Call To Order
The Otter Tail County Board of Commissioners convened Wednesday, July 3, 1991, at
9:30 a.m. at the otter Tail County Courthouse with Commissioners Melo. Olson, Chairman;
Harley Windels, Bill Stone, Andy Lindquist and Malcolm Lee present.
Minutes Approved
Motion by Lee, seconded Windels and unanimously carried to approve the June 26, 1991
minutes as submitted.
Fergus Falls Regional Treatment Center Coalition
Commissioners Olson and Stone provided an update of a recent Fergus Falls Regional
Treatment Center Coalition meeting to the Board.
Resolution Accepting Flex Benefit Plan
Upon a motion by Lee, seconded Lindquist and unanimously carried the following
resolution was adopted:
WHEREAS, the Otter Tail County Board of Commissioners hereby establishes, effective
January 1, 1991, a plan of flexible compensation for the benefit of Eligible Employees
of Otter Tail County, and
WHEREAS, the Otter Tail County Board of Commissioners shall adopt the plan of flexible
compensation known as the Otter Tail County Health Care and Dependent Day Care Expense
Reimbursement Plan, and
WHEREAS, the Otter Tail County Board of Commissioners shall provide Eligible Employees
of Otter Tail County a choice among different employer sponsored health, medical,
disability or hospitalization insurance or other similar accident and health plans for
employees, other health care benefit coverage, and dependent day care coverage.
NOW THEREFORE BE IT RESOLVED, that the Otter Tail County Board of Commissioners hereby
adopts the Otter Tail County Health Care and Dependent Day Care Expense Reimbursement

Detention Facility Food Service
Motion by Lee, seconded Stone and unanimously carried to name the Dispatchers of the Law
Enforcement Center under the same provisions stated in the June 26, 1991, motion
covering the Detention staff, to receive meals only in return for payment of the
County's cost through payroll deduction. The motion of June 26th continues, "Employees
must elect whether to receive meals or bring their own lunch on at least a monthly
basis. After the initial election, a thirty (30) day notice will be required for
changes."
Public Information Officer -Solid waste Department
Motion by Lee, seconded Lindquist and unanimously carried to authorize the Solid Waste
Director to proceed with the Coordinator to advertise for a full time replacement for
the Public Information Officer in the Solid Waste Department.
Tax Correction/Appeal Request
Bill Weitzel appeared before the Board relative to a tax correction on his property and
the fact that the correction took place after a time period where he thought he could
appear before the Board of Equalization. Mr. Weitzel was told to make an appointment
to be heard before the Board of Equalization on his matter.

Motion by Lee, seconded Lindquist and unanimously carried to deny forgiveness of penalty
of Glenn R. Freeland.
Motion by Lindquist, seconded Windels and unanimously carried to deny forgiveness of
penalty of Charles Blonigan/Colette Blonigan Habeeb.

RESIDENTIAL ANTIDISPLACEMENT AND RELOCATION
ASSISTANCE PLAN FOR
OTTER TAIL COUNTY
The County shall provide assistance to all permanently or temporarily displaced persons
in compliance with the Uniform Relocation Assistance and Real Property Acquisition
Policies Act of 1970, as amended.
However, the County plans to minimize displacement in the following ways:
1. No acquisition program is planned or necessary at the present time.
2. No displacement has occurred under any previous County housing rehabilitation
program.
If displacement should occur under any future housing program it will be dealt with in
the following manner:
A. Permanent Displacement
Definition -Any person permanently and involuntarily displaced will be subject to
the Uniform Relocation Assistance and Real Property Acquisition Policies Act of
1970, as amended. The term displaced persons means any person (family, individual,
business, non-profit organization, or farm) that moves from real property or moves
personal property from real property as a direct result of rehabilitation,
demolition, or acquisition for a Small Cities Development Program project.
Actions to be taken to minimize displacement include:
Informing tenants that they may be entitled to relocation payments and other
assistance under the Uniform Relocation Assistance and Real Property Acquisition
Policies Act of 1970, as amended (URA).
Informing tenants that they may be entitled to additional payments above the URA
payment in compliance with requirements of section 104(d) of the Housing and
Community Development Act of 1974, as amended. If rehabilitation activities raise
the market rent (including utility costs) above the applicable fair market rent
established by HUD's Section 8 existing housing program, then the unit must be
replaced and low or moderate income tenants are entitled to additional payments in
compliance with section 104(d).
The County will replace all occupied and vacant occupiable low-to-moderate income
dwelling units demolished or converted to a use other than as low-to-moderate income
housing as a direct result of activities assessed with funds provided under the Housing
and Community Development Act of 1974, as amended, as described in 24 CFR 570.49a(b).
All replacement housing will be provided within three years of the commencement of the
demolition of rehabilitation relating to conversion. Before obligating or expending
funds that will directly result in such demolition or conversion, the County will make
public and submit to the Minnesota Department of Trade and Economic Development the
following information in writing:
1. A description of the proposed assisted activity;

