HomeMy WebLinkAboutBoard of Commissioners - Minutes - 01/07/19920 Minutes of the OTTER TAIL COUNTY BOARD OF COMMISSIONERS Commissioners' Room, Floor 1-B Otter Tail County Courthouse Tuesday, January 7, 1992 9:30 a.m. Statutory Meeting Pursuant to Statutes, the Board of County Commissioners of Otter Tail County, Minnesota, convened Tuesday, January 7, 1992. Call to Order Chairman Selected County Board Clerk and Coordinator Larry Krohn called the meeting to order asking for a roll call attendance: Present were Harley Windels, Malcolm Lee, Andy Lindquist, Bill Stone and Virginia Partmann. The first order of business was the selection of a Chairman for the year 1992. Motion by Lee, seconded Stone and carried, with Lindquist abstaining, to appoint Andy Lindquist as Chairman of the Board of Commissioners for the year 1992. Vice Chairman Selected Lindquist assumed the chair and called for a motion to select the Vice Chairman. Motion by Windels, seconded Portmann and carried, with Lee abstaining, to appoint Malcolm Lee as vice Chairman of the Board of commissioners for the-year 1992. ,,, Approval of MinUies Motion by Lee, seconded Windels and unanimously carried to approve the minutes of December 24, 1991, as submitted. Depository Resolution Motion by Partmann, seconded Lee and unanimously carried, the following resolution was adopted: RESOLVED by the Board of County Commissioners of Otter Tail County, Minnesota, that WHEREAS, all financial institutions in Otter Tail County, including state and federal banks and savings and loan associations, be and are hereby designated as depositories of County funds. January February March April May June July August September October November December Board of Equalization: June 17 & 30 \ Full Day Regular Board 7 & 22 5 & 19 4 & 18 1 & 15 6 & 20 3 & 17 1 & 15 5 & 19 2 & 16 7 & 21 4 & 18 2 & 16 Morning: Human Services Afternoon: Regular Board 15 & 29 12 & 26 11 & 25 8 & 22 13 & 27 10 & 24 8 & 22 12 & 26 9 & 23 14 & 28 11 & 25 9 & 23 Soil Conservation Survey Payment Motion by Lee, seconded Windels and unanimously carried to approve payment to the Soil Conservation Service, in the amount of $18,120, for the reimbursement of costs incurred in the furnishing of technical assistance in accordance with the Soil Survey agreement for the period of October l to December 31, 1991. 0 0 • otter Tail County Board of Commissioners January 7, 1992 Page 3 pocket Gopher Bounty Motion by Stone, seconded Partmann and unanimously carried, the following resolution was adopted: RESOLVED by the Board of County Commissioners of Otter Tail County, Minnesota, that the sum of thirty cents ($.30) be paid out of the Revenue Fund of the County for every pocket gopher killed in said County during the year 1992 in cases where the townships in which pocket gophers were so killed shall provide for the payment of an additional bounty of forty cents ($.40) for each pocket gopher so killed. RESOLVED FURTHER that said payment of such bounty shall be made by the County Auditor upon certificates executed by the Chairman of the Town Board of said township setting forth that the pocket gophers were duly presented to the Chairman of such Board and that the township had issued and delivered to each claimant a town order for seventy cents ($.70) for each pocket gopher so killed. Dated: ~ lfLt lqlj y"/ OTTER TAIL COUNTY BOARD OF By Tax Forfeited Land Sale Apportionment SSIONERS Motion by Windels, seconded Lee and unanimously carried, the following resolution was adopted: RESOLVED by the Board of County Commissioners of Otter Tail County, Minnesota, that WHEREAS, it is provided in M.S. 282.05 for the apportionment of proceeds from the sale of tax-forfeited lands, and WHEREAS, the County Auditor shall apportion the tax sale proceeds to the taxing districts pursuant to M.S. 282.08, and WHEREAS, M.S. 282.08(4)(b) provides that the County Board may set aside 20\ of the proceeds remaining after the value of public improvements, special assessments and bond issues levied on the property have been paid, for acquisition and maintenance of county parks and recreational areas, and WHEREAS, Otter Tail County has a park and recreational area which would benefit by such an apportionment, NOW, THEREFORE, BE IT RESOLVED, that the County Auditor retain 20\ of the proceeds from the sale of tax forfeited lands for acquisition and maintenance of parks and recreational areas from the proceeds available after making the necessary statutory disbursements, said proceeds to be disbursed according to law. Adopted at Fergus Falls, MN, this 7th day of January, 1992. ·, Otter Tail County Board of Commissioners January 7, 1992 Pa<;/e 4 Q Dated: ~ !