Ca.11 To Order
The Otter Tail County Board of Commissioners convened in session on
Wednesday., April 10, 1991, at 1: 00 p.m. at the Otter Tail County
Courthouse with Commissioners Melo. Olson, Chairman; Harley Windels,
Bill Stone, Andy Lindquist and Malcolm Lee present.
Minutes Approved
Motion by Lee, seconded Lindquist and unanimously carried to approve
the minutes of April 3, 1991, as submitted.
Premise Permit -Gambling Application
Motion by Lindquist, seconded Windels and unanimously carried, the
Otter Tail County Board of Commissioners adopted the following
resolution approving a gambling premise permit for the B.P.O. Elks
Lodge# 1093 at the Elks Point located at Wall Lake, Fergus Falls, MN,
of Dane Prairie Township.
WHEREAS, the responsibility for the regulation of lawful gambling and
the issuance of licenses and permits for the conduct of lawful
gambling lies with the Minnesota Gambling Control Board; and
WHEREAS, the B.P.O. Elks Lodge #1093 has made application to the
Gambling Control Board for a premises permit to conduct lawful
gambling at the Elks Point, Wall Lake, in Dane Prairie Township of
Otter Tail County; and
WHEREAS, Minnesota statutes 349.213 provides that the Gambling Control
Board may not issue a premise permit unless they receive a resolution
from the County Board approving the permit; and
WHEREAS, the otter Tail County Board is aware of no reason to oppose
the conduct of lawful gambling by the B.P.O. Elks Lodge #1093 at the
Elks Point, Wall Lake, and
NOW, THEREFORE, IT IS HEREBY RESOLVED, that the Otter Tail County
Board of commissioners hereby approves the conduct of lawful gambling
by the B.P.O. Elks Lodge #1093 at the Elks Point, Wall Lake, in Dane
Prairie Township of Otter Tail County, provided that the applicants
meet all the necessary criteria for the licenses and permits required
by the Gambling Control Board.
IT IS FURTHER RESOLVED, that notice of this application and approval
shall be provided to the Town Board of Dane Prairie Township by
sending them a copy of this resolution.

Joint Airport Zoning Board Authorization
Motion by Lindquist, seconded Lee and unanimously carried to adopt the
following resolution authorizing the following resolution:
WHEREAS, the City of Fergus Falls, hereinafter called the
Municipality, owns and controls the airport; and
WHEREAS, portions of the airport hazard area to such airport are
located outside the territorial limits of said Municipality but within
the territorial limits of this County, and
WHEREAS, the above Municipality as requested in writing that we join
with them and the affected Townships in the creation of a Joint
Airport Zoning Board; and
WHEREAS, this County deems it necessary and expedient to create a
Joint Airport Zoning Board in cooperation with the above Municipality
and the affected Townships pursuant to Minnesota Statutes 360.063,
Subd. 3, and other applicable laws for the purpose of establishing
administering and enforcing zoning laws for the areas surrounding the
airport and for the protection of the airport and the public; and
WHEREAS, the above statute provides that this County has the right to
_appoint two persons to said Board; and
WHEREAS, Subd. 8 of Section 32 of the Appropriations Bill passed by
the Minnesota Legislature effective July 1, 1973, provides that no
moneys shall be expended by the Commissioner of Transportation of the
State of Minnesota to improve and maintain an air[port unless the
governmental unit owning the airport has or is establishing a zoning
authority for the airport.
NOW, THEREFORE, BE IT RESOLVED by the undersigned County as follows:
1. That there is hereby created in cooperation with the above
Municipality a Joint Airport Zoning Board to be composed of
representatives of the undersigned County representatives of the
affected Townships and representatives of the above Municipality
pursuant to Minnesota statutes 360.063, Subd. 3.

2. That the undersigned County hereby appoints Gerald Rufer and David
P. Johnson to be their representatives on said Board, said persons
to serve for an indefinite term until they resign or ar replaced
by the undersigned County.

