Call to Order
The otter Tail County Soard of Commissioners convened Tuesday, April 20, 1993, at
9:30 a.m. at the Otter Tail County Courthouse with Commissioners Malcolm Lee, Chairman;
Andy Lindquist, Harley Windels, Bill Stone, and Virginia Partmann present.
Approval of Minutes
Motion by Windels, seconded by Lindquist and unanimously carried to approve the minutes
of April 13, 1993, with an addition to page 3, section entitled "Shoreland Management
Ordinance Amendments" to include in summary form, provisions of the amendments which:
1. Allow development of non-residential back lots of reduced size;
2. Clarify height restrictions for water orientated accessory structures;
3. Require permits for all grade and fill activities in shore impact zones;
4. Clarify and increase requirements for cluster developments by reducing density;
0 5. Provide exemptions from the restriction on transfer of contiguous substandard
lots in common ownership; and
6. Clarify the procedures for Planning Commission review of Conditional Use
Applications.
A copy of the current Shoreland Management Ordinance with the amendments is on file in
the office of the County Auditor and the office of Land & Resource Management in the
Courthouse in Fergus Falls, Minnesota.

Public Health Abatement
Auditor, Wayne Stein, presented a request from Adrian Klimek to levy hie special public
health assessment over a five year period. The original amount of the assessment was
$1,031.80 plus interest of $82.54 for a total of $1,114.34. The interest rate was set
at 8%. After some discussion, the Board delayed a decision and requested Commissioner
Stone to report back on this matter at the next regular Board meeting.
Lawful Gambling Resolution
Upon a motion by Lindquist, seconded by Partmann and unanimously carried the Otter Tail
County Board of Commissioners adopted the following resolution:
Whereas, the responsibility for the regulation of lawful gambling and the issuance of
licenses and permits for the conduct of lawful gambling lies with the Minnesota Gambling
Control Board; and
Whereas, Lake Country Sportsmen's Club of Otter Tail County has made application to the
Gambling Control board for a premises permit to conduct lawful gambling at the
Riverfront Lounge in Sverdrup Township of Otter Tail County; and
Whereas, Minnesota Statutes 349.213 provides that the Gambling Control Board may not
issue a premise permit unless they receive a resolution from the County Board approving
the permit; and
Whereas, the Otter Tail County Board is aware of no reason to oppose the conduct of
lawful gambling by the Lake Country Sportsmen's Club of Otter Tail County at the
Riverfront Lounge: and
Now, Therefore, It Is Hereby Resolved, that the Otter Tail County Board of Commissioners
hereby approves the conduct of lawful gambling by the Lake Country Sportsmen's Club of
Otter Tail County at the Riverfront Lounge in Sverdrup Township of Otter Tail County,
provided that the applicant meets all the necessary criteria for the licenses and
permits required by the Gambling Control Board.
It Is Further Resolved, that notice of this application and approval shall be provided
to the Town Board of Sverdrup Township by sending them a copy of this resolution.

Motion by Stone, seconded by Windels and unanimously carried to accept the Land
Surveyor's Certificate of Correction to Plat prepared by David A. Anderson, Registered
Land Surveyor under the laws of the State of Minnesota, Registration No. 13620.
Pursuant to the provision of Chapter 505.175, Laws of Minnesota, 1957, David A.
Anderson, Registration No. 13620, the undersigned, a Registered Land Surveyor in and for

required by MnDOT to continue reconstruction from County Road 10 to County Road 22 with
the Schmidt's Bridge Replacement Project and to authorize Braun Intertec to do the soil
boring and analysis in this area at an estimated cost of $7,150.
New York Mills Folk Festival
Motion by Windels, seconded by Lindquist and unanimously carried to approve a detouring
of CSAH 67 and CSAH 84 for a folk festival August 22, 1993, subject to approval of the
Sheriff's Department.
Clarification
Motion by Lindquist, seconded by Windels and unanimously carried to authorize the
Highway Engineer to clarify the status of two Highway Department employees as regular
employees under the personnel policy.
Dust Control
0 Commissioner Lindquist provided information regarding a liquid by-product of soybean oil
processing being used on pilot projects as a dust control agent.

Wally Senyk, County Attorney, read for the record, a letter declining support of
West Central Minnesota Initiative Fund's proposed resolution of Intermodal Surface
Transportation Efficiency Act (ISTEA) planning by a Joint Powers Board.
Conditional Use Permit
Motion by Lindquist, seconded Windels and unanimously carried to approve the application
for conditional use permit of Dale Stein, Stalker Lake, as recommended by the Planning
Commission.
Lida Township Request
Motion by stone, seconded Partmann and unanimously carried to deny the request of Lida
Township to exempt townships from conditional use permit requirements when an existing
road is going to be improved as the otter Tail County Board of Commissioners does not
have the authority to take such action because of MN State Statutes. The County
Attorney was directed to draft a letter to notify Lida Township of their decision.
County Veterans Service Conference
Motion by Fortmann, seconded by Stone and unanimously carried to approve the Veterans
Service Office staff to attend the County Veterans Service Conference to be held
April 28-30, 1993, with a recommendation that either a volunteer be recruited to take
calls in that office or the center desk receptionist take calls with a phone number
provided in case of an emergency.

BCBS Service Agreement
Motion by Stone, seconded by Lindquist and unanimously carried to authorize the County
Coordinator to execute the Blue Cross and Blue Shield of Minnesota Servicing Plan
Agreement for Otter Tail County's health insurance for '93.
Correspondence
The Chairman acknowledged receipt of a letter from the owners of the Balmoral Golf
Course noting their municipal golf course competitors exemption from property tax.
Assessor, Bob Moe, discussed the matter at length with the Board. The Board directed
the Assessor to draft a letter on behalf of the Chairman referring the situation to
state legislators.
Minnesota Counties Insurance Trust Report
Kim Chapman, Meadowbrook Insurance Group, provided two handbooks from MCIT with an
overview of the highlights of Otter Tail County's insurance program.
Approval of Bills
Motion by Stone, seconded Portmann and unanimously carried to approve payment of bills
per Attachment A of these minutes.
Long Range Planning Task Force Report
Virginia Portmann presented the final report of the goals/recommendations of the Long
Range Planning Task Force.
Adjournment
Closed to the Public
At 2:05 p.m. Chairman Lee declared the meeting adjourned and closed to the public for
the purpose of evaluating the performance of Larry Krohn, County Coordinator, and
Roland Sauck, Ag and Weed Inspector, subject to its authority pursuant to M,S. 471.705,
Subd. ld (d). A summary report of conclusions regarding the evaluations will be
provided at the next regular Board meeting. The next scheduled meeting for the
Otter Tail County Board of Commissioners is 1:00 p.m. on Tuesday, April 27, 1993.