£,,1qq.,C OTTER TAIL COUN'rY BOARD OF COMMISSIONERS 0 a Boat & Water Safety Program -Accounting Adjustment Motion by Portmann, seconded stone and unanimously carried to approve a transfer from the Sheriff's Department Budget, in the amount of $3,165.19, to the Boat and Water Safety Department Budget. The Department of Natural Resources conduct a review of the Boat and Water Program for the years 1987 through 1989. As a result of this review they are requesting that we make this transfer. The reason is as follows: In 1988 the County purchased a Dodge B350 Wagon at a total cost of $15,825.95. This vehicle was purchased with Boat and Water Safety Program Funds. This vehicle has been used approximately 80% in the Boat and Water Program and 20% in other county areas. As a result of this usage, they are requesting that 201 of the total cost be paid out of the Sheriff's Department Budget. Delinquent Real Estate -Cost Assessment Motion by Lee, seconded Stone and unanimously carried to increase the cost assessed to delinquent real estate parcels that are published in the Delinquent Tax List from $10 to $15 in 1992 to recover costs incurred against each parcel included in the Delinquent Tax List. Assessment Authorized Motion by Lee, seconded Stone and unanimously carried to authorize the County Auditor to place the assessment on the 1992 tax rolls of Dan Riley, Section 23, Nidaros Township, in the amount of $610.90 for noxious weed destruction. M.C.I.T, Trust I Assessment Motion by Fortmann, seconded Windels and unanimously carried to approve a payment to the Minnesota Counties Insurance Trust in the amount of $15,769 for the County's 1992 Workers• Compensation Trust I Assessment. Printing & Publishing Bids The Board, having previously advertised for bids to be received for printing and publishing of the county board minutes, legal notices, delinquent tax list and the county's annual financial statement, proceeded to open bids which were as follows: Legal Notices, Publications & Commissioner Minutes: The Daily Journal, Fergus Falla, MN Annual Financial Statement: New York Mills Herald, New York Mills, MN Pelican Rapids Press, Pelican Rapids, MN Delinquent Tax List: Review Enterprises Inc., Battle Lake, MN $6.72 per S.A.U. $6.58 per S.A.U. $6.58 per s.A.U. 0 Ot~er Tail County Board of Commissioners January 7, 1992 Page 5 1st Publication 2nd Publication $6.58 per S.A.U. $3.91 per S.A.U. After consideration, motion was made by Lee, seconded Stone and unanimously carried to award bids for publishing and printing for the 1992 year as follows: Legal Notices. Long-Range Planning Committee Chairman Lindquist identified the need for a Long-Range Planning Committee. The purpose of this committee is to address cost-saving long term plans for Otter Tail County. The committee will consist of one appointed commissioner together with one member from each district to serve an annual term. Chairman Lindquist appointed Commissioner Partmann to chair this committee for 1992. Board members were asked to make a recommendation from their district at a later date. Jail -Rental Rates Motion by Stone, seconded Windels and unanimously carried to increase the room and board fee for housing prisoners from outside otter Tail County to $40 per prisoner per day for 1992, with an annual review of the rate. Solid Waste Attendant Position Motion by Stone, seconded Partmann and unanimously carried to authorize the Solid Waste Director to proceed with the replacement hiring of a Solid Waste Attendant at the Parkers Prairie location. Foth & Vanpyke Engineering Consultants Motion by