HomeMy WebLinkAboutBoard of Commissioners - Minutes - 10/30/1991Q 0 Minutes of the OTTER TAIL COUNTY BOARD OF COMMISSIONERS Commissioners• Room, Floor 1-B otter Tail county Courthouse Wednesday, October 30, 1991 1:00 p.m. Call To Order The Otter Tail County Board of Commissioners convened Wednesday, October 30, 1991, at 1:00 p.m. at the Otter Tail County Courthouse with Commissioners Andy Lindquist, Chairman, Harley Windele, Bill Stone and Malcolm Lee present and with the 5th District position vacant. Minutes Approved Motion by Stone, seconded Windels and unanimously carried to approve the October 16, 1991, minutes as submitted. Gambling Permit Upon a motion by Lee, seconded by Windels and unanimously carried, the Otter Tail County Board of Commissioners adopted the following resolutions: WHEREAS, the responsibility for the regulation of lawful gambling and the issuance of licensee and permits for the conduct of lawful gambling lies with the Minnesota Gambling Control Board/ and WHEREAS, the Fergus Falls Hockey Association, has made application to the Gambling Control Board for a premises permit to conduct lawful gambling at the Pier in Otter Tail Township of otter Tail County; and WHEREAS, Minnesota Statutes 349.213 provides that the Gambling Control Board may not issue a premise permit unless they receive a resolution from the County Board approving the permit; and WHEREAS, the otter Tail County Board is aware of no reason to oppose the conduct of lawful gambling by the Fergus Falls Hockey Association at the Pier and NOW, THEREFORE, IT IS HEREBY RESOLVED, that the Otter Tail County Board of Commissioners hereby approves the conduct of lawful gambling by the Fergus Falls Hockey Association at the Pier in otter Tail Township of Otter Tail County, provided that the applicants meet all the necessary criteria for the licensee and permits required by the Gambling Control Board. Adopted this 30th day of October, 1991, OTTER TAIL COUNTY t, C airman County Board of 0 0 Q Otter Tail County Board of Commissioners October 30, 1991 Page 3 Ditch No. 18 Ditch and Weed Inspector, Roland sauck and property owner John Leitch appeared before the board relative to necessary repairs needed in Ditch# 18, Section 2 of Dane Prairie Township, to provide for proper drainage. Lengthy discussion took place on the options to attain authority to make repairs and assess property owners affected by Ditch No. 18, 0 both on the main and branch areas. John Leitch was instructed to bring a petition to the Auditor's office with his signature and any other property owners in favor of the repairs. Notice will then be sent to all property owners affected and a public hearing will be set. U,S. Fish & Wildlife Acquisition Motion by Lee, seconded by Windels and unanimously carried to approve the acquisition of .79 acres of land from the estate of Magnus c. Anderson by the U.S. Fish and Wildlife Service with legal description as follows: Anderson: T. 132 N., R. 43 W., 5th P.M. Motion by Lee, seconded by Stone and unanimously carried to formally request payment in lieu of taxes on the above purchased property. Minnesota Resource Recovery Association Motion by Lee, seconded by Windels and unanimously carried to deny a $500 membership fee to the Minnesota Resource Recovery Association for the upcoming year of 1992. Reclassification committee Larry Krohn informed the Board of a Spencer Lundquist's recent retirement. the representation on the committee. vacancy on the reclassification committee due to The Board's direction was to make no changes in Best, Inc. The County coordinator, Larry Krohn brought forth a letter from Best, Inc. whereby the President of Best, William 8enzick disputes the subtraction of FICA and Worker's Compensation fees from their billing for an otter Tail County Employee that Best has accepted salary responsibility for through the Food Service Contract signed earlier this year. The Board directed the County Attorney to draft a letter to Best, Inc. informing them of their interpretation of the agreement that FICA and Worker's Compensation are both legally mandated and are therefore tied together with wages as part of the employers costs. Q 0 Q oiter Tail County Board of commissioners October JO, 1991 Page 4 Canvassing Board Motion by Lindquist, seconded by Lee and unanimously carried to appoint Bill Stone and Harley Windels to serve at the canvassing board on November 6, 1991. Abatements Motion by Lee, seconded by Windels and unanimously carried to approve the following applications for abatement: Elizabeth Township: Francis R, Peasley Lida Township: Robert L,/Doris LeNoue 22-ooo-11-oos1-001 37-300-50-0209-000 To a midyear seasonal, commercial homestead per Erwin Siems. A homestead card had been filed and due to clerical error, classification did not get changed. Homestead card filed October, 1990. To remove from tax rolls. assessed for 1991. Double Agreement Between The Minnesota Extension