Call to Order
The Otter Tail County Board of Commissioners convened Tuesday, June 22, 1993, at
9:30 a.m. at the Otter Tail County Courthouse with Commissioners Malcolm Lee, Chairman;
Andy Lindquist, Harley Windels, Bill stone and Virginia Partmann present.
Approval of Minutes
Motion by Lindquist, seconded Windels and unanimously carried to approve the minutes of
June 8, 1993, as submitted.
Northeast Landfill Construction Contract
Mike Hanan, Solid Waste Director, discussed construction contract proposals of
R, W, Beck and Foth & VanDyke, engineering consultants. Each firm made an initial
proposal for construction at the Northeast Landfill. There was some question on what
would be required by the Pollution Control Agency (PCA) in the number of tests
necessary. The initial quotations were:

Northeast Landfill: Damaged Tank
Waste Director discussed the damaged leachate storage tank at the Northeast
Repair and/or replacement of the damaged tank as well as what procedures to
recouping damages were discussed. It was the concensus of the Board that the

Roland Sauck, Ditch Inspector, discussed the high water condition and problem with
Ditch 23 between Dead Lake and Star Lake Townships. The Ag Inspector was to contact
both townships regarding a specific culvert issue.
Recycling Newsletter
Motion by Lindquist, seconded Partmann and unanimously carried to approve, with slight
modification, a solid waste recycling newsletter to be sent to Otter Tail County postal
patrons to comply with State of Minnesota mandates regarding public education on
recycling of solid waste.
Pesticide Container Collection
Motion by Portrnann, seconded Lindquist and unanimously carried to authorize Marie Tysdal
to purchase box lunches for individuals working at the pesticide collection site~ during
the collection hours on June 24 and 25, 1993.

Classifications
Motion by Windels, seconded Stone and unanimously carried to approve the recommendations
of the Classification Committee for a Clerk I, Court services Department, Range 10
and a Safety/Emergency Services Director, Range 16.
Adjournment
At 10:55 a.m. Chairman Lee adjourned the regular Board of Commissioners' meeting to
reconvene as Human Services Board under Human Services Board Chairman Windels.
Board Reconvenes
At 10:58 a.m. Chairman Lee reconvened the meeting of the Board of County Commissioners.
Ditch 21
Roland Sauck, Ditch Inspector, discussed the high water condition and problem with
Ditch 21. A number of residents along the ditch expressed concern over the high water
and the threat to personal property along the ditch. The procedure for ditch
cleaning/repair was outlined. Residents were asked to petition the Board for
cleaning/repair and the Ditch Inspector was to seek cost estimates to deal with the
problem.
Exemption from Lawful Gambling License
An Application for Authorization for Exemption from Lawful Gambling License was received
from the St. James Church at Maine for an activity on July 18, 1993. The Board
expressed no interest in prohibiting the application.

Motion by Lindquist, seconded Partmann and unanimously carried to approve the
Final Plat of Hanson's Addition of Beverly Beach as presented by the Land & Resource
Director, Bill Kalar.
Resolution Authorizing Application For
MHFA Rehabilitation Loan Program Funds
Motion by Lindquist, seconded Partmann and unanimously carried to offer the following
resolution to authorize application for MHFA rehabilitation loan program funds:
WHEREAS, the Minnesota Housing Finance Agency, State of Minnesota, has been authorized
to undertake a program to provide loans to property owners for the purpose of housing
rehabilitation; and
WHEREAS, Fergus Falls Housing & Redevelopment Authority has developed an application as
an Administering Entity for the Minnesota Housing Finance Agency Rehabilitation Loan
Programs; and
WHEREAS, Fergus Falls Housing & Redevelopment Authority has demonstrated the ability to
perform the required activities of the Minnesota Housing Finance Agency Rehabilitation
Loan programs;
NOW, THEREFORE, be it resolved, that Fergus Falls Housing & Redevelopment Authority is
hereby authorized as an entity to be charged with the administration of funds made
available through the Minnesota Housing Finance Agency Rehabilitation Loan Programs, in
the county of Otter Tail.

OTCDF Food Service contract
Motion by Windels, seconded Stone and unanimously carried to authorize the Chairman to
sign a renewal of the food service contract with Best, Inc. for July 1, 1993, through
June 30, 1994 subject to approval of the County Attorney.
Motion by Partmann, seconded Stone and unanimously carried to direct the Detention
Facility Administrator to return to the Board by February 1, 1994, with bid
specifications before the next contract year.
R. w. Becki Northeast Landfill construction Documentation Proposal
Fred Doran and others representing R. w. Beck's proposal regarding engineering and
construction at the Northeast Landfill, made a presentation outlining their proposal.
Mike Hanan, Solid Waste Director, provided an update on the proposal of Foth & VanDyke
which adjusted their initial proposal from $228,722 to $207,766. Since Foth & VanDyke
were given an opportunity to change their proposal, citing variance in testing and etc.,
the R. w. Beck firm was offered the same opportunity. The R. W. Beck firm will return
with any amendments at the next Board meeting.
Phelps Mill Dam Repair Project
Motion by Lindquist, seconded Stone and unanimously carried to award the Phelps Mill Dam
Repair Project to the lowest bidder as recommended by the Highway Engineer. The lowest
bidder was Sarbarosa and Sons, Inc. of Osseo, MN, in the amount of $295,790.

