HomeMy WebLinkAboutBoard of Commissioners - Minutes - 08/17/1993w Minutes of the OTTER TAIL COUNTY BOARD OF COMMISSIONERS Commissioners' Room, Floor 1-B Otter Tail County Courthouse Tuesday, August 17, 1993 9:30 a.m. Call to Order The Otter Tail County Board of Commissioners convened Tuesday, August 17, 1993, at 9:30 a.m. at the otter Tail County Courthouse with commissioners Malcolm Lee, Chairman; Andy Lindquist, Harley Windels, Bill Stone and Virginia Partmann present. Approval of Minutes Motion by Partmann, seconded Windels and unanimously carried to approve the minutes of August 10, 1993, as submitted. Household Hazardous Waste Solid Waste Director, Mike Hanan, provided Board members with a handout of financial support estimates for the Regional Household Hazardous Waste Program. Hanan explained the estimates, requirements for trained Household Hazardous Waste staff or contract personnel, and two ways of organizing this program. The Commissioners directed Hanan to communicate with neighboring counties and proceed with evaluation of this program with Otter Tail County as the sponsoring organization. Classification Motion by stone, seconded Partmann and unanimously carried to concur with the Reclassification committee to classify the position of service Fee System Administrator, Solid Waste Department, at a Range 15. New Position Motion by Partmann, seconded Windels and unanimously carried to authorize the Solid Waste Director to proceed with hiring for the new position of Service Fee System Administrator. Resolution of Intent to Establish a Lake Improvement District Upon motion by Lindquist, seconded by Partmann and unanimously carried, the following resolution was adopted: RESOLVED by the Board of county Commissioners of Otter Tail County, Minnesota, that: WHEREAS, Minnesota law provides that in order to preserve and protect the lakes of the state of Minnesota and to increase and enhance the use and enjoyment of these lakes, it is in the public interest that there be established a statewide lake improvement program to preserve, protect and improve the quality of the lakes and their environment; and WHEREAS, Minnesota law permits the creation of lake improvement districts initiated by request and established by resolution of the County Board; and WHEREAS, the Otter Tail County Board of Commissioners has received a petition for establishment by resolution of the Pelican Group of Lakes Improvement District; and 0 0 0 ,otter Tail County Board of Commissioners August 17, 1993 Page 2 WHEREAS, Otter Tail County has previously received two petitions for the establishment of the Pelican Group of Lakes Improvement District, one in 1983 containing 465 signatures and one in 1986 containing 599 signatures of property owners on the Pelican Group of Lakes, which indicates strong support for a lake improvement district among owners in the proposed district; and WHEREAS, in light of the overwhelming support for these prior petitions, the Otter Tail County Board is willing to make an exception to its preferred practice of requiring initiation by petition; and WHEREAS, the Otter Tail County Board wishes to allow formation of a lake improvement district on a trial basis, to provide an opportunity to measure the effectiveness of such organizations in dealing with the variety of issues facing lakeshore property owners in Otter Tail County. NOW, THEREFORE, BE IT RESOLVED that the Otter Tail County Board of Commissioners hereby declares its intent to establish the Pelican Group of Lakes Improvement District. BE IT FURTHER RESOLVED that the following information be provided, as required by Minnesota statutes Section 103B.515, Subd. 1: 1. The boundaries of the Pelican Group of Lakes Improvement District shall encompass all parcels of real property bordering the water's edge of Bass, Big Pelican, Fish and Little Pelican Lakes in Scambler and Dunn Townships of Otter Tail County, to include the entire tax parcels, except all such parcels used for agricultural purposes or for any purposes other than commercial, residential or recreational activities contemplated to be protected or improved by the creation of the lake improvement district. 2. That the water and related land resource management programs to be undertaken in the district include the following: a. Develop and implement a comprehensive plan to eliminate water pollution; b. Receive financial assistance from and participate in projects or enter into contracts with federal and state agencies for the study and treatment of pollution problems and related demonstration programs; c. Undertake research to determine the condition and development of the body of water included within the lake improvement district and to transmit the studies to the Department of Natural Resources, the Minnesota Pollution Control Agency and other interested authorities; d. Make cooperative agreements with the United States or state government or other county or city to effectuate water and related land resource programs; e. Conduct programs of water improvement and conservation; f. Implement a water monitoring system; g. Serve as local sponsor for state and federal projects or grants; h. Regulate water surface use as deemed necessary and reasonable; or i. Such other programs, plans, studies, developments and implementations as are allowed or permitted by law, and approved by the County Board from time to time. 0 0 Otter Tail County Board of Commissioners August 17, 1993 Page 3 3. The programs of the lake improvement district will be financed by the levying of an ad valorem tax solely on the property within the district. 