HomeMy WebLinkAboutBoard of Commissioners - Minutes - 09/09/19920 0 Minutes of the OTTER TAIL COUNTY BOARD OF COMMISSIONERS Commissioners' Room, Floor 1-B Otter Tail County Courthouse Wednesday, September 9, 1992 1:00 p.m. Call To Order The Otter Tail County Board of Commissioners convened Wednesday, September 9, 1992, at 1:00 p.m. at the Otter Tail County Courthouse with Commissioners Andy Lindquist, Chairman; Malcolm Lee, Harley Windels, Bill Stone and Virginia Partmann present. Minutes Approved Motion by Lee, seconded Portmann and unanimously carried to approve the September 2, 1992, minutes as submitted. Veterans Advocate Publication Motion by Lee, seconded Windels and unanimously carried to approve payment of $50 for a two-year subscription for the Veterans Advocate publication as recommended by the Veterans Service Officer. Shoreland Management Ordinance Department of Natural Resource Hydrologists, Russ Schultz and Terry Lejcher, appeared at the request of the County Board to discuss concerns and issues resulting from the administration of the State mandated Shoreland Management Ordinance. Issues discussed included the provision dealing with substandard, contiguous lots of record and cluster developments. Chairman Lindquist requested Russ Schultz and Terry Lejcher to meet with Land & Resource Management Director, Bill Kalar, County Attorney, Wally Senyk and Otter Tail Lake Property Owners Association President, Stan Fetters, to address specific concerns/issues involving the Shoreland Management Ordinance. Conditional Use Applications Motion by Windels, seconded Lee and unanimously carried to approve the Conditional Use Application of Bob & Patricia Miller, Eagle Lake, subject to conditions and recommendations as indicated by the Planning Commission. Motion by Lee, seconded Portmann and unanimously carried to approve the Conditional Use Application of Trondhjem Township% Merlin Watterud, South Branch/Buffalo River, subject to conditions and recommendations as indicated by the Planning Commission. Randal & Joan Hutmacher appeared requesting approval of their Conditional Use Application, Erwin Kremer/Randal & Joan Hutmacher, Otter Tail Lake, with a statement read into the minutes by County Attorney, Wally senyk, addressing the five reasons for denial listed by the Planning Commission. Several residents of the area expressed opposition citing over crowding and erosion concerns. Letters of opposition and petitions were acknowledged. ,-\ '-I 0 •• Otter Tail County Board of Commissioners September 9, 1992 Page 2 Motion by Lee, seconded Windels and unanimously carried to uphold the denial recommended by the Planning Commission on the Conditional Use Application of Erwin Kremer/Randal & Joan Hutmacher, Otter Tail Lake. Motion by Partmann, seconded Lee and unanimously carried to uphold the denial recommended by the Planning Commission on the Conditional Use Application of Paul R. Moore, Star Lake. Motion by Windels, seconded Lee and unanimously carried to approve the Conditional Use Application of Bob Kautzman, Dead Lake, subject to conditions and recommendations as indicated by the Planning Commission. Motion by Lee, seconded Partmann and unanimously carried to approve the Conditional Use Application of Timothy R. Dacy, Otter Tail Lake, subject to conditions and recommendations of the Planning Commission. Motion by Partmann, seconded Windels and unanimously carried to approve the Conditional Use Application of Richard Dielke/Jerry McDonald, Trowbridge Acres, subject to conditions and recommendations of the Planning Commission. Motion by Partmann, seconded Windels and unanimously carried to approve the Conditional Use Application of Trowbridge Acres, subject to conditions and recommendations indicated by the Planning Commission. Orvis Jibben and Anna Hunter appeared requesting twelve additional RV spaces, Conditional Use Application of Anna Hunter/Wagon Wheel Resort, Rush Lake. Orvis Jibben provided the Board with a tier drawing which included a four foot fence surrounding a portion of the Wagon Wheel property. Jess Thompson appeared in favor of the project. Letters and petitions of opposition for this project were acknowledged. Several residents of the surrounding properties voiced their opposition and concerns of over crowding. Motion by Windels, seconded Partmann ~nd unanimously carried to table a decision on the twelve additional RV spaces, Conditional Use Application of Anna Hunter/Wagon Wheel Resort, Rush Lake, for two weeks. Commissioners Lee and Windels and Land & Resource Director, Bill Kalar, will meet with Mr. Jibben and the owners and report back to the Board with a recommendation. Homestead Request Motion by