Call To Order
The otter Tail County Board of Commissioners convened Wednesday, December 4, 1991, at
9:30 a.m. at the Otter Tail County Courthouse with Commissioners Andy Lindquist,
Chairman; Harley Windels, Bill stone, Malcolm Lee and Virginia Partmann present.
Minutes Approved
Motion by Lee, seconded Partmann and unanimously carried to approve the November 27,
1991, Board•minutes as submitted.
Catwalk/Safety Railing -Phelps Mill Dam
Upon motion by Lee, seconded Portmann and unanimously carried, the following resolution
was adopted: 0 RESOLVED, by the Board of County Commissioners of Otter Tail County, Minnesota, that
WHEREAS, on October 9th, 1991, the County Board accepted the proposal of H & R
Construction Company, Dalton, MN, in the amount of $3,400 for the furnishing of salvage
materials for the purpose of installing a catwalk and safety railings across the Phelps
Mill dam, and
WHEREAS, the above project has now been completed to the satisfaction of the County
Board at a total cost of $3,700, an incr~ase of $300 due to the installation of auguard
rail on the downstream side of the dam.
NOW, THEREFORE, BE IT RESOLVED, the County Auditor is hereby authorized and directed to
issue a warrant in the amount of $3,700 to H & R Construction Company in final payment
thereof.

Mark Sand & Gravel Payment -Phelps Mill
Motion by Partmann, seconded Lee and unanimously carried to reimburse the Road and
Bridge Fund $16,372.01 for bituminous surfacing on the Phelps Mill Park Road and Parking
Lot. The project was done by Mark Sand and Gravel Co., under supplemental agreement
No. 2 to s.A.P. 56-601-29. Reimbursement is to be made from the General Fund.
Mobile Home 1991 Delinquent Taxes
Motion by Stone, seconded Windels and unanimously carried to place all delinquent taxes
into judgement and the following report of the County of Otter Tail, State of Minnesota,
of uncollected mobile home taxes for the year 1991 is presented:
BE IT KNOWN, that the County Board of Otter Tail County, Minnesota did meet in session
on the 4th day of December, 1991, that at said session the County Auditor of said County
delivered to said Board the list of uncollected mobile home taxes for the year 1991,
together with Sheriff Certificate as required by law; and that at said session the Board
did duly consider said list of said uncollected mobile home taxes in said County for the
year 199,1, and that the Court Administrator is ordered to issue citations thereon, to
wit:

Premise Permits -Gambling Applications
Motion by Lee, seconded Windels and unanimously carried, the Otter Tail County Board of
Commissioners adopted the following resolution approving a gambling premise permit for
the American Legion Post 30 at the Wee Town Bar and Grill operated by Kim Kugler in
Friberg Township.
WHEREAS, the responsibility for the regulation of lawful gambling and the issuance of
licenses and permits for the conduct of lawful gambling lies with the Minnesota Gambling
Control Board; and
WHEREAS, the American Legion Post 30 has made application to the Gambling Control Board
for a .premises permit to conduct lawful gambling at the Wee Town Bar and Grill, and
WHEREAS, Minnesota Statutes 349.213 provides that the Gambling Control Board may not
issue a premise permit unless they receive a resolution from the County Board approving

the permit; and
WHEREAS, the Otter Tail County Board is aware of no reason to oppose the conduct of
lawful gambling by the American Legion Post 30 at the Wee Town Bar and Grill, and
NOW, THEREFORE, IT IS HEREBY RESOLVED, that the Otter Tail County Board of
Commissioners hereby approves the conduct of lawful gambling by the American Legion Post
30 at the Wee Town Bar and Grill in Friberg Township of Otter Tail County, provided that
the applicants meet all necessary criteria for the licenses and permits required by the
Gambling Control Board.
IT IS FURTHER RESOLVED, that notice of this application and approval shall be provided
to the Town Board of Friberg Township by sending them a copy of this resolution.

correction to Plat
Motion by Windela, seconded Stone and unanimously carried to accept the Certificate of
Correction to plat by Roy A. Smith, Registered Land surveyor under the laws of the State
of Minnesota, Registration No. 12004; that he has reviewed the legal description and the
surveyor's drawing of the Plat of Palubicki's Beach, which according to the document
filed on November 17, 1949, in Book N of Plats, Page 62, is described as follows:
That part of Government Lot 3, Section 26, Township 137, Range 39, described as
follows to-with: from the east end of the south line of said Section at MC #2 thence
west on the section line 303.6 feet to the east right-of-way line of the public road,
thence North 31 degrees 46' East on said right-of-way line 435.6 feet; thence North
60 degrees 0' East 393.2 feet, to the east line of said Lot 1, thence south on this
line 263.0 feet to the shoreline of Little Pine Lake, thence southwesterly on this
line 396.0 feet to the point of beginning. Surveyed and platted as "PALUBICKI 'S
BEACH".
That said plat was certified by Registered Land Surveyor John E. Howard who cannot be
located and is believed to be deceased.
That as a result of the review conducted on the 22nd day of August, 1991, by the
undersigned, it has been determined that the above-underscored call to the east line of
said Lot 1 in said description was established erroneously.
That said pat text should be revised as follows:

