Call To Order
The Otter Tail County Board of Commissioners convened Wednesday, February S, 1992, at
9:3Q a.m. at the Otter Tail County Courthouse with Commissioners Andy Lindquist,
Chairman; Harley Windels, Bill Stone, Malcolm Lee and Virginia Partmann present.
Minutes Approved
Motion by Partmann, seconded Lee, and carried to approve the January 29, 1992, minutes
as submitted.
Joint Powers Board Proposal
Bert Whitcombe outlined a proposal he has made to the Joint Powers Board for a staff
position to serve the Joint Power counties. Discussion followed but it was pointed out
that Otter Tail County has it's own staff and does not support a staff position on the
Joint Powers Board, however, would not stand in the way of the possible needs of the
other member counties.
SAP 56-682-02 & 56-682-03 Bid Opening
Highway Engineer Rick West, having previously advertised for bids to be received for
Projects SAP 56-682-02 & 56-682-03 opened the following bids:

Support of Legislation -Postal Rate
Motion by Lee, seconded Windels and unanimously carried to adopt the following
.resolution in support of legislation authorizing a new postal rate for counties and ,g, other local governments:

WHEREAS, local government budgets and finances and in particular, those 0f counties, are
currently under great stress; and
WHEREAS, given the public purpose of county mailings such as homestead cards, voter
registration cards, jury notices and payments, tax notices, truth in taxation letters
and other necessary government items, they should receive at least a similar treatment
a·s non-profit Third Class mailings;
THEREFORE BE IT RESOLVED, that the Board of Commissioners in and for the County of
otter Tail, State of Minnesota, does hereby support federal legislation authorizing a
Special county government postal rate not greater than that charged to non-profit Third
Class mail for all legally required mailings.
BE IT FURTHER RESOLVED that copies of this resolution be forwarded to the Otter Tail
County Congressional delegation, the National Association of Counties and the
Association of Minnesota Counties.

Incineration Report
Solid Waste Director Mike Hanan, along with members of the Solid Waste Advisory Board,
presented the Otter Tail County Solid Waste Management Planning Report on Financial and
Business Issues Relating to Agreements Between Otter Tail County and Two Solid Waste
Facilities (Quadrant/Fergus Falls) prepared by Evensen Dodge, Inc. The Committee's
recommendation was that Otter Tail County resume negotiations with Quadrant regarding
the processing fee at the earliest possible date. Chairman Lindquist requested the
Solid Waste Director to include one or two Solid Waste Advisory Committee members in the
upcoming negotiation meeting(s).
'92 Solid Waste Service Fee Points
Mbtion by Partmann, seconded Windels and unanimously carried to set the Solid Waste
Service Fee at $6.50 per point.
'92 Solid Waste Fee Schedule
Motion by Lee, seconded Windels and unanimously carried to approve the following Solid
Waste Fee Schedule as presented by the Solid Waste Director with an implementation date
of April 1, 1992, and to include no change in the Solid Waste Hauler Application fees.

The Solid Waste Director presented a letter received from the Minnesota Pollution
Control Agency (MPCA) regarding the petition for environmental assessment worksheet
preparation relative to the proposed Scambler Township demolition site denying the
request for the preparation of an assessment. The Solid Waste Director was then
requested to proceed with scheduling a continued hearing on the Dale Pierce application.
(Note: Date has been set for February 26, 1992 at 2:15 p.m.)
Resolution of Support Accepted
Quartermaster Kelly Ferber presented a resolution of support on behalf of the Harold T.
Swenson Post #612, Veterans of Foreign Wars, Fergus Falls, for the permanent appointment
of Chester Toso as the County Veterans Service Officer at the expiration of his
probationary term. The resolution went on to request for a published endorsement by the o Board of Commissioners in support of the entire Veterans Service Office staff.
Approval to Pay Bills
Motion by Lee, seconded Partmann and unanimously carried to approve the payment of bills
per Attachment A of these minutes.

Soil Survey Update
Soil Conservation Service representative John Schmidt and Soil Survey Party Leaders
David Aldeen and Michael Lieser provided the Board with an update on the status of the
Soil survey.
Employees' Committee -Bylaws
Motion by Windels, seconded Partmann and unanimously carried to accept the revised
bylaws of the Employees' Committee as presented by their Chairman Terry Hoff.
Tax Statement Insert
Motion by Stone, seconded Windels and unanimously carried to approve the substanance of
the tax statement insert and to direct Commissioner Partmann to suggest minor changes in
fbrmatting and headlines.
DCA Benefit Enhancement Proposal
M6tion by Partmann, seconded Lee and unanimously carried to direct the Coordinator to
include Board members Lee and Partmann, to proceed with implementation of the DCA
benefit enhancement proposal.
Assessor Position
Motion by Lee, seconded Partmann and unanimously carried to direct the Assessor's Search
Committee to continue on with the hiring procedure with regard to the Assessor position.
AMC District IV Meeting Report
Commissioner Stone provided an overview of the recent AMC District IV meeting held in
Fergus Falls.
Regional Treatment Coalition Meeting Report
c·ommissioner Partmann provided an update on a recent Regional Treatment Coalition
meeting.
Shoreland Management Ordinance Adopted
Land & Resource Director Bill Kalar presented for adoption the Shoreland Management
Ordinance for otter Tail County. Commissioner Lindquist read correspondence received by
the Board on the matter. After lengthy discussion, there was a motion by Partmann,
seconded Stone and unanimously carried to adopt the Shoreland Management Ordinance of
Otter Tail County as mandated by the State of Minnesota, effective immediately, as
presented by the Land & Resource Director.
Right-of-Way Land Acquisition
Motion by Stone, seconded Windels, and unanimously carried, the following resolution was
adopted:
RESOLVED by the Board of County Commissioners of Otter Tail County, Minnesota, that
WHEREAS, on January 7, 1992, the Otter Tail County Board of Commissioners authorized the
acquisition of certain property owned by the Estate of Honorine J. Mathias through
eminant domain and to take title and possession of that property prior to the filing of
an award by the court appointed commissioners, pursuant to Minnesota Statute Sections
163.02, Subd. 2; 117.011 and 117.042; and

WHEREAS, prior to taking possession, Petitioner otter Tail County shall, pursuant to
Minnesota Statutes Section 117.042, deposit with the Court an amount equal to the
Stipulated estimated market value as agreed upon between the parties; and
WHEREAS , that petitioner and respondent have stipulated to an estimated market value of
said property in the amount of $840.00;
NOW, THEREFORE, BE IT RESOLVED, that the Otter Tail County Board of Commissioners hereby
authorizes the deposit of $840.00 with the Otter Tail County District Court for
purposes of taking possession of said properties on April 23, 1992, prior to the filing
of an award by court appointed commissioners pursuant to Minnesota Statutes 117.042;
said amount representing the stipulated estimated market value of the subject property.
Adopted at Fergus Falls, MN, this 7th day of January, 1992.

At 4:15 p.m., Chairman Lindquist declared the meeting adjourned and closed to the public
for purposes of discussing labor negotiation strategies with the county's four
collective bargaining units and to discuss possible litigation with regard to the
detention facility floor as well as pending litigation with regard to the David L. Olson
matter pursuant to the Attorney-Client Privilege as authorized in 471.705 Subd 1 d. The
next Board meeting is scheduled for 1:00 p.m. on February 12, 1992.