Service And otter Tail County Motion by Lee, seconded by Stone and unanimously carried to authorize the County Board Chairman to sign the Memorandum of Agreement between the University of Minnesota Extension Service and Otter Tail County for employing county extension staff. Motion by Lee, seconded by stone and unanimously carried to table the resolution by the County Board of Commissioners appropriating for county extension work for the year beginning January, 1992, Liquor License Application Motion by Lee, seconded by Windels and unanimously carried to approve the following license application: Applicant Name Name of Business Francis R. Peasley THE LAST RESORT Type of License on/Off Sale Beer License Setup License Q 0 oiter Tail County Board of Commissioners October 30, 1991 Page 5 Payment Approval For The Soil Conservation service Motion by Lee, seconded by Windels and unanimously carried to approve payment in the amount of $8,828 to the Soil Conservation Service for cost incurred in furnishing technical assistance in accordance with the Soil Survey agreement between the Otter Tail County Board of Commissioners and the Soil Conservation Service for the period July 1 to September 30, 1991. County Road Ditch Cleanout The Highway Engineer, Rick West requested approval for property owner Jerry Schmidt to cleanout a county road ditch on the Northwest corner of section 30 in Fergus Falls Township. Motion by Lee, seconded by Windels and unanimously carried to authorize the cleanout per recommendation of the Highway Engineer. Bridge Scour Training Motion by Lee, seconded by Windels and unanimously carried to authorize the Highway Engineer to attend a Bridge ,Scour Training seminar by the Minnesota Department of Transportation held November 19 through November 22, 1991, in Arden Hills, MN. and to report back to the Board. Final Payment for Roadside Mowing Motion by Windels, seconded Lee and unanimously carried to authorize the final payments totalling $2,374.40 to Steve's Roadside Maintenance, Kenneth Anderson, Dennis Johnson, Selmer Halvorson, Archie Wahlin, Carl Wallevand and Orlin Johnson for roadside mowing in areas, A,B,C,D,F,G,H,I and J. S.A.P. 56-608-18 Motion by Windels, Seconded by Stone and carried with Lee abstaining to approve the final payment of $17,054.85 to Sherbrooke Asphalt, Inc., Pelican Rapids, MN, for completion of project s.A.P. 56-608-18 per the recommendation of the Highway Engineer. Notary Public for Employee Motion by Stone, seconded Windels and unanimously carried to authorize an employee, Gerald Thompson, to become a Notary Public based on new duties in the Highway Department. 0 olter Tail county Board of Commissioners October 30, 1991 Page 6 Highway Engineer's Appointment Motion by Lee, seconded by Stone and unanimously carried to clarify the Highway Engineer, Rick West's initial appointment as a 4 year term. County Assessor The County Coordinator, Larry Krohn presented a rough draft for the Board's consideration for the upcoming position opening of the County Assessor. After some discussion, the Board requested some changes in the notice and the receipt of a written resignation from the present County Assessor. Malcolm Lee and Harley Windels were appointed by the Board to handle the initial screening of applicants to refer to the Board for consideration in the hiring process. Re-districting Larry Krohn passed out a handout from the Association of Minnesota Counties District Meeting regarding the specifics of re-districting. Bert Whitcombe Proposal 0 The Joint Powers Board requested each County Board to bring forth Bert Whitcombe's recent proposal for a new public education position in recycling and waste management for consideration. The Board is not in favor of suppcrting such a position as the otter Tail County Solid Waste Department has recently hired Marie Richards in that capacity. Part Time STS Crew Leader Position Motion by Lee, seconded by Windels and unanimously carried to authorize continuation of the part time sentence-To-serve Crew Leader position with review of this position again in December of 1991. Labor Agreement The labor agreement between Otter Tail County and The American Federation of State, County and Municipal Employees, AFL-CIO, Local Union No. 1830 for January 1, 1991 through December 31, 1991, was officially signed by the Chairman of the Board and the County Attorney. Desk Top Publishing System Motion by Lee, seconded Stone and unanimously carried to approve the purchase of a desk top publishing system as requested by Solid waste Director, Mike Hanan and Public Information Officer, Marie Richards, the cost of which is included in the Solid waste Departments budget for 1992. 0 0 . .,, Otter Tail County Board of Commissioners October 30, 1991 Page 7 Adjournment At 3:10 p.m., with no further business, Chairman Lindquist declared the Otter Tail County Board of commissioners' meeting adjourned until 9:30 a.m. on November 6, 1991.
