HomeMy WebLinkAboutBoard of Commissioners - Minutes - 04/06/19930 Minutes of the OTTER TAIL COUllTY BOARD OF COMMISSIONERS Commissioners' Room, Floor 1-B Otter Tail County Courthouse Tuesday, April 6, 1993 9:30 a.m. Call to Order The Otter Tail county Board of commissioners convened Tuesday, March 6, 1993, at 9:35 a.m. at the otter Tail County Courthouse with Commissioners Malcolm Lee, Chairman; Andy Lindquist, Harley Windels, Bill stone, and Virginia Portmann present. Approval of Minutes Motion by Portmann, seconded by Stone and unanimously carried to approve the minutes of March 23, 1993, as submitted. Resolution of Support for Veterans Home RTC Coalition Director, Diana Murack, State of MN DAV Commander, Stanley Morrill, along with a large group of public supporters requested support for a bill establishing a veterans home in Fergus Falls, S.F. No. 555, H.F. No. 794. After discussion, motion by Lindquist, seconded by Portmann, and unanimously carried to approve the following resolution in support of federal funding for a sixty (60) bed veterans nursing home in Fergus Falls: WHEREAS, the State of Minnesota should assist its veterans of the armed service who dutifully served their country, and WHEREAS, the number of veterans in the State of Minnesota who are in need of more medical and nursing care because of their advancing years is rapidly increasing, and WHEREAS, the veterans of northwestern Minnesota deserve a nursing home that will be close to their families and friends, and WHEREAS, Fergus Falls is the population center of the veterans living in northwestern Minnesota and the county seat of otter Tail County which has over 6400 veterans, and WHEREAS, nursing homes are full and have waiting lists in order to become a resident, NOW THEREFORE BE IT RESOLVED, by otter Tail County to support legislation to fund a 60- bed veterans nursing home in Fergus Falls. Gambling Licenses Motion by Stone, seconded by Windels and unanimously carried to waive the required waiting period for the following applications for Exemption from Lawful Gambling License that have been submitted to Otter Tail County. St. Lawrence Catholic Church Ducks Unlimited, Pelican Rapids Chapter Duck Unlimited Maidens of the Prairie Date of Activity: Date of Activity: Date of Activity: Hauler Application June 13, 1993 April 22, 1993 April 27, 1993 Solid Waste Director, Mike Hanan, presented a late Solid Waste Haulers Application for approval. Motion by Windels, seconded by Stone and unanimously carried to deny the license application and refer the matter to the County Attorney. 0 Otter Tail County Board of Commissioners April 6, 1993 Page 3 Cleaners/Installers License Applications Motion by Partmann, seconded Lindquist and unanimously carried to approve the following applications for sewage disposal system cleaners and installers: Cleaners Ketter's Septic Service Koep's Septic Service Sewer Service, Inc. Installers Brad Botner Excavating Gene Payne Construction Joe's Backhoe Service Lloyd's Excavating & Concrete Peter Paul Excavating DNR Sboreland Funding Land & Resource Administrator, Bill Kalar, presented a letter from the Minnesota DNR in response to Otter Tail county's request for payment towards Shoreland Ordinance administration. Proposed Pomme-de-Terre Watershed District Land & Resource Administrator, Bill Kalar, informed the Board of a proposal to provide for the creation of the Pomme-de-Terre Watershed District. Bill Kalar and Commissioner Lindquist will attend a meeting April 12, 1993, at 1:30 p.m. in Morris regarding this matter. Approval of Bills Motion by Stone, seconded by Partmann and unanimously carried to approve payment of bills per Attachment A of these minutes. Committee Appointment Motion by Windels, seconded by Stone and unanimously carried to appoint Alfred Meyer, Henning, MN, as the East Otter Tail County Representative on the Noxious Weed Appeal Committee. Soil Conservation Service Amendment Motion by Lindquist, seconded Windels and unanimously carried to approve an amendment to to include a nondiscrimination statement in the agreement dated September 6, 1985, between Otter Tail County, the Minnesota Agricultural Extension Station, the East and West Otter Tail Soil and Water Conservation District, and the Soil Conservation Service. Minnesota State cooperative Purchase Venture Motion by Partmann, seconded by Stone and unanimously carried to approve an agreement to authorize purchases through the Minnesota Federal Surplus Property Distribution Center. Budget Proposal Resolution Motion by Partmann, seconded Windels and unanimously carried to approve the following resolution: .WHEREAS, the State of Minnesota has mandated many programs for counties to implement, some with funding and some without, and Q Otter Tail County Board of Commiaaioriers April 6, 1993 Page 4 WHEREAS, the State of Minnesota baa mandated pay equity on local units of government, and WHEREAS, the State of Minnesota baa reduced HACA funds to counties in 1990 and 1991, and in 1992 implemented a 6.5% sales tax on local units of government, all in an attempt to balance the state budget, and WHEREAS, the proposed budget for the State of Minnesota continues to increase while decreasing the funding available to counties to carry out their mandated responsibilities, NOW, THEREFORE, BE IT RESOLVED, that the