Call To Order
The Otter Tail County Board of Commissioners convened Wednesday, March 4, 1992, at
9:30 a.m. at the Otter Tail County Courthouse with Commissioners Andy Lindquist,
Chairman;·Harley Windels, Bill Stone, Malcolm Lee and Virginia Portmann present.
Minutes Approved
Motion by Partmann, seconded Lee, and carried to approve the February 26, 1992, minutes
as submitted with the notation that Portmann opposed the White Oak Metals Resolution.
Sheriff's Department Update
Sheriff Gary Nelson and Chief Deputy Dick Kausler discussed views on the part-time peace
officer supervision issue. It was agreed that Chairman Lindquist, Sheriff Nelson and
Chief Deputy Kausler would meet with the affected City Councils and discuss options and
report back their recommendations.
East Otter Tail Aq Inspector's Report
Motion by Windels, seconded Lee and unanimously carried to approve the 1991 County Ag
Inspection Annual Report by Ken Becker for East Otter Tail County and to authorize the
Chairman to sign the report on behalf of the Board.
SAP 56-599-11 -Elizabeth Twp. Bridge over Pelican River
Highway Engineer Rick West, after having previously advertised for bids on project
SAP 56-599-11, Elizabeth Twp. Bridge No. 91900 over the Pelican River, opened the
following bids:
Landwehr Heavy Moving, Inc. $93,461.75
St. Cloud, MN
Midwest Contracting, Inc. $95,270.00
Marshall, MN
Riley Bros. Construction, Inc.
Morris, MN
$94,016.00
Motion by Stone, seconded Windels, and unanimously carried to accept the recommendation
of the Highway Engineer and the Elizabeth Town Board to award the bid to the lowest
bidder, Landwehr Heavy Moving, Inc. of St. Cloud, MN.
North Bituminous Overlay Project -SAP 56-635-25 & Etc.
Motion by Windels, seconded Partmann, and unanimously carried to authorize the Highway
Engineer to advertise for bids on the North Bituminous Overlay Project SAP 56-635-25 &
Etc. for County Roads 60, 49 and part of 35 with closing set for 1:00 p.m. on April a,
1992.

otter Tail Valley Railroad Bridge Disposition
John Secor, representing the Otter Tail Valley Railroad, discussed various options
regarding the disposition of two railroad bridges in Otter Tail County on abandoned rail
lines~ Mr~ Secor cited several options that could be taken and it was decided that
there should be a meeting in Dalton with the City Council regarding any proposed removal
of the bridge by the railroad because they would be most affected.
Parade Request
Motion by Windels, seconded Partmann, and unanimously carried to approve the request of
the Perham VFW to have a parade on March 17, 1992, in Perham to be assisted by the
Perham Police Department.
Com.missioner Lee Absent
At 11:00 a.m. Commissioner Lee was excused for the purposes of testifying on behalf of
the County at an Administrative Law Judge/DNR hearing.
Ag/Ditch Inspector's Update
Motion by Partmann, seconded Stone, and unanimously carried to approve the 1991 County
Ag Inspection Annual Report by Roland Sauck for West Otter Tail County and to authorize
the Chairman to sign the report on behalf of the Board.
Long-Range Planning Committee
Commissioner Partmann reported on the first Long-Range Planning Committee meeting held
oh March 3, 1992, and indicated agenda items for the next committee meeting.
Farm Mediation Program
Minnesota Extension Service Director for Otter Tail County, Denzil Cooper, discussed
with the Board a request from the Minnesota Extension Service for Otter Tail County to
disburse salary money to Ken Rose from University of Minnesota funding per a contract
from October 1, 1991 to September 30, 1992. Mr. Rose serves as a part-time Farm
Mediation Cluster County Coordinator and services the mediation program. Matter was
tabled until the County Attorney could respond to specific areas of the contract.

