Call To Order
The Otter Tail County Board of Commissioners convened Wednesday, February 12, 1992, at
1:00 p.m. at the Otter Tail County Courthouse with Commissioners Andy Lindquist,
Chairman; Harley Windels, Bill Stone, Malcolm Lee and Virginia Partmann present.
Minutes Approved
Motion by Windels, seconded Stone, and carried to approve the February s, 1992, minutes
as.submitted.
Protection Support -MN Lakes & Rivers
Motion by Lee, seconded Stone, and carried the following resolution was offered:
WHEREAS, exotic species such as eurasian water milfoil and zebra mussel constitute a
significant threat to Minnesota lakes and rivers, and
WHEREAS, degradation of Minnesota's water resources will have a catastrophic impact on
lakeshore property values and tourism based industries, and
WHEREAS, current state programs do not adequately address the rapid spread of these
exotic species due to a lack of containment strategies,
WHEREAS, the Otter Tail County Board of Commissioners have an intense concern for the
protection of our own area water resources, as well as those of all Minnesota counties,
and the potential negative impact of exotic species.
NOW THEREFORE, BE IT RESOLVED, that the Otter Tail County Board of Commissioners
encourages the Association of Minnesota Counties to determine the role of counties in
the control, with adequate funding, of exotic species in currently infested waters and
the prevention of spread to non-infested waters.

Gambling Permit
Upon a motion by Lee, seconded Windela, and unanimously carried the Otter Tail County
Board of Commissioners adopted the following resolution:
WHEREAS, the responsibility for the regulation of lawful gambling and the issuance of
licenses and permits for the conduct of lawful gambling lies with the Minnesota Gambling
control Board; and
·WHEREAS, the Fergus Falls Hockey Association has made application to the Gambling
Control Board for a premises permit to conduct lawful gambling at the Grayatone Lodge in
Everts Township of Otter Tail County; and
WHEREAS, Minnesota Statutes 349.213 provides that the Gambling Control Board may not
issue a premise permit unless they receive a resolution from the County Board approving
the permit; and
WHEREAS, the Otter Tail County Board is aware of no reason to oppose the conduct of
lawful gambling by the Fergus Falla.Hockey Association at the Grayatone Lodge, and
NOW, THEREFORE, IT IS HEREBY RESOLVED, that the Otter Tail County Board of Commissioners
hereby approves the conduct of lawful gambling by the Fergus Falls Hockey Association at
the Grayatone Lodge in Everts Township of Otter Tail County, provided that the applicant
meets all the necessary criteria for the licensee and permits required by the Gambling
!=ontrol Board.
IT IS FURTHER RESOLVED, that notice of this application and approval shall be provided
to the Town Board of Everts Township by sending them a copy of this resolution.

hereby approves the conduct of lawful gambling by the B.P.O. Elke Lodge #1093 at the
B.P.O. Elks Lodge #1093 in Dane Prairie Township of Otter Tail County, provided that the
'applicant meets all the necessary criteria for the licenses and permits required by the
'Gambling Control Board.
IT IS FURTHER RESOLVED, that notice of this application and approval shall be provided

Right-of-Way Transfer: City of Perham
Highway Engineer Rick West updated the Board of the Right-of-Way Transfer of south CSAH
No. 8 as it relates to the City of Perham.
Prepayment Requested
Motion by Lee, seconded Partmann, and unanimously carried to authorize the prepayment of
$55.20 to the State of Minnesota for engineering manuals.
Tri-County Agreement
Motion by stone, seconded Windels, and carried to authorize the Chairman to sign the
Tri-County Solid Waste Agreement between Otter Tail County and Fergus Falls.
conditional Use Application
Motion by Stone, seconded Windels, and unanimously carried to uphold the Planning
Commission's recommendation for approval on the Conditional Use Application of Robert
Hawkinson c/o Paul Lohmeyer, Eagle Lake.
Motion by Lee, seconded Partmann and unanimously carried to direct Taylor Investment
Corp. (Maurice Baltes), Dead Lake, to bring their request to the Board of
Adjustment.

