Statutory Meeting
Pursuant to Statutes, the Board of County Commissioners of otter Tail County, Minnesota,
convened Tuesday, January 5, 1993, at 9:30 a.m ••

Call to Order
Chairman Selected
Coordinator Larry Krohn called the meeting to order asking for a

The first order of business was the selection of a Chairman of the Board for the year
1993. Motion by Stone, seconded Portmann and carried, with Lee abstaining, to appoint
Malcolm Lee as Chairman of the Board of Commissioners for the year 1993.
Vice-Chairman Selected
Lee assumed the chair and called for a motion to select the Vice-Chairman. Motion by
Lindquist, seconded Portmann and carried, with Windels abstaining, to appoint
Harley indels as Vice-Chairman of the Board of Commissioners for the year 1993.
Approval of Minutes
Motion by Lindquist, seconded Stone and unanimously carried to approve the minutes of
December 23, 1992, as submitted.

Motion by Partmann, seconded Lindquist and unanimously carried to approve payment of the
Association of Minnesota Counties (AMC) membership dues assessed for 1993 in the amount
of $11,123.
Board Agenda
Chairman Lee requested the Coordinator's office, when setting the Board's meeting
agenda, to schedule time not later than 3:00 p.m. The reason for this is to allow
Commissioners to address the needs of their constituents as it relates to other County
offices and departments.
Depository Resolution
Motion by Stone, seconded Windels and unanimously carried, the following resolution was
adopted:
RESOLVED by the Board of County Commissioners of otter Tail county, Minnesota, that
WHEREAS, all financial institutions in otter Tail County, including state and federal
banks and savings and loan associations, be'and are hereby designated as depositories of
County funds.

Investments -Resolution
Motion by Lindquist, seconded Windels and unanimously carried, the following resolution
was adopted:
RESOLVED by the Board of County Commissioners of Otter Tail County, Minnesota, that
WHEREAS, Otter Tail County Treasurer, Steve Andrews, be and is hereby given authority to
invest County funds as available.

Forgiveness of Penalty
Motion by Lindquist, seconded Partmann and carried, with Stone opposed, to deny the
forgiveness of penalty as requested by LeRoy Thoennes in accordance with established
policy.
U.S. Fish & Wildlife
Motion by Lee, seconded Partmann and unanimously carried to certify the acquisition as
requested by the U.S. Fish and Wildlife Service for fee purchase on property owned by
Norman w. Krabbenhoft and d.escribed as T. 137 N., R. 43 w., 5th P.M., Section 4, that
part of lot four lying north and west of the township road.

Planning Commission
Motion by Windels, seconded Lindquist and unanimously carried to appoint Fred Harker to
a three year term on the Planning Commis.sion commencing January 1, 1993.
1993 Meeting Dates -Resolution
Motion by Partmann, seconded Windels and unanimously carried, the following dates are
established as the dates the County Board will meet during the year 1993 to conduct
County business, with the full day's meetings commencing at 9:30 a.m., the afternoon
meetings of the County Board commencing at 1:00 p.m.:

Motion by stone, seconded Windels and unanimously carried to change the June meeting
dates as indicated by* and to set the date for the Board of Equalization for
June 17, 1993, at 9:30 a.m. and to reconvene the Board of Equalization for final action
on either June 23 or June 30, 1993.
Revenue System Analyst Position
Copies of a proposed job description for a Revenue System Analyst position was
distributed by the Solid Waste Director to Board members. Position will be referred to
the Reclassification Committee for classification.
By-Pass Landfill
Motion by Partmann, seconded Lindquist and unanimously carried to endorse the concept of
a single solid waste monocell for by-pass municipal solid waste. The intent of this
monocell would be to serve both the Fergus Falls and Quadrant incineration facilities.
The monocell would be located at the City of Fergus Falls' landfill site and be subject
to all required permits being obtained.
Solid Waste Sub-Co-ittee
Chairman Lee appointed Mike Hanan (Solid Waste Director), Commissioner Lindquist and
himself to serve on a Solid Waste Sub-Committee. This Committee would begin
negotiations of contracts for the County with Quadrant, City of Fergus Falls and the
participating counties of the Joint Powers Board.

