Approval of Minutes Motion by Partmann, seconded Lindquist and unanimously carried to approve the minutes of July 6, 1993, as submitted. U.S. Fish & Wildlife Waterfowl Easements Motion by Lee, seconded Lindquist and unanimously carried to approve the following waterfowl easements, dated July 13, 1993: Gregory J. Koep: T. 131 N., R. 39 w., 5th P.M., Section 35, as described. 0 Alice R. Wagner: T. 131 N., R. 39 w., 5th P.M., Section 34, SEl/4 SEl/4. 0 Richard G. HRA: Residential Antidisplacement and Relocation Assistance Plan Motion by Lindquist, seconded Partmann and unanimously carried to offer the following resolution to be included as a part of the HRA grant application for Residential Antidisplacement and Relocation Assistance Plan under Section 104(0) of the Housing and_ Community Development Act of 1974, as amended: A. Otter Tail County will replace all occupied and vacant occupiable low/moderate- income dwelling units demolished or converted to a use other than as low/moderate income housing as a direct result of activities assessed with funds provided under the Housing and Community Development Act of 1974, as amended, as described in 24 CFR 570.496a (c)(l). 0 0 0 Otter Tail County Board of Commissioners July 13, 1993 Page 2 All replacement housing will be provided within three years after the commencement of the demolition or conversion. Before entering into a contract committing the county to provide funds for an activity that will directly result in such demolition or conversion, the county will make public and submit to the Minnesota Department of Trade and Economic Development the following information in writing: l. A description of the proposed assisted activity: 2. The location on a map and number of dwelling units by size (number of bedrooms) that will be demolished or converted to a use other than as low/moderate-income dwelling units as a direct result of the assisted activities; 3. A time schedule for the commencement and completion of the demolition or conversions; 4. The location on a map and the number of dwelling units by size (number of bedrooms) that will be provided as replacement dwelling units. If such data are not available at the time of the general submission, the county will identify the general location on an area map and the approximate number of dwelling units by size and provide information identifying the specific location and number of dwelling units by size as soon as it is available; 5. The source of funding and a time schedule for the provision of replacement dwelling units; 6. The basis for concluding that each replacement dwelling unit will remain a low/moderate-income dwelling unit for at least 10 years from the date of initial occupancy. 7. Information demonstrating that any proposed replacement of dwelling units with smaller dwelling units (e.g., a 2-bedroom unit with two 1-bedroom units) is consistent with the housing needs of low and moderate income households in the jurisdiction. The County may request the Minnesota Department of Trade and Economic Development to recommend that the U.S. Department of Housing and Urban Development approve an exception to required replacement housing if there is an adequate local supply of vacant low-to- moderate-income dwelling units in standard condition. Exceptions will be reviewed on a case-by-case basis as described in 24 CFR 570.496a(c)(l)(iv)(C). a. The County will provide relocation assistance, as described in Section 570.496a(c) (2), to any lower-income person displaced by the demolition of any dwelling unit or the conversion of a low/moderate-income dwelling unit to another use in connection with an assisted activity. c. consistent with the goals and objectives of activities assisted under the Act, the county will take the following steps to minimize the displacement of persons from their homes: D. 1. No acquisition program is planned or necessary at the present time. 2. No displacement has occurred under any previous county housing rehabilitation program. Definitions for the purposes of this plan are as follows: A "low/moderate-income dwelling unit" is a unit with a market rental, including utility costs, that does not exceed the applicable fair market rent for existing 0 Otter Tail County Board of Commissioners July 13, 1993 Page 3 housing and moderate rehabilitation, as established under the Section 8 existing housing program. A '"vacant occupiable dwelling unit" is a vacant unit that is in