Request for Sponsorship Resolution
Tim Rogness, Business Manager of White Oak Metals, Dalton, MN, requested a sponsorship
resolution from the local unit of government which is necessary for application of a
challenge grant through the West Central Minnesota Initiative Loan Fund (WCMIF). After
discussion, action was tabled pending recommendation from the County's Economic
Development Consultant, Del Redetzke, and the financial plans could be reviewed.

Motion by Lee, secor;ded Partmann,--a~d unanimously carried to approve the waterfowl
easement, dated February 12, 1992, from Lawrence A. Carroll on lands described as T. 134
N., R. 44 w., 5th P.M.>section 11, W 1/2 SW 1/4.
U.S. Fish & Wildlife Fee Sale
Motion by Lee, seconded Windels, and unanimously carried to approve the purchase
agreement dated February 12, 1992, from Lawrence A. Carroll on land described as T. 134
N., R. 43 w., 5th P.M., Section 30, Lot 3.
Classification of Tax Forfeited Land
WHEREAS, The county Board of Commissioners of the county of Otter Tail, State of
Minnesota, desires to offer for sale certain parcels of land that have forfeited to the
State of Minnesota for non-payment of taxes, and
WHEREAS, Said parcels of land have been reviewed by the County Board of Commissioners
and have been classified as non-conservation lands as provided for in Minnesota Statutes
282. 01.
NOW, THEREFORE, BE IT RESOLVED That the Otter Tail County Board of Commissioners hereby
certifies that all parcels of land have been reviewed and comply with the provisions of
Minnesota Statutes 85.012, 92.461, 282.01 subd. 8, 282.018 and the 1991 Laws of
Minnesota Ch. 354, Art. 10, Sec.9, amending M.S. Sec. 282.018, subd. 2 (1990). The
County Board of Commissioners hereby certifies that the Soil and Water Conservation
Board of the district in which the properties are located has reviewed the attached land
sale list and identified any and all nonforested marginal land and wetland.
BE IT FURTHER RESOLVED That the otter Tail County Board of Commissioners hereby request
approval from the Minnesota Department of Natural Resources for the sale of said lands.

On Sale Non-Intoxicating Liquor Licenses -Resorts
Motion by Stone, seconded Lee, and unanimously carried to continue the policy to issue
on-sale non-intoxicating liquor licensee to resorts as has been past practice.
Conference Report
Auditor Wayne Stein reported on the Minnesota Association of County Officers Conference
which he recently attended.
Vehicle Purchase Request
Motion by Lee, seconded Partmann, and unanimously carried to direct Captain Joe Peloquin
to compare the State's Cooperative Purchase Venture prices with area auto dealers
relative to the purchase of police specially equipped vehicles.
Long-Range Planning Committee
Motion by Lindquist, seconded Windels, and unanimously carried to appoint Jean McKenzie,
Fergus Falls, to the Long-Range Planning Conunittee.
Motion by Lee, seconded Windela and unanimously carried to appoint Loia Dillon,
Elizabeth, to the Long-Range Planning Conunittee.
Veterans' Service Officer
At the request of the County Board, Chester Toso, Veterans' Service Officer, appeared
~elative to the end of hie one year probationary term. The Board reviewed positive
comments and resolutions of support from local and state level veterans' organizations
along with residents' letters. Chairman Lindquist reported that he had investigated an
annonymous allegation made against the Veterans Service Officer which proved unfounded.

Each commissioner responded favorably after having checked with veterans' service groups
'.in their districts. After these reports, Chairman Lindquist made a motion which was
seconded by Windels and unanimously carried, to appoint Chester L. Toso to a permanent
'full time term as Veterans' Service Officer.
Westridge Mall Appraisal
Motion by Lee, seconded Windels and unanimously carried to authorize the payment of
$6,800 to Panger/Benson Appraisal Professionals for the Westridge Mall appraisal. The
total amount will be equally shared by the City of Fergus Falls, School District 544 and
Ott.er Tail County.

At 4:13 p.m., Chairman Lindquist declared the meeting adjourned and closed to the public
for purposes of discussing possible litigation with regard to the tax appeal of
Westridge Mall and the James F. Bucholz matter pursuant to the Attorney-Client Privilege
as authorized in 471.705 Subd 1 d. The next Board meeting is scheduled for 9:30 a.m. on
February 19, 1992.
