Olson, Chairman; Harley Windels, Bill stone, Andy Lindquist and Malcolm Lee present. Minutes Approved Motion by Lindquist, seconded Lee and unanimously carried to approve the May 15, 1991 minutes as subrnitted4 Otter Tail County Solid Waste Management Plan Upon a motion by Lee, seconded Stone and unanimously carried the following resolution was adopted: WHEREAS, the Legislature of the State of Minnesota requires the counties to develop a solid waste management plan in accordance with M.S. llSA.46; M.S. llSA.63; M.S. llSA.84; M.S. llSA.917; and applicable state regulations; and WHEREAS, counties recognize the need to practice sound methods of managing the solid waste stream; NOW THEREFORE BE IT RESOLVED, that the Otter Tail county Board of Commissioners hereby adopts the Otter Tail county Solid Waste Management Plan and supporting documentation as prepared for this Board. Lee, 2nd District ' 0 Otter Tail County Board of COnunissioners May 22, 1991 Page 2 BRA -Community Development Application for Grant Motion by Lee, seconded Lindquist and unanimously carried to have Otter Tail county act as legal sponsor on the Community Development Application for the Housing & Redevelopment Authority of Fergus Falls and to authorize the payment, if grant application is accepted, for the general administration of $20,000.00, $4,000.00 of which is to be allocated through in-kind services by the Otter Tail County Auditor, which would be payable over a three year period. Motion by Lindquist, seconded Lee and unanimously carried to adopt the following resolution: BE IT RESOLVED that Otter Tail County act as the legal sponsor for project(s) contained in the Community Development Application to be submitted on September 1, 1991, and that the County Board Chairman is hereby authorized to apply to the Department of Trade and Economic Development for funding of this project on behalf of Otter Tail County. BE IT FURTHER RESOLVED that Otter Tail County has the legal authority to apply for financial assistance, and the institutional, managerial, and financial capability to ensure adequate construction, operation, maintenance and replacement of the proposed project for its design life. BE IT FURTHER RESOLVED that otter Tail County has not incurred any costs, has not entered into any written agreements to purchase property, and has not contracted for or o begun construction on energy conservation measures for the proposed project. 0 BE IT FURTHER RESOLVED that Otter Tail County has not violated any Federal, State, or local laws pertaining to fraud, bribery, graft, kickbacks, collusion, conflict of interest or other unlawful or corrupt practice. BE IT FURTHER RESOLVED that upon approval of its application by the state, Otter Tail County may enter into an agreement with the state of Minnesota for the above-referenced project(s), and that Otter Tail County certifies that it will comply with all applicable laws and regulations as stated on all contract agreements and described on the Compliances Checklist of the Conununity Development Application. AS APPLICABLE, BE IT FURTHER RESOLVED that Otter Tail County hereby declares that a Redevelopment Area be established as identified on the geographic location map provided with the completed application. BE IT FURTHER RESOLVED that the Redevelopment Area was identified as meeting slum and blight conditions pursuant to the definitions of Minnesota Statutes 469.002 (subd.11) or 469.174 (subd.10). NOW, THEREFORE BE IT RESOLVED that the County Board Chairman is hereby authorized to execute such agreements as are necessary to implement the project(s) on behalf of the applicant. Fees Established Motion by Lee, seconded Windels and unanimously carried to prorate the fee for the County issued On/Off-sale Non Intoxicating Malt Liquor Licenses, Wine Licenses and Liquor Licenses to new establishments during a license perioda The prorated fee in no case shall be less than ten percent (10\) of the annual license fee. Motion by Windels, seconded Lindquist and unanimously carried to permit only one transfer of County issued On/Off-sale Non Intoxicating Malt Liquor License, Wine License, and Liquor License in a license period without a fee. Any additional transfers in the same license period would be at a prorated fee based on the annual fee of the license, but in no case shall the fee be leas than ten percent (10%) of the annual fee. Motion by Lee, seconded Stone and unanimously carried to establish a Seasonal On-Sale Intoxicating Liquor License for the period of May 1 through October 31. The fee for a Seasonal On-sale Intoxicating Liquor License shall be set at $1,600 and for Sunday Sales at $160. Seasonal on-sale Intoxicating Liquor Licenses are permitted by the Minnesota Statute 340A.404, Subd.6a. OCTA -Snowmobile Trail Agreement Motion by Lindquist, seconded Windels and unanimously carried to authorize the Board Chairman to sign the Otter Country Trail Association agreement which would establish a new trail in the Dalton area as well as allow the Association to seek grant funding for the coming year. Page 7 0 Advertise for Bids Motion by Lee, seconded Lindquist and unanimously carried to authorize the Highway Engineer to advertise for bids for two tandem trucks and a survey vehicle with bid opening to be held at 1:00 p.m. on June 19, 1991. BN Railroad Crossing Agreement Motion by Windels, seconded Stone and unanimously carried to authorize the Board Chairman to sign the Burlington Northern Crossing Agreement on behalf of Otter Tail County which includes the easement cost of $4,500 payable by the County with ongoing maintenance of the signal to be done by Burlington Northern. Safety Committee Coordinator Larry Krohn, Highway Engineer Rick West, Chief Deputy Dick Kausler and Building Maintenance Supervisor Rick Sytsma representing a General Policy Committee, appeared before the Board to discuss a proposed Safety/Loss Control Policy Committee formation and the need to promote safety in the workplace. Forgiveness of Penalty Motion by Lee, seconded Windels and unanimously carried to deny forgiveness of tax penalty for first half property taxes payable in 1991, amounting to $70.69, on the S.R. Frendin properties because previous policy has not included this exception. Adjournment At 2:05 p.m., with no further business, Chairman Olson declared the meeting adjourned until 9:30 a.m. on June 5, 1991.
