HomeMy WebLinkAboutBoard of Commissioners - Minutes - 07/20/19930 0 Minutes of the C>TrER TAIL COUNTY BOARD OF COMMISSIONERS Commissioners' Room, Floor 1-B Otter Tail County Courthouse Tuesday, July 20, 1993 9:30 a.m. Call to Order The Otter Tail County Board of Commissioners convened Tuesday, July 20, 1993, at 9:30 a.m. at the Otter Tail County Courthouse with Commissioners Malcolm Lee, Chairman; Andy Lindquist, Harley Windels, Bill stone and Virginia Partmann present. Approval of Minutes Motion by Stone, seconded Partmann and unanimously carried to approve the minutes of July 13, 1993, as submitted. U.S. Fish & Wildlife Fee Purchase Don Kleven, U.S. Fish & Wildlife representative, requested Board approval of a fee purchase on 317.37 acres of land owned by Steven and Judith Rakes, Inman Township. A motion was offered by Partmann, seconded Windels, to approve the fee purchase as requested. After discussion, however, the motion was withdrawn by Partmann citing issues of water drainage and its affects on other farms. Kleven was directed to investigate and report at the next Board meeting answers to specific questions which .arose in the discussion. '93 Tax Bill Highlights Bob Moe, Assessor, provided highlights of the property tax bill changes of the '93 legislative session. Otter Tail County Abatement Policy Review The Assessor provided an updated Otter Tail County Abatement Policy citing the numerous State law changes in the 1993 legislative session. After review of the abatement policy proposed by the Assessor, a motion was offe~ed by Stone, seconded Lindquist and unanimously carried to approve the updated abatement policy subject to those specific changes identified by the Board. '94 Assessment Contracts Motion by Partmann, seconded Lindquist and unanimously carried to approve the 1994 Assessment Contracts as presented by the Assessor. Pesticide Container collection Report Public Information Officer, Marie Tysdal, and Solid Waste Director, Mike Hanan, reported on the empty pesticide container collection held on June 24-25, 1993. Discussion about future pesticide collections followed regarding.new legislation which requires chemical dealers to collect empty pesticide containers. The Solid Waste Director was instructed to contact local chemical dealers regarding the new legislation and their plans to comply. 0 0 Otter Tail County Board of commissioners July 20, 1993 Page 2 Reclassification Motion by Stone, seconded Partmann and unanimously carried to accept the recommendation of the Reclassification Committee to reclassify the position of Scheduling Clerk in the Court Administrator's Office to Range 14 effective July 1, 1993. Motion by Stone, seconded Lindquist and unanimously carried to accept the recommendation of the Reclassification Committee to reclassify the position of Solid Waste Clerk to a Clerk Typist II, Range 12, effective August 1, 1993. After presentation of information by the Committee regarding the Solid Waste Analyst position, the matter was referred to the Assessor, Auditor and Solid Waste Director to evaluate the duties of this position. Kevin Newborg was directed to represent the Committee on this referral. Roadside Mowing contractor Ken Anderson, roadside mowing contractor for areas Band F, discussed a number of roadside mowing problems with the Board. Approval to Pay Bills Motion by Lindquist, seconded Windels and unanimously carried to approve the payment of bills per Attachment A of these minutes. conditional Use Application Jack Donelan, representing the Conditional Use Application of People of a Sacred Place, Inc. on West Battle Lake, discussed with the Board sanitary facilities which were a condition placed on the application by the Board. Mr. Donelan proposed these facilities be placed across a stream with canoe accessibility, however, the concensus of the Board was that the sanitary facility should be on the same side of the stream as the site. Crowding on Area Lakes Bill Kalar, Director of Land & Resources, discussed the crowding on area lakes with the Board. This matter will be further considered. Liquor Licenses Motion by Stone, seconded Windels and unanimously carried to approve the following applications for licenses: Sacred Heart Church Council Mark Stenger, President Dent, MN on-Sale Non-Intoxicating Malt Liquor License -One day license. Subject to the approval of the County Attorney's office and the County Sheriff's office. Country Manor Restaurant & Lounge Highway 10 West Wadena, MN On-Sale Intoxicating Liquor License -Transfer 0 Subject to the approval of the County Attorney's office, the County Sheriff's office and the submission of the required insurance certificate. 