HomeMy WebLinkAboutBoard of Commissioners - Minutes - 08/14/19910 0 Minutes of the OTTER TAIL COUNTY BOARD OF COMMISSIONERS Commissioners' Room, Floor 1-B Otter Tail County Courthouse Wednesday, August 14, 1991 1:00 p.m. Call To Order The Otter Tail County Board of Commissioners convened Wednesday, August 14, 1991, at 1:00 p.m. at the Otter Tail County Courthouse with Commissioners Melo. Olson, Chairman; Harley Windels, Bill Stone, Andy Lindquist and Malcolm Lee present. Minutes Approved Motion by Lindquist, seconded Lee and unanimously carried to approve the August 7, 1991, minutes as submitted. Authorization for Bike Races Motion by Windels, seconded Stone and unanimously carried to approve two bicycle races, on the route described by Calvin K. Miller, Jr., on Sunday, August 17, 1991, sponsored by Miller's Bike Shop, Perham, and Zorbaz, Little Pine Lake, subject to certificate of liability and workmans compensation insurance. Bid Opening: S.A.P. 56-651-11 CSAH No. 51/RR Crossing -Perham Highway Engineer, Rick West, having previously advertised for bids to be received for the CSAH No. 51/RR Crossing Project -City of Perham -opened the following bids: Mark sand & Gravel co. Fergus Falls, MN Sherbrooke Ashpalt, Inc. Pelican Rapids, MN $39,183.00 $30,576.34 Motion Stone, seconded Windels and carried with Lee abstaining to approve the bid of Sherbrooke Ashpalt, Inc. in the amount of $30,576.34 upon the recommendation of the Highway Engineer. Bid Award -Tractor/Loader Motion by Lindquist, seconded Lee and unanimously carried to award the bid for One 70 H.P. Loader Tractor, Mechanical Front Wheel Drive with Cab to Fergus International, Fergus Falls, MN, the lowest bidder, in the total amount of $31,198 which includes the base bid of $30,727 and a forward/reverse shuttle transmission option for $471 as recommended by the Highway Engineer. 0 0 °Ctt:'er 'Tail County August 14, 1991 Page 2 Board of Commissioners County Map Policy Motion by Lee, seconded Windels to approve the map policy as submitted by the Highway Engineer, Rick West, to define the procedures for distribution and sale of County Highway Maps. The distribution of all County Highway Maps will be through the Otter Tail County Highway Department at a cost of $.15 for 17" x 22" black and white maps and $. 50 for 17" x 22" colored maps, with these costs subject to change without notice due to printing costs. Overflow Parking Problem -Zorbaz. Otter Tail Lake The Highway Engineer, Rick West, reported on a meeting with Otter Tail Lake property owners, Joe Peloquin, Sheriff's Department, and an owner/manager of Zorbaz Restaurant. According to West, Zorbaz Restaurant will be policing their operation more closely and changing policies as needed in consideration of neighboring lakeshore owners. "No Parking" signs, although discussed, will not be implemented at this time. Catwalks and Handrails -Phelps Mill The Highway Engineer reported the need to provide a catwalk and handrails for Phelps Mill for the people cleaning grates and debris and monitoring the water elevation. The Highway Engineer will submit a recommendation including costs for review at a future board meeting. County Map Sponsorship Judy Stringer, executive director of the Visitor and Convention Bureau of Fergus Falls and John Johnson, representing Johnson Publications, appeared seeking sponsorship of the County Map to be a part of a new visitor guide brochure used to promote the City of Fergus Falls and Otter Tail County. Stringer was directed to provide a written proposal to the Budget Committee by August 20, 1991, for consideration. U.S. Fish & Wildlife Land Easement Approved Motion by Lee, seconded Lindquist and unanimously carried to approve the acquisition of land by the U.S. Fish and Wildlife Service for the purposes of waterfowl easement rights from Mark E. Henry, of Fergus Falls, MN and another easement from Arthur N. Hoffman and June M. Hoffman, husband and wife, of Fergus Falls, MN and another easement from Willolea Holsteins, Inc. of Underwood, MN and Stanley G. Sha, of Fergus Falls, MN, with legal descriptions as follows: Henry: Hoffman: Willolea Holsteins: T. 133 N., R. 42 W., 5th P.M., Section 32, Nl/2, NEl/4. T. 135 N., R. 42 w., 5th P.M., Section 31, NWl/4, NEl/4. T. 132 N., R. 42 w., 5th P.M., Section 23, lot 9, SWl/4, SWl/4, 0 0 0 otter Tail August 14, Page 3 County Board of Commissioners 1991 