Motion by Lindquist, seconded Stone and unanimously carried to refer
the conditional use permit of Ernest Williams, Marion Lake, back to
the Planning Commission for reconsideration and recommendation.
Installers/Cleaners Renewal Licenses Approved
Motion by Stone, seconded Windels and unanimously carried to approve
the following renewal applications for sewage disposal installers and
cleaners licenses:

Motion by Lee, seconded Windels and unanimously carried to relocate
the radio repeater from the current East otter Tail Telephone tower
location to another site which would correct transmittal problems as
well as being more cost effective.
Annual county Boat & water Safety Agreement
Motion by stone, seconded Windels and unanimously carried to authorize
the Board's Chairman to execute the Annual County Boat & Water Safety
Agreement with the State of Minnesota.
Project 55 Participation
Motion by Stone, seconded Windels and carried with Lindquist and Olson
in favor and Lee opposed to adopt the following resolution supporting
Project 55:
WHEREAS, the Minnesota Department of Public Safety has continued to
promote efforts to ensure compliance with the 55 mph speed limit
through funding of County Sheriffs concentrated speed enforcement
efforts; and,
WHEREAS, the Minnesota Department of Public Safety has established
Project 55 for 1991 to achieve the above stated purpose, promoting law
enforcement and traffic safety; and,m
WHEREAS, the County is eligible to receive up to $13,000 in
reimbursement for participation in Project 55 to be conducted
beginning on May 10, 1991, an extending through September 2, 1991, to
offset any increased overtime patrol costs:

NOW, THEREFORE, BE IT RESOLVED that Otter Tail County enter into
agreement with the State of Minnesota, Department of Public Safety for
the following purposes, to wit: to reimburse the County for money
spent for approved activities in connection with Project 55 for
additional traffic law enforcement on County State Aid Highways within
said county to increase compliance with the 55 mph speed limit.
BE IT FURTHER RESOLVED that the Chairperson of the County Board and
Clerk be and they thereby are authorized to execute such agreement and
any amendment thereto.
BE IT FINALLY RESOLVED that a copy of this resolution be forwarded to
Gary Nelson, County Sheriff.

Prepayment Authorized
Motion by Lindquist, seconded Stone and unanimously carried to approve
the prepayment of $845.55 to Sears for furnishings for the juvenile
temporary hold unit.
Wheel Loader Bids/Recommendations
The matter of the wheel loader bids/recommendations for the Highway
Department was tabled until April 17, 1991, to allow the Highway
Engineer and County Attorney further time to review same.
Date set for Bid Opening
Motion by Lindquist, seconded Windels and unanimously carried to set
the bid opening date for yearly purchases and mowing for 1:00 p.m. on
May 8, 1991.
Position Classification/Reclassification
Motion by Lee, seconded Windels and unanimously carried to accept the
recommendations of the Reclassification Committee on the following new
position classification:

Motion by Lee, seconded Windels and unanimously carried to approve the
reclassification of the Land & Resource Office Manager to Range 13
after the Clerk Typist position has been filled.
Ditch 37 & Ditch 59
Ag/Ditch Inspector Roland Sauck appeared before the Board to provide
an update on Ditch 37 and Ditch 59. The County Attorney was directed
to draft a letter of response regarding the Ditch 37 request.

Johnson, located at RR 2, Underwood, MN of Sverdrup Township.
WHEREAS, the responsibility for the regulation of lawful gambling and
the issuance of licenses and permits for the conduct of lawful
gambling lies with the Minnesota Gambling Control Board; and
WHEREAS, the Lake country Sportsmen's Club of Otter Tail County has
made application to the Gambling Control Board for a premises permit
to conduct lawful gambling at the Riverfront Lounge, and
WHEREAS, Minnesota Statutes 349.213 provides that the Gambling Control
Board may not issue a premise permit unless they receive a resolution
from the County Board approving the permit; and
WHEREAS, the Otter Tail County Board is aware of no reason to oppose

Board of Commissioners hereby approves the conduct of lawful gambling
by the Lake Country Sportsmen's Club of otter Tail County at the
Riverfront Lounge in Sverdrup Township of otter Tail County, provided
that the applicants meet all necessary criteria for the licenses and
permits required by the Gambling Control Board.
IT IS FURTHER RESOLVED, that notice of this application and approval
shall be provided to the Town Board of Sverdrup Township by sending 0 them a copy of this resolution.

Detention Facility Food service Bid Delayed
Upon a request by the County Attorney, a motion was introduced by
Windels, seconded Lindquist and unanimously carried to delay the
Detention Facility Food Service bid set for May 1, 1991 to May 8,
1991.
Adjournment
At 3:30 p.m., with no further business, Chairman Olson declared the
meeting adjourned until 9:00 a.m. on April 17, 1991.
