Approval of Minutes Motion by Lindquist, seconded Stone and unanimously carried to approve the minutes of June 1, 1993, as submitted. Bid Openings The Highway Engineer, having previously advertised for bids opened the following bids: Project SAP 56-659 09 & Etc. -Bituminous Overlay: Mark Sand & Gravel Co. Fergus Falls, MN Starry Construction Co., Inc. Long Prairie, MN Phelps Mill Darn Repair: Atlas Foundation Company Rogers, MN Barbarossa and Sons, Inc. Osseo, MN Industrial Builders, Inc. Fargo, ND Progressive Contractors Inc. Osseo, MN $760,497.62 $881. 697. 47 $413,344.70 $295,790.00 $389,252.00 $332,039.00 Rick West, Highway Engineer, will make a recommendation at the June 22, 1993, Board meeting. Two-Way Radio Communications System Modernization John DuBois, Professional Communications Engineer and Consultant, proposed an upgrade of Highway Department radio system. The proposed project involves a new frequency and equipment for the department as well as allow communication for emergency use. Motion by Lindquist, seconded Windels and unanimously carried to retain DeBois to provide engineering services, to include administrative frequency for a cost not to exceed $9,300. The total projected implementation cost is projected to be $142,000. current budgets are $130,000 with approximately $15,000 from the 1994 budget. 0 Q -' Otter Tail County Board of Commissioners June 8, 1993 Page 2 Bid Award Motion by Windels, seconded Lindquist and unanimously carried to award the bid of Project SAP 56-615-13 & Etc, to the lowest bidder, Mark Sand & Gravel co., Fergus Falls, MN, in the amount of $445,898.97. Motion by Lindquist, seconded Stone and unanimously carried to award the bid of Project SAP 56-618-07 & Etc.to the lowest bidder, Mark Sand & Gravel Co., Fergus Falls, MN, in the amount of $548,557.57. Perham Turtle Fest Motion by Windels, seconded Lindquist and unanimously carried to authorize the close of CSAH 80 and 8, Perham, for June 27, 1993, for parade purposes in connection with the Perham Turtle Fest. Seasonal Supply of Hot Mix Bituminous -West Otter Tail Motion by Stone, seconded Lindquist and unanimously carried to award the bid of Seasonal Supply of Hot Mix Bituminous -West Otter Tail to Mark Sand & Gravel Co., of Fergus Falls, MN, in the amount of $16,400. Tractor/Loader/Mower The Highway Engineer was directed to proceed with development of bid specifications on a tractor/loader/mower and to establish a bid date on same. July 4th Parade Motion by Lindquist, seconded Stone and unanimously carried to tentatively approve, a July 4th parade requested by Pat Garza on CSAH 72 from the nursing home to the bridge along Otter Tail Lake, subject to final approval of the Sheriff, Conditional Use Applications Motion by Windels, seconded Lindquist and unanimously carried to uphold the decision of the Planning Commission to deny the Conditional Use Application of Brenda Minge, Rose Lake, citing the applicant failed to appear. Motion by Lindquist, seconded Windels and unanimously carried to uphold the decision of the Planning Commission to approve the following Conditional Use Applications: Otter Tail County Highway Department, Ten Mile Lake Mark Bergerud, Dayton Hollow Reservoir Carmon D. Jackson, Hoot Lake Barron Todd Johnson et al, Pelican Lake Richard Wayne Sturlaugson, Pelican Lake Michael Conroy, Pickerel Lake Motion by Lindquist, seconded Windels and unanimously carried to table approval of the Conditional Use Application of Charles P. Christopherson, otter Tail Lake, pending further on-site inspection. Motion by Lee, seconded Lindquist and unanimously carried to approve, as recommended by the Planning Commission, the Conditional Use Application of LuRae Louise Melaas, Jewett Lake, with an added condition that the floral consulting service be limited to not more than four business visits per month. 0 ; Otter Tail County Board of Commissioners June B, 1993 Page 3 Motion by Lindquist, seconded Windels and unanimously carried to approve, as recommended by the Planning Commission, the Conditional Use Application of Myron J. Gunderson, Long Lake, with an added condition to include a catch basin to retain run-off at the top of slope to be cut. Note: For detailed information regarding any of the above listed conditional use permits, contact the Land & Resource Management Office. Sewage Disposal Installers License Motion by Lindquist, seconded Windels and unanimously carried to approve the Application for Sewage Disposal Installers License of Jerdee Bridge Company, Edison v. D. Jerdee, Lake Park, MN. Pesticide Regulations Motion by Lee, seconded Lindquist and unanimously carried to decline involvement with pesticide regulations. Wetland Rules John Jasky, Wetland Management Specialist from the Board of Water & Soil Resources, indicated that final wetland rules should be delivered to the Land & Resource Office before July 1, 1993, The final rule must become part of local controls by January 1, 1994. Until the rule is adopted, the