Minutes of the OTTER TAIL COUNTY BOARD OF COMMISSIONERS Commissioners' Room, Floor 1-B Otter Tail County Courthouse Wednesday, June 10, 1992 1:00 p.m. Call To Order The Otter Tail County Board of Commissioners convened Wednesday, June 10, 1992, at 1:00 p.m. at the Otter Tail County Courthouse with Commissioners Andy Lindquist, Chairman; Harley Windels, Bill Stone, Malcolm Lee and Virginia Partmann present. Minutes Approved Motion by stone, seconded Windels and unanimously carried to approve the June 3, 1992, minutes as submitted. Bicycle Race Motion by Lee, seconded Partmann and unanimously carried to grant permission for the Star of the North bicycle games to use County Roads 9, 34, 32 and 23 on June 27, 1992, contingent on the conditions that the games are in compliance with the United States cycling Federation safety rules, that the Sheriff's Department has been notified and do not object to such race being held on the above mentioned County roads, and that the County is not liable for claims arising from the race. Position Authorized Motion by Partmann, seconded Lee and unanimously carried to authorize the replacement hiring of a full-time STS Crew Leader position. Hiring to be open to the public and follow normal procedures through the Coordinator's Office. Phone System Card Payment Authorized Motion by Lee, seconded Stone and unanimously carried to purchase an additional digital card at a cost of approximately $1,000. Conditional Use Applications Motion by Lee, seconded Stone and unanimously carried to approve the following conditional Use Applications subject to conditions and recommendations as indicated by the Planning Commission: Approvals: Donald c. Motion by Lindquist, seconded Lee and unanimously carried to table action on the Conditional Use Application of Charles F. Ernston, Wall Lake, until the Land & Resource Management Office has information as to clarification of wetland. Motion by Lee, seconded Windels and unanimously carried to refer the Conditional Use Application of Gerald Benson, Heilberger Lake, back to the Planning Commission for clarification of the Commission viewing the correct site. Land & Resource Director to ensure correct site is viewed. Note: For detailed information regarding any of the above listed conditional use permits, contact the Land & Resource Management Office. Engineering Consultant Agreement Motion by Lee, seconded Windels and unanimously carried to approve the professional engineering services required for the design and construction of the North Otter Tail County Overlay project with Interstate Engineering, Inc. Highway Construction Contracts Motion by Partmann, seconded Windels and unanimously carried to authorize Chairman Lindquist to execute the highway construction contracts with Starry Construction Company, Inc. for Project No. 56-635-25 & Etc. as well as the highway construction contract with Mark Sand & Gravel company for Project NO. 56-615-12 & Etc. as previously awarded. Transfer of Equipment Motion by Lee, seconded Windels and unanimously carried to approve the transfer of a 1967 Ford Tractor/Loader from the Highway Department to the Solid Waste Department as requested by the Highway Engineer. Inventory to reflect transfer and no funds exchanged. Position Authorized Motion by Lee, seconded Fortmann and unanimously carried to authorize the Highway Engineer to begin the procedure for replacement of the Assistant Highway Engineer (retirement proposed 10/1/92). AMC -M.A.G.I.C. Fund Motion by Lee, seconded Fortmann and unanimously carried to adopt a resolution authorizing entry into a joint powers agreement in the form of a Declaration of Trust establishing an entity known as "Minnesota Association of Governments Investing for Counties" and authorizing participation in certain investment programs. Such resolution to be reviewed by the County Attorney prior to Chairman Lindquist's signature. Motion by Windels, seconded Stone and unanimously carried to authorize the Chairman of the Board to sign the lease agreement between Otter Tail County and Kevin Jackson for the lease of Lot 1 Block 6 of Hidden Trails to the City of New York Mills. Otter Tail Lake Sewer District Motion by Stone, seconded Partmann and unanimously carried to waive the approval requirement according to M.S. 116A.24 Subd. 2 (a) with regard to otter Tail Lake Sewer District's establishment of bonding requirements. Deferred Compensation There was general discussion about deferred compensation plans, the number being offered and possible policy criteria. The coordinator, in conjunction with the Auditor, were asked to draft a policy for establishing guidelines for plans to be offered and recruitment from outside sales staff. Tax Forfeited Lands Lists of proposed tax forfeited lands were distributed by the Auditor to individual commissioners. Board of Equalization/Regular Board Meeting Motion by Partmann, seconded Lee and unanimously carried to continue the regular business for the Board of commissioners' meeting on June 17, 1992, after the Board of Equalization meeting has closed. Phelps Mill Park Manager Motion by Lee, seconded Partmann and unanimously carried to offer the Phelps Mill Park Manager position to Kenneth L. Peterson of Battle Lake. 0 0 Otter Tail County Board of Commissioners June 10, 1992 Page 8 Committee Reports Commissioner Partmann reported on recent Long Range Planning Committee activities and discussed upcoming meeting plans. Several commissioners (Lindquist/Fortmann/Lee) attended the Landfill meeting between Fergus Falls and Otter Tail County. Meeting focus was directed at aspects of one vs two landfills. Sustainable Ag Grant -WOT Motion by Partmann, seconded Lee and unanimously carried to authorize the Auditor to pay grant monies to a full time temporary student serving on the program. Recycling Building -Pelican Rapids Motion by Lee, seconded Stone and unanimously carried to authorize the County Attorney to propose a settlement with regard to the special assessments on the recycling building in Pelican Rapids. Stang Lake Restoration Project Motion by Lee, seconded Fortmann and unanimously carried to authorize the Board's Chairman to execute the engineering contract for the services of Interstate Engineering, Fergus Falls, regarding the impoundment of Stang Lake when the contract has been drafted. Adjournment At 4:12 p.m., with no further business, Chairman Lindquist declared the meeting adjourned and closed to the public.
