Call To Order
The Otter Tail County Board of Commissioners convened Wednesday, August 7, 1991, at
9:30 a.m. at the Otter Tail County Courthouse with Commissioners Melo. Olson, Chairman;
Harley Windels, Bill Stone, Andy Lindquist and Malcolm Lee present.
Minutes Approved
Motion by Lindquist, seconded Lee and unanimously carried to approve the July 24, 1991,
minutes as submitted.
Forgiveness of Penalty/Interest
Alfred and Delores Braasch appeared before the Board requesting forgiveness of penalty
and interest on delinquent taxes on contract-for-deed property, however, the Board
indicated that under the circumstances which was explained to them, they could not
forgive such a request.
Northwest Demolition Site
Motion by Stone, seconded Lee and unanimously carried to authorize the Solid Waste
Director to continue work at the northwest demolition site referred to as the "Larson"
site.
Solid Waste Truck Inspection
Motion by Lee, seconded Lindquist and unanimously carried to approve payment of $72.20,
a fine imposed on one of ~he Solid Waste trucks which had been exempt from the annual
truck inspection,-but because it pulled a trailer, was not considered exempt. Solid
Waste Director Mike Hanan assured the Board that both trucks would be inspected to
ensure compliance.
Final Plat -South View
Motion by Windels, seconded Lee and unanimously carried to approve the final plat of
South View, located on Marion Lake, subject to the signature of the developer.

Fee Schedule Change
Motion by Lee, seconded Stone and carried, with Olson voting "no", to authorize the
Director of Land & Resources to change conditional use and variance fees from $40 and
$25 respectively, to $45 and $30 respectively, due to increased recording fees set by
the State.
Shoreland Ordinance Resolution
Motion by Lee, seconded Windels and unanimously carried the following resolution was
adopted:
RESOLVED by the Board of County Commissioners of Otter Tail County, Minnesota, that
WHEREAS, the State of Minnesota Department of Natural Resources has enacted statewide
standards for management of shoreland areas which were effective July 3, 1989, and which
direct each county in the state to enact a Shoreland Management Ordinance in substantial
compliance with the standards; and
WHEREAS, Otter Tail County was directed by the Minnesota Department of Natural Resources
to enact its revised Shoreland Management Ordinance by February 5, 1992, and substantial
efforts have been expended to develop a proposed Shoreland Management Ordinance for
otter Tail County; and
WHEREAS, on May 1, 1991, the proposed Shoreland Management Ordinance was submitted to
the Minnesota Department of Natural Resources for their review and approval, and the
county has received no written response from the Department of Natural Resources
regarding approval of its proposed Shoreland Management Ordinance; and
WHEREAS, it was the intent and desire of the Otter Tail County Board of Commissioners to
have public hearings concerning the proposed Shoreland Management Ordinance during the
summer months of 1991 when many of the seasonal resident owners of property subject to
the Shoreland Management Ordinance are in the area and able to participate in the public
hearings, but the scheduling of hearings has been delayed to await approval of the
Ordinance by the Department of Natural Resources, a~d it is now late in the summer
recreational season and fewer owners of affected property will have the opportunity to
participate in the public hearings; and
WHEREAS, the anticipated changes to the Shoreland Management Ordinance mandated by the
state will require additional resources for effective implementation, and Otter Tail
County does not have the ability to provide additional resources necessary for effective
implementation and enforcement of the Ordinance in 1992 due to the actions of the state
legislature in restructuring local government financing which will prevent any levy
increases for 1992; and
WHEREAS, Otter Tail County has had a policy of active enforcement of the county
Shoreland Management Ordinance on the large number of recreational lakes located in the
county, and the Board of County Commissioners does not wish to enact an Ordinance which
cannot be effectively enforced following enactment; and
WHEREAS, there is no information available at this time to indicate whether financial
resources will be available in 1993 or any subsequent years.

NOW, THEREFORE, IT IS HEREBY RESOLVED that for the reasons set forth above, the County
of Otter Tail is not able to meet the February 5, 1992, deadline for implementation of
the Shoreland Management Ordinance which was set by the Minnesota Department of Natural
Resources.
BE IT FURTHER RESOLVED that the Otter Tail County Board of Commissioners shall work to
enact and implement a Shoreland Management Ordinance in substantial compliance with
statewide standards no sooner than February 5, 1993, and only when adequate resources
are available to effectively implement the Ordinance.
Adopted at Fergus Falls, Minnesota, this 7th day of August, 1991.

