HomeMy WebLinkAboutBoard of Commissioners - Minutes - 06/29/19930 0 Minutes of the OTTER TAIL COUNTY BOARD OF COMMISSIONERS Commi_ssioners' Room, Floor 1-B Otter Tail County Courthouse Tuesday, June 29, 1993 1:00 p.m. Call to Order The Otter Tail County Board of Commissioners convened Tuesday, June 29, 1993, at 1:00 p.m. at the Otter Tail County Courthouse with Commissioners Malcolm Lee, Chairman; Andy Lindquist, Harley Windels, Bill Stone and Virginia Fortmann present. Approval of Minutes Motion by Stone, seconded Windels and unanimously carried to approve the minutes of June 22, 1993, as submitted. Bid Opening: SP 56-667-22 Highway Engineer Rick West, having previously advertised for bids to be received for Project SP 56-667-22 opened the following bids: Mark Sand & Gravel Co. $507,972.34 Fergus Falls, MN Central Specialties Inc. $479,829.75 Long Prairie, MN Communication Engineer Agreement Motion by Partmann, seconded Lindquist and unanimously carried to enter into a contractual agreement with John DuBois, Communication Engineer, with regard to the radio system used in the Highway, Land & Resource and other departments. Further, the motion went on, to authorize the signature of the Chairman on such agreement as approved by the County Attorney. City of Clitherall, Festivities Motion by Stone, seconded Fortmann and unanimously carried to allow the City of Clitherall to hold their 5th Annual Hog Roast on August 28, 1993, along County Road 5 providing that traffic control is done by the City and meets with the Sheriff's approval. State of Minnesota -CPV Membership r.,, ._,, Motion by Stone, seconded Windels and unanimously carried to approve the request of the Highway Engineer to pay the yearly membership of $350 to the State of Minnesota's Cooperative Purchase Venture (CPV) for cooperative purchasing. 0 0 0 .. :-,. Otter Tail County Board of Commissioners June 29, 1993 Page 2 Henning Transfer Station Road Upon a motion by Stone, seconded Windels and carried with Lindquist abstaining, for the County to participate at a 50% shared cost relating to temporary duet control measures along the Henning Transfer Station Road for a one year period, after which time the matter would be subject to re-evaluation. This cost share is in lieu of a township fee on the solid waste delivered to the transfer station. The County had previously approved a 42% shared cost based on a traffic study of County usage on the affected road. Bid Award: SP 56-667-22 Upon motion by Windels, seconded by Stone and unanimously carried , the following resolution was adopted: WHEREAS, Larry Krohn, the duly qualified and acting County Board Clerk of the County of Otter Tail, and State of Minnesota, do hereby certify that at a regular meeting of the County Board of Commissioners of Otter Tail County held on the 29th day of June, 1993, the following named contractors, Central Specialties, Inc. and Mark sand & Gravel Co. submitted bids for the furnishing of all labor, tools, materials, and equipment necessary for the construction of the work provided for under plans and specifications for that improvement on County State Aid Highway No. 67; and WHEREAS, County State Aid Highway No. 67 is otherwise known as S.P. No. 56-667-22, Fed. No. RS 6479(007) MRP 6479(007), located from 0.038 miles north of County State Aid Highway 58, 2 miles north of New York Mills, to the south junction of County State Aid Highway 8 being approximately 5.454 miles in length; and WHEREAS, the bid of Central Specialties Inc. in the amount of $479,829.75 appeared to be the lowest bid received, subject to final audit. NOW, THEREFORE, be it resolved, it was voted by the Otter Tail County Board of Commissioners to recommend to the Commissioner of Transportation, as Agent for said County, that: said contract be awarded to the lowest responsible bidder, Central Specialties Inc. in the amount of $479,829.75. Charles and Brenda Minge Frazee, MN On/Off Sale Non-Intoxicating Malt Liquor Set-up Licenses Forgiveness of Penalty & Interest Jason and Jamesina Campbell requested forgiveness of penalty and interest with regard to some property owned by them in Urbank. Commissioner Stone was directed to personally view the property, meet with the Auditor, and make a recommendation at the next Board meeting. Northeast Landfill Engineering Consultant Contract Representatives of Foth & Van Dyke made a presentation regarding their engineering and construction services regarding the Northeast Landfill Motion by Stone, seconded Partmann and unanimously carried to offer the engineering consultant contract for the Northeast Landfill construction to Foth & Van Dyke at a projected coat of $198,500 as recommended by the Solid Waste Director. This amount represents the lowest proposal offered. 0 Q Otter Tail County Board of Commissioners June 29, 1993 Page 4 Comprehensive Water Plan Members of both East and West Otter Tail County Soil and Water Conservation Districts met to discuss the Comprehensive Water Plan. John Blashack, Chairman of EOT SWCD, led the discussion. Bill Kalar, Land & Resources Director, outlined numerous areas that the County has addressed relative to the water plan such as the Shoreland Ordinance and the Wetland Conservation Act, etc. Kalar went on to report favorable findings of eleven area lake water samples. A lengthy discussion was held about whether the County could qualify for State grant monies by using some of the costs now being incurred by the County to match State funds. Commissioner Lindquist pointed out that many of the proposed in-kind services now being done by the County are used to match other grant areas, and cannot be used twice. Board of Equalization At 3:20, Chairman Lee declared a recess of the Board of Commissioners' regular meeting to convene as the Board of Equalization for the purpose of discussing matters relative to the Board of Equalization and the Assessor, Bob Moe. At 4:55 p.m. the Board of Commissioners reconvened. Ditch 21 The County Attorney reported a petition of landowners along Ditch 21 has been received regarding a request for repairs to the ditch. The Auditor's office is in the process of validating names/signatures of petitioners and preparations for a public hearing is underway. Public Defender Contract The County Attorney indicated a tentative meeting has been scheduled for 3:30 p.m. on July 21, 1993, for the purpose of discussing Public Defender Contract(s) with the Judges has been set for Board members. Chairman Lee appointed Commissioner Windels to negotiate with the Judges on the Public Defender Contract Agreement(s). Adjournment Closed to Public At 5:25 p.m., Chairman Lee declared the meeting adjourned and closed to the public citing Attorney-Client Privelege regarding the worker's compensation claim of Marvin Becker. Attorney-Client Privilege is authorized by M.S. 471.705, Subd. ld. The next meeting of the Otter Tail County Board of Commissioners is scheduled for a9;30 a.m. on Tuesday, July 6, 1993.
