HomeMy WebLinkAboutBoard of Commissioners - Minutes - 12/23/1992Minutes of the OTTER TAIL COUNTY BOARD OF COMMISSIONERS Commissioners' Room, Floor 1-B Otter Tail County Courthouse Wednesday, December 23, 1992 1:00 p.m. Call To Order The Otter Tail County Board of Commissioners convened Wednesday, December 23, 1992, at 1:00 p.m. at the Otter Tail County Courthouse with Commissioners Andy Lindquist, Chairman; Harley Windels, Bill Stone, Malcolm Lee and Virginia Partmann present. Minutes Approved Motion by Lee, seconded Windels and unanimously carried to approve the December 16, 1992, minutes as submitted. '93 Assessment Contracts Motion by Portm~nn, seconded Lee and unanimously carried to authorize the Chairman to sign the 1993 A~sessment Contracts as presented by the Assessor. Request for Appraiser Position Motion by Windels, seconded Lee and unanimously carried to authorize an additional Appraiser position in the Assessor's office as requested by the Assessor. Performance Appraisals: Department Beads Motion by Windels, seconded Partmann and unanimously carried to adopt a procedure for annual performance reviews of all department heads, both elected and appointed, by the County Soard effective January 1, 1993. Approval to Pay Bills Motion by Stone, seconded Lee and unanimously carried to approve the payment of bills per Attachment A of these minutes. Special Assessment Motion by Lee, seconded Partmann and unanimously carried to certify the following as a special assessment against the 1993 tax rolls: NOXIOUS WEED DESTRUCTION: Parcel# 38-000-35-0268-002 -Paul Sherman Section 35 Township 134 Range 41 27 Acres Part of Government Lot 7 lying Ely & Nely of Center LN CSAH #45 and Part of Government Lot 8 Wly of following line: Com. NE Cor. Government Lot 8 West 845.26' to Beg. of line, South 1,450' to river. Total costs incurred for the destruction of noxious weeds -$471.47. Jacob's Add'n Ex. R.J. Miller Add'n and Ex. Trs. Parcel# 76-000-21-0004-000 Section 21 Township 136 Range 43 SE1/4SE1/4, and Parcel# 76-000-27-0038-000 Section 27 Township 136 Range 43 Nl/2NW1/4 Ex. E. 766', Ex. Trs. and Ex. Trs. to City. That the City desires to obtain said lands for the expansion of its wastewater treatment facility and for the landspreading of sludge from the Wastewater Treatment Facility. Upon a motion by Lee, seconded Windels and unanimously carried the following resolution upon application was offered: Whereas, the County Board of Otter Tail County, Minnesota has examined into the allegations of the applications of the City of Pelican Rapids dated December 22nd, 1992, for the conveyance of certain lands therein described; now, Therefore, be it resolved by the County Board of Otter Tail County, Minnesota, that it hereby approves said applications and recommends that the applications for public use of tax forfeited properties be granted. Lot C of NE1/4NW1/4, Ex. W. 16 RDS and Ex. Tr. and Vacated 1/2 Beech Ave. Adjacent. That the School District desires to obtain said lands which are adjacent to existing School District property for purposes of expansion. Upon a motion by Partmann, seconded Lee and unanimously carried the following resolution upon application was offered: Whereas, the County Board of Otter Tail County, Minnesota has examined into the allegations of the applications of Independent School District #544 dated December 18th, 1992, for the conveyance of certain lands therein described; now, Therefore, be it resolved by the County Board of Otter Tail County, Minnesota, that it hereby approves said application and recommends that the application for public use of a parcel of tax forfeited property be granted. Phelps Mill Dam Project Rick West, Highway Engineer, provided an update on the Phelps Mill Dam Project which included discussion on spillway elevation as well as the feasibility of winter construction because of time element. CSAB 37: MnDOT Overlay Motion by Partmann, seconded Windels and unanimously carried to amend the Board minutes of October 21, 1992, with regard to the CSAB 37: MnDOT Overlay to read " ..• payable to contractor for the County's share of expenses." Minutes reflected payment would be directed to MnDOT under their contract. MnDOT State Aid Manual Purchase Motion by Lee, seconded Stone and unanimously carried to authorize the purchase of an updated set of MnDOT State Aid Manuals as requested by the Highway Engineer at a cost of $507.45. '86 state Aid Bonds After discussion with the Board regarding refunding 1986 state Aid Bonds, the Highway Engineer was directed to work with the Coordinator, Treasurer and Auditor and report back to the Board regarding possible re-issue. Final Payment Motion by Windels, seconded Lee and unanimously carried to authorize final payment in the amount of $15,774.68 to Riley Bros. construction, Inc., Morris, MN, as awarded on September 9, 1992, bid for Gorman Township Bridge No. 95050. Traffic Signing Workshop Motion by Fortmann, seconded Stone and unanimously carried to approve payment for two individuals to attend a traffic signing workshop, the total cost of registration is $60 for both employees. Revenue System Analyst Position Members of the Solid Waste User Fee Committee (Hanan, Moe, Leabo) presented an amended job description for the proposed Revenue System Analyst. After discussion a motion was offered by Partmann, seconded Lee and unanimously carried to direct the Committee to begin the classification process for this position. Hanan was directed to share information about the proposed position with both the Auditor and Treasurer. 0 0 1'\ I;;,,,/ , Otter Tail County Board of Commissioners December 23, 1992 Page 5 Subordination Agreement Motion by Windels, seconded Lee and unanimously carried to approve the Chairman's signature on a subordination agreement on homestead property owned by Robert c. Carter, located in Otto Township so that the lender can proceed with the new mortgage, which would lower the monthly mortgage payments to the property owner and allow the property owner to make monthly payments in the amount of S90 per month until the obligation of S2,776 has been paid in full. Board of Adjustment Motion by Stone, seconded Lee and unanimously carried to reappoint Craig Anderson to a one year term on the Board of Adjustment commencing January 1, 1993. Planning Commission Motion by Partmann, seconded Lee and unanimously carried to reappoint Diane Prischmann to a three year term on the Planning Commission commencing January 1, 1993. Proposed Wetland Rules -Wetland Act of 1991 Motion by Partmann, seconded Stone and unanimously carried to authorize the Chairman's signature on a letter to Judge Allan Klein, Hearing Examiner, regarding formal concern and/or objections with the proposed wetland rules in the Wetland Act of 1991. Stipulation for Entry Into Judgment -Tax Appeal Cases Motion by Partmann, seconded Lee and unanimously carried to authorize the Chairman to sign a Stipulation for Entry Into Judgment on the tax appeal cases of Sidney L. Brennan and Mid-America Dairymen, Inc. Closed to Public Adjournment At 3:01 p.m., Chairman Lindquist declared the meeting adjourned and closed to the public for purposes of discussing with counsel pending litigation with the Minnesota Department of Labor and Industry with regard to laws and regulations relative to safety in the workplace and specifically, contested OSHA citations. The next Board meeting is scheduled for 9:30 a.m. on Tuesday, January S, 1993.
