HomeMy WebLinkAboutBoard of Commissioners - Minutes - 06/24/19920 0 Q Minutes of the OTTER TAIL COUNTY BOARD OF COMMISSIONERS Commissioners' Room, Floor 1-B Otter Tail County Courthouse Wednesday, June 24, 1992 1:00 p.m. Call To Order The Otter Tail County Board of Commissioners convened Wednesday, June 24, 1992, at 1:00 p.m. at the Otter Tail County Courthouse with Commissioners Andy Lindquist, Chairman; Harley Windels, Bill Stone, Malcolm Lee and Virginia Partmann present. Minutes Approved Motion by Lee, seconded Partmann and unanimously carried to approve the June 17, 1992, minutes as submitted. Bids: Yearly Traffic Marking The Highway Engineer, having previously advertised for bids, opened the following bids for Yearly Traffic Marking: A.A.A. Striping Rogers, MN Traffic Marking Service Buffalo, MN $52,091.30 $52,487.56 Motion by Lee, seconded Windels and unanimously carried to award the bid for Yearly Traffic Marking to the low bidder, A.A.A. Striping of Rogers, MN, in the amount of $52,091.30. Pipeline Agreement Reached Rick West, Highway Engineer, reported on negotiations of the Park Rapids Gas Pipeline along CSAH No. 75 and CSAH No. 66 indicating that a tentative agreement had been reached which would result in no cost incurred to Otter Tail County as a result of either moving the pipeline away from the road right-of-ways or that it would be buried deeper. State of Minnesota -CPV Membership Motion by Lee, seconded Partmann and unanimously carried to approve the request of the Highway Engineer to pay the yearly membership of $350 to the State of Minnesota's Cooperative Purchase Venture (CPV) for cooperative purchasing. Insurance Deductible Motion by Partmann, seconded Lee and unanimously carried to approve the payment of $93.75 to Meadowbrook Insurance Group for closing File No. 3064, which is under the County's deductible. ECSU Membership -Purchase Motion by Partmann, seconded Stone and unanimously carried to approve the payment of $250 for Associate Membership with ECSU, Fergus Falls, for contract purchasing of various office supplies, etc. 0 0 0 Otter Tail County Board of Commissioners June 24, 1992 Page 2 otter Tail County Housing Rehabilitation Program The Chairman reported that the Otter Tail County Housing Rehabilitation Program Grant through the State of Minnesota/Department of Trade and Economic Development has been approved. Reclassification Diane Thorson and Chuck Kitzman, representing the Reclassification Committee, indicated they had received a request for a reclassification in the Data Processing Department. It was the Committee's recommendation that there be three levels of programmers within the Department with position titles changed to Programmer I, II and III. During the process, a reclassification was recommended to change the Information Specialist, Range 13 to Programmer I, Range 14 effective July 1, 1992. Positions renamed, but not affected by range changes: Programmer, Range 15, to Programmer II and Programmer/Analyst, Range 17, to Programmer III. The number of employees in each of these classifications, it was pointed out by Thorson, was a matter for the Department Head and the Board. It was indicated that the position of systems Administrator, currently a Range 15, would be reviewed as the result of this reclassification. Motion by Lee, seconded Windels and unanimously carried to approve the above as presented. Viking Library system Members of the Viking Library System, which included David Barton, Teresa Parker, Pat Krekelberg, Dave Ellis and Ginger Stemme provided an update of the library's services and programs. Pat Conroy, Laurel Sorlie and Wes Binner, representing the West Central Minnesota Initiative Fund (WCMIF) discussed various projects and plans with the Board as well as proposed budgeting. Street Dance -Graystone Lodge Motion by Lee, seconded Partmann and unanimously carried to deny the request of Jim Ellis of Graystone Lodge to hold a street dance on July 4th which would result in blocking of a County road due to the amount of highway construction taking place in that area and the need for detouring traffic. Soil Survey Agreement Motion by Stone, seconded Windels and unanimously carried to reimburse the Soil Conservation Service for costs incurred in the amount of $18,120 for furnishing technical assistance in accordance with the Soil Survey agreement between the Otter Tail County Board of Commissioners and the Soil Conservation Service for the period April 1, 1992 to June 30, 1992. 0 0 a Otter Tail County Board of Commissioners June 24, 1992 Page 3 Liquor License Applications Motion by Windels, seconded Fortmann and unanimously carried to approve the following applications for liquor licenses: Balmoral Golf Course, Inc. This parcel is presently in the name of Paul and Nona Rick, but on January 1, 1991, it was in the name of Everett and Shannon Erickson and should have been connected to their primary parcel #96-001 for the 1991 assessment. Card was filed in January of 1991, but was 0 0 Otter Tail County Board of Commissioners June 24, 1992 Page 6 Otter Tail Lakes Area Sewer District Board Motion by Stone, seconded Partmann and unanimously carried, to appoint Mr. Donn Siems to a four year term on the Otter Tail Lakes Area Sewer District Board, as per the recommendation of the Everts Township Board. Lease Agreement Motion by Windels, seconded Stone and unanimously carried to authorize the Chairman of the Board to sign the lease agreement between Otter Tail County and Rita K. Lyles for the lease of Lot 1 Block 6 of Hidden Trails to the City of New York Mills subject to the same conditions offered Kevin Jackson with the understanding that the lease expires when property is sold. Correction to Plat Motion by Lee, seconded Windels and unanimously carried to accept the Certificate of Correction to Plat as presented