HomeMy WebLinkAboutBoard of Commissioners - Minutes - 10/09/1991IQ 0 Minutes of the OTTER TAIL COUNTY BOARD OF COMMISSIONERS Commissioners' Room, Floor 1-B otter Tail County Courthouse Wednesday, October 9, 1991 2,00 p.m. Closed Session/Call To Order The Otter Tail County Board of Commissioners convened Wednesday, October 9, 1991, at 10:30 a.m. in closed session for the purpose of negotiation strategies and mediation with the Employees• Association, a collective bargaining unit. At 2:00 p.m. the Board held it's regular otter Tail County Board of Commissioners' meeting at the Otter Tail county Courthouse with Commissioners Andy Lindquist, Chairman; Harley Windele, Bill stone and Malcolm Lee present, and the 5th District position vacant. Minutes Approved Motion by Lee, seconded Windele and unanimously carried to approve the October 2, 1991, Board minutes as submitted. Correspondence: Minnesota Historical Society letter to Barnhard Community Arte Center DNR, Bruce Winterfeldt Copy of County Attorney's letter on road right-of-way HACo Membership Dues Motion by Lee, seconded Windele and unanimously carried to decline membership in the National Association of Counties (NACo) with 1992 dues at $797 because monies were not budgeted. Installers Licenses Approved Motion by Windels, seconded Lee and unanimously carried the following applications for sewage disposal installers licensee were approved: Denman sewer Service, Lynne Denman Sherbrooke Septic Service, Roes Seifert Final Plat -Krehbiel Addition Motion by Lee, seconded Stone and unanimously carried to approve the final plat of Krehbiel Addition. u 0 0 dtter Tail County Board of Conunissioners October 9, 1991 Page 2 Conditional Use Applications Motion by Lee, seconded Stone and unanimously carried to uphold the reconunendations of the Planning Conunission on the following conditional use applications with conditions as indicated by the Conunission: Eagle Lake Township Roger Gubrud Dunn Township Budd Larson John Martin Linden Shore Resort: Burton c. & Doris A. Kragnes Raymond Lamb Marilyn J. Brunkow Note: For detailed information regarding any of the above listed conditional use permits, contact the Land & Resource Management office. Motion by Lee, seconded Stone and unanimously carried to uphold the recommendation cf the Planning Commission to approve the application of Dunn's 59 Limited and to extend the completion date to five years ending October 9, 1996. Motion by Windels, seconded Lee and unanimously carried to uphold the reconunendation of the Planning Commission to approve the application of Taylor Investment Corporaticn subject to the written approval of the Township regarding the access to the lots. Motion by Lee, seconded Windels and unanimously carried to uphold the recommendations cf the Planning Conunission to deny the Warren Rud application. Motion by Windels, seconded Lee and unanimously carried to refer Berger, Inc. back to the Planning Conunission for reconsideration. Motion by Lee, seconded Windels and unanimously carried to uphold the reconunendations of the Planning Conunission to deny the James Swenson application. Appeal -Denied Abatement Mr. & Mrs. William Seifert appeared before the Board relative to an appeal cf their denied abatement in the city of Perham. After further investigation, a motion by Lee, seconded Windels and unanimously carried was made to approve the abatement because the Siefert's had made homestead application prior to May 15, 1991. Government Services Bldg. -City of Perham Motion by Windels, seconded Lee and unanimously carried to approve payment in the amount of $458.50 for an assessment on the Government Services Building in the City of Perham for improvement made in the central business district parking area. 0 0 Otter Tail county Board of Commissioners October 9, 1991 Page 3 Abatements Motion by Lee, seconded Stone and unanimously carried to approve the following abatements, City of Richville, Larry Kawlewski otter Tail Township: Wendell and Eloise Felton 78-300-50-0030-000 46-000-04-0017-006 To remove the solid waste user fee. The mobile home is uninhabitable. No reduction in penalties and interest should be granted. To remove penalty and interest on special assessment #4614 per letter from Rollie Mann, Executive Director of the Ottertail Lakes Area Sewer District. Highway Department -Payments Approved Motion by Lee, seconded Windels and unanimously carried to approve the final payment of $23,760.04 to Astech Corporation of Box 1025, St. Cloud, MN 56302 for SAP 56-601-33, Etc. Bituminous Material for Seal Coat, seal Coat Aggregate and Temporary Lane Marking. Motion by stone, seconded Lee and unanimously carried to approve the final payment of $42,225.16 to Fairway Construction, Inc. of P.O. Box 426, Hector, MN 55432 for SAP 56-614-07 Bituminous overlay & Aggregate Shoulders Project. Motion by Lee, seconded Windels and unanimously carried to approve payment in the amount of $31,198 to Fergus International, Inc. for 70 H.P. Loader Tractor, Mechanical Front Wheel Drive, Cab. Convevance of Basement for wetland Restoration Motion by Lindquist, seconded Lee and carried to approve the conveyance of wetland easement to otter Tail county from Charles and Kathleen Rovang. County Rd, 84 Motion by Windels, seconded Lee and unanimously carried to accept the quotation of Don Lee Enterprises in the amount of $2,932 for ditch clean-out, etc. along County Road 84, New York Mills. 