HomeMy WebLinkAboutBoard of Commissioners - Minutes - 03/16/19930 Minutes of the OTTER TAIL COUNTY BOARD OF COMMISSIONERS Commissioners' Room, Floor 1-B Otter Tail County Courthouse Tuesday, March 16, 1993 9:30 a.m. Call to Order The Otter Tail County Board of Commissioners convened Wednesday, March 16, 1993, at 9:40 a.m. at the Otter Tail County Courthouse with Commissioners Harley Windels, Vice-Chairman; Andy Lindquist, Bill Stone, and Virginia Fortmann present. Chairman Malcolm Lee was absent due to attendance at the AMC Legislative Conference. Approval of Minutes Motion by Stone, seconded Partmann and unanimously carried to approve the minutes of March 10, 1993, as submitted. The following addition is noted which was inadvertently missed in the official minutes of March 10, 1993: Motion by Stone, seconded Windels and unanimously carried to approve the minutes of March 3, 1993, as submitted. Liquor License Applications Motion by Fortmann, seconded Lindquist and unanimously carried to approve the following license applications: Tom Lorine Peak Supper Club Clitherall, MN 56524 Gerald and John Schultz Ten Mile Lake Resort, Inc. Dalton, MN 56324 Set-up License Set-up License Correspondence Vice-Chair Windels read a letter received from Representative Bob Anderson in reference to HF 112. Commissioner Portmann will draft a letter in response to include that the Board does not disagree with proposal HF 112, but rather, with the matter of the decision making process remaining with the county. Committee Appointments Motion by Lindquist, seconded Fortmann and unanimously carried to appoint Donald w. Schroeder of Fergus Falls as the West Otter Tail County representative on the Noxious Weed Appeal Committee with Truman Eggum of Dalton to serve as alternate. Meeting Report Commissioner Lindquist reported to the Board regarding the recent Community Partner and HACA meetings. Otter Tail County Board of Commissioners March 16, 1993 , Page 2 0 Landfill Permitting Solid Waste Director, Mike Hanan, updated the Board on a meeting with the MPCA in reference to the permitting process of the NE Landfill. The permit application is complete and the MPCA has stated that Otter Tail County will have the permit by July, 1993. Tax Statement Mailer Solid Waste Director, Mike Hanan, and Public Information Officer, Marie Tysdal, provided a draft copy of a tax statement mailer for the Board's review. The mailer focuses on the cost effectiveness of Otter Tail County expanding two present landfill sites, not in seeking a new site. The Board expressed their desire to limit the length of the article so that the postage does not exceed the .29 regular postage rate. The Board directed Ms. Tysdal to submit a condensed version at the next regular Board meeting. Legislative Issues Mike Hanan, Solid Waste Director, provided a handout and updated the Board on proposed legislation in the areas of Waste Management. Motion by Fortmann, seconded Stone and unanimously carried to authorize sending a letter as submitted by the Solid Waste Director to Otter Tail County legislators and to authorize the Chairman to sign such letter. Equipment Purchase Chief Deputy, Richard Kausler, requested authorization to purchase a Video Camera to be used in the Sheriff's Department. Motion by Partmann, seconded Stone and unanimously carried to authorize the Sheriff's Department to purchase a hand held Video Camera (Camcorder) by receiving a bottom line price and allowing the Auditor's Office to issue a check to the retailer for that amount, with the condition that the total purchase price will not exceed $800. Closed to the Public At 11:10 a.m. Chairman Windels declared the meeting closed to the public for the purpose of discussing litigation per the Attorney-Client privilege as authorized in 471.705, Subd. ld. Litigation matters cited were with regard to the justice facility floor and possible construction litigation relative to the condition of the leachate tank at the NE Landfill. At 11:25 a.m., after fifteen minutes of closed litigation discussion, the meeting was adjourned for lunch, to reopen at 1:00 p.m. Approval to Pay Bills Motion by Lindquist, seconded Partmann and unanimously carried to approve payment of bills per Attachment A of these minutes. • 0 Otter Tail County Board of Commissioners March 16, 1993 Page 3 Bid Opening Motion by Fortmann, seconded Lindquist and unanimously carried to close acceptance of bids at 1:00 p.m., March 16, 1993, for four tandem/axle trucks with snow removal equipment. The Highway Engineer will return the following bids and allow the bidders to amend their bids due to a change in the trade-in value with opening postponed until 1:00 p.m., March 23, 1993. Fargo, ND Motion by Lindquist, seconded Stone and unanimously carried to authorize the Highway Engineer to include 2.5 miles of CSAH 67 between CSAH 50 and 52 to the 1993 County Highway Construction program. Load Restrictions Rick West, Highway Engineer, reported that load restrictions are going into effect March 18, 1993, and this information has been publicized. Legislative Issues The Highway Engineer updated the Board on proposed gas tax and CSAH funding distribution formula legislation. correspondence Vice-Chairman Windels read a letter from Amor Township requesting a change in their Board of Review meeting which was set for April 15, 1993. The request was received after all townships and cities had been scheduled for their review meetings. Motion by Fortmann, seconded Lindquist and unanimously carried to regretfully deny the request due to the necessity of rescheduling another meeting in order to accommodate this request and to direct the Clerk of the Board to draft a letter to Amor Township to notify them of the Board's decision. The Board has requested, that in the future, the Assessor provide as early a notice as possible. Performance Evaluation Postponed The Board postponed the performance evaluation of County Assessor, Bob Moe, until the next regular Board meeting. Adjournment V At 2:10 p.m., Vice-Chairman Windels declared the meeting adjourned until 7:30 p.m., March 16, for the purpose of convening the public hearing for the petition to partition Perham Township. Otter Tail County Board of Commissioners March 16, 1993 ; Page 4 0 Public Hearing -Partition of Perham Township The public hearing to partition Perham Township convened at 7:30 p.m., at the Perham Community Center, Perham, MN at 7:30 p.m. with all commissioners in attendance except Chairman Malcolm Lee. Opening comments and general procedures were outlined by Vice-Chair Windels. Auditor, Wayne Stein read the petition as submitted to the Board. The hearing is conducted under M.S. 379.02. This statute requires the Board to arrive at a finding that is both necessary and expedient. The floor was opened to those in attendance with the following speaking in favor of the petition: Phillip Toedter, Perham Township The following spoke against the petition: Kermit Larson, Catherine Clauson, Calvin Rudolph, Hjalmer Peterson, Jim Osterfeldt, and Tim Waylager, all of Perham Township. Questions regarding the petition or process were put forth by Dennis Cheney, Catherine Clauson, Cal Rudolph, and Floyd Hoighart. Fred Huebsch asked for a show of hands from those in attendance. Vice-Chair Windels asked the City of Perham and surrounding townships for their position having discussed the issue at their annual meeting. Eldred Ellenburg of Gorman Township, stated that "people seemed opposed". Albert Jorgenson, Pine Lake Township, stated opposition. Joe Fehrenbach, Perham Township, stated that "no one was in favor". Gary Mathias, Edna Township, referred to the letter they had sent and affirmed opposition. Bob Louiseau, City of Perham, stated 11 the city had no comment or position". Windels asked for a show of hands of those present. overwhelming opposition to the petition. Those in attendance indicated Adjournment At 8:15 p.m., Vice-Chair Windels closed the hearing and reported that the Board would reach a determination at their next regular Board meeting with Commissioner Malcolm Lee present.