Approval to Pay Bills
Motion by Stone, seconded Partmann and unanimously carried to approve the payment of
bills per Attachment A of these minutes ..
Final Plat: Bal-View Estates
Donald and Ann Luhning, owners of Bal-View Estates, appeared before the Board regarding
the matter of the Board tabling approval of the final plat of Bal-View Estates
(December 16, 1992, County Board minutes). After lengthy discussion regarding the road
and County specifications, the matter was tabled pending further information until the
January 20, 1993, Board meeting.
Inter-Departmental Computer Network
Public Health & Court Services Departments
Diane Thorson and Chuck Kitzman, Directors of Public Health and Court Services
Departments respectively, having previously advertised for bids on an Inter-Departmental
Computer Network System, reported receipt of one bid having met the

advertised specifications. The bid received from Best Business Systems represented a
cost of $14,759.41 for Court Services and $19,122.50 for the Public Health Department.
Acting as Human Services Board:
Motion by Fortmann, seconded Stone and unanimously carried to award the bid to
Best Business Systems as presented.
Motion by Fortmann, seconded Stone and unanimously carried to authorize the purchase of
software as follows:

In addition the motion included the purchase of the following budgeted items:
Training of Staff for Network System Operations which would include staff members of
Court Services, Public Health and Data Processing Departments.

The Board, having previously advertised for bids to be received for printing and
publishing of the County Board minutes, legal notices, delinquent tax list and County's
annual financial statement, proceeded to open bids which were found to be as follows:

After consideration, motion was made by Stone, seconded Windels and unanimously carried,
to award bids for publishing and printing for the year 1993 as presented.
Legal Notices, Publications and Commissioners Minutes:
*Since no bids were received for this section of the County's 1993 printing and
publishing requirements, a motion was offered by Partmann, seconded Windels and
unanimously carried to offer this section of the printing and publishing requirements
to The Daily Journal, Fergus Falls, MN, at the same rate that was effective for 1992.
The Auditor was instructed to extend this offer to The Daily Journal and report outcome.

resolution was adopted:

RESOLVED by the Board of County Commissioners of Otter Tail County Minnesota, that
the sum of thirty cents ($.30) be paid out of the Revenue Fund of the County for every
pocket gopher killed in said County during the year 1993 in cases where the township
shall provide for the payment of at least an additional bounty of forty cents ($.40) for
each pocket gopher so killed.
RESOLVED further that said payment of such bounty shall be made by the County Auditor
upon certificates executed by the Chairman of the Town Board of said township setting
forth that the pocket gophers were duly presented to the Chairman of such Board and that
the township had issued and delivered to each claimant a town order for at least seventy
cents ($.70) for each pocket gopher so killed.

Tax Forfeited Land Sale Apportionment
Upon motion made by Lindquist, seconded Stone and unanimously carried, the following
resolution was adopted:
RESOLVED by the Board of County Commissioners of Otter Tail County, Minnesota, that
WHEREAS, it is provided in Minn. Stat. 282.05 for the apportionment of proceeds from the
sale of tax forfeited lands, and
WHEREAS, the county Auditor shall apportion the tax sale proceeds to the taxing
districts pursuant to Minn. Stat. 282.08, and
WHEREAS, Minn. stat. 282.08(4) (b) provides that the County Board may set aside 20\ of
the proceeds remaining after the value of public improvements, special assessments and
bond issues levied on the property have been paid, for acquisition and maintenance of
county parks and recreational areas, and
WHEREAS, Otter Tail County has a park and recreational area which would benefit by such
an apportionment,
NOW, THEREFORE, BE IT RESOLVED, that the County Auditor retain 20% of the proceeds from
the sale of tax forfeited lands for acquisition and maintenance of parks and
recreational areas from the proceeds available after making the necessary statutory
disbursements, said proceeds to be disbursed according to law.

Delinquent Real Estate Parcels
Motion by Lindquist, seconded Fortmann and unanimously carried to increase the cost
assessed to delinquent real estate parcels that are published in the Delinquent Tax List
from $15.00 to $17.00. In 1992 the cost to publish the Delinquent Tax List was
$13,364.23 arid there were approximately 787 parcels published, a per parcel cost of
$16.98. There is statutory authority for the County Board to establish the fee at the
greater of $10.00 or a reasonable fee to recover all the cost incurred against each
parcel included in the Delinquent Tax List.

the following 1993 annual appropriations:

Motion by Lindquist, seconded Windels and unanimously carried to authorize payment of
$85.00, for materials and labor, to Pete J. Pedersen, Underwood, MN, for cost incurred
to repair and paint a boat that was damaged when it was used during work on the Phelps
Mill Dam.

Motion by Fortmann, seconded Lindquist and unanimously carried to authorize the Chairman
to sign the Flexible Spending Account Fee Schedule for Administrative Services for 1993
with DCA, Inc.

City of Elizabeth:
In the matter of the Application of the City of Elizabeth, a Governmental Subdivision,
for the conveyance of the following described parcels of Tax Forfeited properties:

Upon a motion by Lee, seconded Lindquist and unanimously carried the following was

Whereas, the County Board of Otter Tail County, Minnesota, has examined into the
allegations of the applications of the City of Elizabeth dated December 30th, 1992, for
the conveyance of certain lands therein described; now,
Therefore, be it resolved by the County Board of Otter Tail County, Minnesota, that it
hereby approves said application and recommends that the application for a public use of
tax forfeited property be granted.
