HomeMy WebLinkAboutBoard of Commissioners - Minutes - 01/27/1993u Minutes of the OTTER TAIL COUMTY BOARD OF COMNISSIOIIERS commissioners' Room, Floor 1-B otter Tail county courthouse Wednesday, January 27, 1993 1100 p.m. Call to Order ,The Otter Tail County Board of Conunissioners convened Wednesday, January 27, 1993, at :1,20 p.m. at the Otter Tail County Courthouse with Commissioners Harley Windels, 1Vice-Chairman; Virginia Partmann and Bill Stone present and Commissioners Malcolm Lee, ,Chairman; and Andy Lindquist absent until 1:30 p.m. as a result of their attendance at a ,Regional Treatment Center conununity Partners meeting. Approval of Minutes 'Mot ion by Stone, seconded Portmann and unanimously carried to approve the minutes of ,January 20, 1993, as submitted. Solid Waste Issues ,The Solid Waste Director and the Recycling Manager provided information to the Board on proposed '93 Solid Waste Fees, the Northeast Landfill leachate tank issue and possible grant monies availability for the expansion at the recycling center operation. Final Plat: Oak Ridge Estates, Second Addition Motion by Windels, seconded Lindquist and unanimously carried to approve the final plat 'of Oakridge Estates, Second Addition, Wimer Lake. This plat was approved by the County :Board with the acceptance of a check from the developer to be held in lieu of the road ·construction requirement. The road construction will be completed on or before June 15, ;1993, and the Land & Resource Management Office is to be notified of same. Pelican River Watershed District Bill Kalar, Land & Resource Director, gave an overview of the Pelican River Watershed :District• s management plan he had been directed to review. He shared his concern over 'the duplication of effort expressed by the District with regard to permitting and a solution was offered to suggest permitting by the Watershed be required in cases 'unless otherwise regulated. . " ;otter Tail County Board of Commissioners ,January 27, 1993 ,.. :Page 2 • :Motion by Stone, 1resolution: Highway Transportation Funding seconded Portmann and unanimously carried to offer the following ;WHEREAS, there exists a perception that urban counties do not receive a fair portion of ;the county state aid highway funds, and; ,WHEREAS, these perceptions have generated a concern to update the existing county state 1aid highway funding formula to direct more funds to the urban and suburban counties, 1and; iWHEREAS, it is recognized that any county state aid highway funding formula needs to be :responsive to growth in all areas of the state, and; :WHEREAS, the county state aid formula must reflect equalization, population, mileage, ,and construction needs, in addition to other growth factors. ;NOW THEREFORE BE IT RESOLVED, that the County Board of otter Tail County does hereby :endorse the following County state Aid Formula of 10% equalization, 20% registered '.vehicles, 30% mileage (based on lane miles), and 40% construction needs. I :BE IT FURTHER RESOLVED that the above proposed formula allows for future modifications, ;as necessary, to meet the change in demands upon funding, but any proposal should 1 continue to include the categories of equalization, registered vehicles, mileage, and ,construction needs. o :Adopted this 27th day of January, 1993, in Fergus Falls, MN. Crushing Aggregate Shouldering contract :Motion by Lindquist, seconded Stone and unanimously carried to authorize the Chairman to sign the crushing Aggregate Shouldering Contract between Otter Tail County and ,Dave Larson Excavating of Little Falls, MN. 0 0 :• ' ' ,Otter Tail County Board of Commissioners 'January 27, 1993 ,page 3 i 1 Approval to Pay Bills Motion by Stone, seconded Partmann and unanimously carried to authorize the payment of ,bills per Attachment A of these minutes. Petition to Partition Perham Township ;wayne Stein, Auditor, reported a petition for the partition of Perham Township that was previously submitted to the Otter Tail County Board of Commissioners on January 20, 1993, contained 102 signatures. After some discussion, a motion was offered by Windels, seconded Lindquist and 1unanimously carried to schedule a public hearing on the partition of Perham Township tentatively for March 16, 1993, at 7:30 p.m. in Perham pending availability of a :suitable meeting location. ! Motion by Windels, seconded Partmann and unanimously carried to make a request to the 'affected townships to discuss this petition at their upcoming annual meetings. Parking Lot Rental ,Motion by Windels, seconded Stone and unanimously carried to approve payment, in the amount of $600, to David Retta for rent of a parking lot located on Lot 3, City of iPerham. Boiler Machinery Insurance :Motion by Lindquist, seconded Windels and unanimously carried to approve payment, in the '.amount of $1,934, to Meadowbrook Insurance Group for Boiler and Machinery Coverage for ,the period of January 30, 1993 through January 30, 1994. Abatement 1Motion by Partmann, seconded Windels and unanimously carried to abate penalty and 1interest, in the amount of $133.51, to Stanley L. Malikowski for the payment of 1992 !Real Estate Taxes due to clerical error by the County. '86 State Aid Highway Bond Refunding ;wally Dornfeld of Springsted, Inc. presented a proposal to provide refunding services to Otter Tail County regarding the refunding of 1986 State Aid Highway Bonds. After some 1discussion about the presentation, Larry Dorn of Dorn & Co., Inc. reiterated his 'crossover savings report to the Board. !upon a motion by Lindquist, seconded Partmann and unanimously carried Dorn was directed 1to continue his work to arrive at a gross debt savings of $100,000 or more. Should Dorn 1 be unable to achieve this minimum, the refunding would be offered to Springsted, Inc. 9tter Tail County Board of Commissioners ~anuary 27, 1993 Page 4 Regional Treatment Center community Partners ' The County Attorney provided a report of the Regional Treatment Center Community :Partners meeting of which Commissioners Lindquist and Lee had also attended earlier. Tax Forfeited Land: Removal of Trees Motion by Lindquist, seconded Partmann and unanimously carried to allow the acquisition ;of trees on tax forfeited land in Aastad Township, by the Aastad Town Board. The :request by the Aastad Township Board is for the removal of the west row of trees located :on Sec. 29 SW corner in the NWl/4 of Twp. 131 N Range 44. The purpose of the request is !for the public good with regard to highway maintenance and snow removal. :otter Tail County will seek to condition the purchase of this property upon the removal 1of the trees by the purchaser on or before July 1, 1993. i Adjournment Closed to Public :At 4:10 p.m., Chairman Lee declared the meeting adjourned and closed to the public for :purposes of discussing litigation per the Attorney-Client Privilege as authorized in !411.105, Subd. ld. Litigation matters cited were with regard to Dale Pierce and :Scambler Township Demolition Site vs. Otter Tail County; Ethel Barker vs. Otter Tail ,County in a workers' compensation matter; and Malcolm E.