standard condition; or in substandard condition, suitable for rehabilitation; or in dilapidated condition and occupied less than a year from the date of the grantee agreement. An "occupiable dwelling unit" is a unit that is in standard condition or has been raised to a standard condition from a substandard condition, suitable for rehabilitation. A "standard condition dwelling unit" is a well-built unit with adequate space for persons living there. There are no major defects in the structure and only minor maintenance is required. Such dwelling will have the following characteristics; reliable roofs; sound wells and foundations; adequate and stable floors, walls, and ceilings; surfaces and woodwork that are not seriously damaged nor have paint deterioration; sound windows and doors; adequate heating, plumbing, and electrical systems which don't present safety hazards; adequate insulation for local climatic conditions; and is in compliance with local building and housing codes. A "substandard condition dwelling unit, suitable for rehabilitation" will show a lot of deferred maintenance with permanent damage to structural items. Conditions contributing to substandard dwelling, include but are not limited to, sagging, cracked, rotting, or leaking roofs, walls, foundations, ceilings, floors, doors, and windows; deteriorated surfaces and woodwork; unreliable heating, plumbing, or electrical systems which present safety hazards or inadequate insulation. The cost of rehabilitating the unit to a standard condition should not exceed the market value of the dwelling. BE IT RESOLVED, that the Otter Tail County Board of Commissioners hereby adopts the Residential Antidisplacement and Relocation Assistance Plan for Otter Tail County. Lee, Chairman Veterans' Home Task Force Motion by Stone, seconded Windels and unanimously carried to designate Chairman Lee, as Otter Tail county Board representative, to serve on the Veterans' Home Task Force. Death Investigation Seminar The County Attorney reported on the cost share negotiation with Lake Region Hospital and others with regard to the request of the Otter Tail county Coroner, Dr. D. L. Michelis, to expend funds from the 1993 County Budget for training costs for Richard Dahlquist to attend the Masters V Advanced Death Investigation Seminar on August 2-5, 1993. Senyk 0 Otter Tail County Board of Commissioners July 13, 1993 Page 4 indicated that Lake Region Hospital had already paid the preceding seminar and that Sl,098 would, in affect, be otter Tail County's cost share portion. Liquor Licenses Motion by Lindquist, seconded Stone and unanimously carried to approve the following applications for licensee: Tom's Standard and Grocery Thomas Weinhandl Henning, MN Off-Sale Non-Intoxicating Malt Liquor License Subject to the approval of the County Attorney's office and the County Sheriff's office. District #166 Mary Ann Erickson Dent, MN On-Sale Non-Intoxicating Malt Liquor License and a Set-Up License Subject to the approval of the County Attorney's office. Strom Steakhouse Inc. Cheryl Lynn Strom Perham, MN On-Sale Intoxicating Liquor and Sunday Liquor subject to the approval of the County Attorney's office. Perham Oasis, Inc. Don Steering Perham, MN Off-Sale Non-Intoxicating Malt Liquor License Soil Survey Agreement Motion by Partmann, seconded Windels and unanimously carried to approve reimbursement to the Soil Conservation Service, in the amount of $22,552.00, for costs incurred in furnishing technical assistance in accordance with the Soil Survey Agreement for the period of Aprill, 1993 through June 30, 1993. Repurchase Resolution Motion by Windels, seconded Lindquist unanimously carried to adopt the following resolution: RESOLVED by the Board of County Commissioners of Otter Tail County, Minnesota, that WHEREAS, on July 12th, 1993, Loren Born, heir of Emma Kempf owners of record of the following described parcel: Ottertail -Way's Addn. Lots 10 and ll Block 15 Sl/2 Vac. St. N. of ll made application to repurchase said property which was forfeited to the State of Minnesota on August 13th, 1992, for nonpayment of the 1988 tax. Lee, Chairman Conditional Use Applications Motion by Lindquist, seconded Windels and unanimously carried to uphold the recommendation of the Planning Commission to approve the following Conditional Use Applications: Hobart Township, Sybil Lake Ervin J. Sand, Star Lake William L. Butler, Little Pelican Lake Sigurd J. Langdahl, Pelican Lake