OTTER TAIL COUNTY BOARD OF COMMISSIONERS

Call to Order
The Otter Tail County Board of Commissioners convened Tuesday, August 3, 1993, at
9:30 a.m. at the Otter Tail County Courthouse with Commissioners Malcolm Lee, Chairman;
Andy Lindquist, Harley Windels, Bill Stone and Virginia Partmann present.
Approval of Minutes
Motion by Partmann, seconded Stone and unanimously carried to approve the minutes of
July 27, 1993, as submitted.
Homestead Classification
A request for homestead classification for tax year 1992 was presented by Bob Moe,
Assessor, on some property owned by Leonard and Madeline Zuhlsdorf. A motion was
offered by Stone, seconded Partmann to honor the request of the Zuhlsdorf's and grant
homestead for the 1992 tax year based upon the circumstances described. Lengthy
discussion followed and the Chairman asked for a roll call vote:

The request for homestead classification on the Zuhlsdorf property for tax year 1992 was
denied.
Premise Permit Application
Motion by Lee, seconded Lindquist and unanimously carried the following resolution was
adopted by the Otter Tail County Board of Commissioners:
WHEREAS, the responsibility for the regulation of lawful gambling and the issuance of
licenses and permits for conduct of lawful gambling lies with the Minnesota Gambling
control Board; and
WHEREAS, the American Legion Post 30, Fergus Falls, MN, has made application to the
Gambling control Board for a premise permit to conduct lawful gambling at the Wee Town
Pantry and Pub in Friberg Township of Otter Tail County; and
WHEREAS, Minnesota Statutes 349.213 provides that the Gambling Control Board may not
issue a premise permit unless they receive a resolution from the County Board approving
the permit; and
WHEREAS, the otter Tail County Board of Commissioners is aware of no reason to oppose
the conduct of lawful gambling by the American Legion Post 30, Fergus Falls, at the Wee
Town Pantry and Pub in Friberg Township of Otter Tail County; and

NOW, THEREFORE, BE IT FURTHER RESOLVED that the Otter Tail County Board of Commissioners
hereby approves the conduct of lawful gambling by the American Legion Post 30, Fergus
Falls, MN, at the Wee Town Pantry and Pub in Friberg Township of otter Tail County,
provided that the applicant meets all the necessary criteria for the licenses and
permits required by the Gambling Control Board.
IT IS FURTHER RESOLVED, that notice of this application and approval shall be provided
to the Town Board of Friberg Township by sending them a copy of this resolution.

Land Surveyor's Certificate of Correction to Plat
Name of Plat: Amended and Enlarged Plat of Camp Nidaros
Motion by stone, seconded Lindquist and unanimously carried to accept the Land
Surveyor's Certificate of Correction to Plat by David A. Anderson, Registered Land
Surveyor, under the laws of the State of Minnesota, Registration No. 13620; that he has
reviewed the legal description and the surveyor's drawing of the Amended and Enlarged
Plat of Camp Nidaros, and declares as follows:
1. That the plat of Amended and Enlarged Plat of camp Nidaros, dated March 13, 1911,
and filed on July 14, 1911, in the office of the County Recorder, Otter Tail County,
Minnesota, in Book M of Plats, Page 22, was prepared by Martin Aalberg, civil
Engineer and Surveyor, now deceased.
2. That Said plat contains the following omissions to wit:
The call along said shore of Otter Tail Lake was omitted from the legal description
on said plat.
3. That the legal description on said plat is hereby corrected as follows, to wit:
First: All of Camp Nidaros as shown on plat on file and of record in the office of
the Register of Deeds of said Otter Tail County. Second: A parcel of land
described as follows, to wit: Beginning at Meander Post 18 on the section line
between Sections 12 and 13 in Township 134 North of Range 40 West of the 5th
Principal Meridian; thence running East on the section line 1,020 feet to the shore
of otter Tail Lake; thence South 45 1/4 degrees West along said shore of otter Tail
Lake, 297 feet; thence South 17 3/4 degrees West along said shore of Otter Tail
Lake, 164 feet; thence South 57 degrees West along said shore of Otter Tail Lake,
278 feet; thence South 34 1/4 degrees West along said shore of Otter Tail Lake. 306
feet; thence North 25 degrees West, 850 feet to the place of beginning, excepting
from said conveyance the strip of land across said premises used for a public
highway, being a strip of land 4 rods wide that is 2 rods on each side of the center
of the travelled path running parallel with the lake shore on the southeast part of

said premises, and which strip extends from the section line on the north to the
line which bounds said premises on the southwest side, and the title to which
excepted strip the grantor herein reserves to himself and his heirs; all of the
above conveyed premises being part of Lot 1 in Section 13, Township 134 North, Range
40 West and containing 7 3/5 acres.