0 0 Otter Tail County Board of Commissioners July 20, 1993 Page 3 BRA Board Appointment Motion by Lindquist, seconded Windels and unanimously carried to re-appoint Nelvin Thormodson as a board member of the otter Tail County HRA Board for a five year term to commence on August 1, 1993 through July 31, 1998. Resolution Authorizing Execution of Agreement UPON motion by Lindquist, seconded Partmann and unanimously carried the following resolution was adopted: WHEREAS, the Minnesota Department of Public Safety has been designated to administer law enforcement funds available through the Federal Anti-Drug Abuse Act of 1986; and WHEREAS, the County is eligible to receive funds for services set forth in its grant application: NOW, THEREFORE, IT IS RESOLVED THAT the County of Otter Tail enter into a cooperative agreement with the Office of Drug Policy in the Minnesota Department of Public Safety for the project entitled the West Central Minnesota Task Force during the period from January 1, 1994 through December 31, 1994. BE IT FURTHER RESOLVED THAT the Sheriff and County Treasurer be and hereby are authorized to execute such agreements as are necessary to implement the project on behalf of Otter Tail County. Lee, Chairman Bid Award: T-629 & Etc./C.P. 93:154B Motion by Windela, seconded Lindquist and unanimously carried to award the bid of T-629 & Etc./C.P. 93:1548 to the lowest bidder, Central Specialties Inc., Long Prairie, MN, in the amount of $118,748.99. Final Payments Motion by Stone, seconded Windela and unanimously carried to authorize the final payment of $9,620.47 payable to North Country Equipment, Inc., Grand Rapids, MN, for a 135 HP Wheel Loader as previously awarded. Motion by Windels, seconded Stone and unanimously carried to authorize the final payment of $33,901.08 payable to Spec Materials, Inc., Vadnais Heights, MN, for a Double Boiler Asphalt Melter Applicator, Hot Air Lance and Pavement Cutter as previously awarded. 0 0 0 Otter Tail County Board of CommissiOners July 20, 1993 Page 4 New York Mills Office Building Proposal Larry Krohn, Coordinator, gave details of a proposal by the City of New York Mills to relocate the East Otter Tail County Offices from their current location in Perham to New York Mills. Krohn cited lack of office and parking space at the East Otter Tail County location and the unsuccessful attempts to find additional office space within the City of Perham as reasons to consider this proposal. After lengthy discussion about the proposal by the City of New York Mills, a motion was offered by Partmann, seconded Lindquist and unanimously carried to direct the County Coordinator and County Attorney to consult with an architect on suitability of the building offered and, if prudent, to move ahead to workout a cost-effective lease/purchase agreement with the City of New York Mills for property described as a single site school building now owned by r.s.D. #553. Closed to Public Recess At 3:05 p.m. Chairman Lee declared the meeting of the Otter Tail County Board of Commissioners recessed and closed to the public for purpose of an individual performance evaluation subject to its authority pursuant to M.S. 471.705, Subd. ld.(d). The performance evaluated was that of Tim Brand, Data Processing Director. A summary report of performance conclusions will be provided at the next regular Board meeting. Public Hearing -Repair of County Drainage System #21 The Otter Tail County Board of Commissioners convened at 7:40 p.m., on the 20th of July, 1993, to consider the petition to repair that portion of otter Tail County Drainage System #21 running from Fish Lake in Aurdal Township to West Lost in Maine Township. The following county staff were in attendance: Commissioner -Harley Windels Commissioner -Malcolm Lee Commissioner -Andy Lindquist Commissioner -Bill Stone Commissioner -Virginia Partmann Highway Engineer -Richard West County Attorney -Wally Senyk Land and Resource Director -Bill Kalar County Auditor -Wayne Stein Chairman Lee called upon the County Auditor to read the petition for the record. The petition requested the following: The petition asks for the appointment of a qualified engineer to examine County Drainage System #21 and to make a report of the necessary repairs, the estimated cost of repair and all details, plans and specifications required to supply the necessary details to let a contract for such repair and following the receipt of the engineers report, to conduct further proceedings as provided by law. The County Auditor reported that the petition contained 15 signatures. Two of the petition signers did not have property listed in the viewer's report and one of the petition signers was not a property owner. The petitioners represent 2.4% of the total acres included in County Drainage System #21. Chairman Lee called upon Wally Senyk, County Attorney, to explain the purpose of the public hearing, the significance of the amount of property owned by the signers of the petition, and how the County Board of Commissioners would proceed with the process. 0 0 0 Otter Tail County Board of Commissioners July 20, 1993 Page 5 Wally senyk, County Attorney, explained that the County Board of Commissioners would have to find that it was in the best public interest of the affected property owners to have the drainage system repaired. The purpose of this hearing was to determine whether or not the County Board should proceed with the appointment of an engineer to examine the drainage system. Chairman Lee called upon Roland Sauck, Ditch Inspector, to explain the portion of the ditch that was affected by the petition. Roland Sauck, Ditch Inspector, explained that the area under consideration is from Fish Lake in Aurdal Township to West Lost Lake in Maine Township. Roland Sauck commented generally on the condition of the ditch system. Chairman Lee called upon Richard West, Highway Engineer, to discuss the estimate cost of engineering services that would be required. Richard West, Highway Engineer, commented on discussions he has had with Interstate Engineer's Inc. Interstate Engineer's Inc. had submitted a letter to Richard West indicating the level of work that would be required. The proposed