OTTER TAIL COUNTY BOARD OF COMMISSIONERS

Call To Order
The Otter Tail County Board of Commissioners convened Wednesday, May 13, 1992, at
1:00 p.m. at the Otter Tail County Courthouse with Commissioners Andy Lindquist,
Chairman; Harley Windels, Bill Stone, Malcolm Lee and Virginia Partmann present.
Minutes Approved
Motion by Lee, seconded Partmann and unanimously carried to approve the May 6, 1992,
minutes as submitted.
Bid Opening: SAP 56-615-12 & Etc.
The Highway Engineer, having previously advertised for bids, opened the following bids
for project SAP 56-615-12 & Etc.:
Mark Sand & Gravel Company
Fergus Falls, MN
Starry Construction Co., Inc.
Long Prairie, MN
$1,133,540.79
$1,436,051.30
Motion by Partmann, seconded Stone and unanimously carried to award the SAP 56-615-12 &
Etc. project to the lowest bidder, Mark Sand & Gravel Company, Fergus Falls, MN, in the
amount of $1,133,540.79.
Final Payment Approved
Motion by Partmann, seconded Windels and unanimously carried to approve the final
payment to Starry Construction Co., Inc., Long Prairie, MN, for SAP 56-616-06 & Etc. in
the amount of $71,861.59 per February 28, 1990, bid award.
Consulting Agreement for Engineering Services
Motion by Stone, seconded Windels and unanimously carried to approve the consulting
agreement for engineering services for Stalker Lake and Long Lake with Interstate
Engineering, Inc. as requested by the Highway Engineer.
Safety Issues
Motion by Windels, seconded Lee and unanimously carried to direct the Highway Engineer,
Rick West, to proceed with necessary safety measures and issues and to periodically
report progress to the Board.
Seasonal Supply of Hot Mix Bituminous Contracts
Motion by Lee, seconded Windels and unanimously carried to authorize the Chairman to
execute the Seasonal Supply of Hot Mix Bituminous contracts with Wadena Asphalt Company
in the amount of $32,800 and Mark Sand & Gravel Company in the amount of $15,500 as
previously awarded.

Motion by Lee, seconded Stone and carried to approve the following recommendations of
the Reclassification Committee:
That the job title "Sign Man11 be changed to "Sign Technician" and that the job range
remain as previously classed.
That the Court services secretary, due to additional job duties, be changed from a
Range 11 to a Range 12.
Installer's License
Motion by Lee, seconded Partmann and unanimously carried to approve the Installer's
License Application of Ferguson Bros. Excavating, Inc., Alexandria.
Conditional Use Applications
Motion by Stone, seconded Windels and unanimously carried to approve the following
Conditional Use Applications subject to conditions and recommendations as indicated by
the Planning Commission:
Lida Township, Lake Lida
Amor Township, Otter Tail Lake
Norman Selzie, Pickeral Lake

Motion by Partmann, seconded Windels and carried, with Lee opposed, to deny the
Conditional Use Application of Robert Miller, West Battle Lake.
Motion by Lee, seconded Partmann and carried to refer back to the Planning Commission
the Conditional Use Application of Gerald Benson, Heilberger Lake, for review.
Note: For detailed information regarding any of the above listed conditional use
permits, contact the Land & Resource Management Office.
Abatement
JoAnne Pier, together with Auditor, Wayne Stein, was present to discuss parcels
74-000-99-0325-801 and 74-000-99-0325-003. Parcel 325-801 325-801 represents Tract Bon
the map provided and parcel 325-003 represents Tract C & Don the map. The value of the
building that is on Tract Bis assessed and taxed along with the balance of the building
on Tract c, parcel 325-003. JoAnne Pier has sold Tracts Band C. Since Tract C is a
part of parcel 325-003 it has been requested that the 1992 Property taxes be paid in
full before the deed transferring title to Tract c can be recorded. Payment of the
current taxes on property being divided is required to be paid according to the
Minnesota Statute 272.121.
After lengthy discussion, a motion was made by Windels, seconded Partmann and
unanimously carried to table any decision on the above matter until the County Attorney
has had an opportunity to research what constitutes a tax parcel.

Motion by Lee, seconded Partmann and carried, with Stone opposed, to approve the signing
of an agreement with the Department of Administration, Intertechnologies Group for the
production and mailing of redistricting notification cards to each registrant in the
County.
BRA Contract
Motion by Lee, seconded Stone and carried to adopt the following resolution authorizing
contract for services for the 1992 Otter Tail County Housing Rehabilitation Program.
BE IT RESOLVED that Otter Tail County enters into a contract with the Fergus Falls
Housing and Redevelopment Authority (HRA) for the administration of the 1992 Otter Tail
County Housing Program.
The Chairman of the Otter Tail County Board is hereby authorized to execute
certifications as required and execute such contract as is necessary to implement the
program on behalf of Otter Tail County.

Empty Pesticide Container Collection
Solid Waste Public Information Officer, Marie Tysdal, discussed with the Board plans for
an upcoming Empty Pesticide Container Collection tentatively scheduled for
July 21-22, 1992. Planning questions were directed through a telephone conference call
with Larry Palmer, MN Department of Agriculture and Lisa Holmquist, MN Plant, Food &
Chemical Association.
Joint Participation -Necessity & Emergency
Motion by Lee, seconded Partmann and unanimously carried to offer the following
resolution in support of establishing joint participation in case of necessity and
emergency:
WHEREAS, the Board of Commissioners of Otter Tail County recognize the need for joint
utilization of law enforcement necessity, and
WHEREAS, the Boards of County Commissioners of the following counties of Douglas,
Kandiyohi, Wilkin, Traverse, Grant, Yellow Medicine, Stevens, Lac Qui Parle, Chippewa,
Todd, Pope, Meeker, Renville, Big Stone, Redwood, McLeod, Brown, Sibley, and Swift
recognize a similar need for joint utilization of law enforcement facilities, equipment,
personnel in the event of emergency and necessity, and are desirous of joining in such
joint utilization, and
WHEREAS, the County of Otter Tail, pursuant to Minnesota Statute 471.59, may agree,
through action of its governing body, to jointly and cooperatively exercise any power,
with other governmental units, and
WHEREAS, in furtherance of the aforesaid purposes, the Otter Tail County Board of
Commissioners endorses the Joint Agreement document which is attached hereto and
incorporated by reference herein,
IT IS HEREBY RESOLVED, that the appropriate county officials of Otter Tail County are
authorized to execute said Agreement and to thereafter forward said Agreement and a copy
of this resolution to the other above named counties for their consideration and
approval.

Personnel Policy Rules
Motion by Stone, seconded Partmann and unanimously carried to authorize the continued
use of the current Personnel Policy until which time the Personnel Administration Rules
are adopted.

County Vehicle Use
Motion by Stone, seconded Fortmann and unanimously carried to adopt a policy stating
that no employee shall operate a county vehicle after consumption of any alcoholic
beverage. Such policy shall also be adopted into the Personnel Administration Rules.
Adjournment
Closed to Public
At 4:18 p.m., Chairman Lindquist declared the meeting adjourned and closed to the public
for purpose of discussing labor negotiation strategies with the county's collective
bargaining units. Next Board meeting is scheduled for 9:30 a.m. on May 20, 1992.