Lee, seconded Partmann and unanimously carried to approve the consulting service agreement negotiated by the County Attorney with Foth & VanDyke, and to authorize the Chairman of the Board and Clerk to execute such agreement on behalf of Otter Tail County with an addendum incorporating the time table provided by the Solid Waste Director. Approval to Pay Bills Motion by Lee, seconded stone and unanimously carried to approve the payment of the bills per Attachment A of these minutes. C) Motion by Partmann, seconded Lee and unanimously carried to approve the payment of $1,000 on each of two liability claims (numbered 1507 and 2429) to Minnesota Counties Insurance Trust for reimbursement of deductibles. 0 0 ' Otter Tail County Board of Commissioners January 7, 1992 Page 6 Employee Assistance Program Agreement Motion by Lee, seconded Partmann and unanimously carried to continue the Employee Assistance Program Agreement between Lakeland Mental Health Center, Inc. and Otter Tail County for 1992 at a hourly fee of $58. Golombiecki Excavating Lake Region Well Ohm Excavating Stadum Plumbing Wilbur Wegscheid Plumbing & Heating Right-of-Way Acquisition Motion by Stone, seconded Windels and unanimously carried to authorize the Highway Engineer to begin with condemnation procedures with regard to right-of-way acquisition Project S.P. 56-640-04. s.A.P. 56-599-11 -Bid Opening set Motion by Lee, seconded Windels and unanimously carried to approve the bid opening date on March 4, 1992, at 10:00 a.m. for Project No. S.A.P. 56-599-11, Elizabeth Twp. Bridge over the Pelican River. Wetland Restoration -CSAH No. 6 Motion by Lee, seconded Stone and unanimously carried to support the recommendation of the Highway Engineer regarding the proposed U.S. Fish & Wildlife Service's request of wetland restoration along CSAH No. 6 in Leaf Mountain Township since it should not affect the county road. Speed Zone Study Motion by Lee, seconded Partmann to offer the following resolution for a Speed zone Study on a segment of CSAH No. 27: WHEREAS, a group of individuals has requested in the form of a letter, accepted by the Otter Tail County Board of Commissioners on January 7, 1992, that the speed limit be reduced on a segment of County State-Aid Highway No. 27 from the East quarter corner of Section 27 to a point approximately one mile North in Fergus Falls Township, and 0 0 Otter Tail County Board of Commissioners January 7, 1992 Page 7 WHEREAS, the County of otter Tail also believes that a speed zone would be beneficial in this area. NOW, THEREFORE, BE IT RESOLVED, that Otter Tail County does hereby request that the area be studied by the the Minnesota Department of Transportation to determine the need for a reduced speed zone, if any, BE IT ALSO RESOLVED, that Minnesota Department of Transportation proceed with establishing a legal speed zone if the findings of the traffic study are supportive. Motion by Fortmann, seconded Lee and unanimously carried to approve the final payment on Project s.A.P. 56-601-32 for Bituminous Overlay-Reconstruction to the City of Fergus Falls, Fergus Falls, MN, in the amount of $37,510.04. Motion by Lee, seconded stone and unanimously carried to approve the pre-payment of the following: State of Minnesota Department of Agriculture in the amount of $110 for pesticide application licenses. Minnesota Department of Transportation in the amount of $27 for engineering manuals Personnel Director Motion by Stone, sec?nded Lee and unanimously carried to appoint Coordinator Larry Krohn as otter Tail County Personnel Director in accordance with Minnesota Statute Sections 375.56 through 375.71 wherein the County adopted the Personnel Administration system. (J 0 ·olter Tail County January 7, 1992 Page 8 Board of Commissioners Adjournment Closed to Public At 2:30 p.m., Chairman Lindquist declared the meeting adjourned and closed to the public for purposes of discussing potential litigation with regard to the detention facility floor problem and for labor negotiation strategies with the county's four collective bargaining unite. Next Board meeting is scheduled for 1:00 p.m. on January 15, 1992.
