HomeMy WebLinkAboutBoard of Commissioners - Minutes - 12/18/19910 0 0 Minutes of the OTTER TAIL COUNTY BOARD OF COMMISSIONERS Commissioners' Room, Floor 1-B Otter Tail County Courthouse Wednesday, December 18, 1991 9:30 a.m. Call To Order The Otter Tail County Board of Commissioners convened Wednesday, December 18, 1991, at 9:30 a.m. at the Otter Tail County Courthouse with Commissioners Andy Lindquist, Chairman; Harley Windels, Bill Stone, Malcolm Lee and Virginia Partmann present. Minutes Approved Motion by Lee, seconded Partmann and unanimously carried to approve the December 11, 1991, Board minutes as submitted. Motion by Stone, seconded Windels and unanimously carried to approve the December 11, 1991, Budget Hearing minutes as submitted. Proposed Computer Link Data Processing Director, Tim Brand, appeared to request a computer link with the county's offices in Perham and Fergus Falls to prevent repetitious data entry, save time and enhance communication between the two sites. The monthly costs of this system would be split between Public Health and Court Services, with the initial, non-recurring costs coming from the 1991 Data Processing budget. Motion by Windels, seconded Partmann and unanimously carried to table a decision until more information on the actual cost savings is available~ Correspondence Acknowledged Chairman Lindquist acknowledged receipt of an invitation to Erwin Siems retirement party on December 30, 1991. The Chairman read a letter from the County Attorney written to all applicable parties in regards to the deterioration of the jail floor in which a meeting before the end of the year has been requested. Perham Office Building County Coordinator, Larry Krohn, appeared before the Board relevant to the County's office building in Perham. Some of the space in the Perham building is leased to the City of Perham through an agreement developed in 1986 when the building was purchased. The rent paid by the City of Perham is $250 per month and cleaning of the building in lieu of $175 per month. The Coordinator reported that the cleaning time and efforts have been increased and the City of Perham is requesting to pay $200 per month with $50 going towards the extra cleaning costs. Qtter Tail County Board of Commissioners December 18, 1991 -Page 2 Motion by Windels, seconded Lee and unanimously carried to approve the request of the City of Perham t;o pay $200 per month instead of $250 per month for· rent for the County's Perham building with the remaining $50 going towards extra cleaning costs. Temporary Employees The County Coordinator requested the Board's decision on whether or. not· the, Boa,rd must --.ipprove "the l"iir ing of temporary people when the funds have already: -been allocated in the individual department budget's for that purpose. A decision ·;was 'deferred u·n:til this subject can be researched more thoroughly. Bois de Sioux W~t~rshed District Warren Erickson, representative of the Bois Sioux Watershed District appeared, be.fore· the Board requesting approval of a resol lon to allow their organization to join the Red River Watershed Management Board. Motion by Partmann, seconded Lindqui·-~ and carried with Lee opposed and Strine abstaining,· the following resolution was adopted: Bois de Sioux Watershed District Resolution Red River. Watershed Management Board Legislative Changes WHEREAS, The Bois de Sioux Watershed District has identified through public meeting that floodwater retention projects are needed to control flooding, improve water quality and · ,address other water management issues, and WHEREAS, the Bois de Sioux Watershed District needs a source of-local-matching funds to initiate construction of these projects, and WHEREAS,. the Red River Watershed Management Board is a local organiza·t·ion· establishEtd for the purpose of assisting with flood control projects within<_the,·Red River-Valley, . ·:: -.-.·<~.ti and 'WHEREAS, the Bois de Sioux Watershed District is legislation which established the Red River Watershed ' ',:, .. not named i·~'. _i.