OTTER TAIL COUNTY BOARD OF COMMISSIONERS

Call to Order
The Otter Tail County Board of Commissioners convened Wednesday, January 13, 1993, at
1:00 p.m. at the otter Tail County Courthouse with Commissioners Malcolm Lee, Chairman;
Andy Lindquist, Harley Windels, Bill Stone and Virginia Partmann present.
Minutes Approved
Motion by stone, seconded Windels and unanimously carried to approve the
January 5, 1993, as submitted.
Empty Pesticide Container Collection
Pesticide Collection
Marie Tysdal, Public Information Officer from the Solid Waste Department, discussed a
proposed Empty Pesticide Container Collection for 1993. Discussion followed regarding
dates and location sites. Tysdal was directed to prepare a plan and return to the Board
for final approval.
Harold Stanislawski, Ag Extension Agent from the West Otter Tail Extension Service,
discussed Pesticide Collection in Otter Tail County. He described a program offered by
the Minnesota Department of Agriculture, authorized by the 1989 Comprehensive Ground
Water Protection Act, which is designed to help farmers and other pesticide users
dispose of unusable or waste pesticides at no cost to themselves. After lengthy
discussion of the cost share portion, Stanislawski was directed to work with Tysdal and
prepare a plan to present to the Board at the next meeting.
Request for Bids
Motion by Lindquist, seconded Partmann and unanimously carried to authorize the Hi9hway
Engineer to set bid opening of '93 Highway Signe and Posts for 1:00 p.rn. on
February 17, 1993.
'93 Highway Construction Projects
Rick West, Highway Engineer, in a general discussion with the Board regarding the
1993 Highway Construction Projects, shared his concern regarding the need to evaluate
certain 1993 construction projects which require lengthy permitting as it relates to
implementing projects in the '93 construction season.
Speed Zone Study -Twp. Rd, T-261
Leaf Mountain Township
Motion by Lindquist, seconded Stone and unanimously carried to offer the following
resolution in support of a Speed Zone study on Township Road T-261 in
Leaf Mountain Township:

WHEREAS, the Township of Leaf Mountain has requested of the Otter Tail County Board of
Commissioners on January 13, 1993, that the speed limit be reduced on a segment of
Township Road T-261 in Leaf Mountain Township, and
WHEREAS, the County of Otter Tail also believes that a speed zone would be beneficial in
this area.
NOW, THEREFORE, BE IT RESOLVED, that Otter Tail County does hereby request that the area
be studied by the the Minnesota Department of Transportation to determine the need for a
reduced speed zone, if any,
BE IT ALSO RESOLVED, that Minnesota Department of Transportation proceed with
establishing a legal speed zone if the findings of the traffic study are supportive.
Adopted at Fergus Falls, MN, this 13th day of January, 1993.

State Transportation Funding
Rick West, Highway Engineer, discussed transportation issues and various funding
formulas as generally agreed by representatives of MICA, AMC, MCHEA and MTA in an effort
to develop key elements of a State transportation policy.
Motion by Stone, seconded Partmann and unanimously carried to direct West to prepare
letters on behalf of the Board to the AMC Executive Committee as well as local State
representatives, indicating concern and dissatisfaction of the proposed transportation
funding formula(s). The Chairman was authorized to sign these letters when they have
been prepared.
Ice on Roads
Motion by Lindquist, seconded Windels and unanimously carried to authorize the purchase
of two liquid chloride storage/dispensing units when the temperature prohibits normal
sand/salt applications. Use of this product will be an emergency measure only. Funding
for these units will be from the Reserve Fund.
Stone Absent
At 2:45 p.m. Commissioner Stone was absent for the balance of the meeting.
Soil Conservation Service
Motion by Lindquist, seconded Partmann and unanimously carried, to approve payment, in
the amount of $22,552 to reimburse the Soil Conservation Service for costs incurred in
furnishing technical assistance in accordance with the Soil Survey Agreement between
Otter Tail County and the Soil Conservation Service for the period October 1, 1992 to
December 31, 1992.

Payment Approved
Motion by Partmann, seconded Lindquist and unanimously carried, to approve payment,
the amount of $112.50, to Arnold Lofthus for work performed at the Phelps Mill Dam.
confession of Judgment -Delinquent Taxes
in
Motion by Lindquist, seconded Windels and unanimously carried, to designate the filing
fee for Confession of Judgment of Delinquent Taxes as follows:

County Auditor

Transcript Billing
Motion by Windels, seconded Partmann and unanimously carried to continue to process the
billing for transcripts which are prepared by court reporters, after approval of the
Court Administrator, as in the past using an Auditor's Warrant.
County Printing & Publishing
Wayne Stein, Auditor, reported The Daily Journal has agreed to provide the publishing of
the County's legal notices, legal publications and commissioners' minutes at the 1992
rate.
Motion by Fortmann, seconded Lindquist and unanimously carried to accept the 1993 rate
of The Daily Journal as presented by the Auditor.
State Auditor's Office -'93 Audit Engagement
Motion by Windels, seconded 'Portmann and unanimously carried, to authorize the Chairman
of the Board to sign the 1993 audit engagement letter with the State Auditor's Office.
Abatement
Motion by Windels, seconded Lindquist and unanimously carried, to approve the following
abatement:
City of Perham:
Parcel# 77-000-99-0904-000
School District #549
Remove the payable 1992 tax as this parcel should have been tax exempt. Special
assessment would remain in effect. Grant 15 days for payment without penalty from the
date of approval.
Approval to Pay Bills
Motion by Lindquist, seconded Windels and unanimously carried to approve the payment of
bills per Attachment A of these minutes.
Computer Update
Tim Brand, Data Processing Director, updated the Board on the study of the proposed new
computer system. At the recommendation of Windels, Chairman Lee will participate in the
Committee's review process.

Regional Treatment Center Coalition
Chairman Lee reappointed Tom Fawcett, Social Services Director, to an additional three
year term on the Regional Treatment Center Coalition. Chairman Lee also appointed
Jim Wilkus, Administrator of the Fergus Falls Medical Group, to replace Edward Mehl and
he further appointed Larry Merxbaurer, Director of Productive Alternatives, to replace
Steve Lorshbough. All three individuals will serve three year terms commencing as of
this date.
New Committees Named
Motion by Lindquist, seconded Fortmann and unanimously carried to establish both the
Rural Coalition Committee and the GIS Committee as new committees.
Chairman Lee appointed Lindquist, along with himself, to serve on the Rural Coalition
Committee and Partmann to serve on the GIS Committee for 1993.
Insurance coverage: Honesty Bond
Motion by Partmann, seconded Windels and unanimously carried to approve the three year
premium of the Honesty Bond issued through Meadowbrook Insurance Group at a rate of
$1,216 and to authorize an increase in the base coverage to $25,000 at an annual premium
of $115.
Motion by Partmann, seconded Windels and unanimously carried to include each of the
commissioners and other elected officials in the blanket bond coverage.
Minnesota Red River Valley Development Association
Motion by Lee, seconded Partmann and unanimously carried to name Commissioner Windels to
the Minnesota Red River Valley Development Association for a three year term.
Soil Survey Modification
Motion by Lindquist, seconded Windels and unanimously carried to authorize the Chairman
to sign the working agreement between the USDA Soil Conservation Service and the
Minnesota Agricultural Experiment station and the Otter Tail County Board of County
Commissioners relative to acceleration and completion of the soil survey of Otter Tail
County.
Adjournment
At 4:00 p.m., Chairman Lee declared the meeting adjourned until 9:30 a.m. on Wednesday,
January 20, 1993.