Truth in Taxation Bearing
Motion by Windels, seconded Partmann and unanimously carried to set the initial Truth in
Taxation Hearing at 7:30 p.m. on December 14, 1993, and the continuation hearing, if
needed, at 7:30 p.m. on December 20, 1993.
Agricultural Crop Disaster Relief Report
Sandra Giese, ASCS Director; Dan Heckert, ASCS District Manager; Harold Stanislawski,
Minnesota Agriculture Extension Agent and Bill Kalar, Director of Land & Resources
reported on the agricultural crop disaster and potential losses in Otter Tail County.
OSM Contract
Motion by Stone, seconded Windels and unanimously carried to approve the Chairman's
signature on the OSM Contract upon approval of the County Attorney.
U.S. Fish & Wildlife
Don Kleven, U.S. Fish & Wildlife, discussed the purchase of property currently owned by
Steven Rokes in the East 1/2 of Section 20 in Inman Township. The Board had previously
approved a 240 acre fee purchase when the original request was for 317.37 acres. Kleven
again requested the approval for fee purchase of the entire 317.37 acres indicating that
once purchased, the service would offer for exchange the cropland on this parcel.
Motion by Partmann, seconded Stone and unanimously carried to approve the fee purchase
as presented to exchange the cropland of approximately 80 acres, in "the North 1/2 of the
Northeast 1/4 of Section 20.
Office of Waste Management
Upon a motion by Portmann, seconded Lindquist and unanimously carried with a roll call
vote to offer the following resolution of support for the continuation of the Office of
Waste Management:

WHEREAS, Minnesota Counties are interested in continuing their national leadership in
solid waste and recycling issues and,
WHEREAS, the goal for counties is the safe, efficient, and effective management of solid
waste and,

WHEREAS, the Office of Waste Management (OWM) has been instrumental in that process by
efficiently and effectively acting as a planning agency as opposed to a regulatory
agency and,
WHEREAS, Minnesota Counties support small State agencies with clearly defined missions
and good lines of communication which are better able to serve our constituents and,
WHEREAS, Minnesota Counties oppose the concept of super agencies and,
WHEREAS, Minnesota Counties see value in the continued separation of the OWM as a
planning office from the regulatory, enforcement aspect of the Minnesota Pollution
Control Agency (MPCA) and,
WHEREAS, the consolidation of any state agencies should include the input of those
groups including counties who are the "customers" of those agencies,
NOW, THEREFORE, BE IT RESOLVED, that the Otter Tail County Board of Commissioners oppose
the current attempt to enlarge the MPCA by the addition of the OWM into said agency and,
BE IT FURTHER RESOLVED, that the Otter Tail County Board of Commissioners appeals to the
Governor to immediately cease the current closed consolidation process and allow for
open dialogue and planning for any future consolidation plans.

75 H.P. Tractor/Loader to the lowest bidder as recommended by the Highway Engineer,

County Highway Engineer, Rick West, reported survey work done by the Highway Department
relative to County Drainage Ditch 21 which included water elevations.
Motion by Windels, seconded Stone and unanimously carried to serve a notice of
obstruction to Maine and Friberg Township officials to deal with a culvert problem along
a joint township road.
Our Lady of the Prairie
Motion by Lindquist, seconded Stone and unanimously carried to address a public safety
problem in Leaf Mountain Township with regard to public parking at a tourist attraction
known as Our Lady of the Prairie. The motion was to offer $1,000 to assist the township
to address the safety problem created by this attraction.
Radio Communications Contract
Motion by Lindquist, seconded Windels and unanimously carried to authorize the
Chairman's signature on the radio communications contract with John DuBois contingent
upon the County Attorney's approval.
Veterans' Home Report
Chairman Malcolm Lee reported on a recent trip he and others had made to the Veterans'
Home in Luverne, MN. Chet Toso, Veterans' Service Officer, provided a video of the
Luverne site and a video, borrowed from the City of Fergus Falls, of their visit to a
Veterans Home in Silver Bay, MN.

Adjournment
Closed to Public
At 3:30 p.m., Chairman Lee declared the meeting adjourned and closed to the public for
purposes of discussing litigation matters per the Attorney-Client Privilege as
authorized in 471.705, Subd. ld. Litigation matters cited were with regard to Detention
Facility Floor Problem; Dale Pierce and Scambler Township Demolition Site vs.
otter Tail County; and the Northeast Landfill Tank Leak. The next meeting of the
Otter Tail County Board of Commissioners is scheduled for 1:00 p.m. on Tuesday,
August 10, 1993.