Berger, Inc./Charles Clifford/Sandra Kirchenwitz, Big McDonald Lake -both Faith Haven Camp, Eagle Lake Mervin & Phyllis Freeman, Dead Lake After testimony of a number of residents affected by a proposed canoe access along the otter Tail River near Diversion Dam, and representatives of Otter Tail Power company, a motion was offered by Windels, seconded Partmann and unanimously carried to table further discussion of the Conditional Use Application of otter Tail Power Company, otter Tail River, until August lO, 1993. This delay will allow time for Otter Tail Power to attempt resolution of difficulties surrounding this matter. Motion by Windels, seconded Lindquist and unanimously carried to deny the Conditional Use Application of Scott Sunrud/Clint Nelson, Big Pine Lake, as recommended by the Planning Commission. Motion by Windels, seconded Lindquist and unanimously carried to deny the Conditional Use Application and Preliminary Plat of the Estate of Marie Malikowski, "Pine Lake Shores", Little Pine Lake, as recommended by the Planning Commission. Note: For detailed information regarding any of the above listed conditional use permits, contact the Land & Resource Management Office. Payment Approved Motion by Partmann, seconded Stone and unanimously carried to approve payment to the U.S. Postmaster in the amount of $2,552.78, as requested by the Solid Waste Department's Public Information Officer, for the mailing of a solid waste recycling newsletter to be sent to otter Tail County postal patrons. This is to comply with State of Minnesota mandates regarding public education on recycling of solid waste. 0 0 Otter Tail County Board of Commissioners July 13, 1993 Page 6 Regional Treatment Center Coalition Diana Murack, Director of the Regional Treatment Center Coalition, discussed legislative issues which were regarding the RTC and the proposed Veterans' Home. She indicated that members of the Veterans• Home Task Force would be touring the Veterans' Home at Luverne, MN, on July 16, 1993. Forgiveness of Penalty & Interest Charles Watkins, representing Leander Watkins, requested forgiveness of penalty and interest which had previously been denied to his father~ After hearing details surrounding this matter from Watkins, the Board upheld their previous action of denial. City of Vergas Motion by Partmann, seconded Stone and unanimously carried to authorize the City of Vergas to administer on behalf of Otter Tail County for the following projects S.A.P. 56-604-08, S.A.P. 56-617-08 and C.P. 93:MM-4 which are within the City of Vergas. S.A.P. 56-659-09 & Etc. Motion by Stone, seconded Lindquist and unanimously carried to authorize the Chairman to execute contracts with Mark Sand & Gravel Company, Fergus Falls, MN, for Project S.A.P. 56-659-09 & Etc. as previously awarded. Bid Opening: CP 92:157 Motion by Lindquist, seconded Windels and unanimously carried to set the bid opening date and time on the Stalker/Long Lake Project CP 92:157 for 1:00 p.m. on August 17, 1993. Phelps Mill Dam Project Motion by Stone, seconded Lindquist and unanimously carried to authorize the Chairman to execute contracts on behalf of Otter Tail County with Barr Engineering with regard to the Phelps Mill Dam Project as previously awarded. Fair Hills Resort Request Dan Kaldahl of Fair Hills Resort requested a permit for golf carts to routinely cross County Road 20. The Highway Engineer was directed to further investigate the matter and make an appropriate recommendation with regard to safety, costs, etc. Property Classification Request Motion by Windels, seconded Lindquist and unanimously carried to deny the change of classification on property made by Gerald Henry as presented by the Assessor. Early Retirement Incentive for Employees Motion by Fortmann, seconded Lee and unanimously carried to offer each County employee an Early Retirement Incentive as set forth by the Minnesota Legislature which will allow employees, age 55 or older, who meet the other eligibility criteria to increase the pension formula of 1/4% for each year of service to the first thirty years (up to a maximum of 7.5 percent). There is no cost to either the employer or employee. • Otter Tail County Board of Commissioners July 13, 1993 Page 7 Otter Tail Health Supplies 0 Coordinator, Larry Krohn, announced a 15% discount on health supply items would be available to County employees through an offer made by Otter Tail Health Supplies located in Fergus Falls.