Director of Land & Resources
Motion by Lee, seconded Stone and unanimously carried to appoint Bill Kalar, now acting
as temporary Director of Land &,. Resources, to permanent Director of Land & Resources
effective this day, August 7, 1991',"\,ithout salary changes.
Motion by Stone, seconded Lindquist and carried with Lee voting "no" to include the
Director of Emergency Services, a responsibility which previously included Director of
Land & Resources job duties, to Bill Kalar effective August 7, 1991.
Meeting Closed to Public
At 10:30 a.m. Chairman Olson declared the meeting closed to the public until 11:00 a.m.,
for the purpose of discussing labor negotiation strategies with the Sheriff's collective
bargaining unit relative to a grievance that has been filed.
Meeting Open to Public
At 11:00 a.m. the meeting of the Board of Commissioners reconvened in open session.
Sheriff's Union -Grievance Filed
Motion by Lindquist, seconded Lee and unanimously carried to authorize Coordinator Larry
Krohn, in consulting with County Attorney Wally Senyk, to retain the private counsel of
Peter Bergstrom, at their discretion, regarding the grievance filed by the Teamsters
Local 320 bargaining unit.

Satellite Downlink
Motion by Lindquist, seconded Stone and carried to enter into a cost-share arrangement
with the University of Minnesota as follows:
University of Minnesota will pay the costs associated with technical survey of the
proposed installation site, the satelite downlink system hardware purchase and the
satelite dish installation.
The county will provide a television monitor, a VHS videocassette recorder/player; a
speakerphone; a 9600 bps computer modem; fax machine, and the commissioners' meeting
room (when not in use for other county business). The county currently has the above
mentioned equipment.
Upon installation, all of the equipment will become the property and responsibility of
the county.

The Highway Engineer will review the above bids and make recommendation at the
August 14, 1991, Board meeting.
Highway Engineering Manager Position
Motion by Lee, seconded Stone and carried to authorize the Highway Engineer to offer up
to Range 17, Step 5 salary, if necessary, in hiring for the highway engineer manager
position based on qualifications.

Sand Lake Public Restroom Facilities
0 Motion by Lee, seconded Windels and carried to adopt the following resolution:
WHEREAS, the Sand Lake beach area along Trunk Highway No. 59 located in the East 1/2 of
Section 36, Scambler Township receives extensive public use in the summer months for
recreational purposes, and
WHEREAS, there are presently no public restroom facilities available at this location,
and
WHEREAS, the Otter Tail County Board of Commissioners are concerned with this situation
as it relates to public health and sanitation.
NOW, THEREFORE BE IT RESOLVED, that the Otter Tail County Board of Commissioners does
hereby request that the Minnesota Department of Transportation investigate this
situation and take appropriate action to provide public restroom facilities for the
summer use of this beach area on Sand Lake.
Adopted at Fergus Falls, Minnesota, this 7th day of August, 1991.

Girard Township -Drainage Culvert
Motion by Stone, seconded Lee and carried to table until spring of 1992 any
consideration regarding the request of Girard Township on certain drainage culvert{s).
Abandoned Gravel Pit -Corliss Township
Motion by Windels, seconded Lee and carried to authorize the Highway Engineer to proceed
with the disposal of property which includes a county-owned gravel pit located in
Section 19 of Corliss Township.
Approval to Pay Bills
Motion by Lindquist, seconded Windels and unanimously carried to approve payment of
bills per Attachment A of these minutes.

Overflow Parking Problem -Zorbaz, Otter Tail Lake
0 Lakeshore property owner Tom Vessel appeared before the Board, representing himself and
twenty-six other lakeshore residents, relative to an overflow parking problem and
business not contained within the establishment of Zorbaz Restaurant at Otter Tail Lake.
After considerable discussion, Mr. Vessel was instructed by the Board to meet with the
Highway Engineer and the Sheriff's Department regarding possible solutions such as "No
Parking" signs, etc. with a recommendation to be brought to the Board at the next
meeting.

Dangerous Dog Registration
Motion by Lindquist, seconded Windels and carried to authorize the County Auditor to
charge a fee of $10 for certification in addition to the registration fees set forth in
MS 347,51 regarding the registration of dangerous dogs.
Engagement Letter -State Auditor
Motion by Lindquist, seconded Stone and carried to authorize the Chairman of the Board
of County Commissioners to sign the engagement letter with the Office of the State
Auditor for the 12/31/90 audit.

no longer has a dog.