Partmann, seconded Windels and unanimously carried to comply with Minnesota Statute 273.124 and deny residential homestead to David Reynolds on his 99 year lease property as his situation does not comply with all of the requirements of this statute. Courtroom Security Sheriff, Gary Nelson, Maintenance Supervisor, Rick Sytsma and Judge Tom Stringer discussed security improvements recommended by the U.S. Marshall's Office. The Courtroom Security Committee will meet Thursdays rather than Wednesdays in the future to allow either Commissioner Lindquist or Lee to attend. Motion by Lee, seconded Stone and unanimously carried to approve signs for third floor stating "You Are Now Entering A Secure Area" as recommended by the Sheriff. Bid Award: s.A.P. 56-599-14, Bridge No. 95050, Gorman Township Motion by Windels, seconded Lee and unanimously carried to accept the recommendation of the Highway Engineer to award Project No. s.A.P. 56-599-14 to the lowest bidder, Riley Bros. construction, Inc., Morris, MN, in the amount of $125,582. 0 -~ Otter Tail County Board of Commissioners September 9, 1992 Page 3 Highway Right-of-Way Maintenance Motion by Partmann, seconded Lee and unanimously carried to authorize the Highway Engineer to handle maintenance requests of highway right-of-way areas on a case-by-case basis and to allow individuals to care for these areas as long as there is no effect on the drainage of the road bed and the work has been authorized be the Highway Engineer. Adoption of Preliminary Budget Proposed Budget and Property Tax Levy for Payable 1993. Comparable Budget and Proposed Tax Levy Information for Payable 1992 and 1993. 1992 1993 Change Gross Property Tax Levy 11,148,297 11,855,902 6.3% Net Property Tax Levy 9,209,348 9,669,815 5.0% General Fund Budget and Budgeted Special Revenue Funds 32,000,000 35,500,000 10.9% Upon recommendation of the Budget Committee the following resolution was offered by commissioner Lee, seconded by Commissioner Lindquist and unanimously carried with a roll call vote as follows: Yes No Lee X Lindquist X Partmann X Stone X Windels X BE IT Resolved, by the Board of County Commissioners of Otter Tail County Minnesota, that: The amount of 11,855,902 be adopted as the County's Proposed Gross Property Tax Levy for the payable year 1993, representing a 6.3% increase over the gross property tax levy for the payable year 1992, and that the amount of 9,669,815 be adopted as the County's Proposed Net Property Tax Levy for the payable year 1993, representing a 5% increase over the Net Property Tax Levy for the payable 1992 year, and that the amount of $35,500,000 be adopted as the County's Proposed Budget for the General Fund and the Budgeted Special Revenue Funds for the year 1993, representing a 10.9% increase over the County's 1992 Proposed Budget. Q otter Tail County Board of Commissioners September 9, 1992 Page 4 Abatements Motion by Lee, seconded by Stone and unanimously carried to approve the following abatements: Leaf Lake Township: John and Tina Juvrud 35-300-50-0058-000 Abate on as omitted personal property mobile home tax. Perham Township: Tammy Watkins 51-300-50-0191-000 Abate off the personal property tax rolls as the ownership of this mobile home changed July, 1991. Jennifer Dertinger 51-300-50-0191-000 Abate on to the personal property tax rolls to correct the ownership of this mobile home. Liquor License Application Motion by Lee, seconded by Partmann and unanimously carried to approve the following license application: A transfer of the On/Off-sale Non-Intoxicating Malt Liquor License from Johnson Bait and Tackle to Jason North Shore Bait. (No Fee). Recycling Facility Agreement Recycling Manager, Bob Williams, reviewed the Recycling Facility Labor Agreement with Productive Alternatives and informed the Board of changes in the contract. Motion by Partmann, seconded Lee and unanimously carried to authorize the Chairman to sign the modified Recycling Facility Labor Agreement with Productive Alternatives as recommended by the Recycling Manager. United Way Motion by Lee, seconded Windels and unanimously carried to authorize the Employees Committee to organize and conduct the United Way Fund Drive for Otter Tail County. Domestic Violence and Sexual Assault Awareness Month Motion by Partmann, seconded Lee and unanimously carried to authorize the Crisis Center to conduct an evening vigil on October 15, 1992, and to display pictures within the Courthouse during the week of October 12, 1992, in an area to be designated by the County Coordinator. T-shirts displayed on a clothesline may also be displayed on the Courthouse grounds in designated areas for Domestic Violence and Sexual Assault Awareness Month.
