HomeMy WebLinkAboutBoard of Commissioners - Minutes - 02/06/1991Minutes of the OTTER TAIL COUNTY BOARD OF COMMISSIONERS Commissioners' Room, Floor 1-B Otter Tail County Courthouse Wednesday, February 6, 1991 9:30 a.m. Call To Order The Otter Tail County Board of Commissioners convened in session on Wednesday, February 6, 1991, at 9:30 a.m. in the Otter Tail County Commissioners' Room of the otter Tail County Courthouse with Commissioners Mel O. Olson, Chairman; Andy Lindquist; Bill stone, Malcolm Lee and the 1st District Commissioner-Elect Harley Windels present. Minutes Approved Motion by Lee. seconded by Lindquist and unanimously carried to approve the corrected January 23, 1991 minutes. Sentence-To-service Update Sheriff Gary Nelson, STS Program Coordinator Al Keller, and STS Crew Leader Jeff Owen appeared before the Board to present an update of the STS program. court Appointed Attorneys Coordinator Larry Krohn requested the Board to name a committee to clarify situations in which the court is required to appoint attorneys outside of the scope of the public defender agreement. The following individuals were named to serve on this committee: Judge Tom Stringer Court Administrator Ken Rudd County Attorney Wally Senyk Auditor Wayne Stein Social Services Director Tom Fawcett Coordinator Larry Krohn Commissioner/Board Chairman Mel Olson Commissioner Andy Lindquist Glendalough state Park Coordinator Larry Krohn informed the Board he had been requested to appear before the Minnesota House of Representatives to testify on the Glendalough State Park matter on February 14, 1991, He will report back to the Board any developments as they may occur. I/ l 0 Otter Tail County Board of Commissioners February 6, 1991 Page 2 Gambling Permit Richard Erickson representing the Evansville Sportsmen's Club and Tom Macheledt representing Lake County Sportsmen's Club of Otter Tail County appeared before the Board. Upon a motion by Lindquist and seconded by Stone and unanimously carried, the Otter Tail County Board of Commissioners adopted the following resolution: WHEREAS, the responsibility for the regulation of lawful gambling and the issuance of licenses and permits for the conduct of lawful gambling lies with the Minnesota Gambling Control Board; and WHEREAS, the Lake Country Sportsmen's Club of otter Tail County has made application to the Gambling Control Board for a premises permit to conduct lawful gambling at the Graystone Lodge in Everts Township of Otter Tail County; and WHEREAS, Minnesota Statutes 349.213 provides that the Gambling Control Board may not issue a premise permit unless they receive a resolution from the County Board approving the permit; and WHEREAS, the Otter Tail County Board is aware of no reason to oppose the conduct of lawful gambling by the Lake Country Sportsmen's Club at the Graystone Lodge, and WHEREAS, the Lake Country Sportsmen's Club has indicated a firm intention to expend all of its expenditures for lawful purposes within Otter Tail County. NOW, THEREFORE, IT IS HEREBY RESOLVED, that the Otter Tail County Board of Commissioners hereby approves the conduct of lawful gambling by the Lake Country Sportsmen's Club at the Graystone Lodge in Everts Township of otter Tail County, provided that the applicants meet all the necessary criteria for the licenses and permits required by the Gambling Control Board. IT IS FURTHER RESOLVED, that notice of this application and approval shall be provided to the Town Board of Everts Township by sending them a copy of this resolution. I Page 3 Reclassification Request Diane Thorson of the Reclassification committee appeared before the Board with a reclassification recommendation to move an individual from Range 10 to Range 11 based on a change in assigned job responsibilities. The Board requested Thorson to meet with the Department Head regarding various aspects of the reclassification and to report back to the Board with the Department Head. Recommendations of Solid Waste committee Solid Waste Director Mike Hanan appeared before the Board regarding the adoption of solid waste fees for 1991 and to present recommendations made by the Solid Waste Committee. Motion by Lindquist, seconded by Lee and unanimously carried to accept the 1991 budget recommendations of Solid Waste Director Mike Hanan, as modified through discussion before this Board, and to adopt the following rate schedule for solid waste management charges for 1991: Item: Mixed Municipal Waste/Household Waste: Per Ton Per Container (Minimum) Car Load (Trunk) Pickup/Trailer (Level Box) Demolition Debris (Wood, Concrete, etc.) Car (Trunk) Pickup/Trailer (Level Box) Dump Truck (10 yd.) Removed from bags or containers. Free Penalty for uncovered loads beginning July 1, 1991 is 2x regular rate. Service fees for 1991 were established at $6 per point using the existing point system. And further, to direct that all solid waste management charges that are not paid in full within 90 days of the billing date, be referred to the otter Tail County Collections Office for formal collection procedures. Child care Provider Concerns Licensed Child Care Providers Vicki Lee and Val Lalonde shared concerns with the Board about child care. Both were invited to bring their matter before the Human Services Board for further discussion. International coalition Update Development Officer Dennis Parkinson of the International Coalition provided an update of the coalition's activities which included membership recruitment. Some discussion followed regarding the juvenile detention area and Court Services Department Head Spencer Lundquist participated in the discussion. Some of the matters would be referred to the Building Committee for Board recommendation. '91 Proposed Bituminous Overlay Projects Highway Engineer Rick West discussed with the Board on an informational basis the '91 proposed bituminous overlay projects of which he indicated will be brought before the Board for approval at a later date. General discussion covered other areas such as need for software for a pavement management system; need to overlap the replacement of an engineering technician; progress on departmental operations; and the acknowledgement to Chairman Olson that an organizational chart of the Highway Department would be available soon. The 210 By-Pass and Schmidt's Bridge projects were discussed in general. Gambling ordinance To Be Drafted Motion by Lindquist, seconded by Lee and unanimously carried to direct the Otter Tail County Attorney to draft a proposed Lawful Gambling Ordinance, pursuant to the authority of Minnesota Statute 349.213, Subd. l(b), which will require that all licensed organizations conducting lawful gambling with Otter Tail County expend all or a portion of its expenditures for lawful purposes on lawful purposes conducted or located within Otter Tail County. Summary of Conclusions of the Board of County commissioners Following the Performance Appraisal of Brad Bice At its meeting on January 30, 1991, the Otter Tail County Board met in closed session to review the performance of Brad Bice, Veterans Service Officer, whose four year term of appointment ended February 4, 1991, The Board did not reappoint Brad Bice. Although causes is not required because of the expiration of his term of appointment, the Board concluded that Brad Bice had demonstrated poor judgment in several incidents involving the use of county equipment and questionable items of correspondence. 0 Otter Tail County Board of Commissioners February 6, 1991 Page9 Adjournment At 3:30 p.m., with no further business, Chairman Olson declared the meeting adjourned until 1:00 p.m. on February 13, 1991, Chairman Approved Attest:
