Call To Order
The Otter Tail County Board of Commissioners convened Wednesday, September 25, 1991, at
1:00 p.m. at the Otter Tail county Courthouse with commissioners Andy Lindquist,
Chairman; Harley Windels, Bill stone and Malcolm Lee present and with the 5th District
position vacant.
Minutes Approved
Motion by Lee, seconded Windels and unanimously carried to approve the September 18,
1991, minutes as submitted.
Fencing Ordinance Project
0 Tom Springer, representing Big Pine Lake Association, presented various reasons for the
Board to consider adopting a fencing ordinance to restrict livestock, poultry, etc. by
way of fencing a 50' buffer zone of grass along waterways. Lengthy discussion followed
which included objections voiced by some individuals against such an ordinance.

The Chairman polled each Board member individually on whether they would support Mr.
Springer's request for a fencing ordinance. The poll response was: Lee -no; Windels -
no; Stone -no; and Lindquist -no.
Temporary Extended
Motion by Stone, seconded Lee and unanimously carried to extend employment as a
"temporary employee" to an individual in the Treasurer's office as requested by the
Treasurer for a period not to exceed December 15, 1991.
Abatements
Motion by Lee, seconded Windels and carried to approve the following abatements:
Oak Valley:
Melody R. Carlson 45-300-50-0015-000 Omitted. Add 5 solid waste fee
points.

Repurchase of Tax Forfeited Lands
Motion by Windels, seconded Stone and unanimously carried the following resolution was
adopted:
RESOLVED by the Board of County Commissioners of Otter Tail County, Minnesota, that
WHEREAS, on September 24, 1991, Donald Koski, owner of record of Lot 1, Section 4,
Township 137, Range 36 made application to repurchase said property which was forfeited
to the State of Minnesota for the nonpayment of 1984, 1985, 1986, 1987, 1988, 1989, 1990
and 1991 tax, and
WHEREAS, the sum of $371.35 to be submitted, representing aggregate of all delinquent
taxes, penalties, costs and assessments,
NOW THEREFORE BE IT RESOLVED, the County Board does hereby approve the above repurchase,
to be in the best public interest and to relieve undue hardship.

Repurchase of Tax Forfeited Lands
Motion by Windels, seconded Stone and unanimously carried the following resolution was
adopted:
RESOLVED by the Board of County Commissioners of Otter Tail County, Minnesota, that
WHEREAS, on September 24, 1991, Donald Koski, owner of record of Wl/2 SWl/4 and SWl/4
NWl/4 and Government Lot 4, Section 3, Township 137, Range 36 made application to
repurchase said property which was forfeited to the State of Minnesota for the
nonpayment of 1984, 1985, 1986, 1987, 1988, 1989, 1990 and 1991 tax, and
WHEREAS, the sum of $5,426.79 to be submitted, representing aggregate of all delinquent
taxes, penalties, costs and assessments,
NOW THEREFORE BE IT RESOLVED, the County Board does hereby approve the above repurchase,
to be in the best public interest and to relieve undue hardship.

Maintenance Request on Forfeited Parcel
Motion by Lee, seconded Windels and carried to direct the Auditor to request the
Building Maintenance Supervisor, either personally or with staff, to do necessary
maintenance work to prevent freeze-up involving a forfeited mobile home.
Approval to Pay Bills
Motion by Lee, seconded Stone and unanimously carried to pay bills per Attachment A of
these minutes.
Otter Tail county Solid Waste Management Plan
Chairman Lindquist acknowledged receipt of a letter from the Minnesota Office of Waste
Management indicating that on September 13, 1991, the Otter Tail County Solid Waste
Management Plan Update with the SCORE Amendment and Recycling Implementation Strategy
was approved and Otter Tail county was issued a Certificate of Need for land disposal
capacity.