work was divided into two phases. Interstate Engineer's Inc. provided a listing of the possible work that would be done in each of the phases. The estimate cost of phase one would be approximately $5,750.00. Without the information that would be gathered in phase one Interstate Engineer's Inc. would not be able to provide a cost estimate on the phase two work. Richard West, Highway Engineer, estimated that the cost could be between $50,000 and $250,000. Chairman Lee called upon Bill Kalar, Land and Resource Director, to discuss the affects the current wetland regulations would have on the project and the cost of the project. Bill Kalar, Land and Resource Director, discussed his understanding of the Wetlands Conservation Act and how the ditch repair work would be affected by these regulations and to what extent the existing wetlands can be altered. Chairman Lee called upon representatives from any other governmental agencies wishing to comment on the petition and the proposed drainage ditch repairs. Julie Aadland with the Department of Natural Resources indicated that the DNR would be concerned with the water level of Fish Lake, but had no specific comments at this time and would be reviewing and commenting on any plan of repair at a future date. Chairman Lee called upon Wally Senyk, County Attorney, to address the amount of dollars the County can expend and amount of assessment in any one year. Establishment of the Wetland Areas and their Designation. Discussion of the Ordinary High Water Level of Fish Lake and other lakes included in the Drainage System. The coats of the repairs and how they are paid for. High water concerns and the property that is being affected. Buildings that are presently in water (Property Damage). Economic and safety concerns of the established racetrack and other affected property owners .. 7. Concerns regarding the establishment of how deep the original ditch was at the time of construction. 8. Are structures presently located too close to the ordinary high water level. 9. Beavers and how to control and/or eliminate the problem of beaver dams. 10. Is the benefit from the repair of the system worth the amount of dollars that might need to be expended to repair the drainage system. 11. Individuals who are a part of the drainage system that would not receive any benefits from the proposed repairs would have to share in the coats of the repair. 12. Existing landowners being flooded out by the drainage system that is not working properly. 13. The large job to clean the drainage system and the overwhelming cost. 14. Concerns as to how the bill gets paid and concerns as to who are the benefited property owners. 15. Individuals in the area of the drainage system that have petitioned for the repair are requesting the same benefits that others are receiving from the existing drainage system. 16. Concerns regarding who benefits when the drainage system is viewed by ditch viewers making a benefits determination and who benefited the last time benefits were determined. 17. The possibilities_ of placing water control structures in the drainage system to prevent additional flowage into Fish Lake. 18. Are there other sources of funding available that can be used to pay the coats incurred in the repair of the drainage system. 19 .; Are there other agencies that perhaps would assist with this .project. 20. · The drainage system created an additional tax base for Otter Tail County, therefore, the county has benefited from the drainage system and_should pay some of the costs of repair. 21:· The possibilities of abandoning the drainage system. The above thoughts, comments and concerns were expressed and general discussion of the comments and concerns took place at the public hearing. Randy Wasvick presented a petition for the abandonment of the drainage system. The petition will be submitted to the County Auditor's Office for review and for a determination as to whether it represents 51% of the land in the drainage system or 51\ of the property owners within the drainage system. Wally Senyk, County Attorney, addressed the procedures required when a petition for abandonment of a drainage system is received. A report regarding this petition will be made to the County Board as soon as the petition has been fully reviewed by the Auditor's Office. With no additional thoughts, comments or concerns being expressed Chairman Lee called upon Wally Senyk, County Attorney, for closing remarks. Wally Senyk, County Attorney, ·explained to the public that the petition to abandon the drainage system would need to be reviewed. If the petition contains sufficient signatures then viewers would be appointed to make a report as to the useful purpose of the drainage system •. An 0 0 0 Otter Tail County Board of Commissioners July 20, 1993 Page 7 additional public hearing would need to be schedule for the purpose of discussing the abandonment of the drainage system. If the petition to abandon the drainage system does not contain enough signatures then the County Board must consider the petition to repair a portion of the drainage system and make a decision as whether the repairs should be made and if the repairs would be in the best interest of the affected property owners within the drainage system. Adjournment With no additional discussion, the public hearing was declared adjourned at 9:35 p.m. The next regular Board meeting is scheduled for 1:00 p.m., July 27, 1993.
