the information necessary -to properly install the culvert.) 0 0 0 O~ter Tail County Board of Commissioners August 24, 1993 Page 2 Water Plan Base Grant After discussion about line items being used from the Land & Resource Management budget to apply for a base grant, a motion was offered by Windels, seconded Lindquist and unanimously carried to implement the local comprehensive water plan using approximately $13,500 from the Land & Resource Management budget to match the State's approximate $24,000 for a base grant of $37,500. These monies are allocated for GIS work. Conditional Use Application Extended Motion by Partmann, seconded Stone and unanimously carried to extend the Conditional Use Application permit of Otter Tail Power Company, Otter Tail River, from August 1994 to September 1994 as requested by the Land & Resource Management Director. National Guard Duty Motion by Fortmann, seconded Windels and unanimously carried to authorize the use by an employee of up to twenty days for National Guard duty pursuant to M.S. 192.26. Such employee does not anticipate same need in 1994. Bid Award: S.A.P. 56-600-11 Stalker/Long Lake Project Motion by Lindquist, seconded Partmann and unanimously carried to award the bid of S.A.P. 56-600-11 Stalker/Long Lake Project to the lowest bidder as recommended by the Highway Engineer: Dennis Drewes, Inc. $235,649.73 Frazee, MN Final Payments Motion by Stone, seconded Windele and unanimously carried to approve payment in the amount of $215,160 payable to Fargo Freightliner, Fargo, ND, for four heavy duty tandem axle snowplowing dump trucks as previously awarded. Motion by Windels, seconded Stone and unanimously carried to approve payment in the amount of $2,689.29 payable to Dave Larson Excavating, Little Falls, MN, for crushing aggregate shouldering, class 1 as previously awarded. LAND SURVEYOR'S CERTIFICATE OF CORRECTION TO PLAT Name of Plat: Miller Beach Motion by Windels, seconded Lindquist and unanimously carried to accept the Land Surveyor's Certificate of Correction to Plat by David A. Anderson, Registered Land Surveyor, under the laws of the State of Minnesota, Registration No. 13620, that he has reviewed the legal description and the surveyor's drawing of Miller Beach, and declares as follows: 1. That the plat of Miller Beach, dated August 4th, 1960 and filed on September 16th, 1960 in the office of the County Recorder, Otter Tail county, Minnesota, in Book o of Plate, Page 75, was prepared by John Reber, Land Surveyor, Minnesota Registration No. 2650, now deceased. 2. Peterson owner of record of the following legally described parcel: Tri-Tract in Sub Lot A Approximately 196" E and wand Approximately 44' on Lake, made application to repurchase said property which was forfeited to the State of Minnesota on August 13th, 1992, for nonpayment of the 1988 tax. WHEREAS, the sum of $646.64 has been remitted, representing the aggregate of all delinquent taxes, penalties, costs assessments and fees. NOW, THEREFORE, BE IT RESOLVED, the County Board of Otter Tail County does hereby approve the above repurchase to be in the best public interest and to relieve undue hardship. WHEREAS, the sum of $589.35 has been remitted, representing the aggregate of all delinquent taxes, penalties, costs assessments and fees. Lee, Chairman Attest: Clerk Veterans' Home Motion by Partmann, seconded Lindquist and unanimously carried to authorize a referendum for $1.5 million bond issue for the Veterans• Home to be located in Fergus Falls. Such referendum election will be held on November 2, 1993. Motion by Lindquist, seconded Partmann and unanimously carried to authorize the County Attorney to retain Steve Rosholt of Faegre & Benson, Minneapolis, as bond counsel to assist in preparation for the referendum and General Obligation bond issuance for the County's share of the Veterans' Home funding. Northeast Landfill Clay Soils Agreements Motion by Stone, seconded Windels and unanimously carried to authorize the Chairman to sign, on behalf of Otter Tail County, clay soils agreements with Donald Neels and Walter Bolland for the purchase of clay to be used at the Northeast Landfill site. Exemption From Lawful Gambling License Application No objection was expressed to the Exemption From Lawful Gambling License for the Eagle Ducks Unlimited (Perham) to hold a raffle at their September 9, 1993, banquet.