Motion by Lee, seconded Windels and unanimously carried to authorize the Highway
Engineer to proceed in making a land offer,
Closed to Public
At 2:00 p.m. the County Board of Commissioners closed it's public meeting held on
September 25, 1991, for the purpose of discussing negotiation strategies with regard to
the Employees' Association, a collective bargaining unit.
Open to Public
At 2:47 p.m. the Board reconvened it's public meeting.
Employees' Association
Motion by Lee, seconded Windels and unanimously carried to send a memo to all Otter Tail
County Employees regarding a potential strike by members of the Employees• Association.
The memo reads as follows:
",, ,As of 12:01 a.m., October 7, 1991, employees who are members of the Otter Tail
County Employees Association, can legally strike. The Association includes the
following groups: Financial Worker, Financial Assistance Specialist, Case Aide,
Chemical Dependency Counselor, Child Support Officer, Collections Officer, Account
Clerk, Employment Program Specialist, Clerk II, Clerk Typist I and Clerk Typist II.
Negotiation attempts are continuing and we sincerely hope that a strike will not ensue.
However, we believe that it is important that all employees of the county be familiar
with their rights and obligations under strike conditions. In the event of an employee
strike, Minnesota statutes 179A.19 will be applied uniformly and consistently to all
employees who engage or participate in such strike action.
l. Any county employee who is absent from work without permission of the department
head or who abstains wholly or in part from the full, faithful and proper
performance of assigned duties, without permission of the department head, on the
date or dates when such a strike occurs will be presumed to have engaged in a
strike.
2. only employees in the striking bargaining unit (Otter Tail County Employees
Association) may legally strike. All others not at work or not on an authorized
leave will be considered illegal strikers.
3. Any employee who strikes illegally will be subject to the penalty permissible and
prescribed by law which is dismissal on the date the violation first occurs. Should
an illegal striker be subsequently reemployed by the County, a two-year probation
period is directed by law.
4. Any employee who may legally strike also has a right to continue working during a
strike action.

5. No wages shall be paid to any employee who is on strike. The County will mail a
check for the amount of wages due a striking employee for work performed prior to
the strike.
6. The County will not continue contributions to group insurance coverage and other
benefits for striking employees. The current preimums for health insurance are
$182.00 per month for employees electing single coverage and $493.00 per month for
employees electing family coverage. In addition, premiums for life insurance are
$3.50 per month for. employees electing single coverage and $4.32 per month for
employees electing family coverage. Notice will be provided such employees on how
they may continue group insurance coverage at their own coat.
7. No striking employee shall be entitled to vacation pay, sick leave, holiday pay or
any other type of leave including attendance at conferences and conventions during
the period of the strike.
8. There shall be no service credit (seniority) for benefit accrual purposes during a
strike period to any employee participating in such action.
9. All supervisors will be required to report to work during an employee strike and to
perform bargaining unit work if so assigned.
10. Supervisors are to refrain from taking any action which will restrain or coerce
employees who may legally strike.
11. All leaves of absence (including vacation, sick leave and leave without pay) for all
striking employees are cancelled. Leaves of absence for all other employees must
be re-authorized by the department bead.
12. Any leave of absence (including vacation, sick leave and leave without pay) for
employees when a strike is taking place may be granted only with the approval of the
department head.
13. Non-striking employees must be prepared to present acceptable verification of
permitted use of sick leave to their department bead.
14. All non-exempt employees who, as a result of a strike action, are required to work
in excess of the normal work week shall be paid at a rate of one and one-half times
their normal rate for such excess time.
15. Exempt employees, (supervisors), excluding department heads who, as a result of a
strike action, are required to work in excess of the normal work week to perform
services regularly performed by striking employees, shall be paid at the rate of one
and one-half times their normal rate or, at the option of the department head, will
be given compensatory time off at such rate.
16. Any employee who is assigned work appropriate to a higher class shall be paid for
such work performed in the higher class at the compensation rate of that class.
17. Nonstriking employees who incur damage which is causally connected to strike
activities shall be reimbursed by the County, at the time of the alleged incident,
provided the damage is not otherwise covered by insurance and that all reasonable
precautions, under the circumstances, to prevent damage have been taken by the
employee.

18. The County Coordinator is hereby appointed as spokesperson for the County."
Motion by Lee, seconded stone and unanimously carried to request a meeting with the
representatives of the Employees• Association through the Bureau of Mediation.
Adjournment
At 3:20 p.m. with no further business, Chairman Lindquist declared the meeting adjourned
until 9:30 a.m. on October 2, 1991.