Forgiveness of Penalty
Reconsideration in the forgiveness of penalty matter of E. L. Bogenreif, Elizabeth
Township, was offered to the Board with no change taken.
Section 31 1 Culverts
Motion by Lee, seconded Windels and unanimously carried to pay the amount of $1,295.50,
which represents 50% cost of installation and 50% culvert cost shared with Orwell
Township for the replacement of culverts on a road in Section 31 of Orwell Township to
comply with Major Drainage Structure Assistance Plan.
Court Administrator -Retirement
Chairman Lindquist acknowledged with regret a letter of resignation/retirement from
Kenyon E. Rudd, Court Administrator, effective February 28, 1992.
Sand/Salt -Townships
Motion by Fortmann, seconded Stone and carried to continue to sell sand/salt to the
townships as in prior years.
Mobile Home Tax -Clarification
Motion by Lee, seconded Windels and carried to clarify the November 13, 1991, minutes to
include the mobile home taxes in addition to the forgiveness of penalty of Harold
Thorson, Buse Township.
Economic Development Advisory Board
Motion by Lindquist, seconded Partmann and carried, with Lee opposed, to name
R. L. Fleming to the Economic Development Committee as a replacement for an upcoming
opening.
Approval to Pay Bills
Motion by Lee, seconded Windels and unanimously carried to approve the payment of bills
per Attachment A of these minutes.
Wetlands Conservation Act of 1991
Motion by Lee, seconded Windels and carried to direct the County Attorney to write Ron
Nargang, State of Minnesota, regarding their contribution to the enforcement of the
Wetland Conservation Act of 1991.
Phelps Mill Festival
Motion by Lee, seconded Stone and unanimously carried to consent to the assignment
agreement transfer request of the Art of the Lakes to Phelps Mill Country for the use of
the Phelps Mill park and to authorize the Chairman to sign on behalf of the Board of
Commissioners.

County Personnel Ad.ministration
Motion by Lee, seconded Windels and carried, the Otter Tail County Board of
Commissioners adopts the following resolution:
WHEREAS, the Otter Tail county Board of Commissioners has made efforts to implement
uniform personnel practices for all Otter Tail County employees, through adoption and
amendment of the otter Tail County Personnel Policy and Supervisor's Manual; and
WHEREAS, the Board of Commissioners desires to further formalize uniform personnel
procedures, to assure that all Otter Tail County employees receive consistently fair and
equitable treatment; and
WHEREAS, the Minnesota Statute Sections 375.56 through 375.71 provide for the
establishment and conduct of a County Personnel Administration system which will further
the goals of the Board of Commissioners; and
WHEREAS, under the otter Tail County Personnel Policy and Supervisor's Manual, the
office of the Otter Tail County Coordinator has performed most of the functions of a
Personnel Department.
NOW, THEREFORE, THE OTTER TAIL COUNTY BOARD OF COMMISSIONERS HEREBY RESOLVES:
1. To establish a County Personnel Administration System, pursuant to Minnesota statute
Section 375.76, et. seq., effective January 1, 1992.
2. To create the Otter Tail County Personnel Department, within the office of the Otter
Tail County Coordinator.
3. To appoint the following individuals as members of the Otter Tail County Personnel
Board of Appeals, for terms which begin on January 1, 1992 and expire on the dates
indicated below, and whose successors shall be appointed to fill staggered three-
year terms.

At 2:42 p.m. Chairman Lindquist declared the meeting closed to the public for the
purpose of discussing labor negotiation strategies for the county's collective
bargaining unit, AFSCME, representing Highway maintenance workers and for the purpose of
discussing the tax appeal matter of Westridge Mall pursuant to the Attorney-Client
Privilege as authorized in MS 471.705 Subd ld.
Open to Public
At 3:35 p.m. the Board's meeting of December 4, 1991, reconvened in open session.
1992 Health Insurance
Motion by Lee, seconded Partmann and unanimously carried to announce the reduction of
employee contribution for dependent health coverage to $105 per month effective
January 1, 1992.
Adjournment
At 3:45 p.m. with no further business, Chairman Lindquist declared the meeting adjourned
until 1:00 p.m. on December 11, 1991,