2. The general location on a map and approximate number of dwelling units by size
(number of bedrooms) that will be demolished or converted to a use other than as a
low-to-moderate income dwelling units as a direct result of the assisted activity.
3. A time schedule for the commencement and completion of the demolition or
conversions1
4. The general location on map and approximate number of dwelling units by size (number
of bedrooms) that will be provided as replacement dwelling units;
5. The source of funding and a time schedule for the provision of replacement dwelling
units; and
6. The basis for concluding that each replacement dwelling unit will remain a low-to-
moderate income dwelling unit for at least 10 years from the date of initial
occupancy.
The County may request the Minnesota Department of Trade and Economic Development to
recommend that the U.S. Department of Housing and Urban Development approve an exception
to required replacement housing if there is an adequate local supply of vacant low-to-
moderate income dwelling units in standard condition. Exceptions will be reviewed on a
case-by-case basis as described in 24 CFR 570.496a(iii).
B. Relocation
The County will provide relocation assistance, as described in Section 570.496a(b),
to each low-to-moderate income household displaced by the demolition of housing or
by the conversion of a low-to-moderate income dwelling to another use as a direct
result of assisted activities.
Displaced low-to-moderate income persons may choose assistance under the Uniform
Relocation Act or moving costs and an available Section 8 housing
voucher/certificate or moving costs and a housing assistance payment so that rent
and utilities do not exceed 30% of household income for a period of 5 years.
c. Temporary Displacement
Definition -Temporary displacement occurs when people move out of their dwelling,
business, or property for a short period of time due to activities of the Small
Cities development Program. Temporary displacement most frequently occurs with
housing and commercial rehabilitation projects.
Actions to be taken to minimize displacement include:
Planning utility shut-offs for times most convenient to residents.
Providing information and referrals services to individuals who must temporarily leave
their homes.
Stage rehabilitation of housing to allow occupants to remain during and after
rehabilitation.
() Schedule public facility construction and equipment storage to be completed as quickly
as possible and at times most convenient to residents.

BE IT RESOLVED, that the Otter Tail County Board hereby adopts the Residential
Antidisplacement and Relocation Assistance Plan for Otter Tail County.

Gambling License Application
Motion by Lindquist, seconded Lee and carried to approve the application for exemption
from lawful gambling license of the Fergus Falls Chapter of Ducks Unlimited at Elks
Point, Dane Prairie Township for August 28, 1991.
Budget Committee
Commissioners Lindquist and Lee reported on the recent meeting they had as members of
the Budget Committee. A letter to each of the departments and outside providers is
being sent outlining provisions of the upcoming budget plans.
Meeting Closed to Public
At 10:48 a.m. Chairman Olson declared the meeting closed to the public until 1:00 p.m.
for the purpose of discussing pursuant to the Attorney-Client Privilege as authorized in
471.705 Subd ld relative to the pending litigation of the declaratory action regarding
the Sheriff hiring his son; the veterans preference action being brought by David L.
Olson regarding his termination in 1974 as a dispatcher, and possible litigation
relative to the problem with the jail floor.

Building Maintenance Supervisor Rick Sytsma appeared before the Board to provide an
update of the building remodeling/relocation and various other related projects.
Jail Floor Problem
Motion by Lindquist, seconded Lee and unanimously carried allow the County Attorney to
seek the legal representation of Paul Ratwik, of the law firm Ratwik, Roszak, Bergstrom
& Maloney, P.A., based on the Board's past experience with this firm and the need for
counsel regarding construction law.
Approval to Pay Bills
Motion by Lindquist, seconded Lee and unanimously carried to approve the bills per
Attachment A of these minutes.
DNR -Land Acquisition
Motion by Lindquist, seconded Lee and unanimously carried the following resolution was
adopted:
REVIEW OF PROPOSED STATE WILDLIFE LAND ACQUISITION
In accordance with Minnesota statutes 97A.145 Subd. 2, the commissioner of the
Department of Natural Resources on July 3, 1991, provided the county board and the
appropriate town officers with a description of lands to be acquired by the State of
Minnesota for water and wildlife conservation purposes.
Lands to be acquired are described as follows:
Approximately 284 acres of land in Sections 24 and 25, Aastad Township, as described on
Exhibit A.
IT IS HEREBY RESOLVED by the Board of County Commissioners of Otter Tail County on
July 3, 1991, that the State's proposed acquisition of the above described property be
approved.
Adopted July 3, 1991.
