Call to Order
The Otter Tail County Board of Commissioners convened Tuesday, May 11, 1993, at
1:00 p.m. at the Otter Tail County Courthouse with Commissioners Malcolm Lee, Chairman;
Andy Lindquist, Harley Windels, Bill Stone and Virginia Partmann present.
Approval of Minutes
Motion by Lindquist, seconded Windels and unanimously carried to approve the minutes of
May 4, 1993, as submitted.
'93 Yearly Bid Award for Bituminous Materials, Hot Mix Bituminous,
culverts, Herbicides, Snow Removal Equipment, Dump Box, Etc. and Mowing
The Highway Engineer, having previously advertised for bids, made the following
recommendations for bid award:

Motion by Stone, seconded Partmann and unanimously carried to award the Seasonal Supply

Motion by Stone, seconded Fortmann and unanimously carried to grant permission of the
Henning Public School to hold a bike-a-then along a stretch of County Road 16 on
May 22, 1993, pending approval of the Sheriff and contingent upon the conditions that
Otter Tail County is not liable for accidents related to such event.
'93 Hazardous Waste License Fee
Motion by Lindquist, seconded Windels and unanimously carried to authorize the payment
of $94.24 to the Minnesota Pollution Control Agency (MPCA) for the hazardous waste
license fee for 1993.
Preliminary Design: Project 93:0SP
Motion by Windels, seconded Lindquist and unanimously carried to authorize the Highway
Engineer to enter into an agreement with Larson-Peterson & Associates, Detroit Lakes,
MN, in the amount of $8,950 for preliminary design on Project 93:0SP.
Conditional Use Applications
0 Motion by Partmann, seconded Stone and unanimously carried to uphold the recommendation
of the Planning Commission to approve the following Conditional Use Applications subject

Motion by Lindquist, seconded Windels and carried, with Stone opposed, to refer the
Conditional Use Application of Rand V. Araskog, "West Point Shores", Otter Tail Lake,
back to the Planning Commission for more information with notification sent to affected
property owners.
Wetlands Training
Motion by Lindquist, seconded Partmann and unanimously carried to approve sending two
County employees to a wetlands identification seminar in Brainerd, MN, at a cost of $190
per individual. Staff members who will be attending are from the Land & Resource and
Highway Departments.

Closed to Public
At 3:30 p.m., Chairman Lee declared the meeting adjourned and closed to the public for
purposes of discussing litigation per the Attorney-Client Privilege as authorized in
471.705, Subd. ld. Litigation matters cited were with regard to Dale Pierce and
Scambler Township Demolition Site vs. Otter Tail County; Otter Tail County vs parties
involved with the justice facility floor deterioration problem; and the matter with the
Department of Labor & Industry, relating to safety regulations, specifically OSHA.