{, s,· entlrety in Management \Boar~'. s · territory. the THEREFORE BE IT RESOLVED THAT the Otter Tail County Boa.rd of Commissioners'.support legislation that would allow the entire Bois de Sioux Watershed District to be included ·in the Red River Watershed Manangement Board's boundary~ OTTER TAIL COUNTY OARD OF COMMISSIONERS --~-! . , ,.:_---------·::::· . ..:~--' : .. Roland Sauck, Weed and Ditch Inspector, provided Mr. Erickson with a map of the Otter Tail County ditches. Reappointment of County Committee Members Lake Region Arts Council Motion by Lee, seconded Windels and unanimously carried to reappoint Craig Molstad and Grace H. Maje to the Lake Region Arts Council for a three year term. Otter Tail County Court Services Advisory Board Motion by Lee, seconded Stone and unanimously carried to reappoint Richard Jenson, Pelican Rapids, to the Otter Tail County Court Services Advisory Board for a three year term beginning January 1, 1992. Planning commission Motion by Lindquist, seconded Lee and unanimously carried to reappoint Bert Olson, Battle Lake, and Leslie Estes, Battle Lake, to the Planning Commission for a three year term beginning January 1, 1992. Otter Tail County Board of Adjustment Motion by Windels, seconded Lee and unanimously carried to reappoint George Walter, Perham, to the Otter Tail County Board of Adjustment for a one year term beginning January 1, 1992. Motion by Lindquist, seconded Windels and unanimously carried to reappoint John Everts, Battle Lake, to the Otter Tail County Board of Adjustment for a one year term beginning January 1, 1992. Motion by Stone, seconded Partmann and unanimously carried to reappoint Craig Anderson, Ottertail, to the Otter Tail County Board of Adjustment for a one year term beginning January 1, 1992. Motion by Partmann, seconded Lee and unanimously carried to reappoint Daniel Oehler, Fergus Falls, to the Otter Tail County Board of Adjustment for a one year term beginning January 1, 1992. Motion by Lee, seconded Windels and unanimously carried to reappoint Cecil Femling, Pelican Rapids, to the Otter Tail County Board of Adjustment for a one year term beginning January 1, 1992. Solid Waste Advisory Board Motion by Lee, seconded Windels and unanimously carried to reappoint Cecil Femling, Pelican Rapids, to the Solid Waste Advisory Board for a three year term beginning January 1, 1992. Motion by Partmann, seconded Lee and unanimously carried to reappoint Vince Robertson, Fergus Falls, and Chester Gunvaldson, Fergus Falls, to the Solid Waste Advisory Board for a three year term beginning January 1, 1992. Motion by Lee, seconded Windels and unanimously carried to reappoint Max Stroschein, Jr., Fergus Falls, to the Solid Waste Advisory Board for a three year term beginning January 1, 1992. Q 0 qtter Tail County Board of Commissioners December 18, 1991 Page 4 County Extension Committee Motion by Stone, seconded Windels and unanimously carried to reappoint Willis Roehl, Fergus Falls, and Sandy Dombeck, Wadena, to the County Extension Committee for a three year term beginning January l, 1992. Extension Committee Meeting Update Commissioner Stone reported to the Board regarding an Extension Committee Meeting. It was stressed that the loss of the part time East otter Tail County Extension Agent will not reduce services to East Otter Tail County. The remaining agents will be dividing their time evenly throughout the County. Approval of Bills Motion by Stone, seconded Windels and unanimously carried to approve the payment of bills per attachment A of these minutes. Redistricting Motion by Windels, seconded Lee and unanimously carried to authorize the Chairman and the County Coordinator to draw up options to redistrict the areas for the Commissioners to review and choose the best possible option. Highway Past Due Accounts Receivable Highway Engineer Rick West and Accountant Gerald Frederick appeared to discuss several past due accounts receivable. Motion by Lee, seconded Stone and unanimously carried to remove $22,028.52 from the Road and Bridge accounts receivable which represents administration costs from the Federal and State Hazard Elimination Safety Program implemented in 1987 with the reimbursement coming from the General Revenue Fund. Motion by Partmann, seconded Windels and unanimously carried to authorize the Highway Engineer to write off the amount of $832.61 which was for a preliminary survey completed in 1982 in Section 29 and 30 of Newton township from the Road and Bridge Fund to be reimbursed by the General Revenue Fund. Motion by Lee, seconded Windels and unanimously carried to authorize the Highway Oepartment to write off the uncollectable amount of $312.92 for maintenance work performed in 1989 between Sections 4 and 9 in Oscar Township. Motion by Lee, seconded Fortmann and unanimously carried to authorize the transfer of $489.34 for work completed on the Phelps Mill Bridge from the Road and Bridge accounts receivable to the town bridge project account for engineering costs. Motion by Lee, seconded Partmann and unanimously carried to authorize the Highway Department and the Solid Waste Department to write off one-half of the cost each of $1,342.93 