4. The Administrator of the Otter Tail County Department of Land and Resource Management shall be responsible for supervising the programs of the district. 5. A public hearing on whether the Pelican Group of Lakes Improvement District should be established shall be held on August 2B, 1993, at 9:00 a.m., at st. Mary's Church on Otter Tail county Road #20, near the Pelican Group of Lakes. Motion by Windels, seconded Lindquist and unanimously carried to set a Public Hearing Tuesday, September 21, 1993, at 7:30 p.m. at the Otter Tail County Courthouse, third floor, Courtroom l, for the purpose of discussing this petition request. Conditional Use Application Motion by Windels, seconded Stone and unanimously carried to approve the Conditional Use Application of Warren Melquist, West McDonald Lake, as previously presented and subject to conditions, if any, indicated by the Planning Commission. Note Correction to Minutes: B/24/93: Above should include: " ... to conditions, if any, indicated by the Planning Commission and the Land & Resource Management Office." Reduce, Reuse & Recycle Public Information Officer, Marie Tysdal, presented the Commissioners with reusable coffee mugs and spoke to the Commissioners about elimination of the use of throw-away plastic and styrofoam cups. The Commissioners wish to eliminate use of these throw-away cups. Ms. Tysdal also presented postcards addressed to Direct Marketing Association to request name removal from mailing lists contributing to junk mail and informed commissioners of the OWM (Office of Waste Management) Waste Reduction Week, September 27 through October 2, 1993. Approval to Pay Bills Motion by Stone, seconded Windels and unanimously carried to pay the bills per Attachment A of these minutes. Request for Contract Approval Motion by Lindquist, seconded Windels and unanimously carried to authorize the Chairman's signature for approval of the following contracts: 1) C.P. 93:154B, Edna/Hobart Township Road Resurfacing Project; and, 2) S.A.P. 56-633-07, CSAH 33, Resurfacing. Project Review The Highway Engineer updated Board members on the progress of several projects. Deer Trails Days Motion by Partmann, seconded Stone and unanimously carried to approve the closing of main street in the City of Deer Creek on county Road 50 Saturday, August 25, 1993, for the 3rd Annual Deer Trails Days contingent upon approval of the Sheriff's Department. Bid Opening Date Set Motion by Stone, seconded Windels and unanimously carried to authorize the Highway Engineer to advertise for bids for Crushing Salvaged Bituminous Pavement Material stockpiled at the Vining Garage and to set bid opening at 1:00 p.m., Tuesday, September 14, 1993. Proposed Veterans' Home Chairman Lee, member of the Mayor Select Committee Veterans' Home Task Force, discussed with Board members specific issues regarding the proposed Veterans' Home. The Otter Tail County Board of Commissioners requests a written resolution from the City of Fergus Falls to clarify the following specific issues: l) total dollar amount of the Veterans' Home project; 2) number of beds; 3) location of Veterans' Home; and, 4) written confirmation of the State of Minnesota's responsibility to pay operating expenses. The election process and the preparation of absentee ballots were discussed with respect to timing of the potential referendum. 0 0 0 otter Tail County Board of Commissioners August 17, 1993 Page 5 GIS SEMINAR Commissioner Partmann reported on recent Geographic Information Systems (GIS) workshops and the possibility of a voluntary GIS systems demonstration for the county's benefit in September or October. Correspondence Chairman Lee informed Board members of correspondence received from the Commissioner of Human Services, MN Dept. of Public Service and MCIT (Minnesota Counties Insurance Trust) which reports a $60,388 dividend for Otter Tail County. The Chairman acknowledged a letter from the DNR regarding the shortfall in refuge revenue sharing and the U.S. Fish and Wildlife Services's lobbying efforts to insure that 100% revenue sharing funding is achieved by October, 1994. Conditional Use Application Motion by Windels, seconded Lindquist and unanimously carried to refer the Conditional Use Application of Lazy Acres Investors/Dennis Dalziel, Little McDonald Lake, to the Planning commission for a recommendation regarding the need for an Environmental Assessment Worksheet (EAW) to be made following a public hearing. Closed to Public Recess At 2:15 p.m. Chairman Lee declared the meeting of the Otter Tail County Board of Commissioners recessed and closed to the public for the purpose of discussing pending litigation regarding the Otter Tail County Justice Facility floor as authorized in M.S. 471.705, Subd. 1 d., Attorney-Client Privilege. Public Bearing -Abandonment of County Drainage System #21 The Otter Tail County Board of Commissioners convened at 7:35 p.m., on the 17th of August, 1993, to consider the petition to abandon Otter Tail County Drainage System #21. County Drainage System #21 and its branches run from the south side of West Lost Lake in section 31, through Fish Lake, Pleasant Lake, Little Annie Lake, Lake Ann and John Lake. Affecting lands in Section 