Northwest Demolition Site Dale Pierce, together with his attorney David H. Nycklemoe, appeared to request a public hearing on his application for the northwest demolition site. Robert w. Bigwood, attor- ney for Scambler Township, along with law clerk Kent Mattson cited objections to proceeding on with a hearing due to an interim zoning ordinance set forth by Scambler. Motion by Lee, seconded Windels and unanimously carried to table the decision to hold a public hearing pending determination of the County Attorney on the interpretation of the enforcement of the gray areas of the new Scambler Township interim zoning ordinance. A petition signed by a number of Scambler Township property owners in opposition of the proposed disposal site was acknowledged by Chairman Olson. Forgiveness of Penalty Motion by Lee, seconded Windels and unanimously carried to impose a 7% penalty for Gary A./Corinne D. Schattschneider, as recommended by the Treasurer, Steve Andrews. Abatements Motion by Lee, seconded by Stone and carried to approve the following applications for abatement: Dunn Township: Donald L./Phyllis Johnson Janet A. Foss 17-000-99-0807-000 17-000-99-1328-001 Payable 1990 and 1991, Reduce the value of this parcel to com- pensate for a tennis court that had been assessed here since 1985 that actually is on parcel #1328- 001. Per Erwin Siems. Abate on tennis court that pre- viously was assessed on parcel #17-000-99-0807-000. Motion by Lindquist, seconded by Stone and carried, with Olson opposed, to approve the following applications for abatement. Aurdal Township: Jeffrey Christenson 03-000-99-0380-000 To calculate as a midyear homes- tead per Erwin Siems. Moved in May 1990, bt~er'Tail County Board of Commissioners August 14, 1991 Page 4 0 Everts Township: 0 0 Vorderbruggen/Evelyn Hanson Robert/Evelace Hanson Girard Township: Richy/Jennifer Peterson 25-000-99-0997-000 25-000-26-0161-035 29-000-02-0012-003 To calculate as ag homestead. To cancel the solid waste fee of $30 as this parcel no longer has any commercial use. Abate per Erwin Siems. Payable 1985-1991. To split parcel 29-000-02-0012-003. This is a 40 acre piece that at the time of divorce should have been split into two 20 acre parcels. The Court orders did not state how the piece was to be split, therefore no split was made. Now the property is in the process of forfeiting to the State of Minnesota and new orders have been filed that provide an adequate description for us to be able to split the property. Splitting the property will allow each party to protect their interest and relieve an undue hardship. An abatement to split property would not normally be acceptable. Trail Assistance Maintenance Agreement Motion by Lindquist, seconded Windels and carried to approve the trail assistance maintenance agreement for the Lake Runners Snowmobile Trail Association, state appropriation of $2,000, and the OCTA Snowmobile Trail Association state appropriation of $8,000, and the Chairman of the Board and the County Auditor be instructed to execute the agreement on behalf of Otter Tail County Forgiveness of Penalty Motion by Stone, seconded Lee and carried, with Olson and Lindquist opposed, to forgive penalty for Virginia Bechhold, Deer Creek, MN with Mr. & Mrs. Eugene Joerger appearing in her behalf. • 0 Q Ott~r•Tail County Board of Commissioners ... ,. August 14, 1991 Page 5 Conditional Use Applications Preliminary Plats Motion by Windels, seconded Lee and unanimously carried to uphold the reconunendations of the Planning Commission on the following conditional use/preliminary plat applications subject to conditions set forth: Richard Swenson, Big McDonald Lake Paul L. Ebnet, Rush Lake Clear Lake Resort/Reuben Finkelson, Clear Lake Thomas A. Worum & Warren E. Erickson, South Turtle Lake Elizabeth Township (\Otter Tail County Highway Dept.), Pelican River Jeff Cossette, Lake Lizzie Dalton/Rose Jose, Silver Lake Stephen L. Streif & Darvin Rochell (%Larry Streif), (Heilberger Bay), Heilberger Lake Leon L. Moss & Ronald J. Hofland, Big Pine Lake Motion by Lindquist, seconded Lee and unanimously carried to uphold the recommendations of the Planning Commission to deny the conditional use applications of Orrin Streich, Little Pine Lake, and John P. Adjournment At 2:45 p.m., with no further business, Chairman Olson declared the meeting adjourned until 9:30 a.m., on August 21, 1991.