interim rules will remain in effect. Western MN Farm Resource Center Bruce Lubitz, Executive Director of Western Minnesota Farm Resource Center, provided information regarding the Center and requested funding from otter Tail County. No action was taken by the Board. Premises Permit Application Motion by Windels, seconded Lindquist and unanimously carried to adopt the following resolution: WHEREAS, the responsibility for the regulation of lawful gambling and the issuance of licenses and permits for the conduct of lawful gambling lies with the Minnesota Gambling Control Board; and WHEREAS, the Perham Lion's Club have made application to the Gambling Control Board for a premise permit to conduct lawful gambling at the Hamburger Hallow in Pine Lake Township of Otter Tail County; and WHEREAS, Minnesota Statutes 349.213 provides that the Gambling Control Board may not issue a premise permit unless they receive a resolution from the County Board approving the permit; and WHEREAS, the Otter Tail County Board of Commissioners is aware of no reason to oppose the conduct of lawful gambling by the Perham Lion's Club at the Hamburger Hallow in Pine Lake Township of Otter Tail County; and NOW, THEREFORE, IT IS HEREBY RESOLVED, that the Otter Tail County Board of Commissioners hereby approves the conduct of lawful gambling by the Perham Lion's Club at the Hamburger Hallow in Pine Lake Township of Otter Tail County, provided that the applicant meets all the necessary criteria for the licenses and permits required by the Gambling Control Board. 0 0 otter Taii County Board of CommissiOners June 8, 1993 Page 4 IT IS FURTHER RESOLVED, that notice of this application and approval shall be provided to the Town Board of Pine Lake Township by sending them a copy of this resolution. Lee, Chairman Exemption from Lawful Gambling License No action was taken by the Board to prohibit the Application for Authorization for Exemption from Lawful Gambling License by the Fergus Falls Chapter of Ducks Unlimited for an activity taking place August 25, 1993. No action was taken by the Board to prohibit the Application for Authorization for Exemption from Lawful Gambling License by the Pelican Rapids Ladyelippere Ducks Unlimited for an activity taking place August 16, 1993. Abatements Motion by Lindquist, seconded Windels and unanimously carried to approve the following applications for abatement: Elizabeth Township: Darlene E. Berge Jimmy Selvin 22-300-50-0227-000 Abate on the 1993 tax rolls as an omitted personal property mobile home. Woodside Township: David and Nancy Swarts 62-000-13-0109-000 Abate to calculate this parcel as a cross county homestead. The applicant's primary homestead is in Todd County and he has a total of 237.94 acres with a total valuation of $80,900. Pelican Hills Park, Inc John Morgan Pelican Rapids, MN Off-Sale Non-Intoxicating Malt Liquor License Abatement Denied After additional review, the Auditor discussed with the Board a request by Leander L. Watkins for abatement of accrued penalties and interest on past due taxes amounting to $1,842.32. The Board supported the Auditor's recommendation for denial and Stein was requested to notify Watkins. Soil Survey Information The Auditor provided information to Board members on the Soil Survey. He indicated that on June 7, 1985, a resolution was adopted that established the total cost to otter Tail County at $615,000, Payments were to begin in April of 1987 with the final payment in April of 1993. As of June 8, 1993, Otter Tail County has paid $491,779.42. Payment Approved Motion by Lindquist, seconded Windels and unanimously carried to approve payment in the amount of $322 per MN Statute 609.35, to the Fergus Falls Medical Group and stems from a criminal investigation. Request for Additional Staff The Auditor requested a position authorization for an additional clerical staff person. Position proposed would include approximately 60% of individual's .time be spent working in the Motor Vehicle area; approximately 30% of time in Game & Fish; and the remainder of time in the Auditor's office. The matter was tabled until the Auditor prepares a job description of the proposed position. Waste Pesticide Container Collection Marie Tysdal, Public Information Officer in the Solid Waste Department, provided details of the upcoming Waste Pesticide Container Collection scheduled for June 24, 1993, in Fergus Falls and New York Mills and June 25, 1993, in Pelican Rapids and Henning. Bid Opening Motion by Windels, seconded stone and unanimously carried to authorize the Highway Engineer to set the bid opening for Surfacing Projects in Scambler, Hobart and Edna Townships for 1:00 p.m, on July 6, 1993. 0 0 citter Tail County Board of Commissioners June 8, 1993 Page 8 Safety Emergency Services D~rector Motion by Lindquist, seconded Windels and unanimously carried to proceed with the hiring procedure for a full time Safety/Emergency Services Director. Position would require cert'~fication for emergency services.