WHEREAS, the sum of $21,082.76 has been submitted, representing the aggregate of all
delinquent taxes, penalties, costs assessments and fees,
NOW, THEREFORE, BE IT RESOLVED, the County Board does hereby approve the above
repurchase, with the conditions that there be $100 charged for rent on property used and
that signed applications for repurchase of tax forfeited lands and well disclosure
certificates are filed with the County Auditor, to be in the best public interest and to
relieve undu~ hardship.
Adopted at Fergus Falls, MN, this 4th day of March, 1992,
Gambling Permit
Upon a motion by Windels, seconded by Fortmann and unanimously carried, the otter Tail
County Board of Commissioners adopted the following resolution:
WHEREAS, the responsibility for the regulation of lawful gambling and the issuance of
licenses and permits for the conduct of lawful gambling lies with the Minnesota Gambling
Control Board; and
WHEREAS, the Minnesota Therapeutic Camp, Inc. has made application to the Gambling
Control Board for a premises permit to conduct lawful gambling at the Country Manor
Motel Restaurant & Lounge in Compton Township of otter Tail County; and
WHEREAS, Minnesota Statutes 349.213 provides that the Gambling Control Board may not
issue a premise permit unless they receive a resolution from the County Board approving
the permit; and

WHEREAS, the Otter Tail County Board is aware of no reason to oppose the conduct of
lawful gambling by the Minnesota Therapeutic Camp, Inc. at the Country Manor Motel
Restaurant & Lounge, and
NOW, THEREFORE, IT IS HEREBY RESOLVED, that the Otter Tail County Board of Commissioners
hereby approves the conduct of lawful gambling by the Minnesota Therapeutic Camp, Inc.
at the Country Manor Motel Restaurant & Lounge in Compton Township of Otter Tail County,
provided that the applicant meets all the necessary criteria for the licenses and
permits required by the Gambling Control Board.
IT IS FURTHER RESOLVED, that notice of this application and approval shall be provided
to the Town Board of Compton Township by sending them a copy of this resolution.

Upon a motion by Windels, seconded by Partmann and unanimously carried, the Otter Tail
County Board of Commissioners adopted the following resolution:

WHEREAS, the Turn In Poachers, Inc. has made application to the Gambling Control Board
for a premises permit to conduct lawful gambling at the Blue Horizon in Rush Lake
Township of Otter Tail County; and
WHEREAS, Minnesota Statutes 349.213 provides that the Gambling Control Board may not
issue a premise permit unless they receive a resolution from the County Board approving
the permit; and
WHEREAS, the Otter Tail County Board is aware of no reason to oppose the conduct of
lawful gambling by the Turn In Poachers, Inc. at the Blue Horizon, and
NOW, THEREFORE, IT IS HEREBY RESOLVED, that the Otter Tail County Board of Commissioners
hereby approves the conduct of lawful gambling by the Turn In Poachers, Inc, at the Blue
Horizon in Rush Lake Township of Otter Tail County, provided that the applicant meets
all the necessary criteria for the licenses and permits required by the Gambling Control
Board.

Proposals for Engineering Services
Motion by Partmann, seconded Stone, and unanimously carried to authorize the bids for
proposals for engineering services on the Stang Lake impoundment to be advertised for
receipt not later than March 25, 1992, and to be considered by the Otter Tail County
Board of Commissioners at 1:00 p.m. on Aprill, 1992.
Approval to Pay Bills
Motion by Stone, seconded Partmann, and unanimously carried to approve the payment of
bills per Attachment A of these minutes.
DNR Land Purchase Request
Landowner Mike Yaggie met with the Board to discuss proposal to sell 350 acres of land
to the DNR for wildlife habitat. It was agreed that Yaggie would meet with members of
the Western Town Board as well as Bois de Sioux and Chairman Lindquist would meet with
Doug Wells of the DNR to discuss alternatives.
Position Opening -Sheriff's Department
Motion by Partmann, seconded Stone, and carried to authorize the public advertising for
an opening of a Clerk Typist/Civil Process Support person in the Sheriff's Department.
This position is the result of a retirement and promotion within the department.
Closed to Public
Adjournment
At 2:20 p.m., Chairman Lindquist declared the meeting adjourned and closed to the public
for purposes of discussing current labor negotiation strategies with the four collective
bargaining units. The next Board meeting is scheduled for 1:00 p.m. on March 11, 1992.