Otter Tail County Board of Commissioners oppose the budget proposals to reduce criminal justice aid to counties, "freeze" the salaries of local government employees, and other methods of balancing the State of Minnesota budget on the backs of local units of government. Lee, Chairman Fish & Wildlife Service Payment Don Kleven, FWS, presented a shared revenue payment to the Board of $3,066 to make up for a portion of the shortfall of funding created by the FWS purchase of the John Seither tract last January. Bid Awards The Highway Engineer, having previously advertised for bids, made the following recommendations for bid awards: Four (4) Diesel Heavy Duty Tandem Axle Snowplowing Dump Trucks1 Fargo Freightliner Fargo, ND New Units $232,160 Trade-Ins $33,500 $198,660 Motion by Lindquist, seconded by Partmann and unanimously carried to award the Four Diesel Heavy Duty Tandem Axle Snowplowing Dump Trucks to Fargo Freightliner, the lowest bidder, as listed above. One (ll New or Late Model Used 135 HP Wheel Loader: North Country Equipment Grand Rapids, MN New Unit $104,833 John Deere, 624G Trade-In $14,500 Total {includes sales tax\ $96,204.65 ' Otter Tail County Board of Commissioners April 6, 1993 Page 5 Motion by Windels, seconded by Stone and unanimously carried to award One New or Late Model Used 135 HP Wheel Loader to North Country Equipment, the lowest bidder, as listed above. Double Boiler Asphalt Melter Applicator. Bot Air Lance and Pavement Cutter, Motion by Partmann, seconded by Lindquist and unanimously carried to award the Double Boiler Asphalt Melter Applicator, Hot Air Lance, and Pavement Cutter to Spec Materials, Inc. of Vadnais Heights, MN in the amount of $33.901.08 as recommended by the Highway Engineer. Bid Openings Scheduled Motion by stone, seconded by Windels and unanimously carried to authorize the Highway Engineer to schedule the following bid openings on May 4, 1993: (l) Dump Boxes, Hydraulic systems, and Underbody Blades (2) Snowplows, Wings, and Sanders (3) '93 Yearly Bids -Mowing, Culverts, Bituminous Material, Hot Mix Bituminous Patching Material, and Herbicides. Proposed Transportation Legislation The Highway Engineer presented a proposed resolution from the West Central Minnesota Initiative Fund in support of proposed legislation to permit regional transportation planning for West Central Minnesota. The Board recommended that the letter and proposed resolution be sent to the District Highway Engineer and the Board would delay its decision for one week after receiving the District Engineer's recommendation. Purchase of Manuals Motion by Partmann seconded by Stone and unanimously carried to authorize the purchase of the '92 AASHTO Highway Design manual in the amount of $41.50 payable to AASHTO; also, the purchase of the EPA Storm Water Runoff Design manual in the amount of $38 payable to the EPA. consideration of Shoreland Management Ordinance Amendments Land & Resource Administrator, Bill Kalar, provided the Board with copies of the minutes of the Otter Tail County Planning Commission public hearing of March 29, 1993. In addition to the opinions in the minutes, there were approximately thirty (30) letters read at the public hearing and another twelve (12) letters received after the hearing, most of which expressed the same opinions as those documented in the public hearing minutes. Lengthy discussion followed with Bill Kalar, Terry Lejcher, DNR Hydrologist, and commissioners explaining the state mandated rules and the proposed Shoreland Management Ordinance Amendments now being considered by Otter Tail County. Motion by Windels, seconded by Fortmann and unanimously carried to request recommendations from the Planning Commission and table action on the amendments until the next regular Board meeting, April 13, 1993, at 1:30 p.m. H.F. 104/S.F. 160 Barbara Nelson and Morrie Heyen appeared in behalf of the Otter Tail Lakes Property owners Association requesting support of the following resolution regarding contiguous substandard lots: 0 0 otter Tail County Board of Commissioners April 6, 1993 Page 6 Resolution Motion by Lindquist, seconded Fortmann and unanimously carried to offer support of the following resolution: WHEREAS, the Otter Tail Lakes Property Owners Association respectfully requests the passage of a resolution in support of H.F. 104/S.F. 160, and WHEREAS, the bill reads as follows: A bill for an act relating to Otter Tail County; allowing use of certain land in Otter Tail County. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: Section 1. (Shoreland Sales) Notwithstanding any other law contrary, landowners in Otter Tail County affected by shoreland standards and criteria adopted in conformance with MN rule 6120.3300, Subd. 2 (d), (pertaining to contiguous substandard lots of record) may sell, subdivide or transfer their land in compliance with the otter Tail County Shoreland Management Ordinance in effect on February 4, 1992. Section 2. (Effective Date; Repealer) This act is effective the day following final enactment and is repealed effective June 1, 1995. BE IT THEREFORE RESOLVED, that the Otter Tail County Board of Commissioners endorses H.F. 104/S.F. 160 and asks that it receive positive consideration and passage by the Minnesota House of Representatives and the Minnesota Senate and approval by Governor Arne Carlson.