below. LAND SURVEYORS CERTIFICATE OF CORRECTION TO PLAT Pancratz Beach Pursuant to provisions of Chapter 472, Laws of Minnesota, 1955, and Chapter 505.173, 505.174 through 505.177, Laws of Minnesota, Terry Lee Anderson, the undersigned, a Registered Land Surveyor in and for the State of Minnesota declares as follows: (1) The subdivision plat of Pancratz Beach was prepared by Martin A. Alberg, a Civil Engineer, of whom is retired from surveying practice. His whereabouts is unknown and he may be deceased. (2) The subdivision plat of Pancratz Beach was filed on July 13th, 1922 in the office of the County Recorder in and for Otter Tail County, Minnesota and was recorded in Book J of Plats on page 56. (3) That said plat contains errors, omissions or defects in the following particulars to wit: A sliver of land was inadvertently omitted from the boundaries of this plat, which lies between the actual shoreline of Big Pine Lake and the described easterly boundary of the plat. All lot lines are to be extended easterly to intersect the shoreline of Big Pine Lake. The original plat called out the shoreline, but when the legal description was prepared the surveyor described his survey line just westerly of the shoreline. Also, the legal description of the outside boundaries of the plat starts from an unfixed position. Also, the outside boundary line contains several errors in both angle and distance calls to fit what actually lays on the ground. (See Exhibit A) (4) That the following legal description is a correct representation of the boundaries of Pancratz Beach and is to replace the legal description as shown on the plat. That part of Government Lots 2 and 3 of Section 7, Township 136 North, Range 38 West, Otter Tail County, Minnesota described as follows: Commencing at the Southwest corner of said Section 7; thence North 00 degrees 14'10" East (Assumed Bearing) along the West Line of Section 7 a distance of 2,627.71 feet to the West Quarter Section Corner of said Section 7; thence North 00 degrees 23'09" East along the West Line of said Section 7 a distance of 1,307.93 feet to the Northwest Corner of the Southwest Quarter of the Northwest Quarter of Q otter Tail County Board of commissioners June 24, 1992 Page 7 said Section 7; thence on a bearing of East along the North Line of said Southwest Quarter of the Northwest Quarter and the North Line of said Government Lot 2 a distance of 1,935.86 feet to the point of beginning; thence South 10 degrees 47' 53" West a distance of 296.93 feet; thence South 14 degrees 23'33" East a distance of 374.28 feet; thence South 05 degrees 11'47" East a distance of 244.36 feet; thence South 14 degrees 27'16" East a distance of 485.71 feet; thence South 24 degrees 42'23" East a distance of 217.17 feet; thence South 41 degrees 31' 19" East a distance of 321.27 feet; thence North 53 degrees 25' 48" along said shoreline to its intersection with the North Line of said Government Lot 2; thence on a bearing West along said North Line to the point of beginning. (5) That the sidelines of Lots 1 through 22 are to be extended easterly to intersect the shoreline of Big Pine Lake. I hereby certify that this report was prepared by me or under my direct supervision and that I am a duly Registered Land Surveyor under the laws of the State of Minnesota. Terry Lee Anderson, Minnesota Registration Number 14676 Exemption from Lawful Gambling License There was no objection expressed to the lawful gambling license application of The Church of St. James located in Maine. Conditional Use Applications Motion by Lee, seconded stone and carried to approve the Conditional Use Application of Kevin Pederson, Clear Lake, as modified. Bill Kalar, Land & Resource Director, was requested to explain action to Planning Commission. Motion by Windels, seconded Lee to uphold the recommendation for denial by the Planning Commission on Charles Ernston, Wall Lake. The Land & Resource Director indicated the Conditional Use Application of Gerald Benson, Heilberger Lake, was placed on the July Planning Commission Agenda and that the correct site was viewed. Lake Shore Association -Silver Lake Motion by Lee, seconded Partmann and unanimously carried to approve the request of the Silver Lake Lake Shore Association to be placed on the sewer system priority list for abatement of non-conforming sewage systems. Request to Lower Liquor License Fee Virgil Kilde, Amor Villa, requested the Board to reduce the rate of a seasonal liquor license fee which is $1,600 to a lower rate. Motion by Partmann, seconded Windels and unanimously carried to table the request for further study. Food Service Contract Renewal Motion by Partmann, seconded Stone and unanimously carried to renew the food service contract with Best, Inc. effective July 1, 1992. Adjusted actual savings cited were $17,000 during the contract period of July 1, 1991 to June 30, 1992. • 0 0 CJ otter Tail County Board of Commissioners June 24, 1992 Page 8 Committee Reports Commissioner Partmann reported on a recent University of Minnesota Extension, Pine to Prairie Cluster, meeting as well as the Long Range Planning Committee. Commissioner Lee reported on recent Association of Minnesota Counties Policy Committee meetings. Binding Arbitration -Grievance Motion by Partmann, seconded Lee and unanimously carried in response to the binding arbitration award of the grievance filed by the Teamsters Union regarding free meals for detention officer/dispatchers, the County Auditor is hereby authorized to reimburse the regular detention officer/dispatchers $1 for each meal they purchased from Best, Inc. since July 1, 1991; and to provide $1 additional compensation henceforth for each shift, which includes a meal, worked by a regular detention officer/dispatcher. Adjournment At 4:25 p.m., Chairman Lindquist declared the meeting adjourned.
