Call to Order The Otter Tail County Board of Commissioners convened Wednesday, March 3, 1993, at 9:30 a.m. at the Otter Tail County Courthouse with Commissioners Malcolm Lee, Chairman; Andy Lindquist, Harley Windels, Bill Stone and Virginia Fortmann present. Approval of Minutes Motion by Stone, seconded Windels and unanimously carried to approve the minutes of February 24, 1993, as submitted. '92 County Agricultural Inspector's Annual Report Motion by Windels, seconded Lindquist and unanimously carried to approve the 1992 East Otter Tail County Agricultural Inspector's Annual Report as presented by Ken Becker, Ag/Weed Inspector. Motion by Lindquist, seconded Fortmann and unanimously carried to approve the 1992 West Otter Tail County Agricultural Inspector's Annual Report as presented by Roland Sauck, Ag/Weed Inspector, Noxious Weed Appeal Committee After discussion of new legislation regarding noxious weeds, the Chairman appointed Commissioners Andy Lindquist and Harley Windels to serve as Board members on the Noxious Weed Appeal Committee, as established pursuant to M.S, 18.83, Subd. 3 (2). Lindquist will represent West Otter Tail and Windels will represent East Otter Tail. Additional membership of the appeal committee will include Donald W, Schroeder of Fergus Falls Township with an alternate member to be named at a later date. County Road 1 Weight Restrictions Highway Engineer, Rick West, reported on spring weight restrictions posted along County Road l from Fergus Falls to TH 78. A motion was offered by Stone, seconded Partmann and unanimously carried to uphold the recommendation of the County Highway Engineer to post as nine ton, in the interest of fairness and because the road had already been built up to the nine ton specifications, that portion of County Road 1 from the CSAH 83/72 Junction east to TH 78. It was noted, however, that there remains a seven ton portion of County Road 1 which does not have the nine ton road improvement specifications and will remain posted at seven ton. Otter Tail County Board of commissioners M.arch 3, 1993 Page 2 Liquor License Transfer U Motion by Windels, seconded Lindquist and unanimously carried to approve the following liquor license transfer application subject to the approval of the County Attorney and Sheriff and to the submission of a current certificate of insurance: 0 0 Thunder Road Steak House Herbert E. Steeke Perham, MN on-Sale Intoxicating Liquor Sunday Liquor Training Prepayment Authorized Motion by Partmann, seconded Lindquist and unanimously carried to approve the payment of $175 to Sawabin and Associates as tuition for additional training of an investigator from the Sheriff's Department. Transportation Enhancement Fund Application Ray Johnson, representing the Pelican Rapids Economic Development Committee, outlined efforts to explore grant monies from the Transportation Enhancement Fund to construct bicycle and pedestrian pathways along Highway 108 from Pelican Rapids to Maplewood State Park. He also outlined an interest, citing DNR support, to construct pathways from Maplewood State Park to Phelps Mill, Glendalough on to Battle Lake. Motion by Lindquist, seconded Stone and unanimously carried to authorize the Highway Engineer to attend an upcoming meeting on March 9, 1993, in Grand Rapids to learn more about the application and eligibility requirements. The County Attorney's approval would be required prior to further, if any, Board action. Weight Restrictions: Additional shift/scale Help Motion by Lindquist, seconded stone and unanimously carried to authorize the Highway Engineer to use an additional shift for scale help during the spring weight restrictions on County roads. Mid-Am Salt Brine Recycling Motion by Windels, seconded Partmann and unanimously carried to authorize Commissioner Lindquist and the Highway Engineer to meet with Mid-American Dairymen, Inc, to explore use of a liquid salt brine as a possible road deicer. State Wildlife Land Acguisition Motion by Windels, seconded Stone and unanimously carried to offer the following resolution in support of the proposed State Wildlife Land Acquisition citing that this approval would be the last approval