relative to work completed by an employee of the Highway Department, Russell Evjen, for the Solid Waste Department from April, 1987 through July, 1987. () 0 0 o;tter Tail County December 18, 1991 Page 5 Board of Commissioners Projects S.P. 56-667-20 And S.P. 56-640-04 Motion by Windels, seconded Stone and unanimously carried to authorize the Highway Engineer to approve payment on right of way acquistition reconstruction projects S.P. 56-667-20 and S.P. 56-640-04 when signed easements are received from Marvin Nevonen and Dale Venske and Virgil Alexander, respectively. Payment Approvals County Auditor Wayne Stein appeared before the Board relative to the following approvals for payment: Motion by Lee, seconded Partmann and unanimously carried to approve payment of the 1992 AMC dues in the amount of $11,702 with payment to be made in January of 1992. The 1991 dues were $11,807. Motion by Lee, seconded Stone and unanimously carried to approve payment to the Minnesota Red River Valley Development Association in the amount of $600 for their 1992 appropriation which is the same amount as last year. Motion by Windels, seconded Lee and unanimously carried to approve the transfer of both a Liquor and Sunday Liquor License from David Capouch to Kendra Maria Wolford of Dent, MN for operation of the Cactus Gardens, subject to insurance certificate. Motion by Partmann, seconded Stone and unanimously carried to approve payment to the Thorwaldsen, Quam, Beeson, Malmstrom & Sorum Law Firm for Account No. 16938-06M, Otter Tail County vs. Gary A. Nelson/Nepotism litigation in the amount of $4,736.50. Final Plat -Beilberger Bay Motion by Lee, seconded Partmann and unanimously carried to approve the final plat of Heilberger Bay, located on Heilberger Lake. Final Plat -Ethel Lake Motion by Stone, seconded Lee and unanimously carried to approve the final plat of Pleasant Shores, located on Ethel Lake. '91 Wetlands Conservation Act Bill Best, representing the Board of Water and Soil Resources (BWSR} appeared to update the Board on the '91 Wetlands Conservation Act. Two handouts were distributed explaining the two phases of the program which include an interim program and a permanent program along with a flowchart to show the steps involved determining jurisdiction over wetlands. Mr. Best was directed to submit a letter in writing stating that the County is not mandated to administer the interim program of the '91 Wetlands Conservation Act. A copy of the Interim guidelines was given to Bill Kalar and any changes will be communicated to the Land & Resource Department. The Chairman directed Bill Kalar, Land & Resource Department Head and people of his choice to attend the upcoming training sessions offered through BWSR and report back to the Board. 0 0 0 Q'tter Tail County December 18, 1991 Page 6 Board of Commissioners Shoreland Revisions Bill Kalar, Land & Resource Director, presented to the Board a copy of the proposed Shoreland Management Ordinance revisions for their revieww Bill outlined many changes which have been made and the reasons for those changes. The Board will review the proposed draft copy with further action taken the first meeting of 1992. Motion by Lee, seconded Partmann and unanimously carried to approve the cluster development revision as stated on page 38 of the December 18, 1991, Shoreland Management Ordinance draft copy. Interim County Assessor Motion by Lee, seconded Partmann and unanimously carried to appoint Russell Anderson, as the acting County Assessor starting January 1, 1992, to serve until a permanent County Assessor has been hired with this appointment based on seniority. Motion by Partmann, seconded Lee and unanimously carried to raise the acting County Assessor's salary to Range 20, Step 1 ($2,342 per month) during this interim promotional position for a maximum of 60 days. Tri-County Solid Waste Wally Senyk, County Attorney, reported on a meeting between the City of Fergus Falls and Otter Tail County relevant to waste flow control. A source of solid waste has been identified from western Stearns County which would provide enough solid waste in the winter to avoid payment of penalties which could result by not providing the guaranteed minimum (75 tons) per day of solid waste. Motion by Windels, seconded Lee and unanimously carried to authorize the County Attorney to negotiate an agreement with Tri-County Solid Waste to provide Otter Tail County with an even flow of solid waste~ Adjournment At 3:45 p.m. Chairman Lindquist declared the meeting adjourned until the next Board meeting scheduled at 10:30 a.m., Tuesday, December 24, 1991.