31 of Maine Township, Section 36 of Friberg Township, Sections 4, 5, 6, 7, 8, 9, 10, 14, 15, 16, 17, 18, 20, and 21, of Sverdrup Township and Sections 1, 2, 3, 10, 11, 12, and 13 of Aurdal Township. The following county staff were in attendance: Commissioner -Harley Windels Commissioner -Malcolm Lee Commissioner -Andy Lindquist Commissioner -Bill Stone Commissioner -Virginia Portmann Ditch Inspector -Roland Sauck Highway Engineer -Richard West Land and Resource Director -Bill Kalar County Attorney -Wally Senyk County Auditor -Wayne Stein chairman Lee called upon the county Auditor to read the petition for the record. The petition requested the following: outer Tail County Board of Commissioners August 17, 1993 Page 6 The petition asked that County Drainage system #21 be abandoned because the o drainage system has ceased to function and its restoration is not practical. Q 0 The County Auditor reported that the petition contained signatures representing 56.94% of the benefited acres in the drainage system. There are 6,490.6 acres in the drainage system. The signatures on the petition to abandon the drainage system represented 3,695.6 acres. The County Auditor reported that 23 letters containing 26 signatures were received stating objections to the abandonment of County Drainage system #21. Chairman Lee called upon Commissioner Lindquist to read the letter that had been received from the Minnesota Department of Natural Resources. The letter stated that the drainage system serves a useful purpose in that it provides an outlet for several lakes including Fish Lake, Pleasant Lake, Ann Lake, Little Annie Lake and John Lake. The Department of Natural Resources expressed a concern in their letter regarding the mechanism that would be in place to maintain an adequate run out elevation of the affected lakes if the drainage system was to be abandoned. The Department of Natural Resources stated in their letter that since the drainage system has been artificially created, it is questionable whether mother nature would do an adequate job over the long haul in providing a stable control on the various lake levels. The Department of Natural Resources stated that it was their opinion that Drainage System #21 does serve a useful purpose to the general public and that the Department of Natural Resources wishes to go on record objecting to the abandonment at this time. Chairman Lee called upon Wally Senyk, County Attorney, to explain the purpose of the public hearing and to explain what action(s) could be taken by the County Board of Commissioners. Wally Senyk, County Attorney, stated that for the drainage system to be abandoned the County Board would have to find that the drainage system does not serve any useful purpose to the affected property owners and is not of general public benefit. Wally Senyk, County Attorney, explained that if there is at least one written objection to the abandonment the County Board would need to appoint three disinterested persons to serve as drainage system viewers. A number of objections to the abandonment have been received. The County Attorney pointed out that since the Department of Natural Resources is objecting to the abandonment of the drainage system it would not be very likely, after hearing the report of the drainage system viewers, that a finding could be made to abandon the drainage system, therefore, the County Board would need to deny the petition for abandonment and reconsider the petition for repair of the drainage system. Since the Department of Natural Resources has determined that the drainage system does serve a useful purpose to the general public it would be most prudent at this time not to appoint viewers and to take action to deny the petition for abandonment and to give reconsideration to the petition for repair. After discussion and consideration, motion was made by Commissioner Lindquist, seconded by Harley Windels and unanimously carried to deny the petition for abandonment. Chairman Lee than opened the meeting for discussion and public input regarding the petition to repair drainage system #21. The following individuals shared their thoughts regarding the repair of the drainage system: Mitch Davis, Harold Doty, Randy Wasvick, Orlyn Pederson, Sam Krog, Donald Bergem, Carl Trites, David Davis, Gregory Langseth, Mrs. Arnold Hagen, Leonard Davis, and Duane Krog. Q Otiter Tail County Board of Commissioners August 17, 1993 Page 7 The discussion centered around the the following issues: 1. The culvert that should be located under the Maine/Friberg Township Road, 2. The need for an engineer's study, 3. Alternatives for solving the problem, and; 4. Solving the problem with the least amount of cost to the benefited property owners. It was noted that the County Board of Commissioners has scheduled a meeting with the Maine and Friberg Town Boards to discuss the drainage ditch obstruction. The meeting will be held on Tuesday, August 24th, 1993, in the otter Tail County Commissioners' Room at 1:15 p.m. It was the general consent of those in attendance and of the County Board of Commissioners that no additional action should be taken until after the discussions with the Town Boards of Friberg and Maine have been completed. Adjournment With no additional discussion, the public hearing was declared adjourned at 8:50 p.m. The next regular Board meeting is scheduled for 1:00 p.m., Tuesday, August 24, 1993.