0 Otter Tail County Board of Conunissioners October 9, 1991 Page 4 Trunk Highway No. 59 North Motion by Lee, seconded stone and unanimously carried to adopt the following resolution: WHEREAS, the Minnesota-Department of Transportation has developed plans and is presently constructing the T.H. 210 By-pass, Federal Project No. F-036-1(44), and WHEREAS, T.H. No. 59 from the junction of I-94, Exit No. 50 to the junction of I-94, Exit No. 61 upon completion of the T.H. 210 By-pass will be redesignated from its present routing to I-94 causing the former T.H. No. 59 to become a parallel T.H. route making it eligible as a turnback, and WHEREAS, Otter Tail County, the City of Fergus Falls, and the Minnesota Department of Transportation have previously agreed to the jurisdictional change of T.H. 210 from I-94 East and South to the East junction of T.H. No. 59 and T.H. 210 and T.H. No. 59 from the North junction of T.H. 297 South to the junction of I-94 in the form of a turnback, and WHEREAS, Otter Tail County, the City of Fergus Falls, and the Minnesota Department of Transportation has discussed the turnback concept relating to T.H. No. 59 from the junction of I-94, Exit 50 to the North junction of T.H. 297. NOW, THEREFORE, BE IT RESOLVED, that Otter Tail County Board of Commissioners hereby concurs with the concept and will accept the jurisdictional authority of the T.H. No. 59 North from the junction of Fergus Falls Township Road No. T-905 North to the junction of I-94, Exit 50 as a County Turnback subject to the following: is eligibility for funding from the turnback account for all reconstruction costs including future seal coat and the eligibility for funding of all replacement costs of the Pelican River bridge located on T.H. No. 59 North from the turnback account. Passed by the otter Tail County Board of Commissioners on this 9th day of October, 1991. Krohn, Clerk Phelps Mill Dam -Walkway Motion by Lee, seconded Windels and unanimously carried to accept the proposal of H & R Construction Company, Dalton, MN, in the amount of $3,400 to furnish salvage materials to install a catwalk and safety railings across the Phelps Mill dam to be completed this fall. Support for Veterans Service Offices Motion by Lee, seconded Stone and unanimously carried to offer the following resolution in support of continuation of veterans services offices: 0 Q Otter Tail County Board of Commissioners October 9, 1991 Page 5 WBERBAS, Laws of 1991, Chapter 345, Section 27 directs the State Auditor to conduct a study of the county Veterans Service Offices to examine the possibility of elimination or merger of services and personnel and the possibility of State funding of personnel costs; and, WBERBAS, Chapter 197 of Minnesota Statutes currently mandates county government to provide services to veterans through its Veterans Services Office; and, WHERBAS, the Otter Tail County Veterans Service Office is largely responsible for over $5.5 million in Federal veteran, dependent and survivor benefits being received by residents of this County each year; and, WHEREAS, veterans Service Officers have specialized knowledge of programs and services available to veterans; and, WHEREAS, the otter Tail County Veterans Service Office assists thousands of Otter Tail County residents annually through their counseling and claims presentations to the Departments of veterans Affairs for the State of Minnesota and the United States; and, WBERBAS, the Otter Tail County Veterans Service Office provides counseling, claims service and referral in such areas as, alcohol dependency treatment, burial benefits, service-connected disability compensation, dental treatment, discharge reviews, death benefits, education and training, financial assistance programs, United states Department of veterans Affairs home loan guarantee, outpatient and inpatient medical care, nonservice-connected disability pension, survivors' and dependents' benefits entitlements, as well as numerous other entitlement areas; and, WHEREAS, in the absence of a veterans service function, the county human service agencies would become responsible for providing many of the services currently provided by the Veterans Service Office; and, WBERBAS, the volume and variety of constituent requests can best be addressed by staff specialized and dedicated to veterans issues as in the current system; and, WBERBAS, our County Veterans Service Office has provided and continues to provide a very valuable service to the Otter Tail County Board in facilitating assistance to County residents: NOW, THEREFORE, BE IT RESOLVED that the Otter Tail County Board of Commissioners supports the mandates of Minnesota Statues Chapter 197 as the most cost-efficient and effective method for the provision of services to otter Tail County veterans, dependents and survivors. BE IT FINALLY RESOLVED that a copy of this resolution be forwarded to the Auditor for the state of Minnesota Counties, the President and Directors of the Minnesota Association of Urban Counties and the Association of Minnesota County Veterans service Officers. Krohn, Clerk . , 0 ! .... ~ Otter Tail County Board of Commissioners October 9, 1991 Page 6 Public Information Officer -Program Format Solid waste Public Information Officer Marie Richards outlined with the Board her proposed program format regarding recycling and solid waste. consulting Firm -Northeast Landfill Motion by Windels, seconded Stone and unanimously carried to authorize the Solid Waste Director and his committee, to begin negotiating a contract and plan for the Northeast Landfill with the consulting firm of Foth and VanDyke in conjunction with the direction of the Pollution Control Agency (PCA) • State Auditors• Exit Interview Report Auditor Wayne Stein and Coordinator Larry Krohn reported on the State Auditors' Exit Interview and their general conclusions overall. Labor Agreement -AFSCME Motion by Lee, seconded Windels and unanimously carried to approve the January 1, 1991 through December 31, 1991, Labor Agreement between the American Federation of state, county and Municipal Employees, Local 1830, (Highway) with the provisions mutually agreed upon to be included in the final labor agreement document. Adjournment At 4:50 p.m., with no further business, Chairman Lindquist declared the meeting adjourned until 9:30 a.m. October 16, 1991.
