HomeMy WebLinkAboutBoard of Commissioners - Minutes - 03/23/19930 Minutes of the OTTER TAIL COUNTY BOARD OF COMMISSIONERS Commissioners' Room, Floor 1-B Otter Tail County Courthouse Tuesday, March 23, 1993 1:00 p.m. Call to Order The Otter Tail County Board of Commissioners convened Tuesday, March 23, 1993, at 1:00 p.m. at the Otter Tail County Courthouse with Commissioners Malcolm Lee, Chairman; Harley Windels, Bill Stone, and Virginia Partmann present and Commissioner Andy Lindquist absent. Approval of Minutes Motion by Windels, seconded Fortmann and unanimously carried to approve the minutes of the March 16, 1993, meeting with one correction regarding the partition of Perham Township public hearing wherein Joe Fehrenbach was listed as being from Perham Township, should have been Rush Lake Township, Appointment-Economic Development Committee Motion by Lee, seconded Windels and unanimously carried to appoint Dave Aaberg, Pelican Rapids, to the Economic Development Committee filling the vacancy in that area, Bid Opening-Four Heavy Duty Tandem Axle Snowplowing Dump Trucks The Highway Engineer, having previously advertised for bids to be opened on four (4) heavy duty tandem axle snowplowing dump trucks, opened the following bids: Bidders New Trade-In Total Alexandria Diesel $217,760.00 $17,000 $200,760.00 Alexandria, MN Hall GMC, Inc, 220,212.00 16,500 203,712.00 Fargo, ND . State Project Bid Opening Dates Highway Engineer, Rick West, informed the Board that because of a new requirement that all State Aid projects over $300,000 be submitted to the MnDOT EEO office for targeted group business percentage .determination, it is possible we may see some delay in project bid openings. Otter Tail County Board of Commissioners March 23, 1993 Page 3 w Phelps Mill Dam 0 0 DNR Hydrologist, Terry Lejcher, appeared before the Board to explain his recommendation to set a fixed crest elevation for the Phelps Mill Dam and let nature take its course in fluctuating water levels. Chairman Lee directed Mr. Lejcher to include in the permit that a fixed crest elevation would be set allowing for change in water elevation in unusual circumstances by mutual agreement with the DNR and Otter Tail County. Language concerning fixed crest elevation is to be submitted to the County Attorney for review and approval prior to DNR permit issuance. Tax Statement Mailer Public Information Officer, Marie Tysdal, presented a tax statement mailer to the Board. The general consensus of the Board was favorable and the mailer will be sent with the property tax statements. Liquor License Applications Motion by Stone, seconded by Windels and unanimously carried to approve the following license applications: Lenny's Cafe & Dance Barn Leonard Lund/Thelma Ard Underwood, MN Balmoral Golf Course, Inc. Michael J. Hemquist Battle Lake, MN *Blue Horizon Ballroom Diane R. Wanner Perham, MN •subject to payment of the $50 County Fee. Set-Up License Set-Up License Set-Up License City of Parkers Prairie-Parcel# 75-000-99-0079-000 The City of Parkers Prairie would like to acquire the following described parcel of property so that they can remove a structure that is in need of substantial repair: Parcel# 75-000-99-0079-000, Amended Plat -Lot 6 and West 15' of Lot 7, Block 4 Motion by Stone, seconded and amended by Windels and unanimously carried to approve the abatement of the delinquent taxes, penalties, interest, and cost in the amount of $3,961.75 and the abatement of the payable 1993 property tax upon presentation, by the City of Parkers Prairie, of a warranty deed conveying title to the city with the stipulation that the county Attorney examines and approves the process. Annual water Safety Agreement Motion by Partmann, seconded Stone and unanimously carried to authorize the Board's Chairman to execute the 1993 Annual County Boat and Water Safety Agreement with the State of Minnesota. . . otter Tail County Board of commissioners March 23, 1993 Page 4 U Petition to Partition Perham Township 0 Motion by Windels, seconded Partmann and unanimously carried to deny the petition to partition Perham Township based upon the following reasons: (l) financial condition of the township was strong; (2) the surrounding townships which would receive additional land were opposed, and; (3) the overwhelming majority of persons at the public hearing were opposed to partition which indicate it neither necessary nor expedient to allow the petition. AMC Legislative Meeting Chairman Lee reported on the AMC Legislative meeting held in St. Paul and updated the Commissioners on proposed legislation. Adjournment Closed to the Public At 2:59 p.m. Chairman Lee declared the meeting adjourned and closed to the public for the purpose of discussing pending litigation as authorized in M.S. 471.705, Subd. 1 d., Attorney-Client Privilege. Litigation matters which were cited include: (1) Department of Labor & Industry, relating to safety regulations, specifically OSHA; (2) Otter Tail County vs parties involved with the justice facility floor deterioration problem. The Board also closed to evaluate the performance of Robert E. Moe, County Assessor, subject to its authority pursuant to M.S. 471.705, Subd. ld.(d). A summary report of conclusions regarding the evaluation will be provided at the next regular Board meeting.