of the Otter Tail County Board of Commissioners until payments making up the difference of the amount of Payment in Lieu of Taxes and the actual tax amount has been offered. Whereas, in accordance with Minnesota Statutes 97.481, Subd. 2, the Commissioner of the Department of Natural Resources on March 3, 1993, provided the otter Tail County Board and the appropriate town officers with a description of lands to be acquired by the State of Minnesota for water and wildlife conservation purposes. Whereas, the lands to be acquired are described as follows; Tract 1, Head Lake WMA Consisting of lands in Sections 20 and 21, Rush Lake (Tl35 Range 39) 0 0 Q Otter Tail County Board of Commissioners March 3, 1993 Page 3 It Is Hereby Resolved, by the Board of County Commissioners of Otter Tail county on March 3, 1993, that the State's proposed acquisition of the above described property be approved. Lee, Chairman conditional use Permit Motion by Stone, seconded Partmann and unanimously carried to approve the Conditional Use Application of Randal and Joan Hutmacher, Otter Tail Lake, as recommended by the Planning Commission. Proposed Shoreland Management Ordinance Amendments Motion by Stone, seconded Partmann and unanimously carried to authorize the Planning Commission to set a date for a public hearing on the proposed Shoreland Management Ordinance Amendments. Commissioner Windels excused himself at l:00 p.m. Approval to Pay Bills Motion by Stone, seconded Partmann and unanimously carried to approve payment of bills per Attachment A of these minutes. Motion by Lindquist, seconded Stone and unanimously carried to approve payment of $119.44 to The Sandpiper and $52.00 to Dewey Randleman of Lake Region Hospital. Performance Evaluations Motion by Portmann, seconded Lindquist and unanimously carried to adopt a policy to place a written summary of performance evaluations in the individual's personnel file after such evaluation has been conducted by the Board. Performance Evaluation Summary The Board reported that the performance evaluations of Bill Kalar, Land & Resource Director, and Mike Hanan, Solid Waste Director, were both positive. Closed to Public At 1:30 p.m. Chairman Lee declared the meeting of the Otter Tail County Board of Commissioners closed to the public for the purpose of discussing Attorney-Client issues regarding the tax appeal of Mills Fleet Farm and the matter of Rosa Kawlewski v. Ralph Haman/Otter Tail County. Attorney-Client Privilege is authorized by M.S. 471.705, Subd. ld. otter Tail County Board of commissioners March 3, 1993 Page 4 Open to Public 0 At 1:48 p.m. the Otter Tail County Board of Commissioners meeting was reopened to the public, 0 1986 Highway Bond Refinancing Motion by Partmann, seconded Stone and unanimously carried to place a fourteen page resolution awarding the sale of $2,745,000 in General Obligation State Aid Highway Refunding Bonds of 1993; Fixing Their Form and Specifications; Directing Their Execution and Delivery; Providing for Their Payment; Providing for the Escrowing and Investment of the Proceeds Thereof; and Providing for the Redemption of Bonds Refunded Thereby into the February 17, 1993, Board minutes, Motion by Stone, seconded Partmann and unanimously carried to authorize Chairman Lee and the Auditor to execute all necessary bond documents, as prepared by bond counsel on behalf of Otter Tail County, with regard to the 1986 Highway Bond Refinancing. Meeting Date Change Motion by Stone, seconded Lindquist and unanimously carried to change the March 9, 1993, Board of Commissioners meeting to March 10, 1993, due to the annual township elections. The Board will meet at 1:00 p.m. Long Range Planning Committee Recommendations The Long Range Planning committee, composed of Jean McKenzie, Joe Hemmelgarn, Richard Bergquist, Jerry Enderson, Lois Dillon and Commissioner Virginia Partmann, Chair, presented their recommendations to the Board. The mission of this Committee was to examine all areas of county government for the purposes of providing services in a cost effective, efficient manner. Adjournment At 6:45 p.m. Chairman Lee declared the meeting adjourned until 1:00 p.m. on March 10, 1993.