Motion by Partmann, seconded Lindquist and unanimously carried to award the
S.A.P. 56-659-09 & Etc. Project to the lowest bidder as recommended by the Highway
Engineer. The lowest bidder was Mark Sand & Gravel Co., Fergus Falls, MN, in the amount
of $751,468.62.
Bid Opening Set
Motion by Lindquist, seconded Windels and unanimously carried to authorize the Highway
Engineer to proceed with bid opening of S.A.P. 56-633-07 for 1:00 p.m. on July 27, 1993.
Motion by Windels, seconded Stone and unanimously carried to authorize the Highway
Engineer to proceed with bid opening of Tractor/Loader/Mower for 1:00 p.m. on
July 27, 1993.
CSAH 15 Right-of-Way
Motion by Lindquist, seconded Partmann and unanimously carried to approve Right-of-Way
payments amounting to $6,385.53 to landowners along CSAH 15.
Highway Department: Final Payments
Motion by Windels, seconded Fortmann and unanimously carried to authorize the final
payment of $14,672.01 on S.A.P. 56-648-05 & Etc. payable to Mark Sand & Gravel co.,
Fergus Falls, MN.
Motion by Partmann, seconded Stone and unanimously carried to authorize the final
payment of 20,171.25 for Highway Signing Materials payable to M-R Sign Co., Inc.,

Highway Department: contracts
Motion by Lindquist, seconded Windels and unanimously carried to authorize the Chairman
to sign contracts with Mark Sand & Gravel Co., Fergus Falls, MN, as previously awarded
on Project S.A.P. 56-618-07 & Etc.
Motion by Lindquist, seconded Windels and unanimously carried to authorize the Chairman
to sign contracts with Mark Sand & Gravel Co., Fergus Falls, MN, as previously awarded
on Project S.A.P. 56-615-13 & Etc.
Motion by Stone, seconded Partmann and unanimously carried to authorize the Chairman to
sign contracts with Wadena Asphalt, Inc., Wadena, MN, as previously awarded on

Storage Tank Removal
Motion by Stone, seconded Windels and unanimously carried to authorize the Highway
Engineer to proceed with the engineering firm of Widseth, Smith, Nolting (WSN) with
regard to storage tank removal in Parkers Prairie.
Parade
Motion by Stone, seconded Partmann and unanimously carried to approve a detour of
traffic along County Road 67 in the City of Henning for the Henning Harvest Festival
Parade on July 16, 1993, pending final approval of the Sheriff.
Approval to Pay Bills
Motion by Stone, seconded Partmann and unanimously carried to approve the payment of
bills per Attachment A of these minutes.
Motion by Windels, seconded Lindquist and unanimously carried to approve payment of
$1,050 to the City of Perham for cleaning services at the Otter Tail County office
building located in Perham.
U.S. Fish & Wildlife Tax Payment Shortfalls
Motion by Lindqquist, seconded Stone and unanimously carried to send a letter to the
Association of Minnesota Counties and State legislators, concerning tax payment
shortfalls from lands already owned by the u.s. Fish and Wildlife. This letter requests
legislative action at the national level to permanently correct the problem.
Personnel Board Recommendation
Motion by Lindquist, seconded Portmann and unanimously carried to uphold the
recommendation of the Personnel Board with regard to step increases for some part-time
employees in the Solid Waste Department. Increases are retroactive to March l, 1993.
Payment Authorized
Motion reluctantly by Lindquist, seconded Windels and unanimously carried to authorize
payment in the amount of $11,473.80 as settlement of two Department of Labor and
Industry complaints filed as the result of citations issued in the summer of 1992
following an OSHA inspection.
Lake Development
Motion by Windels, seconded Portrnann and unanimously carried to further study over-
crowding potential and shoreline development of area lakes.

Motion by Lindquist, seconded Windels and unanimously carried to authorize the
Coordinator to proceed with the hire of a Safety/Emergency Services Director to comply
with the OSHA settlement agreement.
Adjournment
Closed to Public
At 3:50 p.m., Chairman Lee declared the meeting adjourned and closed to the public for
purposes of discussing labor negotiation strategies with the county's four collective
bargaining units and to discuss possible litigation with regard to the worker's
compensation claim of Marvin Becker as authorized by the Attorney-Client Privilege as
cited in 471.705 Subd 1 d. In addition, the meeting was closed for the purpose of
individual performance evaluations subject to its authority pursuant to M.S. 471.705,
Subd. ld.(d). The performances evaluated were Tom Fawcett, Social Services Director,
and Rick Sytsma, Building Maintenance Supervisor. A summary report of performance
conclusions will be provided at the next regular Board meeting. The next Board meeting
is scheduled for 1:00 p.m. on June 29, 1993.
