HomeMy WebLinkAboutBoard of Commissioners - Minutes - 05/20/19920 0 0 Minutes of the OTTER TAIL COUNTY BOARD OF COMMISSIONERS Commissioners' Room, Floor 1-B Otter Tail County Courthouse Wednesday, May 20, 1992 9:30 a.m. Call To Order The Otter Tail County Board of Commissioners convened Wednesday, May 20, 1992, at 9:30 a.m. at the Otter Tail County Courthouse with Commissioners Andy Lindquist, Chairman; Harley Windels, Bill Stone, Malcolm Lee and Virginia Partmann present. Minutes Approved Motion by Partmann, seconded Stone and unanimously carried to approve the May 13, 1992, minutes as submitted. Solid Waste Issues Solid Waste Director, Mike Hanan, reported on a number of solid waste issues which included Volume Based Pricing, the possible effects of burning barrels and illegal dumping. Motion by Portmann, announced later by Amnesty for Tires & White Goods seconded Lee and unanimously carried to declare a date (to be the Solid Waste Director) for amnesty for tires and white goods directed at a residential level. Motion by Stone, one-third the rate collection date. seconded Partmann and unanimously carried to charge approximately charged for the disposal of tires and white goods on the amnesty Landfill Committee Chairman Lindquist appointed Commissioner Partmann and himself to the Landfill Committee to meet with the City of Fergus Falls to discuss one vs two landfills. This newly formed committee will also include two members of the Solid Waste Advisory Committee from the Perham and New York Mills areas. Pesticide Container Collection Motion by Lee, seconded Windels and carried to authorize the Chairman to sign the Pesticide Planning Group Reports on behalf of Otter Tail County. Abatement Request Motion by Stone, seconded Windels and unanimously carried to deny the request of JoAnne Pier regarding abatement to allow the recording of a sale of one of two lots without payment of the year's taxes on both lots, which are recorded on the tax list as a single tax parcel. After tabling the request to allow the County Attorney time to research the definition of a tax parcel, a denial was based on M.S. 272.03, Subd. 6, which defines tract, lot, piece or parcel of land as ''any contiguous quantity of land in the possession of, owned by, or recorded as the property of, the same claimant or person." The two lots listed as a single tax parcel on the tax list do fall under the requirement Q 0 Otter Tail County Board of Commissioners May 20, 1992 Page 2 of Minnesota Statute 272.121. Under that statute, the entire tax for 1992 must be paid before the sale of one of the lots can be recorded. Reclassification Committee Motion by Lee, seconded Fortmann and unanimously carried to approve the recommendation of the Reclassification Committee to adjust the ranges as follows: Range 14 -Detention Facility Team Leader Range 13 -Line Staff Detention Facility Officer Sand Lake Public Restroom Facilities Motion by Lee, seconded Partmann, and unanimously carried to request that the Department of Transportation investigate and take immediate action to provide public restroom facilities for summer use of the Sand Lake public access beach area. A resolution requesting an investigation of this has been previously adopted on August 7, 1991 by the Otter Tail County Board of Commissioners. Motion by Windels, bills per Attachment Approval to Pay Bills seconded Stone and unanimously carried to authorize the payment of A of these minutes. South Cascade Project Motion by Fortmann, seconded Lee and unanimously carried to enter into an agreement with the City of Fergus Falls regarding the South Cascade Project. Girard Township Culvert A request from Girard Township regarding two 24" culverts was discussed relative to the cost sharing policy between the townships and County. This request does not conform to the County's policy, therefore, no action was taken. Engineering Agreements Motion by Lee, seconded Partmann and unanimously carried to approve the Engineering Agreements with Interstate Engineering, Inc. on approximately 5,000 feet of urban roadway, County Road 16, located in Battle Lake and another agreement with the same engineering firm for replacement of existing Bridge No. 3566 with Bridge No. 97438 over the Pelican River on Elizabeth Township Road 880 located 3-1/2 miles north of Elizabeth. Highway Construction Contract Motion by Windels, seconded Lee, and unanimously carried to approve the Highway Construction Contract with Egge Construction, Inc., Pelican Rapids, for the performance of work and labor in the construction of CSAH No. 28 from 0.75 mile west of T.H. No. 59 to 750 feet west. Otter Tail County May 20, 1992 Page 3 Board of Commissioners Small Hazardous Waste Generator Registration Motion by Partmann, seconded Stone and carried, with Lee opposed, to approve the payment of $94.24 for the Small Hazardous Waste Generator Registration Fee as set forth by the MPCA. Purchase Approved Motion by Stone, seconded Lee and unanimously carried to approve the purchase of a personal computer for the Highway Department from the lowest quotation, Computer Specialists Unlimited, Alexandria, MN, in the amount of $3,995. Final Payment: Seasonal Supply of Herbicides Motion by Lee, seconded Windels and unanimously carried to approve the final payment in the amount of $12,039.81 payable to Ostlund Chemical Co. as was awarded on April 22, 1992. Liquor License Applications Motion by Windels, seconded by Lee and unanimously carried to approve the following liquor license applications: Madsen's Resort and Store Charles Malmstrom Battle Lake, MN Colonial Lounge Suzanne Roble Perham, MN Off-Sale Non-Intoxicating Malt Liquor License *On-Sale Intoxicating Liquor License and Sunday Liquor Off-Sale Non-Intoxicating Malt Liquor License *Note: Subject to the insurance papers being submitted to the Auditor's Office. Mileage Reimbursement Rate Change Motion by Partmann, seconded Windels and unanimously carried to authorize the payment of $.275/mile mileage reimbursement. This figure matches the State's per mile reimbursement and is effective June 1, 1992. New Position Approvals Motion by Lee, seconded Stone and unanimously carried to freeze authorization of any newly created positions pending the first meeting of the Budget Committee which is scheduled for June B, 1992.
